about a national funding strategy for tertiary education, skills and apprenticeships; to make provision about the functions and governance of the Scottish Further and Higher Education Funding Council; to make provision about financial support for students in further and higher education; and for connected purposes.</p></longTitle></preface><body eId="body"><part eId="part-1"><num>Part 1</num><heading>National funding strategy</heading><section eId="section-1"><num>1</num><heading>National funding strategy</heading><subsection eId="section-1-1"><num>(1)</num><content><p>The Scottish Ministers must prepare a national funding strategy for tertiary education, skills and apprenticeships.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>The strategy must set out—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>the Scottish Ministers’ view of skills needs in Scotland, including in different localities within Scotland,</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p>the Scottish Ministers’ priorities for funding further education and higher education, programmes of training for employment, Scottish apprenticeships and work-based learning,</p></content></level><level class="para1" eId="section-1-2-c"><num>(c)</num><content><p>the outcomes which the Scottish Ministers are seeking to deliver through funding those activities, and</p></content></level><level class="para1" eId="section-1-2-d"><num>(d)</num><content><p>such other information as the Scottish Ministers consider appropriate.</p></content></level></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>In <ref href="#section-1-2">subsection (2)</ref>—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-further-education" eId="term-further-education">further education</term>” means a programme of learning which falls within section 6 of the Further and Higher Education (Scotland) Act 1992,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-higher-education" eId="term-higher-education">higher education</term>” has the meaning given by section 38 of that Act,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-programmes-of-training-for-employment" eId="term-programmes-of-training-for-employment">programmes of training for employment</term>” means programmes for which grants are to be made under section 12C(1) of the 2005 Act,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-scottish-apprenticeships" eId="term-scottish-apprenticeships">Scottish apprenticeships</term>” has the meaning given by section 12E(1) of that Act,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-work-based-learning" eId="term-work-based-learning">work-based learning</term>” has the meaning given by section 12I(2) of that Act.</p></content></hcontainer></subsection><subsection eId="section-1-4"><num>(4)</num><content><p>The Scottish Ministers must, as soon as reasonably practicable after this section comes into force, publish the strategy and lay it before the Scottish Parliament.</p></content></subsection><subsection eId="section-1-5"><num>(5)</num><intro><p>The Scottish Ministers—</p></intro><level class="para1" eId="section-1-5-a"><num>(a)</num><content><p>may, from time to time, revise the strategy, and</p></content></level><level class="para1" eId="section-1-5-b"><num>(b)</num><content><p>must, as soon as reasonably practicable after doing so, publish any revised strategy and lay it before the Scottish Parliament.</p></content></level></subsection><subsection eId="section-1-6"><num>(6)</num><intro><p>In preparing or revising the strategy, the Scottish Ministers must consult—</p></intro><level class="para1" eId="section-1-6-a"><num>(a)</num><content><p>the Council,</p></content></level><level class="para1" eId="section-1-6-b"><num>(b)</num><content><p>The Skills Development Scotland Co. Limited,</p></content></level><level class="para1" eId="section-1-6-c"><num>(c)</num><content><p>employers and prospective employers of apprentices,</p></content></level><level class="para1" eId="section-1-6-d"><num>(d)</num><content><p>the post-16 education bodies (within the meaning given by section 35(1) of the 2005 Act),</p></content></level><level class="para1" eId="section-1-6-e"><num>(e)</num><content><p>training providers (within the meaning given by section 12J(3) of the 2005 Act),</p></content></level><level class="para1" eId="section-1-6-f"><num>(f)</num><content><p>representatives of any trade union (within the meaning given by section 1 of the Trade Union and Labour Relations (Consolidation) Act 1992) which appears to the Scottish Ministers to be representative of the interests of apprentices,</p></content></level><level class="para1" eId="section-1-6-g"><num>(g)</num><content><p>education authorities (within the meaning given by section 135(1) of the Education (Scotland) Act 1980),</p></content></level><level class="para1" eId="section-1-6-h"><num>(h)</num><content><p>learners and persons who appear to the Scottish Ministers to represent the interests of learners, and</p></content></level><level class="para1" eId="section-1-6-i"><num>(i)</num><content><p>such other persons as the Scottish Ministers consider appropriate.</p></content></level></subsection><subsection eId="section-1-7"><num>(7)</num><intro><p>The Scottish Ministers must—</p></intro><level class="para1" eId="section-1-7-a"><num>(a)</num><content><p>from time to time, prepare a report on the progress being made in delivering the outcomes set out in the national skills funding strategy, and</p></content></level><level class="para1" eId="section-1-7-b"><num>(b)</num><content><p>publish the report and lay it before the Scottish Parliament.</p></content></level></subsection></section></part><part eId="part-2"><num>Part 2</num><heading>Functions of the Scottish Further and Higher Education Funding Council</heading><hcontainer Ministers</heading><section eId="section-2"><num>2</num><heading>General duty of the Council to secure high-quality learning</heading><subsection eId="section-2-1"><num>(1)</num><content><p>The Further and Higher Education (Scotland) Act 2005 is modified as follows.