57Merger of the Scottish Land Court and the Lands Tribunal for Scotland

(1)

On the appointed day (or days) the following are to transfer to the Court—

(a)

the jurisdiction and functions of the Lands Tribunal for Scotland (referred to in this Part as “the Tribunal”) (and paragraph 15(1)(b) of schedule 1 is to be read accordingly),

(b)

any proceedings or other matter which is in the process of being heard or determined by the Tribunal immediately before the appointed day (including any matter on appeal or under review which may have been, but for the transfer, remitted to the Tribunal),

(c)

the staff of the Tribunal, and

(d)

all property, rights, liabilities and obligations of the Tribunal.

(2)

From the appointed day, a member of the Tribunal may hear and determine proceedings and other matters in the Court in the same manner as a member of the Court.

(3)

For the purposes of this Part, an “appointed day” is such day as the Scottish Ministers may specify in regulations made under section 66.
