eId="section-1"><num>1</num><heading>Power to make provision corresponding to EU law</heading><subsection eId="section-1-1"><num>(1)</num><intro><p>The Scottish Ministers may by regulations—</p></intro><level class="para1" eId="section-1-1-a"><num>(a)</num><intro><p>make provision—</p></intro><level class="para2" eId="section-1-1-a-i"><num>(i)</num><content><p>corresponding to an EU regulation, EU tertiary legislation or an EU decision,</p></content></level><level class="para2" eId="section-1-1-a-ii"><num>(ii)</num><content><p>for the enforcement of provision made under sub-paragraph (i) or otherwise to make it effective,</p></content></level><level class="para2" eId="section-1-1-a-iii"><num>(iii)</num><content><p>to implement an EU directive, or</p></content></level><level class="para2" eId="section-1-1-a-iv"><num>(iv)</num><content><p>modifying any provision of retained EU law relating to the enforcement or implementation of an EU regulation, EU tertiary legislation, an EU decision or an EU directive,</p></content></level><wrapUp><p>so far as the EU regulation, EU tertiary legislation, EU decision or EU directive has effect in EU law after IP completion day, or</p></wrapUp></level><level class="para1" eId="section-1-1-b"><num>(b)</num><intro><p>otherwise make provision for the purpose of dealing with matters arising out of, or related to, the operation from time to time of—</p></intro><level class="para2" eId="section-1-1-b-i"><num>(i)</num><content><p>any rights, powers, liabilities, obligations or restrictions created by regulations made under this subsection, or</p></content></level><level class="para2" eId="section-1-1-b-ii"><num>(ii)</num><content><p>any remedies or proceedings provided for by those regulations.</p></content></level></level></subsection><subsection eId="section-1-2"><num>(2)</num><intro><p>In making regulations under subsection (1)(a)(i), (ii) or (iii), the Scottish Ministers may, in particular—</p></intro><level class="para1" eId="section-1-2-a"><num>(a)</num><content><p>omit anything which has no practical application in relation to Scotland or is otherwise redundant or substantially redundant,</p></content></level><level class="para1" eId="section-1-2-b"><num>(b)</num><content><p>omit functions of, or in relation to, EU entities which no longer have functions in that respect under EU law in relation to Scotland,</p></content></level><level class="para1" eId="section-1-2-c"><num>(c)</num><intro><p>omit provision for, or in connection with, reciprocal arrangements between—</p></intro><level class="para2" eId="section-1-2-c-i"><num>(i)</num><content><p>the United Kingdom or Scotland or a public authority in the United Kingdom, and</p></content></level><level class="para2" eId="section-1-2-c-ii"><num>(ii)</num><content><p>the EU, an EU entity, a member State or a public authority in a member State,</p></content></level><wrapUp><p>which no longer exist or are no longer necessary,</p></wrapUp></level><level class="para1" eId="section-1-2-d"><num>(d)</num><intro><p>omit provision for, or in connection with, other arrangements which—</p></intro><level class="para2" eId="section-1-2-d-i"><num>(i)</num><content><p>involve the EU, an EU entity, a member State or a public authority in a member State, or</p></content></level><level class="para2" eId="section-1-2-d-ii"><num>(ii)</num><content><p>are otherwise dependent upon the United Kingdom’s membership of the EU,</p></content></level><wrapUp><p>and which no longer exist or are no longer necessary,</p></wrapUp></level><level class="para1" eId="section-1-2-e"><num>(e)</num><content><p>omit provision for, or in connection with, any reciprocal or other arrangements not falling within paragraph (c) or (d) which no longer exist, or are no longer necessary, as a result of the United Kingdom ceasing to be a party to any of the EU Treaties,</p></content></level><level class="para1" eId="section-1-2-f"><num>(f)</num><intro><p>confer functions or impose restrictions which—</p></intro><level class="para2" eId="section-1-2-f-i"><num>(i)</num><content><p>are in an EU directive and in force (including any power to make EU tertiary legislation), and</p></content></level><level class="para2" eId="section-1-2-f-ii"><num>(ii)</num><content><p>it is appropriate to retain,</p></content></level></level><level class="para1" eId="section-1-2-g"><num>(g)</num><content><p>omit EU references which are not necessary.</p></content></level></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>Regulations under subsection (1)(a)(i), (ii) or (iii) may provide for functions of EU entities or public authorities in member States (including making an instrument of a legislative character or providing funding) to be—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p>exercisable instead by a Scottish public authority (whether or not established for the purpose), or by any person whom the authority authorises to carry out functions on its behalf, or</p></content></level><level class="para1" eId="section-1-3-b"><num>(b)</num><content><p>omitted or otherwise differently provided for.</p></content></level></subsection><subsection eId="section-1-4"><num>(4)</num><intro><p>Regulations under subsection (1)(a)(iv) may, in relation to any functions in EU instruments that are already exercisable by a Scottish public authority—</p></intro><level class="para1" eId="section-1-4-a"><num>(a)</num><intro><p>provide for the authority to—</p></intro><level class="para2" eId="section-1-4-a-i"><num>(i)</num><content><p>delegate any of the functions to another person, or</p></content></level><level class="para2" eId="section-1-4-a-ii"><num>(ii)</num><content><p>arrange for any of the functions to be carried out by another person, or</p></content></level></level><level class="para1" eId="section-1-4-b"><num>(b)</num><content><p>otherwise provide for the functions to be conferred instead on another Scottish public authority.</p></content></level></subsection><subsection eId="section-1-5"><num>(5)</num><intro><p>Regulations under subsection (1) may make provision for, or in connection with, the charging of fees or other charges in connection with the exercise of a function (“the relevant function”) which a Scottish public authority has by virtue of provision made under that subsection, including—</p></intro><level class="para1" eId="section-1-5-a"><num>(a)</num><content><p>specifying fees or charges or making provision as to how they are to be determined,</p></content></level><level class="para1" eId="section-1-5-b"><num>(b)</num><content><p>providing for the recovery or disposal of any sums payable under the regulations,</p></content></level><level class="para1" eId="section-1-5-c"><num>(c)</num><content><p>conferring power on the Scottish public authority to make, by subordinate legislation, any provision that the Scottish Ministers may make by virtue of this subsection in relation to the relevant function.</p></content></level></subsection><subsection eId="section-1-6"><num>(6)</num><content><p>Regulations under subsection (1) may make any provision that could be made by an Act of the Scottish Parliament.</p></content></subsection></section><section eId="section-2"><num>2</num><heading>Purpose of maintaining and advancing standards</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>The purpose of section 1(1) is, among other things, to contribute towards maintaining and advancing standards in relation to the following matters—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>environmental protection,</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><content><p>animal health and welfare,</p></content></level><level class="para1" eId="section-2-1-c"><num>(c)</num><content><p>plant health,</p></content></level><level class="para1" eId="section-2-1-d"><num>(d)</num><content><p>equality, non-discrimination and human rights,</p></content></level><level class="para1" eId="section-2-1-e"><num>(e)</num><content><p>social protection.</p></content></level></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>When using the power under section 1(1), the Scottish Ministers must have due regard to the purpose referred to in subsection (1).</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><content><p>In subsection (1)(a), “environmental protection” has the meaning given by section 45(1).</p></content></subsection></section><section eId="section-3"><num>3</num><heading>Limitations on the section 1(1) power</heading><subsection eId="section-3-1"><num>(1)</num><intro><p>Regulations under section 1(1) may not—</p></intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content><p>impose or increase taxation,</p></content></level><level class="para1" eId="section-3-1-b"><num>(b)</num><content><p>make retrospective provision,</p></content></level><level class="para1" eId="section-3-1-c"><num>(c)</num><content><p>create a relevant criminal offence,</p></content></level><level class="para1" eId="section-3-1-d"><num>(d)</num><content><p>provide for the establishment of a Scottish public authority,</p></content></level><level class="para1" eId="section-3-1-e"><num>(e)</num><content><p>remove any protection relating to the independence of judicial decision-making, or decision-making of a judicial nature, by a person occupying a judicial office, or otherwise make provision inconsistent with the duty in section 1 of the Judiciary and Courts (Scotland) Act 2008 (guarantee of the continued independence of the judiciary),</p></content></level><level class="para1" eId="section-3-1-f"><num>(f)</num><content><p>confer a function on a Scottish public authority that is not broadly consistent with the general objects and purposes of the authority,</p></content></level><level class="para1" eId="section-3-1-g"><num>(g)</num><content><p>modify any of the matters listed in section 31(5) of the Scotland Act 1998 (protected subject-matter),</p></content></level><level class="para1" eId="section-3-1-h"><num>(h)</num><content><p>modify the Scotland Act 1998,</p></content></level><level class="para1" eId="section-3-1-i"><num>(i)</num><content><p>modify the Equality Act 2006, or</p></content></level><level class="para1" eId="section-3-1-j"><num>(j)</num><content><p>modify the Equality Act 2010.</p></content></level></subsection><subsection eId="section-3-2"><num>(2)</num><content><p>Paragraphs (e) and (j) of subsection (1) do not prevent the removal of a protection or the making of a modification if alternative provision is made in the regulations that is equivalent to the protection being removed or the provision being modified.</p></content></subsection><subsection eId="section-3-3"><num>(3)</num><intro><p>In subsection (1)—</p></intro><hcontainer name="definition"><intro><p>“judicial office” means—</p></intro><level class="para1"><num>(a)</num><content><p>the office of judge of any court,</p></content></level><level class="para1"><num>(b)</num><content><p>the office of member of any tribunal,</p></content></level><level class="para1"><num>(c)</num><content><p>any other office, or appointment, having functions of a judicial nature,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“relevant criminal offence” means an offence for which an individual who has reached the age of 21 is capable of being sentenced to imprisonment for a term of more than 2 years (ignoring any enactment prohibiting or restricting the imprisonment of individuals who have no previous convictions),</p></content></hcontainer><hcontainer name="definition"><content><p>“retrospective provision”, in relation to provision made by regulations, means provision taking effect from a date earlier than the date on which the regulations are made.</p></content></hcontainer></subsection></section><section eId="section-4"><num>4</num><heading>Duration of the section 1(1) power</heading><subsection eId="section-4-1"><num>(1)</num><content><p>No regulations may be made under section 1(1) after the end of the period of 6 years beginning with the day on which section 1(1) comes into force.</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><content><p>The Scottish Ministers may by regulations extend the period mentioned in subsection (1).</p></content></subsection><subsection eId="section-4-3"><num>(3)</num><content><p>That power may be exercised more than once.</p></content></subsection><subsection eId="section-4-4"><num>(4)</num><content><p>But the period mentioned in subsection (1) may not be extended by regulations under subsection (2) beyond the end of the period of 10 years beginning with the day on which section 1(1) comes into force.</p></content></subsection><subsection eId="section-4-5"><num>(5)</num><content><p>Subsection (1) does not affect the continuation in force of any regulations made under section 1(1) during the period mentioned in subsection (1) (including any period of extension provided by regulations under subsection (2)).</p></content></subsection><subsection eId="section-4-6"><num>(6)</num><content><p>Regulations under subsection (2) are subject to the affirmative procedure.</p></content></subsection></section><section eId="section-5"><num>5</num><heading>Scrutiny of regulations under section 1(1)</heading><subsection eId="section-5-1"><num>(1)</num><content><p>Regulations under section 1(1) which contain provision falling within subsection (2) are subject to the affirmative procedure.