ownership</heading><subsection eId="section-4-1"><num>(1)</num><intro><p>Any rule of law in relation to the acquisition of ownership applies, in connection with digital assets, on the basis that—</p></intro><level class="para1" eId="section-4-1-a"><num>(a)</num><content><p>a digital asset is to be treated as though it were a corporeal moveable (despite <ref href="#">section 2</ref>),</p></content></level><level class="para1" eId="section-4-1-b"><num>(b)</num><content><p>control of a digital asset is to be treated as physical possession of it.</p></content></level></subsection><subsection eId="section-4-2"><num>(2)</num><intro><p><mod>But a person (“<term refersTo="#term-the-transferee" eId="term-the-transferee">the transferee</term>”) becomes the owner of a digital asset, despite the person who transferred control of the asset to the transferee (<quotedText>“the transferor”</quotedText>) not being the asset’s owner, if—</mod></p></intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content><p>the circumstances of the transfer were such that, but for the transferor not being the asset’s owner, it would have resulted in the transferee becoming the asset’s owner, and</p></content></level><level class="para1" eId="section-4-2-b"><num>(b)</num><content><p>the transferee took the asset in good faith and for value.</p></content></level></subsection><subsection eId="section-4-3"><num>(3)</num><content><p>Where a person (“<term refersTo="#term-the-transferee" eId="term-the-transferee">the transferee</term>”) acquires ownership of a digital asset from a person whose title as owner of the asset is defective, the transferee’s title is free from that defect provided the transferee took the asset in good faith and for value.</p></content></subsection><subsection eId="section-4-4"><num>(4)</num><content><p>In <ref href="#section-4-1">subsection (1)</ref>, “<term
