purposes.</p></longTitle></preface><body eId="body"><part eId="part-1"><num>Part 1</num><heading>Non-surgical Procedures</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-meaning-of-nonsurgical-procedure"><heading>Meaning of “non-surgical procedure”</heading><section eId="section-1"><num>1</num><heading>Meaning of “non-surgical procedure”</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>In this Part (other than in section 14(5)), a “non-surgical procedure”—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><intro><p>means a procedure that is carried out on a natural person which—</p></intro><level class="para2" eId="section-1-1-a-i"><num>(i)</num><content><p>pierces or penetrates the person’s skin, including by means of a needle, chemical, medicine, heat, cold, light, laser, sound or electricity, and</p></content></level><level class="para2" eId="section-1-1-a-ii"><num>(ii)</num><content><p>is of a kind specified in <ref href="#schedule-1">schedule 1</ref> (or is a combination of two or more of those kinds of procedures), but</p></content></level></level><level class="para1" eId="section-1-1-b"><num>(b)</num><intro><p>does not include a procedure—</p></intro><level class="para2" eId="section-1-1-b-i"><num>(i)</num><content><p>that is provided by a person acting for or on behalf of the health service,</p></content></level><level class="para2" eId="section-1-1-b-ii"><num>(ii)</num><content><p>that is provided by a health care provider for the purpose of, or in connection with, preventing, diagnosing or treating an illness of the person mentioned in paragraph (a),</p></content></level><level class="para2" eId="section-1-1-b-iii"><num>(iii)</num><content><p>that is carried out in relation to a clinical trial (within the meaning given by regulation 2(1) of the Medicines for Human Use (Clinical Trials) Regulations 2004 (<ref eId="c00001" href="http://www.legislation.gov.uk/id/uksi/2004/1031">S.I. 2004/1031</ref>)), or</p></content></level><level class="para2" eId="section-1-1-b-iv"><num>(iv)</num><content><p>the provision of which is designated by an order under

<ref eId="c00004" href="https://www.legislation.gov.uk/ukpga/1982/45/section/44">(b)</ref> of the 
<ref eId="c00005" href="https://www.legislation.gov.uk/ukpga/1982/45/contents">Civic Government (Scotland) Act 1982</ref> as an activity for which a licence is required under Part 2 of that Act.</p></content></level></level></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>In <ref href="#section-1-1">subsection (1)</ref><ref href="#section-1-1-b">(b)</ref><ref href="#section-1-1-b-ii">(ii)</ref>—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-health-care-provider" eId="term-health-care-provider">health care provider</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>an independent health care service that is registered under section 10P of the 1978 Act,</p></content></level><level class="para1"><num>(b)</num><content><p>a regulated health care professional, or</p></content></level><level class="para1"><num>(c)</num><content><p>a person who, in providing the procedure, is acting in accordance with the directions of a regulated health care professional,</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-illness" eId="term-illness">illness</term>” includes—</p></intro><level class="para1"><num>(a)</num><content><p>mental disorder within the meaning of section 328 of the Mental Health (Care and Treatment) (Scotland) Act 2003, and</p></content></level><level class="para1"><num>(b)</num><content><p>any injury or disability requiring medical, surgical or dental treatment, or nursing.</p></content></level></hcontainer></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>In <ref href="#section-1-2">subsection (2)</ref>, “<term refersTo="#term-regulated-health-care-professional" eId="term-regulated-health-care-professional">regulated health care professional</term>” means a person who is regulated by any of the following—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p>the General Medical Council,</p></content></level><level class="para1" modify <ref href="#schedule-1">schedule 1</ref>.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-offence-of-providing-a-nonsurgical-procedure-to-person-under-18"><heading>Offence of providing a non-surgical procedure to person under 18</heading><section eId="section-2"><num>2</num><heading>Offence of providing a non-surgical procedure to person under 18</heading><subsection eId="section-2-1"><num>(1)</num><content><p>It is an offence for a person to provide a non-surgical procedure to another person (“<term refersTo="#term-the-client" eId="term-the-client">the client</term>”) who is under the age of 18.</p></content></subsection><subsection eId="section-2-2"><num>(2)</num><intro><p>It is a defence for a person charged with an offence under <ref href="#section-2-1">subsection (1)</ref> (“the accused”) to show that the accused—</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>had taken reasonable steps to establish the client’s age before providing the non-surgical procedure, and</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>reasonably believed that the client was aged 18 or over at the time of providing the non-surgical procedure.</p></content></level></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>Without limiting the generality of <ref href="#section-2-2">subsection (2)</ref><ref href="#section-2-2-a">(a)</ref>, the accused is to be regarded as having taken reasonable steps to establish the client’s age before providing the non-surgical procedure if the accused had taken such steps to establish the client’s age as the Scottish Ministers may by regulations specify.