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><intro><p>That provision is provision which—</p></intro><level class="para1" eId="section-5-2-a"><num>(a)</num><content><p>abolishes a function of an EU entity or a public authority in a member State without providing for an equivalent function to be exercisable by any person,</p></content></level><level class="para1" eId="section-5-2-b"><num>(b)</num><content><p>provides for a function mentioned in section 1(3) or (4) to be exercisable by a Scottish public authority, or by a different Scottish public authority (as the case may be), or by any person whom the Scottish public authority authorises to carry out functions on its behalf,</p></content></level><level class="para1" eId="section-5-2-c"><num>(c)</num><content><p>falls within section 1(5), regarding the charging of fees or other charges in connection with the exercise of a function by a Scottish public authority, except for provision which relates only to altering the amount of a fee or charge to reflect changes in the value of money,</p></content></level><level class="para1" eId="section-5-2-d"><num>(d)</num><content><p>creates, or widens the scope of, a criminal offence,</p></content></level><level class="para1" eId="section-5-2-e"><num>(e)</num><content><p>creates or amends a power to legislate.</p></content></level></subsection><subsection eId="section-5-3"><num>(3)</num><content><p>Any other regulations under section 1(1) are (if they have not been subject to the affirmative procedure) subject to the negative procedure.</p></content></subsection></section><section eId="section-6"><num>6</num><heading>Policy statement on the section 1(1) power</heading><subsection eId="section-6-1"><num>(1)</num><intro><p>The Scottish Ministers must publish, in such manner as they consider appropriate, a statement of their policy on—</p></intro><level class="para1" eId="section-6-1-a"><num>(a)</num><content><p>the approach to be taken,</p></content></level><level class="para1" eId="section-6-1-b"><num>(b)</num><content><p>the factors to be taken into account, and</p></content></level><level class="para1" eId="section-6-1-c"><num>(c)</num><content><p>the process to be followed,</p></content></level><wrapUp><p>when considering whether to use the power under section 1(1).</p></wrapUp></subsection><subsection eId="section-6-2"><num>(2)</num><content><p>The Scottish Ministers may from time to time revise the policy statement and publish the revised policy statement.</p></content></subsection><subsection eId="section-6-3"><num>(3)</num><intro><p>Where the Scottish Ministers make a statement referred to in subsection (9) of section 9, by virtue of paragraph (c) of that subsection, they must as soon as reasonably practicable after making the statement—</p></intro><level class="para1" eId="section-6-3-a"><num>(a)</num><content><p>review the policy statement, and</p></content></level><level class="para1" eId="section-6-3-b"><num>(b)</num><intro><p>either—</p></intro><level class="para2" eId="section-6-3-b-i"><num>(i)</num><content><p>revise the policy statement and publish the revised policy statement, or</p></content></level><level class="para2" eId="section-6-3-b-ii"><num>(ii)</num><content><p>lay before the Scottish Parliament a document explaining why, in the Scottish Ministers’ opinion, it is not necessary to revise the policy statement.</p></content></level></level></subsection><subsection eId="section-6-4"><num>(4)</num><content><p>In this Part, references to a policy statement under this section include references to the policy statement as revised from time to time.</p></content></subsection><subsection eId="section-6-5"><num>(5)</num><content><p>It is not necessary for a policy statement to have been published under this section before the power under section 1(1) may be used.</p></content></subsection></section><section eId="section-7"><num>7</num><heading>Procedure for publication of policy statement</heading><subsection eId="section-7-1"><num>(1)</num><content><p>Before publishing a policy statement under section 6, the Scottish Ministers must lay a copy of the statement before the Scottish Parliament for approval.</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><content><p>The Scottish Ministers must not publish the policy statement before the end of the 28-day period mentioned in subsection (5).</p></content></subsection><subsection eId="section-7-3"><num>(3)</num><intro><p>Before laying a copy of the policy statement before the Scottish Parliament under subsection (1), the Scottish Ministers must—</p></intro><level class="para1" eId="section-7-3-a"><num>(a)</num><content><p>lay a draft of the statement before the Parliament, and</p></content></level><level class="para1" eId="section-7-3-b"><num>(b)</num><content><p>in preparing the copy of the policy statement that is to be laid before the Parliament under subsection (1), have regard to any representations about the draft statement that are made to them before the end of the period of 28 days beginning with the day on which the draft statement is laid before the Parliament under paragraph (a).</p></content></level></subsection><subsection eId="section-7-4"><num>(4)</num><content><p>When laying a copy of the policy statement before the Scottish Parliament under subsection (1), the Scottish Ministers must at the same time lay before the Parliament a document describing how they have had regard to any representations made about the draft statement in accordance with subsection (3)(b) in preparing the copy of the statement.</p></content></subsection><subsection eId="section-7-5"><num>(5)</num><intro><p>If, within 28 days of a copy of the policy statement having been laid before the Scottish Parliament under subsection (1), the Parliament resolves that the statement should not be approved, the Scottish Ministers must not publish the statement but instead—</p></intro><level class="para1" eId="section-7-5-a"><num>(a)</num><content><p>review and revise the policy statement, having regard to any views expressed by the Parliament in relation to the statement, and</p></content></level><level class="para1" eId="section-7-5-b"><num>(b)</num><content><p>lay a copy of the policy statement as revised before the Parliament.</p></content></level></subsection><subsection eId="section-7-6"><num>(6)</num><content><p>Subsection (5) applies in relation to any policy statement as revised under that subsection as it applies in relation to the first copy of the policy statement laid before the Scottish Parliament under subsection (1).</p></content></subsection><subsection eId="section-7-7"><num>(7)</num><content><p>In calculating the period of 28 days mentioned in subsections (3)(b) and (5), no account is to be taken of any period during which the Parliament is dissolved or in recess for more than 4 days.</p></content></subsection><subsection eId="section-7-8"><num>(8)</num><content><p>The Scottish Ministers must lay a draft of the first policy statement under subsection (3)(a) as soon as reasonably practicable after section 1(1) comes into force.</p></content></subsection></section><section eId="section-8"><num>8</num><heading>Explanatory statements for regulations under section 1(1)</heading><subsection eId="section-8-1"><num>(1)</num><content><p>This section applies where a Scottish statutory instrument containing regulations under section 1(1), or a draft of such an instrument, is to be laid before the Scottish Parliament.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><content><p>When the instrument or draft is laid, the Scottish Ministers must make each of the statements listed in section 9.</p></content></subsection><subsection eId="section-8-3"><num>(3)</num><content><p>If the instrument or draft is laid when the Scottish Parliament is in recess, the Scottish Ministers must make a statement explaining why the instrument or draft was laid at that time.</p></content></subsection><subsection eId="section-8-4"><num>(4)</num><content><p>If the Scottish Ministers fail to make a statement required by subsection (2) or (3) when the instrument or draft is laid, they must make a statement explaining why they have failed to do so.</p></content></subsection><subsection eId="section-8-5"><num>(5)</num><content><p>A statement under subsection (2), (3) or (4) must be made in writing and be published in such manner as the Scottish Ministers consider appropriate.</p></content></subsection><subsection eId="section-8-6"><num>(6)</num><content><p>This section does not apply in relation to any laying before the Scottish Parliament of an instrument or draft instrument where an equivalent instrument or draft (ignoring any differences relating to procedure) has previously been laid before the Parliament.</p></content></subsection></section><section eId="section-9"><num>9</num><heading>Explanatory statements: good reasons, human rights etc.</heading><subsection eId="section-9-1"><num>(1)</num><content><p>The statements referred to in section 8(2) are as follows.</p></content></subsection><subsection eId="section-9-2"><num>(2)</num><intro><p>A statement explaining—</p></intro><level class="para1" eId="section-9-2-a"><num>(a)</num><content><p>the instrument or draft,</p></content></level><level class="para1" eId="section-9-2-b"><num>(b)</num><content><p>why, in the Scottish Ministers’ opinion, there are good reasons for making the provision contained in the instrument or draft,</p></content></level><level class="para1" eId="section-9-2-c"><num>(c)</num><content><p>the law before IP completion day which is relevant to the provision, and</p></content></level><level class="para1" eId="section-9-2-d"><num>(d)</num><content><p>the effect (if any) of the provision on retained EU law.</p></content></level></subsection><subsection eId="section-9-3"><num>(3)</num><intro><p>A statement explaining the effect (if any) of the instrument or draft on—</p></intro><level class="para1" eId="section-9-3-a"><num>(a)</num><content><p>the Convention rights within the meaning of section 1 of the Human Rights Act 1998, and</p></content></level><level class="para1" eId="section-9-3-b"><num>(b)</num><content><p>other human rights contained in any international convention, treaty or other international instrument ratified by the United Kingdom.</p></content></level></subsection><subsection eId="section-9-4"><num>(4)</num><intro><p>A statement—</p></intro><level class="para1" eId="section-9-4-a"><num>(a)</num><content><p>as to whether the instrument or draft amends, repeals or revokes any provision of equality legislation, and</p></content></level><level class="para1" eId="section-9-4-b"><num>(b)</num><content><p>if it does, explaining the effect of each such amendment, repeal or revocation.</p></content></level></subsection><subsection eId="section-9-5"><num>(5)</num><content><p>A statement to the effect that, in relation to the instrument or draft, the Scottish Ministers have, so far as required to do so by equality legislation, had due regard to the need to eliminate discrimination, harassment, victimisation and any other conduct that is prohibited by or under the Equality Act 2010.</p></content></subsection><subsection eId="section-9-6"><num>(6)</num><intro><p>A statement explaining the effect (if any) of the instrument or draft on—</p></intro><level class="para1" eId="section-9-6-a"><num>(a)</num><content><p>rights and duties relating to employment and health and safety,</p></content></level><level class="para1" eId="section-9-6-b"><num>(b)</num><content><p>matters relating to consumer protection,</p></content></level><wrapUp><p>so far as it is within devolved competence (within the meaning of section 54 of the Scotland Act 1998) for the instrument or draft to have any such effect.</p></wrapUp></subsection><subsection eId="section-9-7"><num>(7)</num><intro><p>A statement—</p></intro><level class="para1" eId="section-9-7-a"><num>(a)</num><intro><p>as to whether, in relation to the instrument or draft, the Scottish Ministers have consulted—</p></intro><level class="para2" eId="section-9-7-a-i"><num>(i)</num><content><p>such persons appearing to them to be representative of the interests of local authorities,</p></content></level><level class="para2" eId="section-9-7-a-ii"><num>(ii)</num><content><p>any other person, and</p></content></level></level><level class="para1" eId="section-9-7-b"><num>(b)</num><content><p>if they have, setting out details of the consultation that they carried out.</p></content></level></subsection><subsection eId="section-9-8"><num>(8)</num><content><p>Except where the regulations are subject to the negative procedure, a statement setting out the likely financial implications of the provision contained in the draft.</p></content></subsection><subsection eId="section-9-9"><num>(9)</num><intro><p>If the instrument or draft—</p></intro><level class="para1" eId="section-9-9-a"><num>(a)</num><content><p>is laid before a policy statement is published under section 6(1),</p></content></level><level class="para1" eId="section-9-9-b"><num>(b)</num><content><p>is laid during the period beginning with the day on which a copy of a revised policy statement is laid before the Scottish Parliament under section 7(1) and ending with the day on which the revised policy statement is published under section 6(2) or (3)(b)(i), or</p></content></level><level class="para1" eId="section-9-9-c"><num>(c)</num><content><p>contains provision that involves using the power under section 1(1) in a way that is not in accordance with the policy statement published under section 6,</p></content></level><wrapUp><p>a statement explaining why, in the Scottish Ministers’ opinion, there are good reasons for laying the instrument or draft at that time or, as the case may be, for using the power in that way.</p></wrapUp></subsection><subsection eId="section-9-10"><num>(10)</num><content><p>In this section, “equality legislation” means the Equality Act 2006, the Equality Act 2010 or any subordinate legislation made under either of those Acts.