2Assessment of needs
(1)
A responsible local authority in relation to a person must assess the advice, guidance and assistance needs of—
(a)
each person who falls within section 1(2),
(b)
each person who—
(i)
falls within section 1(3) or (6), and
(ii)
has made an application to the authority under section 1(1)(b)(ii) or (4)(b).
(2)
The Scottish Ministers may by regulations make provision as to assessments for the purposes of subsection (1).
(3)
Regulations under subsection (2) may in particular make provision about—
(a)
who is to be consulted in relation to an assessment,
(b)
the way in which an assessment is to be carried out, by whom and when,
(c)
the recording of the results of an assessment,
(d)
the considerations to which the responsible local authority are to have regard in carrying out the assessment.