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><content><p><mod>In section 3 (the Council: general duty), for the words from “securing” to the end substitute <quotedText startQuote="“">securing—</quotedText><quotedStructure endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" eId="section-3"><num>3</num><heading>General duty of the Scottish Ministers to support delivery</heading><subsection eId="section-3-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p><mod>In section 4 (the Scottish Ministers: general duty), for subsections (1) and (2) ukl:Format="double"><subsection><num>(1)</num><intro><p>It is the duty of the Scottish Ministers to provide support for—</p></intro><level class="para1"><num>(a)</num><intro><p>the provision of—</p></intro><level class="para2"><num>(i)</num><content><p>fundable further education and fundable higher education by the post-16 education bodies, and</p></content></level><level class="para2"><num>(ii)</num><content><p>Scottish apprenticeships and work-based learning, and</p></content></level></level><level class="para1"><num>(b)</num><content><p>the undertaking of research among the post-16 education bodies.</p></content></level></subsection><subsection><num>(2)</num><intro><p>The Scottish Ministers are to do so—</p></intro><level class="para1"><num>(a)</num><intro><p>by—</p></intro><level class="para2"><num>(i)</num><content><p>making grants to the Council under sections 9, 10, 12C or 12I, and</p></content></level><level class="para2"><num>(ii)</num><content><p>such other means as they consider appropriate, and</p></content></level></level><level class="para1"><num>(b)</num><content><p>to such extent as they may determine.</p></content></level></subsection><subsection><num>(3)</num><content><p>When exercising their duty under subsection (1), the Scottish Ministers must have regard to the need for provision to address current and future economic needs.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-review-of-creditbased-funding-model"><heading>Review of credit-based funding model</heading><section eId="section-4"><num>4</num><heading>Review of credit-based funding model</heading><subsection eId="section-4-1"><num>(1)</num><intro><p>The Scottish Ministers must, within 12 months of this section coming into force, undertake a review of the credit-based funding model used by the Council for making payments to—</p></intro><level class="para1" eId="section-4-1-a"><num>(a)</num><content><p>colleges of further education,</p></content></level><level class="para1" eId="section-4-1-b"><num>(b)</num><content><p>any other providers of fundable further education.</p></content></level></subsection><subsection eId="section-4-2"><num>(2)</num><intro><p>The review undertaken under subsection (1) must consider the provision of fundable further education, including—</p></intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content><p>the availability of courses provided across Scotland,</p></content></level><level class="para1" eId="section-4-2-b"><num>(b)</num><content><p>the ability of providers of fundable further education to deliver courses.</p></content></level></subsection><subsection eId="section-4-3"><num>(3)</num><content><p>After completing the review, the Scottish Ministers must publish and lay a report on the review before the Scottish Parliament.</p></content></subsection><subsection eId="section-4-4"><num>(4)</num><content><p>The report must set out the action, if any, the Scottish Ministers intend to take as a result of the review.</p></content></subsection><subsection eId="section-4-5"><num>(5)</num><intro><p>In this section, the following terms have the meaning given by section 35(1) of the 2005 Act—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-colleges-of-further-education" eId="term-colleges-of-further-education">colleges of further education</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-fundable-further-education" eId="term-fundable-further-education">fundable further education</term>”.</p></content></hcontainer></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-conditions-of-funding"><heading>Conditions of funding</heading><section eId="section-5"><num>5</num><heading>Duty to place conditions on funding: transparency</heading><subsection eId="section-5-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><intro><p>In section 9A (higher education institutions: good governance)—</p></intro><level class="para1" which are appropriate in relation to a regional strategic body, as the case may be, includes, in particular, having regard to the need to operate in a way which is transparent and accountable.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section><section eId="section-6"><num>6</num><heading>Duty to place conditions on funding: conflict of interest</heading><subsection eId="section-6-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-6-2"><num>(2)</num><content><p><mod>After section 9E insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>9F</num><heading>Conflict of interest: disclosure</heading><subsection><num>(1)</num><intro><p>The Scottish Ministers must, under section 9(2), impose a condition that the Council must, when making a payment to a fundable post-16 education body under section 12(1), require that the fundable post-16 education body has in place a conflict of interest policy that—</p></intro><level class="para1"><num>(a)</num><content><p>requires each member of its governing body and each senior officer to declare any registerable interest,</p></content></level><level class="para1"><num>(b)</num><content><p>requires that a member of its governing body or senior officer withdraws from any meeting or decision-making process where they have a conflict of interest,</p></content></level><level class="para1"><num>(c)</num><intro><p>ensures that the fundable post-16 education body has a register of interests that is—</p></intro><level class="para2"><num>(i)</num><content><p>publicly accessible online,</p></content></level><level class="para2"><num>(ii)</num><content><p>updated within 28 days of any change, and</p></content></level><level class="para2"><num>(iii)</num><content><p>reviewed on an annual basis.</p></content></level></level></subsection><subsection><num>(2)</num><intro><p>For the purposes of subsection (1), a registerable interest includes—</p></intro><level class="para1"><num>(a)</num><content><p>financial interests,</p></content></level><level class="para1"><num>(b)</num><content><p>shareholdings,</p></content></level><level class="para1"><num>(c)</num><content><p>remunerated consultancies,</p></content></level><level class="para1"><num>(d)</num><content><p>intellectual property interests, and</p></content></level><level class="para1"><num>(e)</num><content><p>close family relationships with contractors or commercial partners.</p></content></level></subsection><subsection><num>(3)</num><content><p>The Scottish Ministers may by regulations amend the list of registerable interests in subsection (2).