the restriction of the physical movement of, or isolation of, pupils by education providers in schools.</p></longTitle></preface><body><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-restraint-and-seclusion"><heading>Restraint and seclusion</heading><section eId="section-1"><num>1</num><heading>Restraint and seclusion</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>In this Act—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>“<term refersTo="#term-restraint" eId="term-restraint">restraint</term>” means physical contact by a member of the staff of an education provider which has the intention of significantly restricting the physical movement of a pupil, including restricting their freedom of movement or ability to move independently,</p></content></level><level class="para1" eId="section-1-1-b"><num>(b)</num><content><p>“<term refersTo="#term-seclusion" eId="term-seclusion">seclusion</term>” means anything done by a member of the staff of an education provider with the intention of isolating a pupil from other pupils and preventing them from leaving the place where they are isolated.</p></content></level></subsection><subsection eId="section-1-2"><num>(2)</num><content><p>References in this Act to “the use of” restraint or seclusion are references to the doing of anything that would constitute restraint or, as the case may be, seclusion.</p></content></subsection><subsection eId="section-1-3"><num>(3)</num><content><p>In <ref href="#section-1-1">subsection (1)</ref>, “<term refersTo="#term-member-of-the-staff-of-an-education-provider" eId="term-member-of-the-staff-of-an-education-provider">member of the staff of an education provider</term>” includes anyone acting under the authority of an education provider.</p></content></subsection><subsection eId="section-1-4"><num>(4)</num><intro><p>The Scottish Ministers may by regulations modify the definitions of restraint and seclusion in subsection (1) where they consider it necessary to do so in order to—</p></intro><level class="para1" eId="section-1-4-a"><num>(a)</num><content><p>prevent the definitions capturing actions which do not carry a significant risk of harm,</p></content></level><level class="para1" eId="section-1-4-b"><num>(b)</num><content><p>allow the definitions to capture additional actions which carry a significant risk of harm.</p></content></level></subsection><subsection eId="section-1-5"><num>(5)</num><content><p>Before laying a draft of a Scottish statutory instrument containing regulations under subsection (4) before the Scottish Parliament, the Scottish Ministers must consult such persons as they consider appropriate.</p></content></subsection></section><section eId="section-2"><num>2</num><heading>Guidance on restraint and seclusion in schools</heading><subsection eId="section-2-1"><num>(1)</num><content><p>The Scottish Ministers must issue guidance to education providers about the use of restraint and seclusion in schools.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>The guidance must include in particular guidance about the following matters—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>what is meant by significantly restricting physical movement for the purposes of the definition of restraint in section 1(1)(a),</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>appropriate and inappropriate forms of restraint and seclusion,</p></content></level><level class="para1" eId="section-2-2-c"><num>(c)</num><content><p>alternatives to restraint and seclusion,</p></content></level><level class="para1" eId="section-2-2-d"><num>(d)</num><content><p>action that might be taken to prevent or minimise the use of restraint and seclusion,</p></content></level><level class="para1" eId="section-2-2-e"><num>(e)</num><content><p>matters to be taken into consideration with a view to safeguarding pupils subject to restraint or seclusion,</p></content></level><level class="para1" eId="section-2-2-f"><num>(f)</num><content><p>legal requirements, and any other legal considerations, that might apply or be relevant to the use of restraint or seclusion,</p></content></level><level class="para1" eId="section-2-2-g"><num>(g)</num><content><p>action to be taken following an incident resulting in the use of restraint or seclusion,</p></content></level><level class="para1" eId="section-2-2-h"><num>(h)</num><content><p>the recording, reporting and monitoring of incidents involving the use of restraint or seclusion,</p></content></level><level class="para1" eId="section-2-2-i"><num>(i)</num><content><p>inspection of the practice of restraint and seclusion,</p></content></level><level class="para1" eId="section-2-2-j"><num>(j)</num><content><p>the training of staff in the use of restraint and seclusion,</p></content></level><level class="para1" eId="section-2-2-k"><num>(k)</num><content><p>compliance with the duties under this Act,</p></content></level><level class="para1" eId="section-2-2-l"><num>(l)</num><content><p>processes for the making of complaints about the use of restraint and seclusion, and the provision of information about the making of such complaints,</p></content></level><level class="para1" eId="section-2-2-m"><num>(m)</num><content><p>action to be taken to resolve or remedy complaints.</p></content></level></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>The Scottish Ministers must keep the guidance under review and may issue revised guidance from to time to time.