procedures</heading><section eId="section-5" uk:target="true"><num>5</num><heading>Power to make further provision about non-surgical procedures</heading><subsection eId="section-5-1"><num>(1)</num><content><p>The Scottish Ministers may by regulations impose further restrictions and requirements in relation to the provision of non-surgical procedures.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><intro><p>Regulations under <ref href="#section-5-1">subsection (1)</ref> may—</p></intro><level class="para1" eId="section-5-2-a"><num>(a)</num><content><p>modify any enactment (including this Act),</p></content></level><level class="para1" eId="section-5-2-b"><num>(b)</num><content><p>create an offence in connection with a contravention of a restriction, or failure to comply with a requirement, imposed by virtue of the regulations.</p></content></level></subsection><subsection eId="section-5-3"><num>(3)</num><intro><p>Regulations under <ref href="#section-5-1">subsection (1)</ref> may, in particular—</p></intro><level class="para1" eId="section-5-3-a"><num>(a)</num><content><p>impose different restrictions and requirements by reference to categories of non-surgical procedure as specified in the regulations,</p></content></level><level class="para1" eId="section-5-3-b"><num>(b)</num><content><p>specify persons, or descriptions of persons, who may provide, or supervise the provision of, a non-surgical procedure,</p></content></level><level class="para1" eId="section-5-3-c"><num>(c)</num><content><p>specify requirements about the training or qualifications of persons who may provide, or supervise the provision of, a non-surgical procedure,</p></content></level><level class="para1" eId="section-5-3-d"><num>(d)</num><content><p>confer functions relating to the enforcement of restrictions and requirements imposed by virtue of the regulations,</p></content></level><level class="para1" eId="section-5-3-e"><num>(e)</num><intro><p>require providers of non-surgical procedures to—</p></intro><level class="para2" eId="section-5-3-e-i"><num>(i)</num><content><p>carry out and document a pre-procedure assessment of relevant medical history, and</p></content></level><level class="para2" eId="section-5-3-e-ii"><num>(ii)</num><content><p>ensure that enhanced informed consent procedures are followed where factors are identified that may increase the risk of harm.</p></content></level></level></subsection><subsection eId="section-5-4"><num>(4)</num><intro><p>Regulations under <ref href="#section-5-1">subsection (1)</ref> may make different provision in relation to the provision of non-surgical procedures to different descriptions of persons to take account of any risks associated with providing non-surgical procedures to those persons, including risks relating to those persons’—</p></intro><level class="para1" eId="section-5-4-a"><num>(a)</num><content><p>medical history,</p></content></level><level class="para1" eId="section-5-4-b"><num>(b)</num><content><p>anatomical factors, and</p></content></level><level class="para1" eId="section-5-4-c"><num>(c)</num><content><p>mental health.</p></content></level></subsection><subsection eId="section-5-5"><num>(5)</num><intro><p>The maximum penalty that may be provided for in regulations under that subsection is—</p></intro><level class="para1" eId="section-5-5-a"><num>(a)</num><content><p>on summary conviction, a fine not exceeding £20,000,</p></content></level><level class="para1" eId="section-5-5-b"><num>(b)</num><content><p>on conviction on indictment, a fine.</p></content></level></subsection><subsection eId="section-5-6"><num>(6)</num><intro><p>Subject to subsection (7), the Scottish Ministers must, by no later than the end of the period of 3 years beginning with the day on which section 3 comes into force, lay a draft of a Scottish statutory instrument containing regulations under <ref href="#section-5-1">subsection (1)</ref> specifying—</p></intro><level class="para1" eId="section-5-6-a"><num>(a)</num><content><p>persons, or descriptions of persons, who may provide, or supervise the provision of, a non-surgical procedure, and</p></content></level><level class="para1" eId="section-5-6-b"><num>(b)</num><content><p>requirements about the training or qualifications of persons who may provide, or supervise the provision of, a non-surgical procedure.</p></content></level></subsection><subsection eId="section-5-7"><num>(7)</num><content><p>If the Scottish Ministers consider that it is not practicable to lay such a draft Scottish statutory instrument (or lay two or more such draft instruments which, taken together, specify each of the matters mentioned in paragraphs (a) and (b) of subsection (6)) before the Scottish Parliament within the period mentioned in that subsection, they must before the end of the period lay a report before the Parliament explaining why they are unable to comply with the duty under that subsection.</p></content></subsection></section></hcontainer></part></body></act></akomaNtoso>