</p></content></subsection><subsection eId="section-2-4"><num>(4)</num><intro><p>It is to be regarded as shown that the accused took the reasonable steps mentioned in <ref href="#section-2-2-a">paragraph (a)</ref> of <ref href="#section-2-2">subsection (2)</ref>, or had the reasonable belief mentioned in <ref href="#section-2-2-b">paragraph (b)</ref> of that subsection, if—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>enough evidence is adduced to raise an issue as to whether that is the case, and</p></content></level><level class="para1" eId="section-2-4-b"><num>(b)</num><content><p>the prosecution does not prove beyond reasonable doubt that is not the case.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-offence-of-providing-a-nonsurgical-procedure-outwith-permitted-premises"><heading>Offence of providing a non-surgical procedure outwith permitted premises</heading><section eId="section-3"><num>3</num><heading>Offence of providing a non-surgical procedure outwith permitted premises</heading><subsection eId="section-3-1"><num>(1)</num><content><p>It is an offence for a person to provide a non-surgical procedure to another person outwith permitted premises.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><content><p>It is a defence for a person charged with an offence under <ref href="#section-3-1">subsection (1)</ref> to show that the person reasonably believed at the time of providing the non-surgical procedure that the procedure was being provided in permitted premises.</p></content></subsection><subsection eId="section-3-3"><num>(3)</num><intro><p>It is to be regarded as shown that the person reasonably believed that the non-surgical procedure was being provided in permitted premises if—</p></intro><level class="para1" eId="section-3-3-a"><num>(a)</num><content><p>enough evidence is adduced to raise an issue as to whether that is the case, and</p></content></level><level class="para1" eId="section-3-3-b"><num>(b)</num><content><p>the prosecution does not prove beyond reasonable doubt that is not the case.</p></content></level></subsection></section><section eId="section-4"><num>4</num><heading>Meaning of “permitted premises”</heading><subsection eId="section-4-1"><num>(1)</num><intro><p>In section 3, “<term refersTo="#term-permitted-premises" eId="term-permitted-premises">permitted premises</term>” means—</p></intro><level class="para1" eId="section-4-1-a"><num>(a)</num><intro><p>premises of a registered independent clinic whose services are provided or managed by a person mentioned in subsection (2) if—</p></intro><level class="para2" eId="section-4-1-a-i"><num>(i)</num><content><p>the address of the premises is entered in the register in relation to the registered independent clinic, or</p></content></level><level class="para2" eId="section-4-1-a-ii"><num>(ii)</num><content><p>the premises are a vehicle that is not a dwelling of the person to whom the non-surgical procedure is being provided,</p></content></level></level><level class="para1" eId="section-4-1-b"><num>(b)</num><content><p>premises the address of which is entered in the register in relation to a registered independent hospital,</p></content></level><level class="para1" eId="section-4-1-c"><num>(c)</num><content><p>any premises (or vehicle), other than a dwelling or care home, at or in which general dental services are provided in accordance with an agreement pursuant to section 25 of the 1978 Act,</p></content></level><level class="para1" eId="section-4-1-d"><num>(d)</num><content><p>premises, other than a dwelling or care home, the address of which is specified in an agreement pursuant to section 17C of the 1978 Act as one at which primary medical services are to be provided in accordance with the agreement,</p></content></level><level class="para1" eId="section-4-1-e"><num>(e)</num><content><p>premises, other than a dwelling or care home, the address of which is specified in a contract pursuant to section 17J of the 1978 Act as one at which general medical services are to be provided in accordance with the contract,</p></content></level><level class="para1" eId="section-4-1-f"><num>(f)</num><content><p>a registered pharmacy within the meaning of section 74 of the Medicines Act 1968.</p></content></level></subsection><subsection eId="section-4-2"><num>(2)</num><intro><p>The persons referred to in subsection (1)(a) are—</p></intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content><p>a registered medical practitioner,</p></content></level><level class="para1" eId="section-4-2-b"><num>(b)</num><content><p>a person registered in the dentists register under the 
<ref eId="c00006" href="https://www.legislation.gov.uk/ukpga/1984/24/contents">Dentists Act 1984</ref>,</p></content></level><level class="para1" eId="section-4-2-c"><num>(c)</num><content><p>a registered nurse who is noted in the Nursing and Midwifery Register as being qualified to order drugs, medicines and appliances as a nurse independent prescriber,</p></content></level><level class="para1" eId="section-4-2-d"><num>(d)</num><content><p>a registered midwife who is noted in the Nursing and Midwifery Register as being qualified to order drugs, medicines and appliances as a nurse independent prescriber,</p></content></level><level class="para1" eId="section-4-2-e"><num>(e)</num><content><p>a pharmacist independent prescriber.</p></content></level></subsection><subsection eId="section-4-3"><num>(3)</num><content><p>The Scottish Ministers may by regulations modify <ref href="#section-4">this section</ref>.</p></content></subsection><subsection eId="section-4-4"><num>(4)</num><intro><p>In <ref href="#section-4">this section</ref>—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-care-home" eId="term-care-home">care home</term>” means accommodation occupied exclusively or mainly by individuals aged 16 or over that is provided by an organisation carrying on a care home service (within the meaning of paragraph 2 of schedule 12 of the 
