eId="section-62" uk:target="true"><num>62</num><heading>Reviews of the operation and jurisdiction of the Court</heading><subsection eId="section-62-1"><num>(1)</num><intro><p>The Scottish Ministers must—</p></intro><level class="para1" eId="section-62-1-a"><num>(a)</num><content><p>as soon as practicable after the post-commencement period (or each of them), review the operation of this Part as respects the provisions listed or matters and appeals described in <ref href="#section-62-3">subsection (3)</ref>,</p></content></level><level class="para1" eId="section-62-1-b"><num>(b)</num><content><p>as soon as practicable after the period of 3 years beginning with the date this section comes into force, assess whether any areas of environmental law may, having regard to the nature and range of matters and appeals within the Court’s existing competence and jurisdiction, be suitable for adding to the competence and jurisdiction of the Court.</p></content></level></subsection><subsection eId="section-62-2"><num>(2)</num><content><p>The Scottish Ministers must, before carrying out a review under <ref href="#section-62-1">subsection (1)</ref><ref href="#section-62-1-a">(a)</ref>, consult the Lord President of the Court of Session as to the appropriate terms for such a review.</p></content></subsection><subsection eId="section-62-3"><num>(3)</num><intro><p>For the purposes of <ref href="#section-62-1">subsection (1)</ref><ref href="#section-62-1-a">(a)</ref>, the provisions are—</p></intro><level class="para1" eId="section-62-3-a"><num>(a)</num><content><p>paragraph 16 of schedule 1 (access rights),</p></content></level><level class="para1" eId="section-62-3-b"><num>(b)</num><content><p>paragraphs 18 to 20 of schedule 1 (arbitration and compensation),</p></content></level><level class="para1" eId="section-62-3-c"><num>(c)</num><content><p>paragraphs 21 and 22 of schedule 1 (community rights to buy: appeals),</p></content></level><level class="para1" eId="section-62-3-d"><num>(d)</num><content><p>paragraphs 23 of schedule 1 (crofting and crofting community right to buy),</p></content></level><level class="para1" eId="section-62-3-e"><num>(e)</num><content><p>paragraph 24 of schedule 1 (march dykes, runrig and commonties),</p></content></level><level class="para1" eId="section-62-3-f"><num>(f)</num><content><p>paragraph 25 of schedule 1 (small landholdings),</p></content></level><level class="para1" eId="section-62-3-g"><num>(g)</num><content><p>paragraph 26 of schedule 1 (succession to certain leases),</p></content></level><level class="para1" eId="section-62-3-h"><num>(h)</num><content><p>any other matter or appeal which is added to the competence or jurisdiction of the Court after the coming into force of this section but before the expiry of the period referred to in <ref href="#section-62-1">subsection (1)</ref><ref href="#section-62-1-b">(b)</ref>.</p></content></level></subsection><subsection eId="section-62-4"><num>(4)</num><intro><p>A review under <ref href="#section-62-1">subsection (1)</ref><ref href="#section-62-1-a">(a)</ref> must, in particular, consider—</p></intro><level class="para1" eId="section-62-4-a"><num>(a)</num><content><p>whether it is desirable to make provision under section 59 or paragraph 15(2) of schedule 1 to improve the operation of the Court or method of appeal in respect of the provision or matter or appeal under review,</p></content></level><level class="para1" eId="section-62-4-b"><num>(b)</num><content><p>if any changes to the eligibility criteria for members of the Court (other than the Chair) are desirable as a result of the competence and jurisdiction of the Court having expanded, and</p></content></level><level class="para1" eId="section-62-4-c"><num>(c)</num><content><p>such other matters as the Scottish Ministers consider relevant.</p></content></level></subsection><subsection eId="section-62-5"><num>(5)</num><intro><p>In carrying out a review or an assessment under this section, the Scottish Ministers must consult—</p></intro><level class="para1" eId="section-62-5-a"><num>(a)</num><content><p>the Lord President of the Court of Session,</p></content></level><level class="para1" eId="section-62-5-b"><num>(b)</num><content><p>the Chair,</p></content></level><level class="para1" eId="section-62-5-c"><num>(c)</num><content><p>the Scottish Courts and Tribunals Service,</p></content></level><level class="para1" eId="section-62-5-d"><num>(d)</num><content><p>the Scottish Civil Justice Council,</p></content></level><level class="para1" eId="section-62-5-e"><num>(e)</num><content><p>such persons as they consider represent the interests of persons who use the Court, and</p></content></level><level class="para1" eId="section-62-5-f"><num>(f)</num><content><p>such other persons as they consider appropriate.</p></content></level></subsection><subsection eId="section-62-6"><num>(6)</num><intro><p>As soon as reasonably practicable after completing a review or an assessment under this section, the Scottish Ministers must—</p></intro><level class="para1" eId="section-62-6-a"><num>(a)</num><content><p>prepare a report on the review or assessment,</p></content></level><level class="para1" eId="section-62-6-b"><num>(b)</num><content><p>lay a copy of the report before the Scottish Parliament, and</p></content></level><level class="para1" eId="section-62-6-c"><num>(c)</num><content><p>publish the report in such manner as they consider appropriate.</p></content></level></subsection><subsection eId="section-62-7"><num>(7)</num><intro><p>A report prepared under <ref href="#section-62-6">subsection (6)</ref><ref href="#section-62-6-a">(a)</ref> must include—</p></intro><level class="para1" eId="section-62-7-a"><num>(a)</num><content><p>in relation to a review, information on the type and number of cases brought within the relevant period, and</p></content></level><level class="para1" eId="section-62-7-b"><num>(b)</num><intro><p>in every case, a statement by the Scottish Ministers setting out—</p></intro><level class="para2" eId="section-62-7-b-i"><num>(i)</num><content><p>whether they intend to bring forward proposals to modify this Part (including schedule 1),</p></content></level><level class="para2" eId="section-62-7-b-ii"><num>(ii)</num><content><p>where no such proposals are being brought forward, their reasons for not doing so.</p></content></level></level></subsection><subsection eId="section-62-8"><num>(8)</num><content><p>In this section, “<term refersTo="#term-the-post-commencement-period" eId="term-the-post-commencement-period">the post-commencement period</term>” means the period of 3 years beginning with the date on which a provision listed or matter described in <ref href="#section-62-3">subsection (3)</ref> comes into force.</p></content></subsection><subsection eId="section-62-9"><num>(9)</num><content><p>Where more than one provision listed or matter described in <ref href="#section-62-3">subsection (3)</ref> comes into force on the same day, the Scottish Ministers may review and report on them at the same time and in the same
