(1)Regulations under the following provisions are subject to the affirmative procedure: sections 6(1), 9(2), 9(5), 11(1), 12(2), 15(6), 22(1) and 53(2).
(2)Regulations under the following provisions are subject to the negative procedure: sections 10(3)(b), 18, 19, 23(1), 24(2), 30(1), 31(1) and 32(1).
(3)Any power of the Scottish Ministers to make regulations under this Act includes power to make—
(a)different provision for different purposes, and
(b)incidental, supplemental, consequential, transitional, transitory or saving provision.
(4)Regulations under section 50(1)—
(a)are subject to the affirmative procedure if they add to, replace or omit any part of the text of an Act,
(b)otherwise, are subject to the negative procedure.
(5)This section does not apply to regulations under section 52.
