eId="part-1-chapter-6"><num>Chapter 6</num><heading>Place of safety for children who have been arrested</heading><section eId="section-59" uk:target="true"><num>59</num><heading>Power to require that arrested children be taken to a place other than a police station, etc.</heading><subsection eId="section-59-1"><num>(1)</num><intro><p>The Scottish Ministers may by regulations modify Part 1 of the Criminal Justice (Scotland) Act 2016—</p></intro><level class="para1" eId="section-59-1-a"><num>(a)</num><content><p>so that where, following arrest, a child is to be taken to a place in accordance with section 4(1) of the Act, that place is not a police station,</p></content></level><level class="para1" eId="section-59-1-b"><num>(b)</num><intro><p>so that section 4(1) of the Act does not require a child to be taken anywhere if the child is arrested at a place that—</p></intro><level class="para2" eId="section-59-1-b-i"><num>(i)</num><content><p>is not a police station, but</p></content></level><level class="para2" eId="section-59-1-b-ii"><num>(ii)</num><content><p>is a place to which a child may be taken in accordance with section 4(1) of the Act by virtue of provision made under paragraph (a),</p></content></level></level><level class="para1" eId="section-59-1-c"><num>(c)</num><intro><p>for the purpose of having provisions of the Part—</p></intro><level class="para2" eId="section-59-1-c-i"><num>(i)</num><content><p>apply in relation to a child who, in accordance with section 4(1) of the Act, has been or is to be taken to a place other than a police station as they would apply in relation to a person who has been or is to be taken to a police station in accordance with that section,</p></content></level><level class="para2" eId="section-59-1-c-ii"><num>(ii)</num><content><p>apply in relation to a child who has been arrested at a place of the kind described by paragraph (b)(i) and (ii) as they would in relation to a person arrested at a police station,</p></content></level></level><level class="para1" eId="section-59-1-d"><num>(d)</num><content><p>to require the recording and reporting of information connected to the operation of provision made under the other paragraphs of this subsection.</p></content></level></subsection><subsection eId="section-59-2"><num>(2)</num><content><p>The power under subsection (1)(a) may be exercised only for the purpose of requiring children to be taken to places that the Scottish Ministers consider to be more suitable for children than police stations.</p></content></subsection><subsection eId="section-59-3"><num>(3)</num><intro><p>Provision made under subsection (1)(a) may identify the places to which a child is to be taken by reference to a document that is not an enactment only if the following conditions are met—</p></intro><level class="para1" eId="section-59-3-a"><num>(a)</num><content><p>the Scottish Ministers are under a duty to make the document publicly available,</p></content></level><level class="para1" eId="section-59-3-b"><num>(b)</num><intro><p>if the document does not exist on the day the provision is made, the Scottish Ministers are under a duty to consult the following persons before finalising the document’s content—</p></intro><level class="para2" eId="section-59-3-b-i"><num>(i)</num><content><p>the Police Service of Scotland,</p></content></level><level class="para2" eId="section-59-3-b-ii"><num>(ii)</num><content><p>local authorities,</p></content></level><level class="para2" eId="section-59-3-b-iii"><num>(iii)</num><content><p>any other persons that the Scottish Ministers consider appropriate.</p></content></level></level></subsection><subsection eId="section-59-4"><num>(4)</num><content><p>For the purposes of subsection (3), a new version of a document (for example, an updated version of a web page) is a different document from any prior version.</p></content></subsection><subsection eId="section-59-5"><num>(5)</num><intro><p>Without prejudice to the generality of section 68(1)—</p></intro><level class="para1" eId="section-59-5-a"><num>(a)</num><content><p>the powers conferred by subsection (1) include the power to make different provision for different areas,</p></content></level><level class="para1" eId="section-59-5-b"><num>(b)</num><content><p>the power conferred by subsection (1)(a) need not be exercised so that there is no case in which a child is to be taken to a police station under section