</p></content></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section><section eId="section-7"><num>7</num><heading>Duty to place conditions on funding: whistleblowing</heading><subsection eId="section-7-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><content><p><mod>After section 9F (as inserted by section 6(2)) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>9G</num><heading>Whistleblowing</heading><subsection><num>(1)</num><intro><p>The Scottish Ministers may, under section 9(2), impose a condition that the Council must, when making a payment to a fundable post-16 education body under section 12(1), require that the fundable post-16 education body has in place a whistleblowing procedure that—</p></intro><level class="para1"><num>(a)</num><content><p>is clearly communicated to all staff, students and members of the governing body of the fundable post-16 education body,</p></content></level><level class="para1"><num>(b)</num><intro><p>provides for the confidential reporting of concerns relating to issues including—</p></intro><level class="para2"><num>(i)</num><content><p>financial mismanagement,</p></content></level><level class="para2"><num>(ii)</num><content><p>failure of governance,</p></content></level><level class="para2"><num>(iii)</num><content><p>bullying or retaliation,</p></content></level><level class="para2"><num>(iv)</num><content><p>risks to learner provision, and</p></content></level></level><level class="para1"><num>(c)</num><content><p>provides protection against detriment (as a result of raising concerns) to individuals who raise concerns in good faith.</p></content></level></subsection><subsection><num>(2)</num><content><p>A fundable post-16 education body must notify the Council when it has received information through its whistleblowing procedure that suggests a material risk to continuity of learner provision or financial sustainability.</p></content></subsection><subsection><num>(3)</num><content><p>A notification under subsection (2) may be made on a confidential basis.</p></content></subsection><subsection><num>(4)</num><intro><p>On receipt of a notification under subsection (2), the Council must—</p></intro><level class="para1"><num>(a)</num><content><p>consider whether any action or support is required as a result of the notification,</p></content></level><level class="para1"><num>(b)</num><content><p>record any actions taken or support provided.</p></content></level></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-7-3"><num>(3)</num><content><p><mod>In schedule 1, paragraph 18, after sub-paragraph (1) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="double"><subparagraph><num>(1A)</num><intro><p>A report under sub-paragraph (1) must include an anonymised summary of the notifications received during the financial year under section 9G(2), including—</p></intro><level class="para1"><num>(a)</num><content><p>the number of notifications received,</p></content></level><level class="para1"><num>(b)</num><content><p>the nature of the concerns raised,</p></content></level><level class="para1"><num>(c)</num><content><p>any themes arising eId="section-8"><num>8</num><heading>Duty to place conditions on funding: engagement with trade unions, students and external partners</heading><subsection eId="section-8-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><content><p><mod>After section 9G (as inserted by section 7(2)) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>9H</num><heading>Engagement with trade unions, students and external partners</heading><subsection><num>(1)</num><intro><p>The Scottish Ministers must, under section 9(2), impose a condition that the Council must, when making a payment to a fundable post-16 education body under section 12(1), require that—</p></intro><level class="para1"><num>(a)</num><intro><p>the fundable post-16 education body takes reasonable steps to inform and consult the persons mentioned in subsection (2) before implementing any decision that could significantly impact its—</p></intro><level class="para2"><num>(i)</num><content><p>provision for learners,</p></content></level><level class="para2"><num>(ii)</num><content><p>levels of staffing, or</p></content></level><level class="para2"><num>(iii)</num><content><p>financial sustainability,</p></content></level></level><level class="para1"><num>(b)</num><intro><p>the fundable post-16 education body must, where requested by the Council, submit a report to the Council in relation to a decision on—</p></intro><level class="para2"><num>(i)</num><content><p>the persons consulted,</p></content></level><level class="para2"><num>(ii)</num><content><p>the issues raised by the persons consulted,</p></content></level><level class="para2"><num>(iii)</num><content><p>whether and, if so, how the issues raised by the persons consulted were addressed,</p></content></level><level class="para2"><num>(iv)</num><content><p>if the issues raised were not addressed, the reasons for not doing so.</p></content></level></level></subsection><subsection><num>(2)</num><intro><p>The persons include—</p></intro><level class="para1"><num>(a)</num><content><p>recognised trade unions representing employees of the body,</p></content></level><level class="para1"><num>(b)</num><content><p>organisations representing students of the body,</p></content></level><level class="para1"><num>(c)</num><content><p>any external partners which may be impacted by the decision.</p></content></level></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section><section eId="section-9"><num>9</num><heading>Duty to place conditions on funding: prevention of gender-based violence</heading><subsection eId="section-9-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-9-2"><num>(2)</num><content><p><mod>After section 9H (as inserted by section 8(2)) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>9I</num><heading>Prevention of gender-based violence</heading><subsection><num>(1)</num><intro><p>The Scottish Ministers may, under section 9(2), impose a condition that the Council must, when making a payment to a fundable post-16 education body under section 12(1), require the body to—</p></intro><level class="para1"><num>(a)</num><intro><p>take action—</p></intro><level class="para2"><num>(i)</num><content><p>to prevent gender-based violence against its students and staff, and</p></content></level><level class="para2"><num>(ii)</num><content><p>to provide support for its students and staff who are experiencing or have experienced gender-based violence, and</p></content></level></level><level class="para1"><num>(b)</num><intro><p>prepare and publish, as soon as reasonably practicable after the end of each academic year, a report setting out—</p></intro><level class="para2"><num>(i)</num><content><p>the action it has taken under paragraph (a) over the previous year, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the action it intends to take under paragraph (a) over the next year.