greyhound on a racetrack</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>A person commits an offence if the person—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><content><p>owns or is responsible for a greyhound, and</p></content></level><level class="para1" eId="section-1-1-b"><num>(b)</num><content><p>knowingly causes that greyhound to run on a racetrack or knowingly permits another person to cause that greyhound to run on a racetrack.</p></content></level></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>A person who commits an offence under this section is liable—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>on summary conviction, to imprisonment for a term not exceeding 12 months or a fine not exceeding £20,000 (or both),</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p>on conviction on indictment, to imprisonment for a term not exceeding 5 years or a fine (or both).</p></content></level></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>In this section, a person “is responsible for” a greyhound where the person—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p>is responsible for the greyhound on a temporary or permanent basis,</p></content></level><level class="para1" eId="section-1-3-b"><num>(b)</num><content><p>is in charge of the greyhound, or</p></content></level><level class="para1" eId="section-1-3-c"><num>(c)</num><content><p>has actual care and control of a person under the age of 16 years who is responsible for the greyhound under <ref href="#section-1-3-a">paragraph (a)</ref> or <ref href="#section-1-3-b">(b)</ref>.</p></content></level></subsection><subsection eId="section-1-4"><num>(4)</num><content><p>In this section and in <ref href="#section-2">section 2</ref>, “<term refersTo="#term-racetrack" eId="term-racetrack">racetrack</term>” means premises in Scotland provided for the purpose of running greyhounds on a track that is oval in shape.</p></content></subsection><subsection eId="section-1-5"><num>(5)</num><content><p>The Scottish Ministers may by regulations modify the definition of “racetrack” in <ref href="#section-1-4">subsection (4)</ref> to include other categories of premises in Scotland used for the purpose of the competing of running greyhounds.</p></content></subsection><subsection eId="section-1-6"><num>(6)</num><content><p>The power in subsection (5) may only be exercised for the purpose of preventing harm to greyhounds.</p></content></subsection><subsection eId="section-1-7"><num>(7)</num><content><p>Regulations under <ref href="#section-1-5">subsection (5)</ref> are subject to the affirmative procedure.</p></content></subsection></section><section eId="section-2"><num>2</num><heading>Offence of operating a track for the racing of greyhounds</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>A person commits an offence if the person—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>owns or is responsible for the operation of a racetrack, and</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><content><p>knowingly causes or permits another person to cause a greyhound to run on that racetrack.</p></content></level></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>A person who commits an offence under this section is liable—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>on summary conviction, to imprisonment for a term not exceeding 12 months or a fine not exceeding £20,000 (or both),</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>on conviction on indictment, to imprisonment for a term not exceeding 5 years or a fine (or both).</p></content></level></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>In this section, a person is responsible for the operation of a racetrack if the person—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>manages or controls that racetrack, or</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>is authorised to give permission for another person to cause a greyhound to run on that racetrack.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-further-provision-relating-to-offences"><heading>Further provision relating to offences</heading><section eId="section-3"><num>3</num><heading>Powers of enforcement</heading><content><p>Schedule 1 makes provision about the powers of constables for the purposes of and in connection with this Act.</p></content></section><section eId="section-4"><num>4</num><heading>Disposals following conviction, etc.</heading><content><p>Schedule 2 modifies the Animal Health and Welfare (Scotland) Act 2006 in relation to the making of deprivation, disqualification and seizure orders in connection with an offence under section 1(1) or 2(1).