</p></content></subsection></section><section eId="section-10"><num>10</num><heading>Reports relating to the use of the section 1(1) power</heading><subsection eId="section-10-1"><num>(1)</num><intro><p>The Scottish Ministers must, for each reporting period, prepare and lay before the Scottish Parliament a report explaining—</p></intro><level class="para1" eId="section-10-1-a"><num>(a)</num><content><p>how the power under section 1(1) has been used during the reporting period,</p></content></level><level class="para1" eId="section-10-1-b"><num>(b)</num><content><p>how that use of the power under section 1(1) contributes or has contributed towards maintaining and advancing standards in relation to the matters mentioned in section 2(1)(a) to (e),</p></content></level><level class="para1" eId="section-10-1-c"><num>(c)</num><content><p>how they intend to use the power under section 1(1) in the period (of such length as they may determine) following the reporting period,</p></content></level><level class="para1" eId="section-10-1-d"><num>(d)</num><content><p>how their intended use of the power under section 1(1) would contribute towards maintaining and advancing standards in relation to the matters mentioned in section 2(1)(a) to (e), and</p></content></level><level class="para1" eId="section-10-1-e"><num>(e)</num><content><p>any use of the power under section 1(1) that has been considered by the Scottish Ministers during the reporting period.</p></content></level></subsection><subsection eId="section-10-2"><num>(2)</num><intro><p>The reporting periods are—</p></intro><level class="para1" eId="section-10-2-a"><num>(a)</num><content><p>the period beginning with the day on which section 1(1) comes into force and ending with 31 August 2021,</p></content></level><level class="para1" eId="section-10-2-b"><num>(b)</num><content><p>each subsequent period of one year (during the total period in which regulations may be made under section 1(1) in accordance with section 4), and</p></content></level><level class="para1" eId="section-10-2-c"><num>(c)</num><content><p>the period (the “final reporting period”) beginning with the day after the end of the last period of one year determined under paragraph (b) and ending with the day on which the power to make regulations under section 1(1) expires in accordance with section 4.</p></content></level></subsection><subsection eId="section-10-3"><num>(3)</num><content><p>Paragraphs (c) and (d) of subsection (1) do not apply to the report for the final reporting period.</p></content></subsection></section><section eId="section-11"><num>11</num><heading>Consultation on reports under section 10(1)</heading><subsection eId="section-11-1"><num>(1)</num><intro><p>Before laying a report before the Scottish Parliament under section 10(1), the Scottish Ministers must—</p></intro><level class="para1" eId="section-11-1-a"><num>(a)</num><content><p>lay a draft of the report before the Parliament, and</p></content></level><level class="para1" eId="section-11-1-b"><num>(b)</num><content><p>in preparing the report, have regard to any representations about the draft report that are made to them before the expiry of the consultation period.</p></content></level></subsection><subsection eId="section-11-2"><num>(2)</num><content><p>References in this section to a draft of the report are references only to a draft of the provision to be contained in the report under section 10(1)(c).</p></content></subsection><subsection eId="section-11-3"><num>(3)</num><content><p>The draft report must be laid before the Parliament under subsection (1)(a) as soon as practicable, and no later than 2 months, after the end of the reporting period to which it relates.</p></content></subsection><subsection eId="section-11-4"><num>(4)</num><content><p>Where the Scottish Ministers lay a draft report before the Scottish Parliament under subsection (1)(a), they must not lay the report before the Parliament under section 10(1) before the expiry of the consultation period.</p></content></subsection><subsection eId="section-11-5"><num>(5)</num><intro><p>When laying the report before the Scottish Parliament under section 10(1), the Scottish Ministers must at the same time lay before the Parliament a document setting out—</p></intro><level class="para1" eId="section-11-5-a"><num>(a)</num><content><p>a summary of any representations about the draft report made during the consultation period, and</p></content></level><level class="para1" eId="section-11-5-b"><num>(b)</num><content><p>how they have had regard to those representations in preparing the report.</p></content></level></subsection><subsection eId="section-11-6"><num>(6)</num><content><p>Where the representations about the draft report made during the consultation period include representations that any particular intended use or uses of the power under section 1(1) as explained in the draft report should instead be provided for by means of an Act of the Scottish Parliament, the document laid under subsection (5) must cover those representations separately.</p></content></subsection><subsection eId="section-11-7"><num>(7)</num><content><p>In this section, “consultation period” means the period of 28 days beginning with the day on which the draft report is laid before the Scottish Parliament under subsection (1)(a).</p></content></subsection><subsection eId="section-11-8"><num>(8)</num><content><p>In calculating the period of 28 days mentioned in subsection (7), no account is to be taken of any period during which the Parliament is dissolved or in recess for more than 4 days.</p></content></subsection></section><section eId="section-12"><num>12</num><heading>Interpretation of Part 1</heading><subsection eId="section-12-1"><num>(1)</num><intro><p>In this Part—</p></intro><hcontainer name="definition"><intro><p>“EU decision” means—</p></intro><level class="para1"><num>(a)</num><content><p>a decision within the meaning of Article 288 of the Treaty on the Functioning of the European Union, or</p></content></level><level class="para1"><num>(b)</num><content><p>a decision under former Article 34(2)(c) of the Treaty on European Union,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“EU directive” means a directive within the meaning of Article 288 of the Treaty on the Functioning of the European Union,</p></content></hcontainer><hcontainer name="definition"><content><p>“EU entity” means an EU institution or any office, body or agency of the EU,</p></content></hcontainer><hcontainer name="definition"><intro><p>“EU reference” means—</p></intro><level class="para1"><num>(a)</num><content><p>any reference to the EU, an EU entity or a member State,</p></content></level><level class="para1"><num>(b)</num><content><p>any reference to an EU directive or any other EU law, or</p></content></level><level class="para1"><num>(c)</num><content><p>any other reference which relates to the EU,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“EU regulation” means a regulation within the meaning of Article 288 of the Treaty on the Functioning of the European Union,</p></content></hcontainer><hcontainer name="definition"><intro><p>“EU tertiary legislation” means—</p></intro><level class="para1"><num>(a)</num><content><p>any provision made under—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>an EU regulation,</p></item><item><num>(ii)</num><p>a decision within the meaning of Article 288 of the Treaty on the Functioning of the European Union, or</p></item><item><num>(iii)</num><p>an EU directive,</p></item></blockList><p>by virtue of Article 290 or 291(2) of the Treaty on the Functioning of the European Union or former Article 202 of the Treaty establishing the European Community, or</p></content></level><level class="para1"><num>(b)</num><content><p>any measure adopted in accordance with former Article 34(2)(c) of the Treaty on European Union to implement decisions under former Article 34(2)(c),</p></content></level><wrapUp><p>but does not include any such provision or measure which is an EU directive,</p></wrapUp></hcontainer><hcontainer name="definition"><content><p>“member State” (except in the definition of “EU reference”) does not include the United Kingdom,</p></content></hcontainer><hcontainer name="definition"><intro><p>“public authority”—</p></intro><level class="para1"><num>(a)</num><content><p>means a public authority within the meaning of section 6 of the Human Rights Act 1998, but</p></content></level><level class="para1"><num>(b)</num><content><p>does not include the Scottish Parliament or a person exercising functions in connection with proceedings in the Scottish Parliament,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“Scottish public authority” means a public authority whose functions are exercisable only in or as regards Scotland.</p></content></hcontainer></subsection><subsection eId="section-12-2"><num>(2)</num><content><p>References in section 1(1) to an EU regulation, EU tertiary legislation, an EU decision or an EU directive include references to any provision or part of the EU regulation, EU tertiary legislation, the EU decision or the EU directive.</p></content></subsection><subsection eId="section-12-3"><num>(3)</num><content><p>References in subsection (1) to former Article 34(2)(c) of the Treaty on European Union are references to that Article as it had effect at any time before the coming into force of the Treaty of Lisbon Amending the Treaty on European Union and the Treaty establishing the European Community signed at Lisbon on 13 December 2007.</p></content></subsection><subsection eId="section-12-4"><num>(4)</num><content><p>Any other reference in subsection (1) to an Article of the Treaty on European Union or the Treaty on the Functioning of the European Union includes a reference to that Article as applied by Article 106a of the Euratom Treaty.</p></content></subsection></section></part><part eId="part-2"><num>PART 2</num><heading>ENVIRONMENT</heading><chapter eId="part-2-chapter-1"><num>CHAPTER 1</num><heading>ENVIRONMENTAL PRINCIPLES</heading><section eId="section-13"><num>13</num><heading>The guiding principles on the environment</heading><subsection eId="section-13-1"><num>(1)</num><intro><p>In this Chapter, references to the guiding principles on the environment are references to the following principles—</p></intro><level class="para1" eId="section-13-1-a"><num>(a)</num><content><p>the principle that protecting the environment should be integrated into the making of policies,</p></content></level><level class="para1" eId="section-13-1-b"><num>(b)</num><content><p>the precautionary principle as it relates to the environment,</p></content></level><level class="para1" eId="section-13-1-c"><num>(c)</num><content><p>the principle that preventative action should be taken to avert environmental damage,</p></content></level><level class="para1" eId="section-13-1-d"><num>(d)</num><content><p>the principle that environmental damage should as a priority be rectified at source,</p></content></level><level class="para1" eId="section-13-1-e"><num>(e)</num><content><p>the principle that the polluter should pay.</p></content></level></subsection><subsection eId="section-13-2"><num>(2)</num><content><p>Those principles are derived from the equivalent principles provided for in Article 11 of Title II and Article 191(2) of Title XX of the Treaty on the Functioning of the European Union.</p></content></subsection><subsection eId="section-13-3"><num>(3)</num><content><p>Accordingly, in preparing guidance under section 17 relating to the interpretation and application of the principles, the Scottish Ministers must have regard to the interpretation of those equivalent principles by the European Court from time to time.</p></content></subsection><subsection eId="section-13-4"><num>(4)</num><intro><p>The Scottish Ministers may by regulations—</p></intro><level class="para1" eId="section-13-4-a"><num>(a)</num><intro><p>modify this section so as to—</p></intro><level class="para2" eId="section-13-4-a-i"><num>(i)</num><content><p>add or remove guiding principles on the environment,</p></content></level><level class="para2" eId="section-13-4-a-ii"><num>(ii)</num><content><p>amend any of the guiding principles for the time being specified in this section,</p></content></level></level><level class="para1" eId="section-13-4-b"><num>(b)</num><content><p>further define any of the guiding principles for the time being specified in this section.</p></content></level></subsection><subsection eId="section-13-5"><num>(5)</num><intro><p>Regulations under subsection (4) may remove, amend or further define a guiding principle on the environment that is derived from the equivalent principles mentioned in subsection (2) only so far as necessary—</p></intro><level class="para1" eId="section-13-5-a"><num>(a)</num><content><p>to reflect the removal of or an amendment to the equivalent principle in accordance with EU law, or</p></content></level><level class="para1" eId="section-13-5-b"><num>(b)</num><content><p>otherwise to ensure that the guiding principle reflects the equivalent principle as it has effect in EU law from time to time.</p></content></level></subsection><subsection eId="section-13-6"><num>(6)</num><content><p>Regulations under subsection (4) are subject to the affirmative procedure.</p></content></subsection><subsection eId="section-13-7"><num>(7)</num><intro><p>Before laying a draft of regulations under subsection (4) before the Scottish Parliament for approval, the Scottish Ministers must consult—</p></intro><level class="para1" eId="section-13-7-a"><num>(a)</num><content><p>a Minister of the Crown,</p></content></level><level class="para1" eId="section-13-7-b"><num>(b)</num><content><p>each responsible authority that is subject to the duty in section 15,</p></content></level><level class="para1" eId="section-13-7-c"><num>(c)</num><content><p>such persons appearing to them to be representative of the interests of local government, industry, agriculture, fisheries or small businesses as they consider appropriate, and</p></content></level><level class="para1" eId="section-13-7-d"><num>(d)</num><content><p>such other persons as they consider appropriate.</p></content></level></subsection><subsection eId="section-13-8"><num>(8)</num><intro><p>In this Chapter—</p></intro><hcontainer name="definition"><content><p>“making policies” includes developing, adopting or revising policies,</p></content></hcontainer><hcontainer name="definition"><content><p>“Minister of the Crown” has the same meaning as in the Ministers of the Crown Act 1975.