eId="section-2-1"><num>(1)</num><content><p>The 1993 Act is modified as follows.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>In section 5B (crofters: duty not to misuse or neglect croft)—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p><mod>for subsections (2) and (3), substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(2)</num><intro><p>A crofter misuses a croft where the crofter—</p></intro><level class="para1"><num>(a)</num><intro><p>wilfully and knowingly uses it otherwise than for the purpose of its being—</p></intro><level class="para2"><num>(i)</num><content><p>cultivated,</p></content></level><level class="para2"><num>(ii)</num><content><p>put to any environmental use, or</p></content></level><level class="para2"><num>(iii)</num><content><p>put to such other purposeful use as is consented to under section 5C(4), or</p></content></level></level><level class="para1"><num>(b)</num><intro><p>fails to—</p></intro><level class="para2"><num>(i)</num><content><p>use the croft for the purposes of its being cultivated,</p></content></level><level class="para2"><num>(ii)</num><content><p>put the croft to any environmental use, or</p></content></level><level class="para2"><num>(iii)</num><content><p>put the croft to another purposeful use.</p></content></level></level></subsection><subsection><num>(3)</num><content><p>A crofter neglects a croft where the croft is not managed so as to meet the standards of good agricultural and environmental condition referred to in regulation 3(2) of, and in Part 2 of the schedule to, the Common Agricultural Policy (Cross-Compliance) (Scotland) Regulations 2014 (<ref eId="c00001" href="http://www.legislation.gov.uk/id/ssi/2014/325">S.S.I. 2014 No. 325</ref>) (except in so far as the use of the croft for a use mentioned in paragraph (a)(ii) or (iii) of subsection (2) is incompatible with the croft being kept in accordance with such standards).</p></content></subsection></quotedStructure><inline name="appendText">,</inline></mod></p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>subsection (4) is repealed.</p></content></level></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>In section 5C (crofters: duty to cultivate and maintain)—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p><mod>for subsection (2), substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d25e188"><num>(2)</num><intro><p>Those duties are that the crofter—</p></intro><level class="para1" eId="d25e194"><num>(a)</num><intro><p>must by themselves or with their family, with or without hired labour—</p></intro><level class="para2"><num>(i)</num><content><p>cultivate the croft,</p></content></level><level class="para2" eId="d25e206"><num>(ii)</num><content><p>put it to any environmental use, or</p></content></level><level class="para2" eId="d25e212"><num>(iii)</num><content><p>put it to another purposeful use,</p></content></level></level><level class="para1"><num>(b)</num><content><p>must ensure that every part of the croft which is capable of being cultivated or put to a use mentioned in <ref href="#d25e194">paragraph (a)</ref><ref href="#d25e206">(ii)</ref> or <ref href="#d25e212">(iii)</ref> is so cultivated or used,</p></content></level><level class="para1"><num>(c)</num><content><p>must keep the croft in a fit state for cultivation (except in so far as the use of the croft for a use mentioned in <ref href="#d25e194">paragraph (a)</ref><ref href="#d25e206">(ii)</ref> or <ref href="#d25e212">(iii)</ref> is incompatible with the croft being kept in such a state).</p></content></level></subsection></quotedStructure><inline name="appendText">,</inline></mod></p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p><mod>in subsection (3), for “(b)” substitute <quotedText>“(c)”</quotedText>,</mod></p></content></level><level class="para1" eId="section-2-3-c"><num>(c)</num><content><p><mod>in subsection (4), for “(2)(a)(ii)” substitute <quotedText>“<ref href="#d25e188">(2)</ref><ref href="#d25e194">(a)</ref><ref in the opening words, after “and” insert <quotedText>“actively”</quotedText>,</mod></p></content></level><level class="para1" eId="section-2-3-e"><num>(e)</num><content><p><mod>after subsection (8), insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d25e289"><num>(8A)</num><intro><p>In this section and section 5B, “<term refersTo="#term-environmental-use">environmental use</term>” means any planned and actively managed use that is intended to provide an environmental benefit and does not adversely affect the croft or the use of adjacent land, which may include (but is not limited to) the person engaging in a use for the purpose of—</p></intro><level class="para1"><num>(a)</num><content><p>peatland restoration,</p></content></level><level class="para1"><num>(b)</num><content><p>habitat creation and restoration,</p></content></level><level class="para1"><num>(c)</num><content><p>water management (for example, the making or improving of watercourses, ponds or wells),</p></content></level><level class="para1"><num>(d)</num><content><p>preserving, protecting, restoring, enhancing or otherwise improving the natural heritage or environment,</p></content></level><wrapUp><p>but may not include the person engaging in a use for the purpose of the generation, transmission or storage of energy.</p></wrapUp></subsection><subsection><num>(8B)</num><content><p>Without prejudice to the generality of <ref href="#d25e289">subsection (8A)</ref>, the Scottish Ministers may by regulations modify that subsection to add, amend, remove or exclude a purpose.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></subsection><subsection eId="section-2-4"><num>(4)</num><intro><p>In section 19C (duties of owner-occupier crofters)—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p><mod>in subsection (2), for paragraphs (c) and (d), substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><level class="para1" eId="d25e348"><num>(c)</num><intro><p>must by themselves or with their family, with or without hired labour—</p></intro><level class="para2"><num>(i)</num><content><p>cultivate the (3) and (4), substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(3)</num><intro><p>For the purposes of subsection (2)(b), an owner-occupier crofter misuses an owner-occupied croft where the owner-occupier crofter—</p></intro><level class="para1"><num>(a)</num><intro><p>wilfully and knowingly uses it otherwise than for the purpose of its being—</p></intro><level