</p></content></subsection><subsection eId="section-2-4"><num>(4)</num><content><p>Guidance under this section may elaborate upon the definitions of “restraint” and “seclusion” in <ref href="#section-1">section 1</ref>.</p></content></subsection><subsection eId="section-2-5"><num>(5)</num><content><p>Guidance under this section may make different provision for different purposes, including different provision for different education providers or different schools.</p></content></subsection><subsection eId="section-2-6"><num>(6)</num><intro><p>Before issuing guidance or revised guidance under this section, the Scottish Ministers must consult—</p></intro><level class="para1" eId="section-2-6-a"><num>(a)</num><content><p>education providers,</p></content></level><level class="para1" eId="section-2-6-b"><num>(b)</num><content><p>persons or bodies appearing to the Scottish Ministers to be representative of the interests of parents of pupils,</p></content></level><level class="para1" eId="section-2-6-c"><num>(c)</num><content><p>any trade union appearing to the Scottish Ministers to be representative of the staff in schools,</p></content></level><level class="para1" eId="section-2-6-d"><num>(d)</num><content><p>children and young people,</p></content></level><level class="para1" eId="section-2-6-e"><num>(e)</num><content><p>the Commissioner for Children and Young People in Scotland,</p></content></level><level class="para1" eId="section-2-6-f"><num>(f)</num><content><p>such voluntary organisations and other persons as the Scottish Ministers consider appropriate.</p></content></level></subsection><subsection eId="section-2-7"><num>(7)</num><content><p>For the purposes of subsection (6), it is immaterial that anything done by way of consultation in relation to the first guidance issued under this section was done before this section comes into force.</p></content></subsection><subsection eId="section-2-8"><num>(8)</num><content><p>An education provider must have regard to guidance and revised guidance issued under this section.</p></content></subsection><subsection eId="section-2-9"><num>(9)</num><content><p>Guidance and revised guidance issued under this section must be published in such manner as the Scottish Ministers consider appropriate.</p></content></subsection></section><section eId="section-3"><num>3</num><heading>Duty to inform parents of use of restraint or seclusion</heading><subsection eId="section-3-1"><num>(1)</num><intro><p>Where a pupil is subject to restraint or seclusion in a school, the responsible person for that school must inform the parent of the pupil of—</p></intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content><p>the fact that the pupil has been subject to restraint or seclusion, and</p></content></level><level class="para1" eId="section-3-1-b"><num>(b)</num><content><p>details of the incident giving rise to the use of restraint or seclusion in relation to the pupil.</p></content></level></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>The responsible person must inform the parent as soon as possible and, in any event, no later than—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>the end of the school day on which the incident giving rise to the restraint and seclusion took place, or</p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><content><p>where it is not reasonably practicable to inform by then, 24 hours after the occurrence of the incident giving rise to the restraint or seclusion.</p></content></level></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>If the parent indicates that information about whether a pupil has been subject to restraint or seclusion may be given to another person, the responsible person may comply with subsection (1) by informing that other person instead of the parent.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><content><p>The duty under this section to inform the parent when a pupil is subject to restraint or seclusion in a school does not apply to types of restraint or seclusion specified in regulations under section 4(9).</p></content></subsection><subsection eId="section-3-5"><num>(5)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>the “<term refersTo="#term-responsible-person" eId="term-responsible-person">responsible person</term>” for a school is—</p></intro><level class="para1"><num>(a)</num><content><p>in relation to a school under the management of an education authority, the headteacher of the school or another member of the school staff authorised by the headteacher,</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to an independent school, the proprietor of the school,</p></content></level><level class="para1"><num>(c)</num><content><p>in relation to a grant-aided school, the managers of the school,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-end-of-the-school-day" eId="term-end-of-the-school-day">end of the school day</term>” means, for any day on which the school is open to its pupils for the purpose of their school education, the time at which the pupils are dismissed from school.</p></content></hcontainer></subsection></section><section eId="section-4"><num>4</num><heading>Duty to record and report on use of restraint and seclusion</heading><subsection eId="section-4-1"><num>(1)</num><content><p>Each education provider must record all incidences of the use of restraint or seclusion in its schools.