Compliance notices
34Variation of a compliance notice
(1)
Environmental Standards Scotland may vary a compliance notice so as to extend the period mentioned in section 33(1)(d) (“the compliance period”).
(2)
A compliance notice may be varied under subsection (1)—
(a)
at any time before expiry of the compliance period,
(b)
by giving notice in writing to that effect to the public authority to whom the compliance notice was issued.
(3)
The variation of a compliance notice under subsection (1) does not affect the date of its issue for the purpose of section 36(2)(a).