</p></content></hcontainer></subsection></section><section eId="section-14"><num>14</num><heading>Ministers’ duties to have due regard to the guiding principles</heading><subsection eId="section-14-1"><num>(1)</num><content><p>The Scottish Ministers must, in making policies (including proposals for legislation), have due regard to the guiding principles on the environment.</p></content></subsection><subsection eId="section-14-2"><num>(2)</num><content><p>Ministers of the Crown must, in making policies (including proposals for legislation) so far as extending to Scotland, have due regard to the guiding principles on the environment.</p></content></subsection><subsection eId="section-14-3"><num>(3)</num><intro><p>The duties in subsections (1) and (2) do not apply in relation to any policy or proposal so far as relating to—</p></intro><level class="para1" eId="section-14-3-a"><num>(a)</num><content><p>national defence or civil emergency,</p></content></level><level class="para1" eId="section-14-3-b"><num>(b)</num><content><p>finance or budgets.</p></content></level></subsection><subsection eId="section-14-4"><num>(4)</num><intro><p>In this section, “legislation” includes—</p></intro><level class="para1" eId="section-14-4-a"><num>(a)</num><content><p>an Act of Parliament,</p></content></level><level class="para1" eId="section-14-4-b"><num>(b)</num><content><p>an Act of the Scottish Parliament,</p></content></level><level class="para1" eId="section-14-4-c"><num>(c)</num><content><p>subordinate legislation.</p></content></level></subsection></section><section eId="section-15"><num>15</num><heading>Other authorities’ duty to have due regard to the guiding principles</heading><subsection eId="section-15-1"><num>(1)</num><content><p>A responsible authority must, in doing anything in respect of which the duty under section 1 of the Environmental Assessment (Scotland) Act 2005 (“the 2005 Act”) applies (requirement for environmental assessment), have due regard to the guiding principles on the environment.</p></content></subsection><subsection eId="section-15-2"><num>(2)</num><content><p>In subsection (1), “responsible authority” is to be construed in accordance with section 2 of the 2005 Act but does not include the Scottish Ministers or a Minister of the Crown.</p></content></subsection></section><section eId="section-16"><num>16</num><heading>Purpose of the duties under sections 14 and 15</heading><subsection eId="section-16-1"><num>(1)</num><intro><p>Those to whom the duties in sections 14 and 15 apply are to comply with the duties with a view to—</p></intro><level class="para1" eId="section-16-1-a"><num>(a)</num><content><p>protecting and improving the environment, and</p></content></level><level class="para1" eId="section-16-1-b"><num>(b)</num><content><p>contributing to sustainable development.</p></content></level></subsection><subsection eId="section-16-2"><num>(2)</num><intro><p>In subsection (1), “the environment”—</p></intro><level class="para1" eId="section-16-2-a"><num>(a)</num><content><p>means all, or any, of the air, water and land (including the earth’s crust), and “air” includes the air within buildings and the air within other natural or man-made structures above or below ground, and</p></content></level><level class="para1" eId="section-16-2-b"><num>(b)</num><content><p>includes wild animal and plant life and the habitats of wild animal and plant life.</p></content></level></subsection><subsection eId="section-16-3"><num>(3)</num><content><p>In subsection  (2)(b), “animal and plant life” includes any living organisms.</p></content></subsection></section><section eId="section-17"><num>17</num><heading>Guidance</heading><subsection eId="section-17-1"><num>(1)</num><intro><p>The Scottish Ministers must publish guidance on—</p></intro><level class="para1" eId="section-17-1-a"><num>(a)</num><content><p>the guiding principles on the environment, and</p></content></level><level class="para1" eId="section-17-1-b"><num>(b)</num><content><p>the duties in sections 14 and 15 as read with section 16.</p></content></level></subsection><subsection eId="section-17-2"><num>(2)</num><intro><p>The guidance may, in particular, include provision about—</p></intro><level class="para1" eId="section-17-2-a"><num>(a)</num><content><p>the interpretation of the principles,</p></content></level><level class="para1" eId="section-17-2-b"><num>(b)</num><content><p>how the principles relate to each other,</p></content></level><level class="para1" eId="section-17-2-c"><num>(c)</num><content><p>how the duties relate to other duties relating to the environment including the duties in the Environmental Assessment (Scotland) Act 2005,</p></content></level><level class="para1" eId="section-17-2-d"><num>(d)</num><content><p>complying with the duties,</p></content></level><level class="para1" eId="section-17-2-e"><num>(e)</num><content><p>how those who are subject to the duties should demonstrate that they have complied and are complying with the duties.</p></content></level></subsection><subsection eId="section-17-3"><num>(3)</num><content><p>A person who is subject to one or other of the duties must, in doing anything in respect of which the duty applies, have regard to the guidance published under this section.</p></content></subsection><subsection eId="section-17-4"><num>(4)</num><content><p>The Scottish Ministers must from time to time review guidance published under this section and may revise the guidance and publish the revised guidance.</p></content></subsection><subsection eId="section-17-5"><num>(5)</num><content><p>References in subsections (2) to (4) and in section 18 to guidance under this section include references to revised guidance.</p></content></subsection></section><section eId="section-18"><num>18</num><heading>Procedure for publication of guidance</heading><subsection eId="section-18-1"><num>(1)</num><content><p>Before publishing guidance under section 17, the Scottish Ministers must lay the guidance before the Scottish Parliament.</p></content></subsection><subsection eId="section-18-2"><num>(2)</num><content><p>The Scottish Ministers must not publish the guidance before the end of the 40-day period mentioned in subsection (5).</p></content></subsection><subsection eId="section-18-3"><num>(3)</num><intro><p>Before laying guidance before the Scottish Parliament under subsection (1), the Scottish Ministers must consult the following persons about the guidance—</p></intro><level class="para1" eId="section-18-3-a"><num>(a)</num><content><p>a Minister of the Crown,</p></content></level><level class="para1" eId="section-18-3-b"><num>(b)</num><content><p>each responsible authority who is subject to the duty under section 15, and</p></content></level><level class="para1" eId="section-18-3-c"><num>(c)</num><content><p>such other persons as they consider appropriate.</p></content></level></subsection><subsection eId="section-18-4"><num>(4)</num><intro><p>When laying guidance before the Scottish Parliament under subsection (1), the Scottish Ministers must at the same time lay before the Parliament a statement setting out—</p></intro><level class="para1" eId="section-18-4-a"><num>(a)</num><content><p>details of the consultation about the guidance that was carried out under subsection (3),</p></content></level><level class="para1" eId="section-18-4-b"><num>(b)</num><content><p>a summary of any views expressed in response to the consultation, and</p></content></level><level class="para1" eId="section-18-4-c"><num>(c)</num><intro><p>either—</p></intro><level class="para2" eId="section-18-4-c-i"><num>(i)</num><content><p>details of how those views (if any) have been taken into account in preparing the guidance that is laid before the Parliament, or</p></content></level><level class="para2" eId="section-18-4-c-ii"><num>(ii)</num><content><p>a statement that no views were expressed in response to the consultation or that no account has been taken of views expressed.</p></content></level></level></subsection><subsection eId="section-18-5"><num>(5)</num><content><p>If, within 40 days of guidance having been laid before the Scottish Parliament under subsection (1), the Parliament resolves that the guidance should not be published, the Scottish Ministers must not publish the guidance.</p></content></subsection><subsection eId="section-18-6"><num>(6)</num><content><p>In calculating the period of 40 days, no account is to be taken of any period during which the Parliament is dissolved or in recess for more than 4 days.</p></content></subsection></section></chapter><chapter eId="part-2-chapter-2"><num>CHAPTER 2</num><heading>ENVIRONMENTAL GOVERNANCE</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-establishment-of-environmental-standards-scotland"><heading>Establishment of Environmental Standards Scotland</heading><section eId="section-19"><num>19</num><heading>Environmental Standards Scotland</heading><subsection eId="section-19-1"><num>(1)</num><content><p>Environmental Standards Scotland (in Gaelic, Ìrean Àrainneachdail na h-Alba) is established.</p></content></subsection><subsection eId="section-19-2"><num>(2)</num><content><p>It is a body corporate.</p></content></subsection><subsection eId="section-19-3"><num>(3)</num><content><p>Schedule 1 makes further provision about Environmental Standards Scotland.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-functions-of-environmental-standards-scotland"><heading>Functions of Environmental Standards Scotland</heading><section eId="section-20"><num>20</num><heading>Functions</heading><subsection eId="section-20-1"><num>(1)</num><intro><p>Environmental Standards Scotland’s functions are—</p></intro><level class="para1" eId="section-20-1-a"><num>(a)</num><intro><p>to monitor as it considers appropriate—</p></intro><level class="para2" eId="section-20-1-a-i"><num>(i)</num><content><p>public authorities’ compliance with environmental law,</p></content></level><level class="para2" eId="section-20-1-a-ii"><num>(ii)</num><content><p>the effectiveness of environmental law and of how it is implemented and applied,</p></content></level></level><level class="para1" eId="section-20-1-b"><num>(b)</num><intro><p>to investigate (either on its own initiative or in response to any representations made to it by another person) any matter concerning—</p></intro><level class="para2" eId="section-20-1-b-i"><num>(i)</num><content><p>whether a public authority is failing (or has failed) to comply with environmental law,</p></content></level><level class="para2" eId="section-20-1-b-ii"><num>(ii)</num><content><p>the effectiveness of environmental law or of how it is (or has been) implemented or applied,</p></content></level></level><level class="para1" eId="section-20-1-c"><num>(c)</num><intro><p>to take the steps it considers appropriate to secure—</p></intro><level class="para2" eId="section-20-1-c-i"><num>(i)</num><content><p>a public authority’s compliance with environmental law,</p></content></level><level class="para2" eId="section-20-1-c-ii"><num>(ii)</num><content><p>improvement in the effectiveness of environmental law or in how it is implemented or applied, and</p></content></level></level><level class="para1" eId="section-20-1-d"><num>(d)</num><content><p>the additional functions conferred on it by this or any other enactment.</p></content></level></subsection><subsection eId="section-20-2"><num>(2)</num><intro><p>In exercising its functions, Environmental Standards Scotland may, in particular—</p></intro><level class="para1" eId="section-20-2-a"><num>(a)</num><content><p>carry out, commission or support any research it considers appropriate,</p></content></level><level class="para1" eId="section-20-2-b"><num>(b)</num><content><p>seek any independent and expert advice it considers appropriate,</p></content></level><level class="para1" eId="section-20-2-c"><num>(c)</num><content><p>make recommendations in relation to any matter relevant to its functions,</p></content></level><level class="para1" eId="section-20-2-d"><num>(d)</num><content><p>consider, assess and review data on the quality of the environment in Scotland,</p></content></level><level class="para1" eId="section-20-2-e"><num>(e)</num><content><p>keep under review implementation of any international obligation of the United Kingdom relating to environmental protection,</p></content></level><level class="para1" eId="section-20-2-f"><num>(f)</num><content><p>have regard to developments in, and information on the effectiveness of, international environmental protection legislation,</p></content></level><level class="para1" eId="section-20-2-g"><num>(g)</num><content><p>collaborate with any other environmental governance body in the United Kingdom, including the Office for Environmental Protection, or such other persons as Environmental Standards Scotland considers appropriate,</p></content></level><level class="para1" eId="section-20-2-h"><num>(h)</num><content><p>request information from public authorities about the exercise of their functions under environmental law.</p></content></level></subsection><subsection eId="section-20-3"><num>(3)</num><content><p>In exercising its functions, Environmental Standards Scotland must act objectively, impartially, proportionately and transparently.</p></content></subsection></section><section eId="section-21"><num>21</num><heading>Power to modify functions</heading><subsection eId="section-21-1"><num>(1)</num><content><p>The Scottish Ministers may by regulations modify Environmental Standards Scotland’s functions for the purpose of implementing an international obligation that arises or may arise under an agreement or arrangement between the United Kingdom and the EU following the withdrawal of the United Kingdom from the EU.</p></content></subsection><subsection eId="section-21-2"><num>(2)</num><content><p>Regulations under subsection (1) may modify this Act.