<ref eId="c00007" href="https://www.legislation.gov.uk/asp/2010/8/contents">Public Services Reform (Scotland) Act 2010</ref>),</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-nursing-and-midwifery-register" eId="term-nursing-and-midwifery-register">Nursing and Midwifery Register</term>” means the register maintained under article 5 of the Nursing and Midwifery Order 2001 (<ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/2002/253">S.I. 2002/253</ref>),</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-pharmacist-independent-prescriber" eId="term-pharmacist-independent-prescriber">pharmacist independent prescriber</term>” means a person who is—</p></intro><level class="para1"><num>(a)</num><content><p>registered as a pharmacist in—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p><ref href="#part-1">Part 1</ref> of the register maintained under 
<ref eId="c00009" href="https://www.legislation.gov.uk/uksi/2010/231/article/19">article 19</ref> of the 
<ref eId="c00010" href="https://www.legislation.gov.uk/uksi/2010/231/contents">Pharmacy Order 2010</ref> (<ref eId="c00011" href="http://www.legislation.gov.uk/id/uksi/2010/231">S.I. 2010/231</ref>), or</p></item><item><num>(ii)</num><p>the register maintained in pursuance of articles 6 and 9 of the Pharmacy (Northern Ireland) Order 1976 (<ref eId="c00012" href="http://www.legislation.gov.uk/id/nisi/1976/1213">S.I. 1976/1213 (N.I. 22)</ref>, and</p></item></blockList></content></level><level class="para1"><num>(b)</num><content><p>noted in that register as being qualified to order drugs, medicines and appliances as a pharmacist independent prescriber,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-the-register" eId="term-the-register">the register</term>” means the register maintained under regulation 6 of the Healthcare Improvement Scotland (Applications and Registration) Regulations 2011 (<ref eId="c00013" href="http://www.legislation.gov.uk/id/ssi/2011/35">S.S.I. 2011/35</ref>),</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-registered-independent-clinic" eId="term-registered-independent-clinic">registered independent clinic</term>” means an independent clinic within the meaning given by section 10F(2) of the 1978 Act that is registered under section 10P of that Act,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-registered-independent-hospital" eId="term-registered-independent-hospital">registered independent hospital</term>” means an independent hospital within the meaning given by section 10F(2) of the 1978 Act that is registered under section 10P of that Act,</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-vehicle" eId="term-vehicle">vehicle</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>a mechanically-propelled vehicle, or</p></content></level><level class="para1"><num>(b)</num><content><p>a structure that is capable of being moved from one place to another by being—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>towed, or</p></item><item><num>(ii)</num><p>transported on a mechanically-propelled vehicle or trailer.</p></item></blockList></content></level></hcontainer></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-power-to-make-further-provision-about-nonsurgical-procedures"><heading>Power to make further provision about non-surgical procedures</heading><section eId="section-5"><num>5</num><heading>Power to make further provision about non-surgical procedures</heading><subsection eId="section-5-1"><num>(1)</num><content><p>The Scottish Ministers may by regulations impose further restrictions and requirements in relation to the provision of non-surgical procedures.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><intro><p>Regulations under <ref href="#section-5-1">subsection (1)</ref> may—</p></intro><level class="para1" eId="section-5-2-a"><num>(a)</num><content><p>modify any enactment (including this Act),</p></content></level><level class="para1" eId="section-5-2-b"><num>(b)</num><content><p>create an offence in connection with a contravention of a restriction, or failure to comply with a requirement, imposed by virtue of the regulations.</p></content></level></subsection><subsection eId="section-5-3"><num>(3)</num><intro><p>Regulations under <ref href="#section-5-1">subsection (1)</ref> may, in particular—</p></intro><level class="para1" eId="section-5-3-a"><num>(a)</num><content><p>impose different restrictions and requirements by reference to categories of non-surgical procedure as specified in the regulations,</p></content></level><level class="para1" eId="section-5-3-b"><num>(b)</num><content><p>specify persons, or descriptions of persons, who may provide, or supervise the provision of, a non-surgical procedure,</p></content></level><level class="para1" eId="section-5-3-c"><num>(c)</num><content><p>specify requirements about the training or qualifications of persons who may provide, or supervise the provision of, a non-surgical procedure,</p></content></level><level class="para1" eId="section-5-3-d"><num>(d)</num><content><p>confer functions relating to the enforcement of restrictions and requirements imposed by virtue of the regulations,</p></content></level><level class="para1" eId="section-5-3-e"><num>(e)</num><intro><p>require providers of non-surgical procedures to—</p></intro><level class="para2" eId="section-5-3-e-i"><num>(i)</num><content><p>carry out and document a pre-procedure assessment of relevant medical history, and</p></content></level><level class="para2" eId="section-5-3-e-ii"><num>(ii)</num><content><p>ensure that enhanced informed consent procedures are followed where factors are identified that may increase the risk of harm.</p></content></level></level></subsection><subsection eId="section-5-4"><num>(4)</num><intro><p>Regulations under <ref href="#section-5-1">subsection (1)</ref> may make different provision in relation to the provision of non-surgical procedures to different descriptions of persons to take account of any risks associated with providing non-surgical procedures to those persons, including risks relating to those persons’—</p></intro><level class="para1" eId="section-5-4-a"><num>(a)</num><content><p>medical history,</p></content></level><level class="para1" eId="section-5-4-b"><num>(b)</num><content><p>anatomical factors, and</p></content></level><level class="para1" eId="section-5-4-c"><num>(c)</num><content><p>mental health.