54Review of victim’s right to receive information on fixed penalties

(1)

The Scottish Ministers must, within the period of 2 years beginning with the day on which this section comes into force, undertake a review of the information to which persons who are or appear to be victims of offences are entitled by virtue of any enactment in relation to—

(a)

the acceptance or rejection of a fixed penalty offer by alleged offenders in accordance with section 302 of the 1995 Act, and

(b)

any reasons given by alleged offenders as to why the offer has been accepted or rejected.

(2)

The review under subsection (1) must, in particular, include consideration of whether any legislative changes are required.

(3)

As soon as reasonably practicable after completing the review under subsection (1), the Scottish Ministers must—

(a)

prepare and publish a report on the review,

(b)

lay a copy of the report before the Scottish Parliament.