</p></content></subsection><subsection eId="section-21-3"><num>(3)</num><content><p>Regulations under subsection (1) are subject to the affirmative procedure.</p></content></subsection><subsection eId="section-21-4"><num>(4)</num><intro><p>Before laying a draft of regulations under subsection (1) before the Scottish Parliament for approval, the Scottish Ministers must consult—</p></intro><level class="para1" eId="section-21-4-a"><num>(a)</num><content><p>Environmental Standards Scotland, and</p></content></level><level class="para1" eId="section-21-4-b"><num>(b)</num><content><p>such other persons as the Scottish Ministers consider appropriate.</p></content></level></subsection><subsection eId="section-21-5"><num>(5)</num><content><p>In subsection (1), “modify” includes confer or remove a function.</p></content></subsection></section><section eId="section-22"><num>22</num><heading>Duty to prepare and publish strategy on exercise of functions</heading><subsection eId="section-22-1"><num>(1)</num><intro><p>Environmental Standards Scotland must—</p></intro><level class="para1" eId="section-22-1-a"><num>(a)</num><content><p>prepare and publish a strategy that sets out how it intends to exercise its functions, and</p></content></level><level class="para1" eId="section-22-1-b"><num>(b)</num><content><p>exercise its functions in accordance with the strategy.</p></content></level></subsection><subsection eId="section-22-2"><num>(2)</num><content><p>Schedule 2 makes further provision about the strategy.</p></content></subsection></section><section eId="section-23"><num>23</num><heading>Co-operation duties of public authorities and Environmental Standards Scotland</heading><subsection eId="section-23-1"><num>(1)</num><content><p>A public authority must co-operate with Environmental Standards Scotland, and give it such reasonable assistance as it requests (including the provision of information), in connection with the exercise of its functions.</p></content></subsection><subsection eId="section-23-2"><num>(2)</num><intro><p>In addition, a public authority must make all reasonable efforts to—</p></intro><level class="para1" eId="section-23-2-a"><num>(a)</num><content><p>swiftly resolve any matter which Environmental Standards Scotland raises concerning the authority’s failure to comply with environmental law, to make effective environmental law or to implement or apply it effectively, and</p></content></level><level class="para1" eId="section-23-2-b"><num>(b)</num><content><p>reach agreement with Environmental Standards Scotland on any remedial action the authority should take for the purpose of environmental protection.</p></content></level></subsection><subsection eId="section-23-3"><num>(3)</num><content><p>If Environmental Standards Scotland considers that a particular exercise of its functions may be relevant to the exercise of an environmental governance function by the Office for Environmental Protection, or any other environmental governance body in the United Kingdom, Environmental Standards Scotland must consult that body.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-information-notices"><heading>Information notices</heading><section eId="section-24"><num>24</num><heading>Power to require information</heading><subsection eId="section-24-1"><num>(1)</num><content><p>Environmental Standards Scotland may, by issuing a notice in writing (an “information notice”), require a public authority to provide information which Environmental Standards Scotland reasonably requires for the purpose of exercising any of its functions.</p></content></subsection><subsection eId="section-24-2"><num>(2)</num><intro><p>An information notice must specify—</p></intro><level class="para1" eId="section-24-2-a"><num>(a)</num><content><p>the information, or the nature of the information, which is to be provided,</p></content></level><level class="para1" eId="section-24-2-b"><num>(b)</num><content><p>the purposes for which, and the particular matters in connection with which, it is required,</p></content></level><level class="para1" eId="section-24-2-c"><num>(c)</num><content><p>the form in which it is to be provided,</p></content></level><level class="para1" eId="section-24-2-d"><num>(d)</num><content><p>the means by which it is to be provided, and</p></content></level><level class="para1" eId="section-24-2-e"><num>(e)</num><content><p>the date on or by which, or the period within which, it must be provided.</p></content></level></subsection><subsection eId="section-24-3"><num>(3)</num><content><p>Environmental Standards Scotland may withdraw an information notice by giving notice in writing to that effect to the public authority to whom the information notice was issued.</p></content></subsection><subsection eId="section-24-4"><num>(4)</num><intro><p>In this section, “information” includes—</p></intro><level class="para1" eId="section-24-4-a"><num>(a)</num><content><p>any document or a copy of, or extract from, any document,</p></content></level><level class="para1" eId="section-24-4-b"><num>(b)</num><content><p>documents of any type or copies of, or extracts from, such documents,</p></content></level><level class="para1" eId="section-24-4-c"><num>(c)</num><content><p>any explanation or other information (including unrecorded information).</p></content></level></subsection></section><section eId="section-25"><num>25</num><heading>Failure to comply with an information notice</heading><subsection eId="section-25-1"><num>(1)</num><content><p>Where a public authority fails, without reasonable excuse, to comply with an information notice issued to it under section 24(1), Environmental Standards Scotland may report the matter to the Court of Session.</p></content></subsection><subsection eId="section-25-2"><num>(2)</num><intro><p>After receiving a report under subsection (1), and hearing any evidence or representations on the matter, the Court may (either or both)—</p></intro><level class="para1" eId="section-25-2-a"><num>(a)</num><content><p>make such order for enforcement as it considers appropriate,</p></content></level><level class="para1" eId="section-25-2-b"><num>(b)</num><content><p>deal with the matter as if it were a contempt of the Court.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-improvement-reports-and-improvement-plans"><heading>Improvement reports and improvement plans</heading><section eId="section-26"><num>26</num><heading>Improvement report</heading><subsection eId="section-26-1"><num>(1)</num><intro><p>Environmental Standards Scotland may prepare an improvement report if it considers that, in exercising its functions (including regulatory functions), a public authority has failed to—</p></intro><level class="para1" eId="section-26-1-a"><num>(a)</num><content><p>comply with environmental law,</p></content></level><level class="para1" eId="section-26-1-b"><num>(b)</num><content><p>make effective environmental law, or</p></content></level><level class="para1" eId="section-26-1-c"><num>(c)</num><content><p>implement or apply environmental law effectively.</p></content></level></subsection><subsection eId="section-26-2"><num>(2)</num><intro><p>Environmental Standards Scotland may also prepare an improvement report if it considers that the combined effect of two or more public authorities exercising their functions (including regulatory functions) in the same or a similar way constitutes a systemic failure by those authorities to—</p></intro><level class="para1" eId="section-26-2-a"><num>(a)</num><content><p>comply with environmental law,</p></content></level><level class="para1" eId="section-26-2-b"><num>(b)</num><content><p>make effective environmental law, or</p></content></level><level class="para1" eId="section-26-2-c"><num>(c)</num><content><p>implement or apply environmental law effectively.</p></content></level></subsection><subsection eId="section-26-3"><num>(3)</num><content><p>Before preparing an improvement report in respect of any failure arising out of a public authority exercising its regulatory functions, Environmental Standards Scotland must be satisfied that the failure could not be addressed more effectively by issuing a compliance notice under section 31(1) instead.</p></content></subsection><subsection eId="section-26-4"><num>(4)</num><intro><p>An improvement report is a report setting out the details of the alleged failure and recommending measures that the Scottish Ministers, or any other public authority, should take in order to—</p></intro><level class="para1" eId="section-26-4-a"><num>(a)</num><content><p>comply with environmental law, or</p></content></level><level class="para1" eId="section-26-4-b"><num>(b)</num><content><p>improve the effectiveness of environmental law or of how it is implemented or applied.</p></content></level></subsection></section><section eId="section-27"><num>27</num><heading>Restrictions on preparing an improvement report</heading><intro><p>Environmental Standards Scotland may not prepare an improvement report in respect of—</p></intro><level class="para1" eId="section-27-a"><num>(a)</num><content><p>a failure to comply with environmental law arising out of any decision taken by a public authority in the exercise of its regulatory functions in relation to a particular person or case (for example, a decision on an application for a licence or a decision on regulatory enforcement in a specific case), or</p></content></level><level class="para1" eId="section-27-b"><num>(b)</num><intro><p>a failure to comply with environmental law arising out of particular conduct if—</p></intro><level class="para2" eId="section-27-b-i"><num>(i)</num><content><p>it has issued a compliance notice under section 31(1) in respect of the same failure arising out of the same conduct, and</p></content></level><level class="para2" eId="section-27-b-ii"><num>(ii)</num><content><p>it has not subsequently withdrawn the compliance notice under section 35(1).</p></content></level></level></section><section eId="section-28"><num>28</num><heading>Content of an improvement report</heading><intro><p>An improvement report must—</p></intro><level class="para1" eId="section-28-a"><num>(a)</num><intro><p>set out the grounds for preparing the report, including details of the alleged conduct and circumstances which have caused Environmental Standards Scotland to conclude that a public authority has failed, or (as the case may be) that two or more public authorities have collectively failed, to—</p></intro><level class="para2" eId="section-28-a-i"><num>(i)</num><content><p>comply with environmental law,</p></content></level><level class="para2" eId="section-28-a-ii"><num>(ii)</num><content><p>make effective environmental law, or</p></content></level><level class="para2" eId="section-28-a-iii"><num>(iii)</num><content><p>implement or apply environmental law effectively,</p></content></level></level><level class="para1" eId="section-28-b"><num>(b)</num><content><p>explain Environmental Standards Scotland’s reasons for reaching that conclusion (including details of the relevant environmental law and any evidence, research, expert advice or other information which it took into account),</p></content></level><level class="para1" eId="section-28-c"><num>(c)</num><content><p>set out the impact of the failure (including any environmental harm, risk of environmental harm or missed opportunity to improve the quality of the environment), and</p></content></level><level class="para1" eId="section-28-d"><num>(d)</num><content><p>propose a timescale for the Scottish Ministers, or other public authority, to take the remedial measures recommended in the report.</p></content></level></section><section eId="section-29"><num>29</num><heading>Improvement report: procedural requirements</heading><intro><p>Where Environmental Standards Scotland prepares an improvement report under section 26(1), it must—</p></intro><level class="para1" eId="section-29-a"><num>(a)</num><content><p>send a copy of the report to the Scottish Ministers,</p></content></level><level class="para1" eId="section-29-b"><num>(b)</num><content><p>lay a copy of the report before the Scottish Parliament, and</p></content></level><level class="para1" eId="section-29-c"><num>(c)</num><content><p>publish a copy of the report.</p></content></level></section><section eId="section-30"><num>30</num><heading>Improvement plan</heading><subsection eId="section-30-1"><num>(1)</num><content><p>Where Environmental Standards Scotland lays a copy of an improvement report before the Scottish Parliament under section 29, the Scottish Ministers must respond to the report by preparing an improvement plan.</p></content></subsection><subsection eId="section-30-2"><num>(2)</num><intro><p>An improvement plan must set out—</p></intro><level class="para1" eId="section-30-2-a"><num>(a)</num><intro><p>what the Scottish Ministers propose to do in response to the recommendations in the improvement report, including in particular—</p></intro><level class="para2" eId="section-30-2-a-i"><num>(i)</num><content><p>the measures that the Scottish Ministers propose to take to implement the recommendations (in full or in part),</p></content></level><level class="para2" eId="section-30-2-a-ii"><num>(ii)</num><content><p>the proposed timescale for implementing the recommendations,</p></content></level><level class="para2" eId="section-30-2-a-iii"><num>(iii)</num><content><p>the arrangements for reviewing, and reporting on, progress in implementing the recommendations, and</p></content></level></level><level class="para1" eId="section-30-2-b"><num>(b)</num><content><p>if the Scottish Ministers do not intend to implement the recommendations in the improvement report (in full or in part), the reasons for that.