</p></content></level></subsection><subsection eId="section-5-5"><num>(5)</num><intro><p>The maximum penalty that may be provided for in regulations under that subsection is—</p></intro><level class="para1" eId="section-5-5-a"><num>(a)</num><content><p>on summary conviction, a fine not exceeding £20,000,</p></content></level><level class="para1" eId="section-5-5-b"><num>(b)</num><content><p>on conviction on indictment, a fine.</p></content></level></subsection><subsection eId="section-5-6"><num>(6)</num><intro><p>Subject to subsection (7), the Scottish Ministers must, by no later than the end of the period of 3 years beginning with the day on which section 3 comes into force, lay a draft of a Scottish statutory instrument containing regulations under <ref href="#section-5-1">subsection (1)</ref> specifying—</p></intro><level class="para1" eId="section-5-6-a"><num>(a)</num><content><p>persons, or descriptions of persons, who may provide, or supervise the provision of, a non-surgical procedure, and</p></content></level><level class="para1" eId="section-5-6-b"><num>(b)</num><content><p>requirements about the training or qualifications of persons who may provide, or supervise the provision of, a non-surgical procedure.</p></content></level></subsection><subsection eId="section-5-7"><num>(7)</num><content><p>If the Scottish Ministers consider that it is not practicable to lay such a draft Scottish statutory instrument (or lay two or more such draft instruments which, taken together, specify each of the matters mentioned in paragraphs (a) and (b) of subsection (6)) before the Scottish Parliament within the period mentioned in that subsection, they must before the end of the period lay a report before the Parliament explaining why they are unable to comply with the duty under that subsection.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-enforcement-powers"><heading>Enforcement powers</heading><section eId="section-6"><num>6</num><heading>Meaning of “authorised person”</heading><subsection eId="section-6-1"><num>(1)</num><content><p>In this Part, an “authorised person” is a person authorised by HIS to exercise functions conferred on an authorised person by this Part.</p></content></subsection><subsection eId="section-6-2"><num>(2)</num><content><p>An authorised person must, on request, produce a document from HIS which confirms the person is authorised under <ref href="#section-6-1">subsection (1)</ref>.</p></content></subsection></section><section eId="section-7"><num>7</num><heading>Powers of entry, search and seizure</heading><subsection eId="section-7-1"><num>(1)</num><content><p>An authorised person may, subject to <ref href="#section-7-8">subsection (8)</ref>, enter and search any premises for the purpose of ascertaining whether or not an offence under section <ref href="#section-2">2</ref> or <ref href="#section-3">3</ref> has been or is being committed if condition A and condition B are satisfied.</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><intro><p>Condition A is that the authorised person has reasonable grounds to believe that—</p></intro><level class="para1" eId="section-7-2-a"><num>(a)</num><content><p>an offence under section <ref href="#section-2">2</ref> or <ref href="#section-3">3</ref> has been or is being committed at the premises, or</p></content></level><level class="para1" eId="section-7-2-b"><num>(b)</num><content><p>the premises have been or are being used in connection with an offence under section <ref href="#section-2">2</ref> or <ref href="#section-3">3</ref>.</p></content></level></subsection><subsection eId="section-7-3"><num>(3)</num><intro><p>Condition B is that—</p></intro><level class="para1" eId="section-7-3-a"><num>(a)</num><content><p>permission has been given by the occupier of the premises (or another person with the authority to do so),</p></content></level><level class="para1" eId="section-7-3-b"><num>(b)</num><content><p>a warrant has been granted under <ref href="#section-9">section 9</ref> in relation to the premises, or</p></content></level><level class="para1" eId="section-7-3-c"><num>(c)</num><content><p><ref href="#section-7-4">subsection (4)</ref> applies.</p></content></level></subsection><subsection eId="section-7-4"><num>(4)</num><intro><p>This subsection applies if—</p></intro><level class="para1" eId="section-7-4-a"><num>(a)</num><content><p>it appears to the authorised person that any delay would frustrate the purpose of ascertaining whether or not an offence under section <ref href="#section-2">2</ref> or <ref href="#section-3">3</ref> has been or is being committed, and</p></content></level><level class="para1" eId="section-7-4-b"><num>(b)</num><content><p>the premises are not used as a dwelling.</p></content></level></subsection><subsection eId="section-7-5"><num>(5)</num><content><p>An authorised person may seize any thing found on the premises if the person has reasonable cause to believe that it may provide evidence of the commission of an offence under section <ref href="#section-2">2</ref> or <ref href="#section-3">3</ref>.</p></content></subsection><subsection eId="section-7-6"><num>(6)</num><content><p>An authorised person, entitled by this section to enter premises, may take onto or into the premises any other person, or any equipment, as may be necessary for the purposes of assisting the authorised person.</p></content></subsection><subsection eId="section-7-7"><num>(7)</num><intro><p>The occupier of the premises, or any person who appears to be under the direction or control of the occupier, must—</p></intro><level class="para1" eId="section-7-7-a"><num>(a)</num><content><p>comply with a reasonable direction given by an authorised person exercising a power under <ref href="#section-7">this section</ref>, and</p></content></level><level class="para1" eId="section-7-7-b"><num>(b)</num><content><p>in particular, give the authorised person such information or assistance as the authorised person may reasonably require.