</p></content></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-final-provisions"><heading>Final provisions</heading><section eId="section-5"><num>5</num><heading>Individual culpability where organisation commits an offence</heading><subsection eId="section-5-1"><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1" eId="section-5-1-a"><num>(a)</num><content><p>an offence under this Act is committed by a relevant organisation, and</p></content></level><level class="para1" eId="section-5-1-b"><num>(b)</num><intro><p>the commission of the offence—</p></intro><level class="para2" eId="section-5-1-b-i"><num>(i)</num><content><p>involves consent or connivance on the part of a responsible individual, or</p></content></level><level class="para2" eId="section-5-1-b-ii"><num>(ii)</num><content><p>is attributable to neglect on the part of a responsible individual.</p></content></level></level></subsection><subsection eId="section-5-2"><num>(2)</num><content><p>The responsible individual (as well as the relevant organisation) commits the offence.</p></content></subsection><subsection eId="section-5-3"><num>(3)</num><intro><p>For the purposes of this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-relevant-organisation" eId="term-relevant-organisation">relevant organisation</term>” means an organisation listed in the first column of the table in <ref href="#section-5-4">subsection (4)</ref>,</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-responsible-individual" eId="term-responsible-individual">responsible individual</term>” means, in relation to a relevant organisation—</p></intro><level class="para1"><num>(a)</num><content><p>an individual falling within the corresponding entry in the second column of the table in <ref href="#section-5-4">subsection (4)</ref>,</p></content></level><level class="para1"><num>(b)</num><content><p>an individual purporting to act in the capacity of an individual falling procedure.</p></content></level></subsection></section><section eId="section-7"><num>7</num><heading>Interpretation</heading><intro><p>In this Act, unless the contrary intention eId="section-8-1"><num>(1)</num><content><p>This section and sections 6 and 9 come into force on the day after Royal Assent.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><content><p>The other provisions of this Act come into force on such day as the Scottish Ministers may by regulations appoint.</p></content></subsection><subsection provision.</p></content></level></subsection></section><section eId="section-9"><num>9</num><heading>Short title</heading><content><p>The short title of this Act is the Greyhound Racing (Offences) (Scotland) Act 2026.</p></content></section></hcontainer><hcontainer name="schedules" eId="schedules"><hcontainer name="schedule" eId="schedule-1"><num>Schedule 1<authorialNote class="referenceNote"><p>(introduced by section 3)</p></authorialNote></num><heading>Enforcement powers</heading><hcontainer name="crossheading" class="schGroup7" eId="d25e570"><heading>Interpretation</heading><paragraph eId="schedule-1-paragraph-1" class="schProv1"><num>1</num><intro><p>In this schedule—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-domestic-premises" eId="term-domestic-premises">domestic premises</term>”—</p></intro><level class="para1"><num>(a)</num><content><p>means premises, or a part of premises, used (or used for the time being) exclusively as a dwelling-house, and</p></content></level><level class="para1"><num>(b)</num><content><p>includes any land or warrant granted under a provision of this schedule.</p></content></level></hcontainer></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e673"><heading>Entry and associated powers</heading><paragraph eId="schedule-1-paragraph-2" class="schProv1"><num>2</num><intro><p>A constable may enter any premises (other than domestic premises)—</p></intro><level class="para1" eId="schedule-1-paragraph-2-a"><num>(a)</num><content><p>if there are reasonable grounds for suspecting that a relevant offence has been or is being committed at the premises, and</p></content></level><level class="para1" eId="schedule-1-paragraph-2-b"><num>(b)</num><content><p>for the purpose of ascertaining whether or not a relevant offence has been or is being committed at the premises.</p></content></level></paragraph><paragraph eId="schedule-1-paragraph-3" class="schProv1"><num>3</num><subparagraph eId="schedule-1-paragraph-3-1"><num>(1)</num><intro><p>A sheriff or justice of the peace may grant a warrant under this sub-paragraph if satisfied—</p></intro><level class="para1" eId="schedule-1-paragraph-3-1-a"><num>(a)</num><intro><p>that there are reasonable grounds for suspecting—</p></intro><level class="para2" eId="schedule-1-paragraph-3-1-a-i"><num>(i)</num><content><p>that a relevant offence has been or is being committed at any premises, or</p></content></level><level class="para2" eId="schedule-1-paragraph-3-1-a-ii"><num>(ii)</num><content><p>that evidence of the commission of, or participation in, a relevant offence is to be found at any premises, and</p></content></level></level><level class="para1" eId="schedule-1-paragraph-3-1-b"><num>(b)</num><content><p>that sub-paragraph (2) or (3) applies.