</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><content><p>The proprietor of an independent school and the managers of a grant-aided school must inform the Scottish Ministers, by such time as they may specify, of the number of incidences of restraint and seclusion in the school.</p></content></subsection><subsection eId="section-4-3"><num>(3)</num><content><p>Each education authority must inform the Scottish Ministers, by such time as they may specify, of the number of incidences of restraint and seclusion in schools under its management.</p></content></subsection><subsection eId="section-4-4"><num>(4)</num><content><p>The Scottish Ministers may by regulations make provision for education providers to report incidences of the use of restraint or seclusion in schools to a person specified in the regulations.</p></content></subsection><subsection eId="section-4-5"><num>(5)</num><intro><p>Regulations under subsection (4) may in particular include provision—</p></intro><level class="para1" eId="section-4-5-a"><num>(a)</num><content><p>about the timescales for reporting,</p></content></level><level class="para1" eId="section-4-5-b"><num>(b)</num><content><p>about the form and content of reports,</p></content></level><level class="para1" eId="section-4-5-c"><num>(c)</num><content><p>requiring information about incidences to be provided by the person specified in the regulations to the Scottish Ministers,</p></content></level><level class="para1" eId="section-4-5-d"><num>(d)</num><content><p>about the timescales for providing that information,</p></content></level><level class="para1" eId="section-4-5-e"><num>(e)</num><content><p>about the form and content of that information.</p></content></level></subsection><subsection eId="section-4-6"><num>(6)</num><intro><p>Regulations under subsection (4) may—</p></intro><level class="para1" eId="section-4-6-a"><num>(a)</num><content><p>make different provision for different types of education provider,</p></content></level><level class="para1" eId="section-4-6-b"><num>(b)</num><content><p>modify any enactment (including this Act).</p></content></level></subsection><subsection eId="section-4-7"><num>(7)</num><content><p>Before laying a draft of a Scottish statutory instrument containing regulations under subsection (4) before the Scottish Parliament, the Scottish Ministers must consult such persons as they consider appropriate.</p></content></subsection><subsection eId="section-4-8"><num>(8)</num><intro><p>The Scottish Ministers must, for each year—</p></intro><level class="para1" eId="section-4-8-a"><num>(a)</num><content><p>prepare a report setting out the number of incidences of the use of restraint and seclusion in schools in Scotland in the year, and</p></content></level><level class="para1" eId="section-4-8-b"><num>(b)</num><content><p>lay the report before the Scottish Parliament as soon as practicable after the end of the year.</p></content></level></subsection><subsection eId="section-4-9"><num>(9)</num><intro><p>The Scottish Ministers may by regulations specify types of restraint or seclusion which need not be—</p></intro><level class="para1" eId="section-4-9-a"><num>(a)</num><content><p>recorded under subsection (1), or</p></content></level><level class="para1" eId="section-4-9-b"><num>(b)</num><intro><p>reported to—</p></intro><level class="para2" eId="section-4-9-b-i"><num>(i)</num><content><p>the Scottish Ministers under subsection (2) or (3), or</p></content></level><level class="para2" eId="section-4-9-b-ii"><num>(ii)</num><content><p>a person specified in regulations made under subsection (4).</p></content></level></level></subsection><subsection eId="section-4-10"><num>(10)</num><content><p>Before laying a draft of a Scottish statutory instrument containing regulations under subsection (9) before the Scottish Parliament, the Scottish Ministers must consult such persons as they consider appropriate.</p></content></subsection><subsection eId="section-4-11"><num>(11)</num><intro><p>In <ref href="#section-4-8">subsection (8)</ref>, “<term refersTo="#term-year" eId="term-year">year</term>” means—</p></intro><level class="para1" eId="section-4-11-a"><num>(a)</num><content><p>the period beginning with the date on which this Act comes into force and ending on the following 31 July, and</p></content></level><level class="para1" eId="section-4-11-b"><num>(b)</num><content><p>each subsequent period of one year beginning on 1 August.</p></content></level></subsection></section><section eId="section-5"><num>5</num><heading>Training standards</heading><subsection eId="section-5-1"><num>(1)</num><intro><p>The Scottish Ministers may—</p></intro><level class="para1" eId="section-5-1-a"><num>(a)</num><content><p>develop standards for the provision of training on the use of restraint and seclusion in schools and maintain a list of persons who meet those standards,</p></content></level><level class="para1" eId="section-5-1-b"><num>(b)</num><intro><p>maintain—</p></intro><level class="para2" eId="section-5-1-b-i"><num>(i)</num><content><p>a list of standards developed by other persons for the provision of training on the use of restraint and seclusion in schools that the Scottish Ministers consider appropriate, and</p></content></level><level class="para2" eId="section-5-1-b-ii"><num>(ii)</num><content><p>a list of persons who meet those standards.