search and seizure</heading><subsection eId="section-7-1"><num>(1)</num><content><p>An authorised person may, subject to <ref href="#section-7-8">subsection (8)</ref>, enter and search any premises for the purpose of ascertaining whether or not an offence under section <ref href="#">2</ref> or <ref href="#">3</ref> has been or is being committed if condition A and condition B are satisfied.</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><intro><p>Condition A is that the authorised person has reasonable grounds to believe that—</p></intro><level class="para1" eId="section-7-2-a"><num>(a)</num><content><p>an offence under section <ref href="#">2</ref> or <ref href="#">3</ref> has been or is being committed at the premises, or</p></content></level><level class="para1" eId="section-7-2-b"><num>(b)</num><content><p>the premises have been or are being used in connection with an offence under section <ref href="#">2</ref> or <ref href="#">3</ref>.</p></content></level></subsection><subsection eId="section-7-3"><num>(3)</num><intro><p>Condition B is that—</p></intro><level class="para1" eId="section-7-3-a"><num>(a)</num><content><p>permission has been given by the occupier of the premises (or another person with the authority to do so),</p></content></level><level class="para1" eId="section-7-3-b"><num>(b)</num><content><p>a warrant has been granted under <ref href="#">section 9</ref> in relation to the premises, or</p></content></level><level class="para1" eId="section-7-3-c"><num>(c)</num><content><p><ref href="#section-7-4">subsection (4)</ref> applies.</p></content></level></subsection><subsection eId="section-7-4"><num>(4)</num><intro><p>This subsection applies if—</p></intro><level class="para1" eId="section-7-4-a"><num>(a)</num><content><p>it appears to the authorised person that any delay would frustrate the purpose of ascertaining whether or not an offence under section <ref href="#">2</ref> or <ref href="#">3</ref> has been or is being committed, and</p></content></level><level class="para1" eId="section-7-4-b"><num>(b)</num><content><p>the premises are not used as a dwelling.</p></content></level></subsection><subsection eId="section-7-5"><num>(5)</num><content><p>An authorised person may seize any thing found on the premises if the person has reasonable cause to believe that it may provide evidence of the commission of an offence under section <ref href="#">2</ref> or <ref href="#">3</ref>.</p></content></subsection><subsection eId="section-7-6"><num>(6)</num><content><p>An authorised person, entitled by this section to enter premises, may take onto or into the premises any other person, or any equipment, as may be necessary for the purposes of assisting the authorised person.</p></content></subsection><subsection eId="section-7-7"><num>(7)</num><intro><p>The occupier of the premises, or any person who appears to be under the direction or control of the occupier, must—</p></intro><level class="para1" eId="section-7-7-a"><num>(a)</num><content><p>comply with a reasonable direction given by an authorised person exercising a power under <ref href="#section-7">this section</ref>, and</p></content></level><level class="para1" eId="section-7-7-b"><num>(b)</num><content><p>in particular, give the authorised person such information or assistance as the authorised person may reasonably require.</p></content></level></subsection><subsection eId="section-7-8"><num>(8)</num><content><p><ref href="#section-7">This section</ref> does not apply in relation to any premises that are used, or which HIS (or a person acting on behalf of HIS) has reasonable cause to believe are used, for the purpose of providing an independent health care service.</p></content></subsection><subsection eId="section-7-9"><num>(9)</num><intro><p>In <ref href="#section-7">this section</ref>, “<term refersTo="#term-premises" eId="term-premises">premises</term>” includes any—</p></intro><level class="para1" eId="section-7-9-a"><num>(a)</num><content><p>land or building,</p></content></level><level class="para1" eId="section-7-9-b"><num>(b)</num><content><p>vehicle, vessel, trailer, aircraft or hovercraft,</p></content></level><level class="para1" eId="section-7-9-c"><num>(c)</num><content><p>tent or other moveable