</p></content></level></subsection><subsection eId="section-30-3"><num>(3)</num><intro><p>The Scottish Ministers must lay a copy of the improvement plan before the Scottish Parliament either—</p></intro><level class="para1" eId="section-30-3-a"><num>(a)</num><content><p>before the end of the period of 6 months beginning with the date on which the improvement report was laid before the Parliament, or</p></content></level><level class="para1" eId="section-30-3-b"><num>(b)</num><content><p>before the end of the period of 9 months beginning with that date, if the Scottish Ministers consider that it is necessary to consult other persons (or the public more generally) about the plan.</p></content></level></subsection><subsection eId="section-30-4"><num>(4)</num><intro><p>When laying a copy of the improvement plan before the Scottish Parliament in accordance with subsection (3)(b), the Scottish Ministers must at the same time lay before the Parliament a statement setting out—</p></intro><level class="para1" eId="section-30-4-a"><num>(a)</num><content><p>details of the consultation about the plan that was carried out under that subsection,</p></content></level><level class="para1" eId="section-30-4-b"><num>(b)</num><content><p>a summary of any views expressed in response to the consultation, and</p></content></level><level class="para1" eId="section-30-4-c"><num>(c)</num><intro><p>either—</p></intro><level class="para2" eId="section-30-4-c-i"><num>(i)</num><content><p>details of how those views (if any) have been taken into account in preparing the plan that is laid before the Parliament, or</p></content></level><level class="para2" eId="section-30-4-c-ii"><num>(ii)</num><content><p>a statement that no views were expressed in response to the consultation or that no account has been taken of views expressed.</p></content></level></level></subsection><subsection eId="section-30-5"><num>(5)</num><intro><p>If, within 40 days of a copy of the improvement plan having been laid before the Scottish Parliament under subsection (3), the Parliament resolves that the plan should not be approved, the Scottish Ministers must—</p></intro><level class="para1" eId="section-30-5-a"><num>(a)</num><content><p>review and revise the plan, having regard to any views expressed by the Parliament in relation to the plan, and</p></content></level><level class="para1" eId="section-30-5-b"><num>(b)</num><content><p>lay a copy of a revised improvement plan before the Parliament before the end of the period of 3 months beginning with the date on which the Parliament resolved not to approve the plan.</p></content></level></subsection><subsection eId="section-30-6"><num>(6)</num><content><p>Subsection (5) applies in relation to any revised improvement plan as it applies in relation to the first improvement plan.</p></content></subsection><subsection eId="section-30-7"><num>(7)</num><content><p>Once the Scottish Parliament resolves that the improvement plan laid under subsection (3), or any revised improvement plan laid under subsection (5)(b), should be approved, the Scottish Ministers must publish the plan.</p></content></subsection><subsection eId="section-30-8"><num>(8)</num><content><p>In calculating the period of 40 days mentioned in subsection (5), no account is to be taken of any period during which the Parliament is dissolved or in recess for more than 4 days.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-compliance-notices"><heading>Compliance notices</heading><section eId="section-31"><num>31</num><heading>Compliance notice</heading><subsection eId="section-31-1"><num>(1)</num><intro><p>Environmental Standards Scotland may issue a compliance notice to a public authority if Environmental Standards Scotland considers that—</p></intro><level class="para1" eId="section-31-1-a"><num>(a)</num><intro><p>in exercising its regulatory functions, the public authority—</p></intro><level class="para2" eId="section-31-1-a-i"><num>(i)</num><content><p>is failing to comply with environmental law, or</p></content></level><level class="para2" eId="section-31-1-a-ii"><num>(ii)</num><content><p>has failed to comply with environmental law in circumstances that make it likely that the failure will continue or be repeated, and</p></content></level></level><level class="para1" eId="section-31-1-b"><num>(b)</num><content><p>its failure to comply with environmental law is causing, or has caused, environmental harm or a risk of environmental harm.</p></content></level></subsection><subsection eId="section-31-2"><num>(2)</num><content><p>A compliance notice is a notice requiring the public authority to whom it is issued to take the steps set out in the notice in order to address its failure to comply with environmental law.</p></content></subsection></section><section eId="section-32"><num>32</num><heading>Restrictions on issuing a compliance notice</heading><subsection eId="section-32-1"><num>(1)</num><intro><p>Environmental Standards Scotland may not issue a compliance notice in respect of—</p></intro><level class="para1" eId="section-32-1-a"><num>(a)</num><content><p>a failure to comply with environmental law arising out of any decision taken by a public authority in the exercise of its regulatory functions in relation to a particular person or case (for example, a decision on an application for a licence or a decision on regulatory enforcement in a specific case), or</p></content></level><level class="para1" eId="section-32-1-b"><num>(b)</num><content><p>a failure to comply with environmental law arising out of particular conduct if it has prepared an improvement report under section 26(1) or (2) in respect of the same failure arising out of the same conduct.</p></content></level></subsection><subsection eId="section-32-2"><num>(2)</num><content><p>A compliance notice issued in contravention of subsection (1) is of no effect.</p></content></subsection></section><section eId="section-33"><num>33</num><heading>Content of a compliance notice</heading><subsection eId="section-33-1"><num>(1)</num><intro><p>A compliance notice must include the following information—</p></intro><level class="para1" eId="section-33-1-a"><num>(a)</num><intro><p>a statement of the grounds for issuing the notice, including a statement of—</p></intro><level class="para2" eId="section-33-1-a-i"><num>(i)</num><content><p>the regulatory function of the public authority to which the alleged failure to comply with environmental law relates,</p></content></level><level class="para2" eId="section-33-1-a-ii"><num>(ii)</num><content><p>the provision of environmental law to which the alleged failure relates,</p></content></level><level class="para2" eId="section-33-1-a-iii"><num>(iii)</num><content><p>the alleged conduct which has caused Environmental Standards Scotland to conclude that the public authority is failing to comply with environmental law or has failed to comply with environmental law and the failure will likely continue or be repeated,</p></content></level><level class="para2" eId="section-33-1-a-iv"><num>(iv)</num><content><p>Environmental Standards Scotland’s reasons for reaching that conclusion, and</p></content></level><level class="para2" eId="section-33-1-a-v"><num>(v)</num><content><p>the environmental harm or risk of environmental harm being caused, or having been caused, by the alleged failure,</p></content></level></level><level class="para1" eId="section-33-1-b"><num>(b)</num><content><p>details of the steps that Environmental Standards Scotland requires the public authority to take in order to address its failure to comply with environmental law (which may include steps designed to remedy or mitigate, or prevent any continuance or repeat of, the failure),</p></content></level><level class="para1" eId="section-33-1-c"><num>(c)</num><content><p>the date of issue of the notice,</p></content></level><level class="para1" eId="section-33-1-d"><num>(d)</num><content><p>the period within which the required steps are to be taken,</p></content></level><level class="para1" eId="section-33-1-e"><num>(e)</num><content><p>information about the person to whom, and as to how and by when, any representations about the notice may be made,</p></content></level><level class="para1" eId="section-33-1-f"><num>(f)</num><content><p>information about the right to appeal, including the period within which an appeal may be made, and</p></content></level><level class="para1" eId="section-33-1-g"><num>(g)</num><content><p>an explanation of the consequences of failure to comply with the requirements of the notice.</p></content></level></subsection><subsection eId="section-33-2"><num>(2)</num><content><p>The reference in subsection (1)(d) to the period within which the required steps are to be taken is a reference to such period of not less than 28 days, beginning with the date on which the notice was issued, as Environmental Standards Scotland determines.</p></content></subsection></section><section eId="section-34"><num>34</num><heading>Variation of a compliance notice</heading><subsection eId="section-34-1"><num>(1)</num><content><p>Environmental Standards Scotland may vary a compliance notice so as to extend the period mentioned in section 33(1)(d) (“the compliance period”).</p></content></subsection><subsection eId="section-34-2"><num>(2)</num><intro><p>A compliance notice may be varied under subsection (1)—</p></intro><level class="para1" eId="section-34-2-a"><num>(a)</num><content><p>at any time before expiry of the compliance period,</p></content></level><level class="para1" eId="section-34-2-b"><num>(b)</num><content><p>by giving notice in writing to that effect to the public authority to whom the compliance notice was issued.</p></content></level></subsection><subsection eId="section-34-3"><num>(3)</num><content><p>The variation of a compliance notice under subsection (1) does not affect the date of its issue for the purpose of section 36(2)(a).</p></content></subsection></section><section eId="section-35"><num>35</num><heading>Withdrawal of a compliance notice</heading><subsection eId="section-35-1"><num>(1)</num><content><p>Environmental Standards Scotland may withdraw a compliance notice.</p></content></subsection><subsection eId="section-35-2"><num>(2)</num><intro><p>A compliance notice may be withdrawn under subsection (1)—</p></intro><level class="para1" eId="section-35-2-a"><num>(a)</num><content><p>at any time before completion of the steps that are to be taken to comply with the requirements of the notice,</p></content></level><level class="para1" eId="section-35-2-b"><num>(b)</num><content><p>by giving notice in writing to that effect to the public authority to whom the compliance notice was issued.</p></content></level></subsection><subsection eId="section-35-3"><num>(3)</num><content><p>Where a compliance notice is withdrawn under subsection (1), it is to be treated as if it had never been issued.</p></content></subsection></section><section eId="section-36"><num>36</num><heading>Appeal against a compliance notice</heading><subsection eId="section-36-1"><num>(1)</num><intro><p>A public authority to whom a compliance notice has been issued may appeal to a sheriff against Environmental Standards Scotland’s decision to issue the notice on the ground that—</p></intro><level class="para1" eId="section-36-1-a"><num>(a)</num><content><p>it has not conducted itself in the manner alleged in the notice,</p></content></level><level class="para1" eId="section-36-1-b"><num>(b)</num><intro><p>the alleged conduct specified in the notice does not constitute—</p></intro><level class="para2" eId="section-36-1-b-i"><num>(i)</num><content><p>a failure to comply with environmental law, or</p></content></level><level class="para2" eId="section-36-1-b-ii"><num>(ii)</num><content><p>a failure to comply with environmental law in circumstances that make it likely that the failure will continue or be repeated, or</p></content></level></level><level class="para1" eId="section-36-1-c"><num>(c)</num><content><p>the alleged failure to comply with environmental law specified in the notice is not causing, or has not caused, environmental harm or a risk of environmental harm.</p></content></level></subsection><subsection eId="section-36-2"><num>(2)</num><intro><p>An appeal under this section—</p></intro><level class="para1" eId="section-36-2-a"><num>(a)</num><content><p>must be made before the expiry of the period of 21 days beginning with the date of issue of the notice (“the 21-day period”), but</p></content></level><level class="para1" eId="section-36-2-b"><num>(b)</num><content><p>may be made later with the sheriff’s permission.</p></content></level></subsection><subsection eId="section-36-3"><num>(3)</num><content><p>The sheriff may give permission under subsection (2)(b) for an appeal to be made after the expiry of the 21-day period only if the sheriff is satisfied that the public authority has a good reason for not making the appeal before the expiry of that period.</p></content></subsection><subsection eId="section-36-4"><num>(4)</num><intro><p>In determining an appeal under this section, the sheriff may—</p></intro><level class="para1" eId="section-36-4-a"><num>(a)</num><content><p>cancel the compliance notice, or</p></content></level><level class="para1" eId="section-36-4-b"><num>(b)</num><content><p>confirm the notice, either with or without modifications.</p></content></level></subsection><subsection eId="section-36-5"><num>(5)</num><content><p>Where an appeal is made under this section, the period mentioned in section 33(1)(d) is suspended until the appeal is finally determined or is withdrawn.</p></content></subsection></section><section eId="section-37"><num>37</num><heading>Failure to comply with a compliance notice</heading><subsection eId="section-37-1"><num>(1)</num><content><p>Where a public authority fails, without reasonable excuse, to comply with a compliance notice issued to it under section 31(1), Environmental Standards Scotland may report the matter to the Court of Session.