Compensation on termination and resumption

24Power to make provision about compensation on resumption

(1)

The Scottish Ministers may by regulations modify the enactment specified in column 1 of the table below for the purpose specified in column 2.

The Agricultural Holdings (Scotland) Act 2003 (“the 2003 Act”), schedule 2 (as inserted by section 21(6) of this Act)

Changing or clarifying the method for determining the additional amount of compensation payable to a tenant under section 17(4A) of the 2003 Act (as inserted, or to be inserted, by section 21(2)(c) of this Act)

Regulations under subsection (1) may be made before section 21 of this Act comes into force so that the modifications the regulations make to schedule 2 of the 2003 Act come into force at the same time as section 21 of this Act inserts that schedule.

(3)

Section 46 applies in relation to the first regulations to be made under subsection (1).

(4)

No regulations may be made under subsection (1) after the end of the period of 5 years beginning with the day after Royal Assent.