</p></content></level></level></subsection><subsection eId="section-5-2"><num>(2)</num><content><p>The Scottish Ministers must publish any standards developed and any lists maintained under subsection (1) in such manner as they consider appropriate.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-general"><heading>General</heading><section eId="section-6"><num>6</num><heading>Interpretation</heading><subsection eId="section-6-1"><num>(1)</num><intro><p>References in this Act to an “education provider” are references to—</p></intro><level class="para1" eId="section-6-1-a"><num>(a)</num><content><p>in relation to a school under the management of an education authority, that education authority,</p></content></level><level class="para1" eId="section-6-1-b"><num>(b)</num><content><p>in relation to an independent school, the proprietor of the school,</p></content></level><level class="para1" eId="section-6-1-c"><num>(c)</num><content><p>in relation to a grant-aided school, the managers of the school.</p></content></level></subsection><subsection eId="section-6-2"><num>(2)</num><intro><p>The following terms have the meanings given in

<ref eId="c00003" href="https://www.legislation.gov.uk/ukpga/1980/44/contents">Education (Scotland) Act 1980</ref> (and plural or other related forms are to be construed accordingly)—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-area" eId="term-area">area</term>” (in relation to an education authority),</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-child" eId="term-child">child</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-education-authority" eId="term-education-authority">education authority</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-grant-aided-school" eId="term-grant-aided-school">grant-aided school</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-independent-school" eId="term-independent-school">independent school</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-managers" eId="term-managers">managers</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-parent" eId="term-parent">parent</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-proprietor" eId="term-proprietor">proprietor</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-pupil" eId="term-pupil">pupil</term>”,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-school" eId="term-school">school</term>” (but here the expression does not include a nursery school or a nursery class in a school within the meaning of that section),</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-young-person" eId="term-young-person">young person</term>”.</p></content></hcontainer></subsection></section><section eId="section-7"><num>7</num><heading>Regulation-making powers</heading><subsection eId="section-7-1"><num>(1)</num><content><p>A power to make regulations conferred by this Act includes the power to make different provision for different purposes or different areas.</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><content><p>Regulations under this Act (other than section 8(1)) are subject to the affirmative procedure.</p></content></subsection><subsection eId="section-7-3"><num>(3)</num><content><p>This section does not apply to regulations under section 9(2).</p></content></subsection></section><section eId="section-8"><num>8</num><heading>Ancillary provision</heading><subsection eId="section-8-1"><num>(1)</num><content><p>The Scottish Ministers may by regulations make any incidental, supplementary, consequential, transitional, transitory or saving provision they consider appropriate for the purposes of, in connection with or for giving full effect to this Act or any provision made under it.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><content><p>Regulations under this section may modify any enactment (including this Act).</p></content></subsection><subsection eId="section-8-3"><num>(3)</num><intro><p>Regulations under this section—</p></intro><level class="para1" eId="section-8-3-a"><num>(a)</num><content><p>are subject to the affirmative procedure if they add to, replace or omit any part of the text of an Act,</p></content></level><level class="para1" eId="section-8-3-b"><num>(b)</num><content><p>otherwise, are subject to the negative procedure.</p></content></level></subsection></section><section eId="section-9"><num>9</num><heading>Commencement</heading><subsection eId="section-9-1"><num>(1)</num><content><p>This section and sections 6, 7, 8 and 10 come into force on the day after Royal Assent.</p></content></subsection><subsection eId="section-9-2"><num>(2)</num><content><p>Sections 1 to 5 come into force on such day as the Scottish Ministers may by regulations appoint.</p></content></subsection><subsection eId="section-9-3"><num>(3)</num><intro><p>Regulations under subsection (2) may—</p></intro><level class="para1" eId="section-9-3-a"><num>(a)</num><content><p>include transitional, transitory or saving provision,</p></content></level><level class="para1" eId="section-9-3-b"><num>(b)</num><content><p>make different provision for different purposes.</p></content></level></subsection><subsection eId="section-9-4"><num>(4)</num><content><p>The Scottish Ministers must make regulations under subsection (2) no later than 31 July 2028.</p></content></subsection></section><section eId="section-10"><num>10</num><heading>Short title</heading><content><p>The short title of this Act is the Restraint and Seclusion in Schools (Scotland) Act 2026.</p></content></section></hcontainer></body></act></akomaNtoso>
