powers of entry, search and seizure</heading><subsection eId="section-8-1"><num>(1)</num><content><p>A power under <ref href="#">section 7</ref><ref href="#">(1)</ref> may be exercised by an authorised person only at a reasonable time unless it appears to the person that the purpose of exercising the power would be frustrated by exercising it at such a time.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><content><p>On leaving any premises, the authorised person must, if the premises are unoccupied or the occupier of the premises is temporarily absent, leave the premises as effectively secured against entry as the authorised person found them.</p></content></subsection><subsection eId="section-8-3"><num>(3)</num><intro><p>A thing seized under <ref href="#">section 7</ref><ref href="#">(5)</ref> must be returned when its retention is no longer justified for the purpose of—</p></intro><level class="para1" eId="section-8-3-a"><num>(a)</num><content><p>enabling it to be used in proceedings for an offence under section <ref href="#">2</ref> or <ref href="#">3</ref>, or</p></content></level><level class="para1" eId="section-8-3-b"><num>(b)</num><content><p>enabling it to be forfeited in accordance with Part 2 of the Proceeds of Crime (Scotland) Act 1995.</p></content></level></subsection><subsection eId="section-8-4"><num>(4)</num><content><p><ref href="#section-8-3">Subsection (3)</ref> does not apply to perishable things which no longer have