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-3-2"><num>(2)</num><intro><p>This sub-paragraph applies if—</p></intro><level class="para1" eId="schedule-1-paragraph-3-2-a"><num>(a)</num><content><p>admission to the premises has been refused or such a refusal may reasonably be expected, and</p></content></level><level class="para1" eId="schedule-1-paragraph-3-2-b"><num>(b)</num><intro><p>either—</p></intro><level class="para2" eId="schedule-1-paragraph-3-2-b-i"><num>(i)</num><content><p>notice of the intention to seek a warrant has been given to the occupier of the premises, or</p></content></level><level class="para2" eId="schedule-1-paragraph-3-2-b-ii"><num>(ii)</num><content><p>the giving of such notice would frustrate the purpose for which the warrant is sought.</p></content></level></level></subparagraph><subparagraph eId="schedule-1-paragraph-3-3"><num>(3)</num><intro><p>This sub-paragraph applies if—</p></intro><level class="para1" eId="schedule-1-paragraph-3-3-a"><num>(a)</num><content><p>the premises are unoccupied, or</p></content></level><level class="para1" eId="schedule-1-paragraph-3-3-b"><num>(b)</num><content><p>the occupier is temporarily absent.</p></content></level></subparagraph></paragraph><paragraph eId="schedule-1-paragraph-4" class="schProv1"><num>4</num><intro><p>A warrant under paragraph 3(1) authorises a constable—</p></intro><level class="para1" eId="schedule-1-paragraph-4-a"><num>(a)</num><content><p>to enter the premises,</p></content></level><level class="para1" eId="schedule-1-paragraph-4-b"><num>(b)</num><content><p>to search for, examine and seize any greyhound, equipment, document or other thing tending to provide evidence of the commission of, or participation in, a relevant offence.</p></content></level></paragraph><paragraph eId="schedule-1-paragraph-5" class="schProv1"><num>5</num><subparagraph eId="schedule-1-paragraph-5-1"><num>(1)</num><intro><p>A constable may exercise the powers in sub-paragraph (2) without a warrant under paragraph 3(1) if—</p></intro><level class="para1" eId="schedule-1-paragraph-5-1-a"><num>(a)</num><content><p>it appears to the constable that any delay would frustrate the purpose for which the powers are to be exercised, and</p></content></level><level class="para1" eId="schedule-1-paragraph-5-1-b"><num>(b)</num><content><p>the premises are not domestic premises.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-5-2"><num>(2)</num><intro><p>The powers are—</p></intro><level class="para1" eId="schedule-1-paragraph-5-2-a"><num>(a)</num><content><p>to enter premises,</p></content></level><level class="para1" eId="schedule-1-paragraph-5-2-b"><num>(b)</num><content><p>to search for, examine and seize any greyhound, equipment, document or other thing tending to provide evidence of the commission of, or participation in, a relevant offence.</p></content></level></subparagraph></paragraph><paragraph eId="schedule-1-paragraph-6" class="schProv1"><num>6</num><intro><p>The power to seize a greyhound under paragraph 4(b) or 5(2)(b) may only be exercised—</p></intro><level class="para1" eId="schedule-1-paragraph-6-a"><num>(a)</num><content><p>where the greyhound is in the possession or control of a person who the constable has reasonable grounds for suspecting has committed or is committing a relevant offence, and</p></content></level><level class="para1" eId="schedule-1-paragraph-6-b"><num>(b)</num><intro><p>where the constable considers it appropriate to seize the greyhound for the purposes of—</p></intro><level class="para2" eId="schedule-1-paragraph-6-b-i"><num>(i)</num><content><p>enabling the greyhound to be used in proceedings for a relevant offence, or</p></content></level><level class="para2" eId="schedule-1-paragraph-6-b-ii"><num>(ii)</num><content><p>enabling the greyhound to be forfeited in accordance with <ref eId="c00004" href="https://www.legislation.gov.uk/ukpga/1995/43/part/2">Part 2</ref> of the <ref eId="c00005" href="https://www.legislation.gov.uk/ukpga/1995/43/contents">Proceeds of Crime (Scotland) Act 1995</ref>.</p></content></level></level></paragraph><paragraph eId="schedule-1-paragraph-7" class="schProv1"><num>7</num><subparagraph eId="schedule-1-paragraph-7-1"><num>(1)</num><intro><p>A thing seized in exercise of the power in paragraph 4(b) or 5(2)(b) must be returned when retention of it is no longer justified for the purposes of—</p></intro><level class="para1" eId="schedule-1-paragraph-7-1-a"><num>(a)</num><content><p>enabling it to be used in proceedings for a relevant offence, or</p></content></level><level class="para1" eId="schedule-1-paragraph-7-1-b"><num>(b)</num><content><p>enabling it to be forfeited in accordance with <ref eId="c00006" href="https://www.legislation.gov.uk/ukpga/1995/43/part/2">Part 2</ref> of the <ref eId="c00007" href="https://www.legislation.gov.uk/ukpga/1995/43/contents">Proceeds of Crime (Scotland) Act 1995</ref>.</p></content></level></subparagraph><subparagraph eId="schedule-1-paragraph-7-2"><num>(2)</num><content><p>Sub-paragraph (1) does not apply to perishable things which no longer have any commercial value.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e910"><heading>Stopping and detaining vehicles or vessels</heading><paragraph eId="schedule-1-paragraph-8" class="schProv1"><num>8</num><subparagraph eId="schedule-1-paragraph-8-1"><num>(1)</num><content><p>A constable in uniform may stop and detain a vehicle or vessel for the purpose of the exercise of a relevant power.