</p></content></level></level></subsection><subsection><num>(2)</num><content><p>Where the Council imposes requirements on fundable post-16 education bodies by virtue of this section, it must publish those requirements.</p></content></subsection><subsection><num>(3)</num><content><p>The Council must issue guidance to fundable post-16 education bodies on compliance with requirements imposed by virtue of this section, including on what constitutes gender-based violence for the purposes of this section.</p></content></subsection><subsection><num>(4)</num><intro><p>Before issuing guidance under subsection (3), the Council must consult—</p></intro><level class="para1"><num>(a)</num><content><p>the Scottish Ministers,</p></content></level><level class="para1"><num>(b)</num><content><p>fundable post-16 education bodies,</p></content></level><level class="para1"><num>(c)</num><content><p>persons the Council considers to be representative of organisations campaigning for the prevention of gender-based violence, and</p></content></level><level class="para1"><num>(d)</num><content><p>such other persons the Council considers appropriate.</p></content></level></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-funding-for-national-training-programmes"><heading>Funding for national training programmes</heading><section eId="section-10"><num>10</num><heading>Funding for national training programmes</heading><subsection eId="section-10-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-10-2"><num>(2)</num><content><p><mod>In section 11 (administration of funds), in subsection (2)(b), after “purposes” insert <quotedText>“, except any funds made available to it under national training programmes</heading><section><num>12C</num><heading>Grants to the Council for national training programmes</heading><subsection><num>(1)</num><content><p>The Scottish Ministers may make grants to the Council for the purpose of securing the delivery of programmes of training for employment.</p></content></subsection><subsection><num>(2)</num><content><p>A grant made under subsection (1) is subject to such terms and conditions as the Scottish Ministers consider it appropriate to impose.</p></content></subsection><subsection><num>(3)</num><intro><p>Terms and conditions imposed under subsection (2) may, in particular, require—</p></intro><level class="para1"><num>(a)</num><content><p>that a specified programme is to be secured,</p></content></level><level class="para1"><num>(b)</num><content><p>that a programme to achieve a specified outcome is to be secured,</p></content></level><level class="para1"><num>(c)</num><content><p>that a programme directed at specified persons or specified descriptions of persons is to be secured,</p></content></level><level class="para1"><num>(d)</num><content><p>that, when making a payment to any person under section 12D, the Council is to impose a specified condition.</p></content></level></subsection><subsection><num>(4)</num><intro><p>The Scottish Ministers must—</p></intro><level class="para1"><num>(a)</num><content><p>publish terms and conditions imposed under subsection (2), together with the reasons for considering them appropriate to impose, or</p></content></level><level class="para1"><num>(b)</num><content><p>if they consider it would not be appropriate to publish terms and conditions imposed under subsection (2), publish a statement of their reasons for considering it would not be appropriate to do so.</p></content></level></subsection><subsection><num>(5)</num><content><p>In subsection (3), “<term refersTo="#term-specified">specified</term>” means specified in the terms and conditions.</p></content></subsection></section><section eId="d25e1149"><num>12D</num><heading>Administration of funds by the Council for national training programmes</heading><subsection><num>(1)</num><content><p>The Council is responsible for administering all grants made to it under section 12C for the purpose of securing the delivery of programmes of training for employment.</p></content></subsection><subsection><num>(2)</num><content><p>The Council may make grants, loans or other payments to any person for the purpose of the delivery of programmes of training for employment.</p></content></subsection><subsection><num>(3)</num><intro><p>A payment made under subsection (2)—</p></intro><level class="para1"><num>(a)</num><intro><p>may be subject to such terms and conditions as the Council considers it appropriate to impose, which may, in particular, relate to—</p></intro><level class="para2"><num>(i)</num><content><p>the repayment (in whole or in part) of a payment in such circumstances as the Council may specify,</p></content></level><level class="para2"><num>(ii)</num><content><p>the interest payable in respect of any period during which a sum due to the Council is outstanding, but</p></content></level></level><level class="para1"><num>(b)</num><content><p>must be subject to any terms and conditions imposed by the Scottish Ministers by virtue of section 12C.</p></content></level></subsection></section></hcontainer></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-scottish-apprenticeships"><heading>Scottish apprenticeships</heading><section eId="section-11"><num>11</num><heading>Scottish apprenticeships</heading><subsection eId="section-11-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-11-2"><num>(2)</num><content><p><mod>After <ref href="#d25e1149">section 12D</ref> (as inserted by <ref href="#section-10">section 10</ref><ref href="#section-10-3">(3)</ref>) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Scottish apprenticeships</heading><section><num>12E</num><heading>Definition of Scottish apprenticeship</heading><subsection><num>(1)</num><intro><p>For the purposes of this Part, a Scottish apprenticeship means an arrangement where—</p></intro><level class="para1"><num>(a)</num><content><p>an apprentice works for a person (“<term refersTo="#term-the-employer">the employer</term>”) for reward in an occupation or activity included in a Scottish apprenticeship framework,</p></content></level><level class="para1"><num>(b)</num><content><p>the apprentice receives training to meet the relevant requirements specified in a Scottish apprenticeship framework,</p></content></level><level class="para1"><num>(c)</num><content><p>there is an apprenticeship agreement in place between the apprentice and the employer and any training provider involved in the delivery of the apprenticeship, and</p></content></level><level class="para1"><num>(d)</num><content><p>any other criteria set out in regulations made by the Scottish Ministers are satisfied.