uk:target="true"><num>1</num><heading>Meaning of “non-surgical procedure”</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>In this Part (other than in section 14(5)), a “non-surgical procedure”—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><intro><p>means a procedure that is carried out on a natural person which—</p></intro><level class="para2" eId="section-1-1-a-i"><num>(i)</num><content><p>pierces or penetrates the person’s skin, including by means of a needle, chemical, medicine, heat, cold, light, laser, sound or electricity, and</p></content></level><level class="para2" eId="section-1-1-a-ii"><num>(ii)</num><content><p>is of a kind specified in <ref href="#">schedule 1</ref> (or is a combination of two or more of those kinds of procedures), but</p></content></level></level><level class="para1" eId="section-1-1-b"><num>(b)</num><intro><p>does not include a procedure—</p></intro><level class="para2" eId="section-1-1-b-i"><num>(i)</num><content><p>that is provided by a person acting for or on behalf of the health service,</p></content></level><level class="para2" eId="section-1-1-b-ii"><num>(ii)</num><content><p>that is provided by a health care provider for the purpose of, or in connection with, preventing, diagnosing or treating an illness of the person mentioned in paragraph (a),</p></content></level><level class="para2" eId="section-1-1-b-iii"><num>(iii)</num><content><p>that is carried out in relation to a clinical trial (within the meaning given by regulation 2(1) of the Medicines for Human Use (Clinical Trials) Regulations 2004 (<ref eId="c00001" href="http://www.legislation.gov.uk/id/uksi/2004/1031">S.I. 2004/1031</ref>)), or</p></content></level><level class="para2" eId="section-1-1-b-iv"><num>(iv)</num><content><p>the provision of which is designated by an order under 
<ref eId="c00002" href="https://www.legislation.gov.uk/ukpga/1982/45/section/44">section 44</ref>
<ref eId="c00003" href="https://www.legislation.gov.uk/ukpga/1982/45/section/44">(1)</ref>
<ref eId="c00004" href="https://www.legislation.gov.uk/ukpga/1982/45/section/44">(b)</ref> of the 
<ref eId="c00005" href="https://www.legislation.gov.uk/ukpga/1982/45/contents">Civic Government (Scotland) Act 1982</ref> as an activity for which a licence is required under Part 2 of that Act.</p></content></level></level></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>In <ref href="#section-1-1">subsection (1)</ref><ref href="#section-1-1-b">(b)</ref><ref href="#section-1-1-b-ii">(ii)</ref>—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-health-care-provider" eId="term-health-care-provider">health care provider</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>an independent health care service that is registered under section 10P of the 1978 Act,</p></content></level><level class="para1"><num>(b)</num><content><p>a regulated health care professional, or</p></content></level><level class="para1"><num>(c)</num><content><p>a person who, in providing the procedure, is acting in accordance with the directions of a regulated health care professional,</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-illness" eId="term-illness">illness</term>” includes—</p></intro><level class="para1"><num>(a)</num><content><p>mental disorder within the meaning of section 328 of the Mental Health (Care and Treatment) (Scotland) Act 2003, and</p></content></level><level class="para1"><num>(b)</num><content><p>any injury or disability requiring medical, surgical or dental treatment, or nursing.</p></content></level></hcontainer></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>In <ref href="#section-1-2">subsection (2)</ref>, “<term refersTo="#term-regulated-health-care-professional" eId="term-regulated-health-care-professional">regulated health care professional</term>” means a person who is regulated by any of the following—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p>the General Medical Council,</p></content></level><level class="para1" eId="section-1-3-b"><num>(b)</num><content><p>the General Dental Council,</p></content></level><level class="para1" eId="section-1-3-c"><num>(c)</num><content><p>the General Optical Council,</p></content></level><level class="para1" eId="section-1-3-d"><num>(d)</num><content><p>the General Osteopathic Council,</p></content></level><level class="para1" eId="section-1-3-e"><num>(e)</num><content><p>the General Chiropractic Council,</p></content></level><level class="para1" eId="section-1-3-f"><num>(f)</num><content><p>the General Pharmaceutical Council,</p></content></level><level class="para1" eId="section-1-3-g"><num>(g)</num><content><p>the Nursing and Midwifery Council,</p></content></level><level class="para1" eId="section-1-3-h"><num>(h)</num><content><p>the Health and Care Professions Council.</p></content></level></subsection><subsection eId="section-1-4"><num>(4)</num><content><p>The Scottish Ministers may by regulations modify <ref href="#section-1-3">subsection (3)</ref>.</p></content></subsection><subsection eId="section-1-5"><num>(5)</num><content><p>The Scottish Ministers may by regulations modify <ref href="#">schedule 1</ref>.</p></content></subsection></section></hcontainer></part></body></act></akomaNtoso>