</p></content></level></subsection><subsection eId="section-7-8"><num>(8)</num><content><p><ref href="#section-7">This section</ref> does not apply in relation to any premises that are used, or which HIS (or a person acting on behalf of HIS) has reasonable cause to believe are used, for the purpose of providing an independent health care service.</p></content></subsection><subsection eId="section-7-9"><num>(9)</num><intro><p>In <ref href="#section-7">this section</ref>, “<term refersTo="#term-premises" eId="term-premises">premises</term>” includes any—</p></intro><level class="para1" eId="section-7-9-a"><num>(a)</num><content><p>land or building,</p></content></level><level class="para1" eId="section-7-9-b"><num>(b)</num><content><p>vehicle, vessel, trailer, aircraft or hovercraft,</p></content></level><level class="para1" eId="section-7-9-c"><num>(c)</num><content><p>tent or other moveable structure.</p></content></level></subsection></section><section eId="section-8"><num>8</num><heading>Restrictions on powers of entry, search and seizure</heading><subsection eId="section-8-1"><num>(1)</num><content><p>A power under <ref href="#section-7">section 7</ref><ref href="#section-7-1">(1)</ref> may be exercised by an authorised person only at a reasonable time unless it appears to the person that the purpose of exercising the power would be frustrated by exercising it at such a time.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><content><p>On leaving any premises, the authorised person must, if the premises are unoccupied or the occupier of the premises is temporarily absent, leave the premises as effectively secured against entry as the authorised person found them.</p></content></subsection><subsection eId="section-8-3"><num>(3)</num><intro><p>A thing seized under <ref href="#section-7">section 7</ref><ref href="#section-7-5">(5)</ref> must be returned when its retention is no longer justified for the purpose of—</p></intro><level class="para1" eId="section-8-3-a"><num>(a)</num><content><p>enabling it to be used in proceedings for an offence under section <ref href="#section-2">2</ref> or <ref href="#section-3">3</ref>, or</p></content></level><level class="para1" eId="section-8-3-b"><num>(b)</num><content><p>enabling it to be forfeited in accordance with Part 2 of the Proceeds of Crime (Scotland) Act 1995.</p></content></level></subsection><subsection eId="section-8-4"><num>(4)</num><content><p><ref href="#section-8-3">Subsection (3)</ref> does not apply to perishable things which no longer have any commercial value.</p></content></subsection></section><section eId="section-9"><num>9</num><heading>Conditions for issue of warrant</heading><subsection eId="section-9-1"><num>(1)</num><intro><p>A sheriff or justice of the peace may grant a warrant under this section in relation to premises if satisfied—</p></intro><level class="para1" eId="section-9-1-a"><num>(a)</num><intro><p>that there are reasonable grounds for believing that—</p></intro><level class="para2" eId="section-9-1-a-i"><num>(i)</num><content><p>an offence under section <ref href="#section-2">2</ref> or <ref href="#section-3">3</ref> has been or is being committed at the premises, or</p></content></level><level class="para2" eId="section-9-1-a-ii"><num>(ii)</num><content><p>the premises have been or are being used in connection with an offence under section <ref href="#section-2">2</ref> or <ref href="#section-3">3</ref>, and</p></content></level></level><level class="para1" eId="section-9-1-b"><num>(b)</num><content><p>condition A or condition B is satisfied.</p></content></level></subsection><subsection eId="section-9-2"><num>(2)</num><intro><p>Condition A is—</p></intro><level class="para1" eId="section-9-2-a"><num>(a)</num><content><p>that admission to the premises has been refused or a refusal may be reasonably expected, or</p></content></level><level class="para1" eId="section-9-2-b"><num>(b)</num><content><p>that notice of the intention to seek a warrant has been given to the occupier of the premises, or the giving of such notice would frustrate the purpose for which the warrant is sought.</p></content></level></subsection><subsection eId="section-9-3"><num>(3)</num><intro><p>Condition B is—</p></intro><level class="para1" eId="section-9-3-a"><num>(a)</num><content><p>that the premises are unoccupied, or</p></content></level><level class="para1" eId="section-9-3-b"><num>(b)</num><content><p>that the occupier of the premises is temporarily absent.</p></content></level></subsection></section><section eId="section-10"><num>10</num><heading>Expiry of warrant</heading><content><p>A warrant granted under <ref href="#section-9">section 9</ref> remains in force until it is no longer required for the purpose for which it is granted.</p></content></section><section eId="section-11"><num>11</num><heading>Offence of obstructing an authorised person</heading><intro><p>A person commits an offence if the person—</p></intro><level class="para1" eId="section-11-a"><num>(a)</num><content><p>intentionally prevents or obstructs an authorised person from doing anything which the authorised person is authorised or entitled to do by virtue of this Act, or</p></content></level><level class="para1" eId="section-11-b"><num>(b)</num><content><p>contravenes <ref href="#section-7">section 7</ref><ref href="#section-7-7">(7)</ref> without reasonable offences</heading><section eId="section-12"><num>12</num><heading>Penalties</heading><intro><p>A person who commits an offence under section <ref href="#section-2">2</ref>, <ref href="#section-3">3</ref> or <ref href="#section-11">11</ref> is liable—</p></intro><level class="para1" eId="section-12-a"><num>(a)</num><content><p>on summary conviction, to a fine not exceeding £20,000,</p></content></level><level class="para1" eId="section-12-b"><num>(b)</num><content><p>on conviction on indictment, to a fine.