</p></content></subsection><subsection eId="section-37-2"><num>(2)</num><intro><p>After receiving a report under subsection (1), and hearing any evidence or representations on the matter, the Court may (either or both)—</p></intro><level class="para1" eId="section-37-2-a"><num>(a)</num><content><p>make such order for enforcement as it considers appropriate,</p></content></level><level class="para1" eId="section-37-2-b"><num>(b)</num><content><p>deal with the matter as if it were a contempt of the Court.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-judicial-review-and-other-civil-proceedings"><heading>Judicial review and other civil proceedings</heading><section eId="section-38"><num>38</num><heading>Power to apply for judicial review or intervene in civil proceedings</heading><subsection eId="section-38-1"><num>(1)</num><intro><p>Environmental Standards Scotland may make an application for judicial review in relation to a public authority’s conduct (whether or not it has issued a compliance notice or prepared an improvement report in respect of that conduct) if Environmental Standards Scotland considers that—</p></intro><level class="para1" eId="section-38-1-a"><num>(a)</num><content><p>the conduct constitutes a serious failure to comply with environmental law, and</p></content></level><level class="para1" eId="section-38-1-b"><num>(b)</num><content><p>it is necessary to make the application to prevent, or mitigate, serious environmental harm.</p></content></level></subsection><subsection eId="section-38-2"><num>(2)</num><content><p>Subsection (3) applies where legal proceedings relate to an alleged failure by a public authority to comply with environmental law (however the allegation is framed in those proceedings).</p></content></subsection><subsection eId="section-38-3"><num>(3)</num><content><p>Environmental Standards Scotland may, either with the court’s permission or at the court’s invitation, intervene in the proceedings for the purpose of making a submission to the court on an issue arising in the proceedings.</p></content></subsection><subsection eId="section-38-4"><num>(4)</num><intro><p>Environmental Standards Scotland may apply under subsection (3) to intervene in proceedings only if it considers that—</p></intro><level class="para1" eId="section-38-4-a"><num>(a)</num><content><p>the allegation relates to a serious failure by a public authority to comply with environmental law, and</p></content></level><level class="para1" eId="section-38-4-b"><num>(b)</num><content><p>it is necessary to intervene to prevent, or mitigate, serious environmental harm.</p></content></level></subsection><subsection eId="section-38-5"><num>(5)</num><content><p>The court may grant permission to, or invite, Environmental Standards Scotland to intervene under subsection (3) only if it is satisfied that Environmental Standards Scotland’s intervention is likely to assist the court.</p></content></subsection><subsection eId="section-38-6"><num>(6)</num><content><p>For the purpose of subsection (1) or (3), Environmental Standards Scotland is to be treated as having sufficient interest in the subject matter of any application which it may make or of any legal proceedings in which it may intervene.</p></content></subsection><subsection eId="section-38-7"><num>(7)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“court” means the Court of Session, the sheriff, the Sheriff Appeal Court or the Scottish Land Court,</p></content></hcontainer><hcontainer name="definition"><content><p>“legal proceedings” means civil proceedings before a court, including appeal proceedings and proceedings on an application for judicial review.</p></content></hcontainer></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-disclosure-of-information"><heading>Disclosure of information</heading><section eId="section-39"><num>39</num><heading>Disclosure of information to Environmental Standards Scotland</heading><subsection eId="section-39-1"><num>(1)</num><intro><p>No enactment or rule of law prohibiting or restricting the disclosure of information prevents a public authority from providing Environmental Standards Scotland with information necessary for the exercise of Environmental Standards Scotland’s functions in accordance with—</p></intro><level class="para1" eId="section-39-1-a"><num>(a)</num><content><p>the authority’s duty to co-operate under section 23(1), or</p></content></level><level class="para1" eId="section-39-1-b"><num>(b)</num><content><p>an information notice issued under section 24(1).</p></content></level></subsection><subsection eId="section-39-2"><num>(2)</num><intro><p>But nothing in this Chapter requires a public authority to provide Environmental Standards Scotland with information that the authority—</p></intro><level class="para1" eId="section-39-2-a"><num>(a)</num><content><p>would be entitled to refuse to provide in civil proceedings on grounds of confidentiality of communications, or</p></content></level><level class="para1" eId="section-39-2-b"><num>(b)</num><content><p>would be entitled, or required by any rule of law, to refuse to provide in civil proceedings on grounds of public interest immunity.</p></content></level></subsection><subsection eId="section-39-3"><num>(3)</num><content><p>Nothing in this Chapter requires or authorises a disclosure of information which, although made in accordance with a duty or a power provided for in this Chapter, would contravene the data protection legislation.</p></content></subsection><subsection eId="section-39-4"><num>(4)</num><content><p>In subsection (3), “the data protection legislation” has the same meaning as in the Data Protection Act 2018 (see section 3(9) of that Act).</p></content></subsection></section><section eId="section-40"><num>40</num><heading>Confidentiality of proceedings</heading><subsection eId="section-40-1"><num>(1)</num><intro><p>Environmental Standards Scotland must not disclose—</p></intro><level class="para1" eId="section-40-1-a"><num>(a)</num><content><p>information obtained under section 23(1) or 24(1), or</p></content></level><level class="para1" eId="section-40-1-b"><num>(b)</num><intro><p>correspondence between Environmental Standards Scotland and a public authority that—</p></intro><level class="para2" eId="section-40-1-b-i"><num>(i)</num><content><p>relates to a particular information notice or compliance notice, or to the preparation of a particular improvement report,</p></content></level><level class="para2" eId="section-40-1-b-ii"><num>(ii)</num><content><p>is, or contains, such a notice or an unpublished draft of such a report.</p></content></level></level></subsection><subsection eId="section-40-2"><num>(2)</num><intro><p>Subsection (1) does not apply to—</p></intro><level class="para1" eId="section-40-2-a"><num>(a)</num><content><p>a disclosure (other than a disclosure of an information notice, a compliance notice or an unpublished draft of an improvement report) made with the consent of the public authority who provided the information or correspondence,</p></content></level><level class="para1" eId="section-40-2-b"><num>(b)</num><content><p>a disclosure made for purposes connected with the exercise of Environmental Standards Scotland’s functions,</p></content></level><level class="para1" eId="section-40-2-c"><num>(c)</num><content><p>a disclosure made to the Office for Environmental Protection, or any other environmental governance body, for purposes connected with the exercise of an environmental governance function,</p></content></level><level class="para1" eId="section-40-2-d"><num>(d)</num><content><p>a disclosure of information, or correspondence, that relates only to a matter in relation to which Environmental Standards Scotland does not intend to take any further action under this Chapter,</p></content></level><level class="para1" eId="section-40-2-e"><num>(e)</num><content><p>a disclosure made for the purposes of civil proceedings,</p></content></level><level class="para1" eId="section-40-2-f"><num>(f)</num><content><p>a disclosure made for the purposes of the investigation or prosecution of any offence or suspected offence or for the purposes of the prevention or detection of crime,</p></content></level><level class="para1" eId="section-40-2-g"><num>(g)</num><content><p>a disclosure made in pursuance of an order of a court or tribunal,</p></content></level><level class="para1" eId="section-40-2-h"><num>(h)</num><content><p>a disclosure made in accordance with any other enactment requiring or permitting the disclosure.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-duty-to-consult-on-effectiveness-of-governance-arrangements"><heading>Duty to consult on effectiveness of governance arrangements</heading><section eId="section-41"><num>41</num><heading>Duty to consult on effectiveness of governance arrangements</heading><subsection eId="section-41-1"><num>(1)</num><intro><p>The Scottish Ministers must—</p></intro><level class="para1" eId="section-41-1-a"><num>(a)</num><content><p>prepare a report on the matters mentioned in subsection (2), and</p></content></level><level class="para1" eId="section-41-1-b"><num>(b)</num><content><p>after preparing the report, consult the persons mentioned in subsection (3).</p></content></level></subsection><subsection eId="section-41-2"><num>(2)</num><intro><p>The matters referred to in subsection (1)(a) are—</p></intro><level class="para1" eId="section-41-2-a"><num>(a)</num><content><p>whether the provisions of this Chapter have ensured that there continues to be effective and appropriate governance relating to the environment following the withdrawal of the United Kingdom from the EU,</p></content></level><level class="para1" eId="section-41-2-b"><num>(b)</num><content><p>whether the law in Scotland on access to justice on environmental matters is effective and sufficient, and</p></content></level><level class="para1" eId="section-41-2-c"><num>(c)</num><content><p>whether and, if so, how the establishment of an environmental court could enhance the governance arrangements referred to in paragraph (a).</p></content></level></subsection><subsection eId="section-41-3"><num>(3)</num><intro><p>The persons referred to in subsection (1)(b) are—</p></intro><level class="para1" eId="section-41-3-a"><num>(a)</num><content><p>Environmental Standards Scotland,</p></content></level><level class="para1" eId="section-41-3-b"><num>(b)</num><content><p>such persons as appear to the Scottish Ministers to be representative of the interests of persons likely to be affected by the governance arrangements referred to in subsection (2)(a), and</p></content></level><level class="para1" eId="section-41-3-c"><num>(c)</num><content><p>such other persons as the Scottish Ministers consider appropriate.</p></content></level></subsection><subsection eId="section-41-4"><num>(4)</num><content><p>The consultation under subsection (1)(b) must begin before the end of the period of 6 months beginning with the date on which Environmental Standards Scotland publishes the strategy under section 22(1).</p></content></subsection><subsection eId="section-41-5"><num>(5)</num><content><p>The Scottish Ministers must, as soon as reasonably practicable after the consultation under subsection (1)(b) begins, lay before the Scottish Parliament a copy of the consultation document.</p></content></subsection><subsection eId="section-41-6"><num>(6)</num><intro><p>Following the consultation under subsection (1)(b), the Scottish Ministers must lay before the Scottish Parliament a statement setting out—</p></intro><level class="para1" eId="section-41-6-a"><num>(a)</num><content><p>details of the consultation that was carried out under subsection (1)(b),</p></content></level><level class="para1" eId="section-41-6-b"><num>(b)</num><content><p>a summary of any views expressed in response to the consultation, and</p></content></level><level class="para1" eId="section-41-6-c"><num>(c)</num><content><p>the Scottish Ministers’ recommendations in response to those views.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-chapter-2-crossheading-interpretation-of-chapter-2"><heading>Interpretation of Chapter 2</heading><section eId="section-42"><num>42</num><heading>Meaning of “public authority”</heading><intro><p>In this Chapter, “public authority” means a person exercising any function of a public nature that is not—</p></intro><level class="para1" eId="section-42-a"><num>(a)</num><intro><p>a function of any of the following persons—</p></intro><level class="para2" eId="section-42-a-i"><num>(i)</num><content><p>Environmental Standards Scotland,</p></content></level><level class="para2" eId="section-42-a-ii"><num>(ii)</num><content><p>a court or tribunal,</p></content></level><level class="para2" eId="section-42-a-iii"><num>(iii)</num><content><p>the Scottish Parliament,</p></content></level><level class="para2" eId="section-42-a-iv"><num>(iv)</num><content><p>the Parliament of the United Kingdom,</p></content></level><level class="para2" eId="section-42-a-v"><num>(v)</num><content><p>a Minister of the Crown (within the meaning of the Ministers of the Crown Act 1975),</p></content></level><level class="para2" eId="section-42-a-vi"><num>(vi)</num><content><p>a body to which paragraph 3 (reserved bodies) of Part III of schedule 5 of the Scotland Act 1998 applies, or</p></content></level></level><level class="para1" eId="section-42-b"><num>(b)</num><content><p>a function in connection with proceedings in the Scottish Parliament or the Parliament of the United Kingdom.</p></content></level></section><section eId="section-43"><num>43</num><heading>Meaning of “failing to comply with environmental law”</heading><intro><p>For the purposes of this Chapter, any reference (however expressed) to a public authority failing (or having failed) to comply with environmental law is a reference to any of the following conduct by the authority—</p></intro><level class="para1" eId="section-43-a"><num>(a)</num><content><p>the authority failing (or having failed) to take proper account of environmental law when exercising its functions,</p></content></level><level class="para1" eId="section-43-b"><num>(b)</num><content><p>the authority exercising (or having exercised) its functions in a way that is contrary to, or incompatible with, environmental law,</p></content></level><level class="para1" eId="section-43-c"><num>(c)</num><content><p>the authority failing (or having failed) to exercise its functions where the failure is contrary to, or incompatible with, environmental law,</p></content></level><wrapUp><p>and references to “compliance with environmental law” are to be construed accordingly.