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-8-2"><num>(2)</num><content><p>A vehicle or vessel may be detained under sub-paragraph (1) for so long as it is reasonably required for the purpose of the exercise of the power concerned.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-8-3"><num>(3)</num><content><p>The power concerned may be exercised either at the place where the vehicle or vessel was first detained or nearby.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-8-4"><num>(4)</num><content><p>In this paragraph, “<term refersTo="#term-vehicle" eId="term-vehicle">vehicle</term>” includes caravan (within the meaning of <a href="https://www.legislation.gov.uk/ukpga/Eliz2/8-9/62/section/29">section 29</a><a href="https://www.legislation.gov.uk/ukpga/Eliz2/8-9/62/section/29">(1)</a> of the <a href="https://www.legislation.gov.uk/ukpga/Eliz2/8-9/62/contents">Caravan Sites and Control of Development Act 1960</a>).</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e953"><heading>Entry and associated powers: supplementary</heading><paragraph eId="schedule-1-paragraph-9" class="schProv1"><num>9</num><content><p>A warrant granted under a provision of this schedule remains in force for one month beginning with the date on which it was granted.</p></content></paragraph><paragraph eId="schedule-1-paragraph-10" class="schProv1"><num>10</num><content><p>A constable may, if necessary, use reasonable force when exercising a relevant power.</p></content></paragraph><paragraph eId="schedule-1-paragraph-11" class="schProv1"><num>11</num><content><p>A constable exercising a relevant power must produce evidence of the constable’s authority if asked to do so.</p></content></paragraph><paragraph eId="schedule-1-paragraph-12" class="schProv1"><num>12</num><intro><p>A relevant power includes power to take onto premises—</p></intro><level class="para1" eId="schedule-1-paragraph-12-a"><num>(a)</num><content><p>such persons for assistance as are required for the purpose of exercising the power, and</p></content></level><level class="para1" eId="schedule-1-paragraph-12-b"><num>(b)</num><content><p>such equipment as is required for that purpose.</p></content></level></paragraph><paragraph eId="schedule-1-paragraph-13" class="schProv1"><num>13</num><subparagraph eId="schedule-1-paragraph-13-1"><num>(1)</num><intro><p>A person mentioned in sub-paragraph (2) must—</p></intro><level class="para1" eId="schedule-1-paragraph-13-1-a"><num>(a)</num><content><p>comply with any reasonable direction made by a constable exercising a relevant power, and</p></content></level><level class="para1" eId="schedule-1-paragraph-13-1-b"><num>(b)</num><content><p>in particular, give the constable such information and assistance as the constable may reasonably eId="schedule-1-paragraph-13-2-a"><num>(a)</num><content><p>the occupier of premises in relation to which a relevant power is being exercised,</p></content></level><level class="para1" eId="schedule-1-paragraph-13-2-b"><num>(b)</num><intro><p>a person who, in relation to a greyhound at the premises, appears—</p></intro><level class="para2" eId="schedule-1-paragraph-13-2-b-i"><num>(i)</num><content><p>to be the owner of the greyhound,</p></content></level><level class="para2" eId="schedule-1-paragraph-13-2-b-ii"><num>(ii)</num><content><p>to be responsible for the greyhound on a temporary or permanent basis,</p></content></level><level class="para2" eId="schedule-1-paragraph-13-2-b-iii"><num>(iii)</num><content><p>to be in charge of the greyhound,</p></content></level><level class="para2" eId="schedule-1-paragraph-13-2-b-iv"><num>(iv)</num><content><p>to have actual care and control of a person under the age of 16 years who is responsible for the greyhound,</p></content></level></level><level class="para1" eId="schedule-1-paragraph-13-2-c"><num>(c)</num><content><p>a person who appears to be under the direction or control of a person mentioned in paragraph (a) or (b).</p></content></level></subparagraph></paragraph><paragraph eId="schedule-1-paragraph-14" class="schProv1"><num>14</num><content><p>A constable exercising a relevant power in relation to unoccupied premises must leave the premises as effectively secured against entry as the constable found them.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e1074"><heading>Offences</heading><paragraph eId="schedule-1-paragraph-15" class="schProv1"><num>15</num><subparagraph eId="schedule-1-paragraph-15-1"><num>(1)</num><content><p>A person commits an offence if the person contravenes paragraph 13(1) without reasonable excuse.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-15-2"><num>(2)</num><content><p>A person commits an offence if the person intentionally obstructs a constable in the exercise of a relevant power.</p></content></subparagraph><subparagraph eId="schedule-1-paragraph-15-3"><num>(3)</num><content><p>A person who commits an offence under sub-paragraph (1) or (2) is liable on summary