</p></content></level></section><section eId="section-13"><num>13</num><heading>Individual culpability where organisation commits an offence</heading><subsection eId="section-13-1"><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1" eId="section-13-1-a"><num>(a)</num><content><p>an offence under section <ref href="#section-2">2</ref>, <ref href="#section-3">3</ref> or <ref offence—</p></intro><level class="para2" eId="section-13-1-b-i"><num>(i)</num><content><p>involves consent or connivance on the part of a responsible individual, or</p></content></level><level class="para2" eId="section-13-1-b-ii"><num>(ii)</num><content><p>is attributable to neglect on the part of a responsible individual.</p></content></level></level></subsection><subsection eId="section-13-2"><num>(2)</num><content><p>The responsible individual (as well as the relevant organisation) commits the offence.</p></content></subsection><subsection eId="section-13-3"><num>(3)</num><intro><p>For the purposes of this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-relevant-organisation" eId="term-relevant-organisation">relevant organisation</term>” means an organisation listed in the first column of the table in <ref href="#section-13-4">subsection (4)</ref>,</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-responsible-individual" eId="term-responsible-individual">responsible individual</term>” means, in relation to a relevant organisation—</p></intro><level class="para1"><num>(a)</num><content><p>an individual falling within the corresponding entry in the second column of the table, or</p></content></level><level class="para1"><num>(b)</num><content><p>an individual purporting to act in the capacity of an individual falling within the corresponding by regulations make provision for or in connection with the establishment and administration of one or more processes to which section 26 of the 2020 Act applies under which individuals may apply for approval to provide, or supervise the provision of, in Scotland—</p></intro><level class="para1" eId="section-14-1-a"><num>(a)</num><content><p>non-surgical procedures, or</p></content></level><level class="para1" eId="section-14-1-b"><num>(b)</num><content><p>licensed procedures.</p></content></level></subsection><subsection eId="section-14-2"><num>(2)</num><intro><p>Regulations under <ref href="#section-14-1">subsection (1)</ref> may, in particular, make provision in relation to—</p></intro><level class="para1" eId="section-14-2-a"><num>(a)</num><content><p>the form and manner of an application,</p></content></level><level class="para1" eId="section-14-2-b"><num>(b)</num><content><p>the procedure for making an application,</p></content></level><level class="para1" eId="section-14-2-c"><num>(c)</num><content><p>the information to be provided in connection with an application,</p></content></level><level class="para1" eId="section-14-2-d"><num>(d)</num><content><p>any fees to be paid in connection with an application,</p></content></level><level class="para1" eId="section-14-2-e"><num>(e)</num><intro><p>the designation of a person (which may include the Scottish Ministers) (“the regulator”) responsible for—</p></intro><level class="para2" eId="section-14-2-e-i"><num>(i)</num><content><p>making decisions in relation to applications, and</p></content></level><level class="para2" eId="section-14-2-e-ii"><num>(ii)</num><content><p>other matters in connection with administering the process (or processes),</p></content></level></level><level class="para1" eId="section-14-2-f"><num>(f)</num><content><p>the duties and powers of a regulator in connection with an application,</p></content></level><level class="para1" eId="section-14-2-g"><num>(g)</num><content><p>reviews of the regulator’s decisions in relation to applications,</p></content></level><level class="para1" eId="section-14-2-h"><num>(h)</num><content><p>appeals against the regulator’s decisions in relation to applications.</p></content></level></subsection><subsection eId="section-14-3"><num>(3)</num><intro><p>Regulations under <ref href="#section-14-1">subsection (1)</ref> may—</p></intro><level class="para1" eId="section-14-3-a"><num>(a)</num><content><p>modify any enactment (including this Act),</p></content></level><level class="para1" eId="section-14-3-b"><num>(b)</num><content><p>create an offence of making a false or misleading statement in connection with an application,</p></content></level><level class="para1" eId="section-14-3-c"><num>(c)</num><content><p>designate different persons as the regulator in relation to different processes.</p></content></level></subsection><subsection eId="section-14-4"><num>(4)</num><content><p>The maximum penalty that may be provided for in regulations under <ref href="#section-14-1">subsection (1)</ref> for a person who commits an offence created by regulations under that subsection is, on summary conviction, a fine not exceeding level 5 on the standard eId="part-1-crossheading-minor-and-consequential-modifications-of-the-1978-act"><heading>Minor and consequential modifications of the 1978 Act</heading><section eId="section-15"><num>15</num><heading>Modifications of the 1978 Act</heading><content><p><ref href="#schedule-2">Schedule 2</ref> makes minor and consequential modifications of the 1978 Act in relation to the provision of non-surgical procedures.</p></content></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-interpretation-of-part-1"><heading>Interpretation of Part 1</heading><section eId="section-16"><num>16</num><heading>Interpretation of Part 1</heading><intro><p>In this Part—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-the-1978-act" eId="term-the-1978-act">the 1978 Act</term>” means the 