</p></content></level></subsection><subsection><num>(2)</num><content><p>The Scottish Ministers may by regulations modify the definition of a Scottish apprenticeship in subsection (1).</p></content></subsection><subsection><num>(3)</num><intro><p>Before laying a draft of regulations under subsection (2) before the Scottish Parliament, the Scottish Ministers must consult—</p></intro><level class="para1"><num>(a)</num><content><p>the Council,</p></content></level><level class="para1"><num>(b)</num><content><p>apprentices and persons who appear to the Scottish Ministers to represent the interests of apprentices,</p></content></level><level class="para1"><num>(c)</num><content><p>representatives of any trade union (within the meaning given by section 1 of the Trade Union and Labour Relations (Consolidation) Act 1992) which appears to the Scottish Ministers to be representative of the interests of apprentices,</p></content></level><level class="para1"><num>(d)</num><content><p>employers and prospective employers of apprentices,</p></content></level><level class="para1"><num>(e)</num><content><p>the post-16 education bodies,</p></content></level><level class="para1"><num>(f)</num><content><p>training providers (within the meaning given by section 12J(3)), and</p></content></level><level class="para1"><num>(g)</num><content><p>such other persons as the Scottish Ministers consider appropriate.</p></content></level></subsection><subsection><num>(4)</num><content><p>In subsection (1), an “<term refersTo="#term-apprenticeship-agreement">apprenticeship agreement</term>” means an agreement which provides for an apprentice to receive training in order to assist the apprentice to meet the relevant requirements specified in an apprenticeship framework.</p></content></subsection></section><section><num>12F</num><heading>Scottish apprenticeship frameworks</heading><subsection><num>(1)</num><content><p>The Council may prepare and publish Scottish apprenticeship frameworks.</p></content></subsection><subsection><num>(2)</num><intro><p>A framework is to set out the relevant requirements for a Scottish apprenticeship in respect of different occupations or activities, including—</p></intro><level class="para1"><num>(a)</num><content><p>the required standards or qualifications to be achieved by apprentices during an apprenticeship, and</p></content></level><level class="para1"><num>(b)</num><content><p>the required types or amount of training.</p></content></level></subsection><subsection><num>(3)</num><intro><p>In preparing a framework, the Council must have regard to the views of—</p></intro><level class="para1"><num>(a)</num><content><p>such apprentices, prospective apprentices, and persons who appear to the Council to represent their interests, as the Council considers likely to be affected by the framework,</p></content></level><level class="para1"><num>(b)</num><content><p>representatives of any trade union (within the meaning given by section 1 of the Trade Union and Labour Relations (Consolidation) Act 1992) which appears to the Council to be representative of the interests of apprentices likely to be affected by the framework,</p></content></level><level class="para1"><num>(c)</num><content><p>such employers and prospective employers of apprentices as the Council considers likely to be affected by the framework, and</p></content></level><level class="para1"><num>(d)</num><content><p>such other persons as the Council considers likely to be affected.</p></content></level></subsection><subsection><num>(4)</num><content><p>The Council may amend or revoke a Scottish apprenticeship framework.</p></content></subsection><subsection><num>(5)</num><content><p>Where it amends or revokes a framework, the Council must publish a statement of its reasons for doing so.</p></content></subsection><subsection><num>(6)</num><intro><p>Before amending or revoking a framework, the Council must have regard to the views of—</p></intro><level class="para1"><num>(a)</num><content><p>such apprentices, prospective apprentices, and persons who appear to the Council to represent their interests, as the Council considers likely to be affected by the amendment or revocation of the framework,</p></content></level><level class="para1"><num>(b)</num><content><p>representatives of any trade union (within the meaning given by section 1 of the Trade Union and Labour Relations (Consolidation) Act 1992) which appears to the Council to be representative of the interests of apprentices likely to be affected by the amendment or revocation of the or revocation of the framework, and</p></content></level><level class="para1"><num>(d)</num><content><p>such other persons as the Council considers likely to be affected.</p></content></level></subsection><subsection><num>(7)</num><intro><p>The Scottish Ministers may by regulations make further provision about—</p></intro><level class="para1"><num>(a)</num><content><p>the requirements for Scottish apprenticeships which are to be specified in a framework, and</p></content></level><level class="para1"><num>(b)</num><content><p>the process to be followed by the Council in preparing, publishing, amending and revoking frameworks.</p></content></level></subsection></section><section><num>12G</num><heading>Requests for apprenticeship frameworks</heading><subsection><num>(1)</num><content><p>A person may request the Council to prepare or amend a Scottish apprenticeship framework for a particular occupation or activity.</p></content></subsection><subsection><num>(2)</num><content><p>The Council must consider any request made to it under subsection (1).</p></content></subsection><subsection><num>(3)</num><content><p>The Council may charge a reasonable fee to cover the cost, in whole or in part, of preparing or amending a framework as requested.</p></content></subsection><subsection><num>(4)</num><content><p>Subsections (2) to (6) of section 12F apply to a framework requested to be prepared or amended under this section.