eId="section-2" uk:target="true"><num>2</num><heading>Offence of providing a non-surgical procedure to person under 18</heading><subsection eId="section-2-1"><num>(1)</num><content><p>It is an offence for a person to provide a non-surgical procedure to another person (“<term refersTo="#term-the-client" eId="term-the-client">the client</term>”) who is under the age of 18.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>It is a defence for a person charged with an offence under <ref href="#section-2-1">subsection (1)</ref> (“the accused”) to show that the accused—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>had taken reasonable steps to establish the client’s age before providing the non-surgical procedure, and</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>reasonably believed that the client was aged 18 or over at the time of providing the non-surgical procedure.</p></content></level></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>Without limiting the generality of <ref href="#section-2-2">subsection (2)</ref><ref href="#section-2-2-a">(a)</ref>, the accused is to be regarded as having taken reasonable steps to establish the client’s age before providing the non-surgical procedure if the accused had taken such steps to establish the client’s age as the Scottish Ministers may by regulations specify.</p></content></subsection><subsection eId="section-2-4"><num>(4)</num><intro><p>It is to be regarded as shown that the accused took the reasonable steps mentioned in <ref href="#section-2-2-a">paragraph (a)</ref> of <ref href="#section-2-2">subsection (2)</ref>, or had the reasonable belief mentioned in <ref href="#section-2-2-b">paragraph (b)</ref> of that subsection, if—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>enough evidence is adduced to raise an issue as to whether that is the case, and</p></content></level><level class="para1" eId="section-2-4-b"><num>(b)</num><content><p>the prosecution does not prove beyond reasonable doubt that is not the