<ref eId="c00015" href="https://www.legislation.gov.uk/ukpga/1978/29/contents">National Health Service (Scotland) Act 1978</ref>,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-authorised-person" eId="term-authorised-person">authorised person</term>” has the meaning given by <ref href="#section-6">section 6</ref>,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-health-service" eId="term-health-service">health service</term>” means the health service established under section 1 of the 1978 Act,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-his" eId="term-his">HIS</term>” means Healthcare Improvement Scotland,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-independent-health-care-service" eId="term-independent-health-care-service">independent health care service</term>” has the meaning given by section 10F of the 1978 Act,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-non-surgical-procedure" eId="term-non-surgical-procedure">non-surgical procedure</term>” (other than in section 14(5)) has the meaning given by <ref href="#section-1">section 1</ref>.</p></content></hcontainer></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-guidance"><heading>Guidance</heading><section eId="section-17"><num>17</num><heading>Guidance about the provision of non-surgical procedures</heading><subsection eId="section-17-1"><num>(1)</num><content><p>The Scottish Ministers must issue guidance about the provision of non-surgical procedures.</p></content></subsection><subsection eId="section-17-2"><num>(2)</num><intro><p>The guidance may, in particular, include information about—</p></intro><level class="para1" eId="section-17-2-a"><num>(a)</num><content><p>the requirements imposed under this Part in relation to the provision of non-surgical procedures, and</p></content></level><level class="para1" eId="section-17-2-b"><num>(b)</num><intro><p>steps to be taken by providers of non-surgical procedures in connection with complying with those requirements including—</p></intro><level class="para2" eId="section-17-2-b-i"><num>(i)</num><content><p>registration with HIS,</p></content></level><level class="para2" eId="section-17-2-b-ii"><num>(ii)</num><content><p>staffing requirements, and</p></content></level><level class="para2" eId="section-17-2-b-iii"><num>(iii)</num><content><p>establishing the age of persons to whom non-surgical procedures may be provided.</p></content></level></level></subsection><subsection eId="section-17-3"><num>(3)</num><intro><p>The Scottish Ministers—</p></intro><level class="para1" eId="section-17-3-a"><num>(a)</num><content><p>must publish the guidance, and</p></content></level><level class="para1" eId="section-17-3-b"><num>(b)</num><content><p>may revise or revoke the guidance.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-review"><heading>Review</heading><section eId="section-18"><num>18</num><heading>Review of Part 1</heading><subsection eId="section-18-1"><num>(1)</num><intro><p>The Scottish Ministers must, within the period of 5 years beginning with the day on which section 3 comes into force—</p></intro><level class="para1" eId="section-18-1-a"><num>(a)</num><intro><p>carry out a review of—</p></intro><level class="para2" eId="section-18-1-a-i"><num>(i)</num><content><p>the inclusion of the kinds of procedures that are specified in schedule 1 at the time of the review, and</p></content></level><level class="para2" eId="section-18-1-a-ii"><num>(ii)</num><content><p>the operation of Part 1,</p></content></level></level><level class="para1" eId="section-18-1-b"><num>(b)</num><content><p>prepare a report on the findings of the review, and</p></content></level><level class="para1" eId="section-18-1-c"><num>(c)</num><content><p>publish the report.</p></content></level></subsection><subsection eId="section-18-2"><num>(2)</num><content><p>The Scottish Ministers may delegate any or all of their functions under <ref href="#section-18-1">subsection (1)</ref> to such person as they consider appropriate.</p></content></subsection><subsection eId="section-18-3"><num>(3)</num><intro><p>The review must, in particular, include an assessment of—</p></intro><level class="para1" eId="section-18-3-a"><num>(a)</num><content><p>the impact of this Part on businesses,</p></content></level><level class="para1" eId="section-18-3-b"><num>(b)</num><content><p>the enforcement of the requirements imposed under this Part, and</p></content></level><level class="para1" eId="section-18-3-c"><num>(c)</num><content><p>such other matters as are considered appropriate by the Scottish Ministers (or, if applicable, the delegatee).</p></content></level></subsection><subsection eId="section-18-4"><num>(4)</num><intro><p>When carrying out the review, the Scottish Ministers (or, if applicable, the delegatee) must consult—</p></intro><level class="para1" eId="section-18-4-a"><num>(a)</num><content><p>HIS,</p></content></level><level class="para1" eId="section-18-4-b"><num>(b)</num><content><p>the chief constable of the Police Service of Scotland, and</p></content></level><level class="para1" eId="section-18-4-c"><num>(c)</num><content><p>such other persons as are considered appropriate by the Scottish Ministers (or, if applicable, the delegatee).</p></content></level></subsection><subsection eId="section-18-5"><num>(5)</num><content><p>The Scottish Ministers must, as soon as reasonably practicable after a report on the findings of the review is prepared, lay the report before the Scottish Parliament.</p></content></subsection><subsection eId="section-18-6"><num>(6)</num><content><p>In this section, “<term refersTo="#term-the-delegatee" eId="term-the-delegatee">the delegatee</term>” means the person to whom the Scottish Ministers have delegated their functions under <ref href="#section-18-2">subsection (2)</ref>.</p></content></subsection></section></hcontainer></part><part class="schProv1"><num>3</num><content><p>A procedure in which a needle is inserted into skin and is used to remove a small core of skin tissue.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e2232"><heading>Injectable procedure</heading><paragraph eId="schedule-1-paragraph-4" class="schProv1"><num>4</num><content><p>A procedure other than tattooing in which a substance is injected (including by means of a microneedle) into or under skin for a cosmetic or wellbeing purpose (or both).