</p></content></subsection><subsection><num>(5)</num><intro><p>The Scottish Ministers may by regulations make provision about—</p></intro><level class="para1"><num>(a)</num><content><p>the process to be followed by the Council in responding to requests to prepare or amend a framework,</p></content></level><level class="para1"><num>(b)</num><content><p>the amount of the fee that the Council may charge for preparing or amending a framework,</p></content></level><level class="para1"><num>(c)</num><content><p>the circumstances in which the fee is to be waived by the Council.</p></content></level></subsection></section><section><num>12H</num><heading>Scottish apprenticeship certificates</heading><subsection><num>(1)</num><content><p>An individual who is or has been an apprentice, or another person on behalf of such an individual, may apply to the Council for a Scottish apprenticeship certificate.</p></content></subsection><subsection><num>(2)</num><content><p>The Council may issue a Scottish apprenticeship certificate where it is satisfied that the individual in respect of whom an application has made has completed a Scottish apprenticeship.</p></content></subsection><subsection><num>(3)</num><content><p>The Council may charge a reasonable fee for issuing a Scottish apprenticeship certificate.</p></content></subsection><subsection><num>(4)</num><intro><p>The Scottish Ministers may by regulations make provision about—</p></intro><level class="para1"><num>(a)</num><content><p>the process for requesting and issuing apprenticeship certificates, and</p></content></level><level class="para1"><num>(b)</num><content><p>the amount of the which work-based activities are undertaken by the individual, and</p></content></level><level class="para1"><num>(b)</num><content><p>on the basis of a work-based learning agreement.</p></content></level></subsection><subsection><num>(3)</num><content><p>In subsection (2), a “<term refersTo="#term-work-based-learning-agreement">work-based learning agreement</term>” means an agreement which sets out the educational and vocational standards to be met by an individual and provides for the individual to receive education and training in order to meet those standards.</p></content></subsection><subsection><num>(4)</num><content><p>A grant made under subsection (1) is subject to such terms and conditions as the Scottish Ministers consider it appropriate to impose.</p></content></subsection><subsection><num>(5)</num><intro><p>The Scottish Ministers may by regulations make further provision about—</p></intro><level class="para1"><num>(a)</num><content><p>what activities constitute work-based learning, and</p></content></level><level class="para1"><num>(b)</num><content><p>the requirements of work-based learning.</p></content></level></subsection></section><section><num>12J</num><heading>Administration of funds by the Council for Scottish apprenticeships and work-based learning</heading><subsection><num>(1)</num><content><p>The Council is responsible for administering all grants made to it under section 12I for the purpose of securing the delivery of Scottish apprenticeships and work-based learning.</p></content></subsection><subsection><num>(2)</num><content><p>The Council may make grants, loans or other payments to a training provider for the purpose of the delivery of Scottish apprenticeships or work-based learning.</p></content></subsection><subsection><num>(3)</num><intro><p>In subsection (2), a “<term refersTo="#term-training-provider">training provider</term>” means a person who—</p></intro><level class="para1"><num>(a)</num><content><p>provides either work-based learning or the training of an apprentice required under a Scottish apprenticeship framework, and</p></content></level><level class="para1"><num>(b)</num><content><p>meets criteria set out in regulations made by the Scottish Ministers.</p></content></level></subsection><subsection><num>(4)</num><content><p>A payment made under subsection (2) may be subject to such terms and conditions as the Council considers it appropriate to impose.</p></content></subsection><subsection><num>(5)</num><intro><p>The Council must impose conditions on a payment made under subsection (2) that—</p></intro><level class="para1"><num>(a)</num><content><p>any person who is contracted by a training provider to deliver the learning or training must also be a training provider within the meaning of subsection (3), and</p></content></level><level class="para1"><num>(b)</num><content><p>no training provider (whether the person receiving the payment or another person contracted to deliver the learning or training) is entitled to retain more than such percentage of the payment as the Council considers reasonable as a fee for managing the delivery of the learning or purposes of the examination.</p></wrapUp></subsection><subsection><num>(4)</num><content><p>The Scottish Ministers may request the Council to provide them with information and advice in relation to the financial sustainability of post-16 education bodies.</p></content></subsection><subsection><num>(5)</num><intro><p>The Council—</p></intro><level class="para1"><num>(a)</num><content><p>must provide such information and advice when requested by the Scottish Ministers, and</p></content></level><level class="para1"><num>(b)</num><content><p>otherwise may provide such information and advice whenever it considers it appropriate to do so.</p></content></level></subsection></section></quotedStructure><inline and manner in which information required to be provided to the Council under or by virtue of this Act is to be provided,</p></content></level><level class="para1"><num>(d)</num><content><p>the identification of skills needs and skills planning in particular localities.</p></content></level></subsection><subsection><num>(3)</num><content><p>Guidance relating to the matters mentioned in subsection (2)(c) must be consistent with any regulations made by the Scottish Ministers under section 14B(1).</p></content></subsection><subsection><num>(4)</num><content><p>A person must have regard to any guidance issued under subsection (1) about activities in respect of which the person is in receipt of payments from the Council.</p></content></subsection><subsection><num>(5)</num><intro><p>Before issuing guidance under subsection (1), the Council must consult—</p></intro><level class="para1"><num>(a)</num><content><p>the Scottish Ministers,</p></content></level><level class="para1"><num>(b)</num><content><p>the persons mentioned in subsection (1), and</p></content></level><level class="para1"><num>(c)</num><content><p>such other persons as the Council considers appropriate.