Enforcement powers in respect of certain environmental offences

Section 20: Offences in respect of which powers may be exercised

120.Section 20 of the Act amends other pieces of legislation so that they allow the section 110A powers to be exercised in respect of the offences for which they create. These are as follows:

  • the offence of transporting controlled waste without registering in section 1 of the Control of Pollution (Amendment) Act 1989 (with consequential changes to the provisions on the duty to produce authority to transport controlled waste in section 5);

  • the prohibition on unauthorised or harmful deposit, treatment or disposal of waste in section 33 of the Environmental Protection Act 1990;

  • offences relating to the duty of care as regards waste in section 34(1)(a), (aa), (b) and (c) and (2I) of the Environmental Protection Act 1990;

  • offences under regulation 67(1)(a) or (b) of the Pollution Prevention and Control (Scotland) Regulations 2012 (S.S.I. 2012/360).