</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e2242"><heading>Intravenous procedure</heading><paragraph eId="schedule-1-paragraph-5" class="schProv1"><num>5</num><content><p>A procedure in which a substance is administered intravenously (including by insertion of a microneedle) for a cosmetic or wellbeing purpose (or both).</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e2252"><heading>Licensed procedure carried out with prescribed anaesthetic</heading><paragraph eId="schedule-1-paragraph-6" class="schProv1"><num>6</num><intro><p>A procedure—</p></intro><level class="para1" eId="schedule-1-paragraph-6-a"><num>(a)</num><content><p>that is of a kind specified in schedule 1 of the Civic Government (Scotland) Act 1982 (Licensing of Non-surgical Procedures) Order 2026 (<ref eId="c00025" href="http://www.legislation.gov.uk/id/ssi/2026/87">S.S.I. 2026/87</ref>), and</p></content></level><level class="para1" eId="schedule-1-paragraph-6-b"><num>(b)</num><content><p>for which a prescribed anaesthetic is used.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e2277"><heading>Licensed procedure carried out on an intimate area (other than non-ablative laser treatment for hair removal)</heading><paragraph eId="schedule-1-paragraph-7" class="schProv1"><num>7</num><intro><p>A procedure, other than non-ablative laser treatment for hair removal, that—</p></intro><level class="para1" eId="schedule-1-paragraph-7-a"><num>(a)</num><content><p>is of a kind specified in schedule 1 of the Civic Government (Scotland) Act 1982 (Licensing of Non-surgical Procedures) Order 2026 (<ref eId="c00026" href="http://www.legislation.gov.uk/id/ssi/2026/87">S.S.I. 2026/87</ref>), and</p></content></level><level class="para1" eId="schedule-1-paragraph-7-b"><num>(b)</num><content><p>is carried out on an intimate area.</p></content></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e2302"><heading>Microneedling</heading><paragraph eId="schedule-1-paragraph-8" class="schProv1"><num>8</num><intro><p>A procedure in which one or more microneedles are used to puncture skin multiple times on a single occasion—</p></intro><level class="para1" eId="schedule-1-paragraph-8-a"><num>(a)</num><content><p>to any depth if one or more microneedles are used to deliver radio frequency electromagnetic radiation, or</p></content></level><level class="para1" eId="schedule-1-paragraph-8-b"><num>(b)</num><content><p>to a depth of 1.5 millimetres or more in any other case.</p></content></level></paragraph><paragraph eId="schedule-1-paragraph-9" class="schProv1"><num>9</num><intro><p>But <ref href="#schedule-1-paragraph-8">paragraph 8</ref> does not include—</p></intro><level class="para1" eId="schedule-1-paragraph-9-a"><num>(a)</num><content><p>acupuncture, cosmetic body piercing, electrolysis or tattooing, or</p></content></level><level class="para1" eId="schedule-1-paragraph-9-b"><num>(b)</num><intro><p>the use of a microneedle to—</p></intro><level class="para2" eId="schedule-1-paragraph-9-b-i"><num>(i)</num><content><p>inject a substance into or under skin, or</p></content></level><level class="para2" eId="schedule-1-paragraph-9-b-ii"><num>(ii)</num><content><p>administer a substance intravenously.</p></content></level></level></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e2358"><heading>Subcision</heading><paragraph eId="schedule-1-paragraph-10" class="schProv1"><num>10</num><content><p>A procedure in which a needle is used to cut fibrous bands that connect skin to underlying tissue.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e2368"><heading>Thread lift</heading><paragraph eId="schedule-1-paragraph-11" class="schProv1"><num>11</num><content><p>A procedure in which threads (whether smooth or textured) are inserted under skin.</p></content></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7" eId="d25e2378"><heading>Interpretation</heading><paragraph eId="schedule-1-paragraph-12" class="schProv1"><num>12</num><intro><p>In this schedule—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-filler" eId="term-filler">filler</term>” means any substance used for dermal or mucous membrane filling (whether or not designed to be so used),</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-intimate-area" eId="term-intimate-area">intimate area</term>” means the anus or genitals or an area around the anus or genitals,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-non-ablative-laser-treatment-for-hair-removal" eId="term-non-ablative-laser-treatment-for-hair-removal">non-ablative laser treatment for hair removal</term>” means a procedure in which a laser is used to remove hair and which does not remove any of the epidermis,</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-prescribed-anaesthetic" eId="term-prescribed-anaesthetic">prescribed anaesthetic</term>” means an anaesthetic that is a prescription only medicine within the meaning given by regulation 8 of the Human Medicines Regulations 2012 (<ref eId="c00027" href="http://www.legislation.gov.uk/id/uksi/2012/1916">S.I. 2012/1916</ref>),</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-substance" eId="term-substance">substance</term>”—</p></intro><level class="para1"><num>(a)</num><content><p>includes any medicine, vitamin, mineral, toxin, filler and gas,</p></content></level><level purpose if it is injected or administered for the purpose of achieving an actual or perceived improvement in the person’s—</p></intro><level class="para1" eId="schedule-1-paragraph-14-a"><num>(a)</num><content><p>physical, mental or emotional wellbeing,</p></content></level><level class="para1" eId="schedule-1-paragraph-14-b"><num>(b)</num><content><p>physical strength or stamina,</p></content></level><level class="para1" eId="schedule-1-paragraph-14-c"><num>(c)</num><content><p>ability to concentrate, or</p></content></level><level class="para1" eId="schedule-1-paragraph-14-d"><num>(d)</num><content><p>mental