</p></content></level></subsection><subsection><num>(6)</num><content><p>The Council may publish any guidance issued under subsection (1) as it considers class="para1"><num>(a)</num><content><p>report on the matters mentioned in paragraphs (a) and (b) of that subsection either in a single report or separately,</p></content></level><level class="para1"><num>(b)</num><content><p>be part of another document.</p></content></level></subsection><subsection><num>(3)</num><intro><p>The Scottish Ministers may direct the Council to—</p></intro><level class="para1"><num>(a)</num><content><p>include in a report under subsection (1) particular aspects of the matters mentioned in paragraphs (a) and (b) of that subsection,</p></content></level><level class="para1"><num>(b)</num><content><p>prepare and publish a report on any matter relating to its functions as the Scottish Ministers may determine.</p></content></level></subsection><subsection><num>(4)</num><content><p>A direction under subsection (3)(b) may require the Council to publish the report within a particular period or at particular intervals.</p></content></subsection><subsection><num>(5)</num><content><p>The Council must comply with a direction given to it under this section.</p></content></subsection><subsection><num>(6)</num><content><p>The Scottish Ministers may vary or revoke a direction given under this participation in fundable further education or fundable higher education by persons belonging to any socio-economic group which the Scottish Ministers reasonably consider to be under-represented in such education.</p></content></subsection><subsection><num>(4)</num><intro><p>Regulations under <ref href="#d25e2648">subsection (1)</ref> may in particular—</p></intro><level class="para1"><num>(a)</num><content><p>require information holders to provide the specified information to a relevant body,</p></content></level><level class="para1"><num>(b)</num><content><p>require a relevant body to provide the specified information to another relevant body,</p></content></level><level class="para1"><num>(c)</num><content><p>make provision about the circumstances in which an information holder or a relevant body is not required to provide the specified information.</p></content></level></subsection><subsection><num>(5)</num><content><p>Where the specified information is that a school lunch is or has been provided for a pupil free of charge by virtue of section 53 of the 1980 Act, regulations under <ref href="#d25e2648">subsection (1)</ref> may disapply section 53B of that Act in relation to the sharing of that information.</p></content></subsection><subsection><num>(6)</num><content><p>For the purposes of <ref href="#d25e2666">subsection (3)</ref> a socio-economic group is to be treated as under-represented in fundable further education or fundable higher education if participation in such education by persons in that group is disproportionately low.</p></content></subsection><subsection><num>(7)</num><content><p>The Scottish Ministers may take into account any social or economic characteristics which they consider appropriate when determining which groups are to constitute “<term refersTo="#term-socio-economic-groups">socio-economic groups</term>” for the purposes of this provider under section 84 of the Higher Education and Research Act 2017,</p></content></level><level class="para1"><num>(b)</num><content><p>the Welsh Ministers have designated the provider under section 83 of the Tertiary Education and Research (Wales) Act 2022, or</p></content></level><level class="para1"><num>(c)</num><content><p>the Department of Education in Northern Ireland has designated the provider’s courses as eligible for student support under Article 3 of the <ref eId="c00001" href="http://www.legislation.gov.uk/id/nisi/1998/1760">Education (Student Support) (Northern Ireland) Order 1998 (1998/1760) (N.I. 14)</ref>.</p></content></level></subsection><subsection><num>(4)</num><content><p>A provider which has been designated for the purpose of this section may apply to the Scottish Ministers for particular courses of education it provides to be approved for the payment of allowances or loans by virtue of section 73(f) of this Act.</p></content></subsection><subsection><num>(5)</num><intro><p>The Scottish Ministers may by regulations make provision about—</p></intro><level class="para1"><num>(a)</num><content><p>the process for applying for a designation,</p></content></level><level class="para1"><num>(b)</num><intro><p>the charging of a fee for applying for a designation, including—</p></intro><level class="para2"><num>(i)</num><content><p>the amount of the fee payable, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the circumstances in which the fee is to be waived by Ministers,</p></content></level></level><level class="para1"><num>(c)</num><content><p>the process for making a designation (including provision about the factors which Ministers are to take into account when deciding whether to make a designation),</p></content></level><level class="para1"><num>(d)</num><content><p>the withdrawal of a designation (including provision about the factors which Ministers are to take into account when deciding whether to withdraw a designation),</p></content></level><level class="para1"><num>(e)</num><content><p>the effect of withdrawal of a designation (including provision for allowances or loans made by virtue of regulations under section 73(f) to continue to be payable following withdrawal of a designation),</p></content></level><level class="para1"><num>(f)</num><content><p>the process for applying for particular courses of education to be approved for the payment of allowances or loans by virtue of section 73(f) of this Act (including provision about the factors which Ministers are to take into account when deciding whether to approve courses).</p></content></level></subsection><subsection><num>(6)</num><content><p>Regulations under subsection (5) may make different provision for different purposes.</p></content></subsection><subsection><num>(7)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-further-education">further education</term>” means a programme of learning which falls within section 6 of the Further and Higher Education (Scotland) Act 1992,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-higher-education">higher education</term>” has the meaning given by section 38 of that eId="section-33"><num>33</num><heading>Directions relating to student support</heading><subsection eId="section-33-1"><num>(1)</num><content><p>The Education (Scotland) Act 1980 is modified as follows.</p></content></subsection><subsection eId="section-33-2"><num>(2)</num><intro><p>In section 73ZA (administration of certain sums)—</p></intro><level class="para1" eId="section-33-2-a"><num>(a)</num><content><p><mod>in subsection (3), for the words from “persons—” to the end substitute <quotedText startQuote="“">persons undertaking, or who have undertaken, eId="section-35"><num>35</num><heading>Review of operation of Act</heading><subsection eId="section-35-1"><num>(1)</num><intro><p>As soon as reasonably practicable after the end of each of the two review periods, the Scottish Ministers must—</p></intro><level class="para1" eId="section-35-1-a"><num>(a)</num><content><p>undertake a review of the operation of this Act, and</p></content></level><level class="para1" eId="section-35-1-b"><num>(b)</num><content><p>prepare a report on that review.</p></content></level></subsection><subsection eId="section-35-2"><num>(2)</num><content><p>The Scottish Ministers may delegate their functions under subsection (1) to such person as they consider appropriate.</p></content></subsection><subsection eId="section-35-3"><num>(3)</num><intro><p>When undertaking a review under subsection (1)(a), the Scottish Ministers (or, if applicable, the person to whom the function is delegated under subsection (2)) must consult—</p></intro><level class="para1" eId="section-35-3-a"><num>(a)</num><content><p>learners or persons who appear to be representative of learners,</p></content></level><level class="para1" eId="section-35-3-b"><num>(b)</num><content><p>post-16 education bodies,</p></content></level><level class="para1" eId="section-35-3-c"><num>(c)</num><content><p>training providers or persons who appear to be representative of training providers,</p></content></level><level class="para1" eId="section-35-3-d"><num>(d)</num><content><p>employers or persons who appear to be representative of employers,</p></content></level><level class="para1" eId="section-35-3-e"><num>(e)</num><content><p>the Council, and</p></content></level><level class="para1" eId="section-35-3-f"><num>(f)</num><content><p>such other persons as are considered appropriate.</p></content></level></subsection><subsection eId="section-35-4"><num>(4)</num><intro><p>The Scottish Ministers must, as soon as reasonably practicable after the report is prepared—</p></intro><level class="para1" eId="section-35-4-a"><num>(a)</num><content><p>publish the report, and</p></content></level><level class="para1" eId="section-35-4-b"><num>(b)</num><content><p>lay a copy of the report before the Scottish Parliament.</p></content></level></subsection><subsection eId="section-35-5"><num>(5)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-review-period" eId="term-review-period">review period</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>in the case of the first review, the period of 1 year beginning with the day on which this section comes into force, and</p></content></level><level class="para1"><num>(b)</num><content><p>in the case of the second review, the period of 5 years beginning with the day on which this section comes into force,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-post-16-education-body" eId="term-post-16-education-body">post-16 education body</term>” has the meaning given by section 35(1) of the 2005 Act,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-training-provider" eId="term-training-provider">training provider</term>” has the meaning given by section 12J(3) of that Act.</p></content></hcontainer></subsection></section></part><part eId="part-6"><num>Part 6</num><heading>Final provisions</heading><section eId="section-36"><num>36</num><heading>Interpretation</heading><intro><p>In this Act—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-the-2005-act" eId="term-the-2005-act">the 2005 Act</term>” means the Further and Higher Education (Scotland) Act 2005,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-the-council" eId="term-the-council">the Council</term>” means the Scottish Further and Higher Education Funding Council established under section 1 of the 2005 Act.</p></content></hcontainer></section><section eId="section-37"><num>37</num><heading>Ancillary provision</heading><subsection eId="section-37-1"><num>(1)</num><content><p>The Scottish Ministers may by regulations make any incidental, supplementary, consequential, transitional, transitory or saving provision they consider appropriate for the purposes of, in connection with or for giving full effect to this Act.</p></content></subsection><subsection eId="section-37-2"><num>(2)</num><intro><p>Regulations under this section may—</p></intro><level class="para1" eId="section-37-2-a"><num>(a)</num><content><p>make different provision for different purposes,</p></content></level><level class="para1" eId="section-37-2-b"><num>(b)</num><content><p>modify any enactment (including this Act).</p></content></level></subsection><subsection eId="section-37-3"><num>(3)</num><intro><p>Regulations under this section—</p></intro><level class="para1" eId="section-37-3-a"><num>(a)</num><content><p>are subject to the affirmative procedure if they add to, replace or omit any part of the text of an Act, but</p></content></level><level class="para1" eId="section-37-3-b"><num>(b)</num><content><p>otherwise are subject to the negative procedure.</p></content></level></subsection></section><section eId="section-38"><num>38</num><heading>Regulation-making powers</heading><subsection eId="section-38-1"><num>(1)</num><content><p>The 2005 Act is modified as follows.</p></content></subsection><subsection eId="section-38-2"><num>(2)</num><content><p><mod>In section 34 (orders and regulations), in subsection (4)(a), after “7(2)(i)” insert <quotedText>“, 12E(2), 14B(1) or 25B(1)”</quotedText>.</mod></p></content></subsection></section><section eId="section-39"><num>39</num><heading>Commencement</heading><subsection eId="section-39-1"><num>(1)</num><content><p>This Part comes into force on the day after Royal Assent.</p></content></subsection><subsection eId="section-39-2"><num>(2)</num><content><p>The other provisions of this Act come into force on such day as the Scottish Ministers may by regulations appoint.</p></content></subsection><subsection eId="section-39-3"><num>(3)</num><intro><p>Regulations