</p></wrapUp></section><section eId="section-44"><num>44</num><heading>Meaning of “environmental law” and “effectiveness of environmental law”</heading><subsection eId="section-44-1"><num>(1)</num><intro><p>In this Chapter, “environmental law” means any legislative provision to the extent that it—</p></intro><level class="para1" eId="section-44-1-a"><num>(a)</num><content><p>is mainly concerned with environmental protection, and</p></content></level><level class="para1" eId="section-44-1-b"><num>(b)</num><content><p>is not concerned with an excluded matter.</p></content></level></subsection><subsection eId="section-44-2"><num>(2)</num><intro><p>Excluded matters are—</p></intro><level class="para1" eId="section-44-2-a"><num>(a)</num><content><p>disclosure of, or access to, information,</p></content></level><level class="para1" eId="section-44-2-b"><num>(b)</num><content><p>national defence or civil emergency,</p></content></level><level class="para1" eId="section-44-2-c"><num>(c)</num><content><p>finance or budgets.</p></content></level></subsection><subsection eId="section-44-3"><num>(3)</num><intro><p>In subsection (1), “legislative provision” means—</p></intro><level class="para1" eId="section-44-3-a"><num>(a)</num><content><p>provision contained in, or in an instrument made under, an Act of the Scottish Parliament, and</p></content></level><level class="para1" eId="section-44-3-b"><num>(b)</num><content><p>provision contained in any other enactment which, if contained in an Act of the Scottish Parliament, would be within the legislative competence of the Parliament.</p></content></level></subsection><subsection eId="section-44-4"><num>(4)</num><content><p>The Scottish Ministers may by regulations provide that a legislative provision specified in the regulations is, or is not, within the definition of “environmental law” in subsection (1) (and this Chapter applies accordingly).</p></content></subsection><subsection eId="section-44-5"><num>(5)</num><content><p>Regulations under subsection (4) are subject to the affirmative procedure.</p></content></subsection><subsection eId="section-44-6"><num>(6)</num><intro><p>Before laying a draft of regulations under subsection (4) before the Scottish Parliament for approval, the Scottish Ministers must consult—</p></intro><level class="para1" eId="section-44-6-a"><num>(a)</num><content><p>Environmental Standards Scotland, and</p></content></level><level class="para1" eId="section-44-6-b"><num>(b)</num><content><p>such other persons as the Scottish Ministers consider appropriate.</p></content></level></subsection><subsection eId="section-44-7"><num>(7)</num><intro><p>In this Chapter, references to the effectiveness of environmental law are references to the effectiveness of environmental law, or any particular aspect of it—</p></intro><level class="para1" eId="section-44-7-a"><num>(a)</num><intro><p>in achieving its intended effect by reference to its contribution to—</p></intro><level class="para2" eId="section-44-7-a-i"><num>(i)</num><content><p>environmental protection, and</p></content></level><level class="para2" eId="section-44-7-a-ii"><num>(ii)</num><content><p>improving the health and wellbeing of Scotland’s people, and achieving sustainable economic growth, so far as consistent with environmental protection, and</p></content></level></level><level class="para1" eId="section-44-7-b"><num>(b)</num><content><p>in contributing to the implementation of any international obligation of the United Kingdom relating to environmental protection,</p></content></level><wrapUp><p>and references to “effective environmental law” are to be construed accordingly.</p></wrapUp></subsection></section><section eId="section-45"><num>45</num><heading>Meaning of “environmental protection”, “environmental harm” and “the environment”</heading><subsection eId="section-45-1"><num>(1)</num><intro><p>In this Chapter, “environmental protection” means—</p></intro><level class="para1" eId="section-45-1-a"><num>(a)</num><content><p>protecting, maintaining, restoring or improving the quality of the environment,</p></content></level><level class="para1" eId="section-45-1-b"><num>(b)</num><content><p>preventing, mitigating, minimising or remedying environmental harm caused by human activities,</p></content></level><level class="para1" eId="section-45-1-c"><num>(c)</num><content><p>monitoring, considering, assessing, recording, reporting on or managing data on anything relating to paragraphs (a) and (b).</p></content></level></subsection><subsection eId="section-45-2"><num>(2)</num><intro><p>In this Chapter, “environmental harm” means—</p></intro><level class="para1" eId="section-45-2-a"><num>(a)</num><content><p>harm to the health of human beings, animals, plants or any other living organisms,</p></content></level><level class="para1" eId="section-45-2-b"><num>(b)</num><intro><p>harm to the quality of the environment, including—</p></intro><level class="para2" eId="section-45-2-b-i"><num>(i)</num><content><p>harm to the quality of the environment taken as a whole,</p></content></level><level class="para2" eId="section-45-2-b-ii"><num>(ii)</num><content><p>harm to the quality of air, water or land, and</p></content></level><level class="para2" eId="section-45-2-b-iii"><num>(iii)</num><content><p>other impairment of, or interference with, biodiversity or ecosystems,</p></content></level></level><level class="para1" eId="section-45-2-c"><num>(c)</num><content><p>offence to the senses of human beings,</p></content></level><level class="para1" eId="section-45-2-d"><num>(d)</num><content><p>damage to property, or</p></content></level><level class="para1" eId="section-45-2-e"><num>(e)</num><content><p>impairment of, or interference with, amenities or other legitimate uses of the environment.</p></content></level></subsection><subsection eId="section-45-3"><num>(3)</num><intro><p>In this Chapter, “the environment”—</p></intro><level class="para1" eId="section-45-3-a"><num>(a)</num><content><p>means all, or any, of the air, water and land (including the earth’s crust), and “air” includes the air within buildings and the air within other natural or man-made structures above or below ground, and</p></content></level><level class="para1" eId="section-45-3-b"><num>(b)</num><content><p>includes wild animal and plant life and the habitats of wild animal and plant life.</p></content></level></subsection><subsection eId="section-45-4"><num>(4)</num><intro><p>In subsection (1), “human activities”—</p></intro><level class="para1" eId="section-45-4-a"><num>(a)</num><content><p>means human activities of any kind (whether industrial, commercial or otherwise), and any connected activities, that are capable of causing, or liable to cause, environmental harm, and</p></content></level><level class="para1" eId="section-45-4-b"><num>(b)</num><content><p>includes (with or without other activities) the production, treatment, keeping, depositing or disposal of any substance.</p></content></level></subsection><subsection eId="section-45-5"><num>(5)</num><content><p>In subsection (3)(b), “animal and plant life” includes any living organisms.</p></content></subsection></section><section eId="section-46"><num>46</num><heading>Interpretation of Chapter 2: general</heading><subsection eId="section-46-1"><num>(1)</num><intro><p>In this Chapter—</p></intro><hcontainer name="definition"><content><p>“application for judicial review” means an application to the supervisory jurisdiction of the Court of Session,</p></content></hcontainer><hcontainer name="definition"><content><p>“compliance notice” means a notice issued under section 31(1),</p></content></hcontainer><hcontainer name="definition"><content><p>“the environment” has the meaning given by section 45(3),</p></content></hcontainer><hcontainer name="definition"><content><p>“environmental governance body” means a person on whom an environmental governance function has been conferred,</p></content></hcontainer><hcontainer name="definition"><content><p>“environmental governance function” means a function that is similar to a function conferred on Environmental Standards Scotland,</p></content></hcontainer><hcontainer name="definition"><content><p>“environmental harm” has the meaning given by section 45(2),</p></content></hcontainer><hcontainer name="definition"><content><p>“environmental law”, “effectiveness of environmental law” and “effective environmental law” have the meanings given by section 44,
“environmental protection” has the meaning given by section 45(1),</p></content></hcontainer><hcontainer name="definition"><content><p>“improvement report” means a report prepared under section 26(1) or (2),</p></content></hcontainer><hcontainer name="definition"><content><p>“information notice” means a notice issued under section 24(1),</p></content></hcontainer><hcontainer name="definition"><content><p>“international environmental protection legislation” means legislation of countries and territories outwith Scotland (including legislation of other parts of the United Kingdom), and of international organisations (including the EU), that is mainly concerned with environmental protection,</p></content></hcontainer><hcontainer name="definition"><content><p>“international obligation of the United Kingdom” includes any obligation that arises or may arise under an international agreement or arrangement to which the United Kingdom is a party,</p></content></hcontainer><hcontainer name="definition"><content><p>“Office for Environmental Protection” has the meaning given by section 21 of the Environment Act 2021,</p></content></hcontainer><hcontainer name="definition"><content><p>“public authority” has the meaning given by section 42,</p></content></hcontainer><hcontainer name="definition"><intro><p>“regulatory functions” means—</p></intro><level class="para1"><num>(a)</num><content><p>functions conferred by or under any enactment of—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>imposing requirements, restrictions or conditions in relation to an activity,</p></item><item><num>(ii)</num><p>setting standards and outcomes in relation to an activity, or</p></item><item><num>(iii)</num><p>giving guidance in relation to an activity, or</p></item></blockList></content></level><level class="para1"><num>(b)</num><content><p>functions which relate to the securing of compliance with, or enforcement of, requirements, restrictions, conditions, standards, outcomes or guidance which by or under any enactment relate to an activity,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“strategy” means a strategy prepared under section 22(1).</p></content></hcontainer></subsection><subsection eId="section-46-2"><num>(2)</num><intro><p>In this Chapter, references (however expressed) to—</p></intro><level class="para1" eId="section-46-2-a"><num>(a)</num><content><p>a public authority failing to comply with environmental law are to be construed in accordance with section 43,</p></content></level><level class="para1" eId="section-46-2-b"><num>(b)</num><intro><p>a public authority failing to make effective environmental law are references to the authority—</p></intro><level class="para2" eId="section-46-2-b-i"><num>(i)</num><content><p>failing to exercise any function it has of making, confirming or approving subordinate legislation, or</p></content></level><level class="para2" eId="section-46-2-b-ii"><num>(ii)</num><content><p>failing to exercise that function in such a way,</p></content></level><wrapUp><p>so as to secure the effectiveness of environmental law.</p></wrapUp></level></subsection></section></hcontainer></chapter><chapter eId="part-2-chapter-3"><num>CHAPTER 3</num><heading>ENVIRONMENTAL POLICY STRATEGY</heading><section eId="section-47"><num>47</num><heading>Environmental policy strategy</heading><subsection eId="section-47-1"><num>(1)</num><content><p>The Scottish Ministers must prepare and publish an environmental policy strategy.</p></content></subsection><subsection eId="section-47-2"><num>(2)</num><intro><p>The strategy must set out—</p></intro><level class="para1" eId="section-47-2-a"><num>(a)</num><content><p>objectives for protecting and improving the environment,</p></content></level><level class="para1" eId="section-47-2-b"><num>(b)</num><content><p>policies and proposals for achieving the objectives (or a summary or indication of such polices and proposals), and</p></content></level><level class="para1" eId="section-47-2-c"><num>(c)</num><content><p>arrangements for monitoring progress towards achieving the objectives.</p></content></level></subsection><subsection eId="section-47-3"><num>(3)</num><intro><p>In preparing the strategy the Scottish Ministers must have regard to the desirability of securing that environmental policy—</p></intro><level class="para1" eId="section-47-3-a"><num>(a)</num><content><p>aims at a high level of environmental protection,</p></content></level><level class="para1" eId="section-47-3-b"><num>(b)</num><content><p>contributes to sustainable development,</p></content></level><level class="para1" eId="section-47-3-c"><num>(c)</num><content><p>contributes to improving the health and wellbeing of Scotland’s people,</p></content></level><level class="para1" eId="section-47-3-d"><num>(d)</num><content><p>contributes to objectives in policy areas other than environmental policy,</p></content></level><level class="para1" eId="section-47-3-e"><num>(e)</num><content><p>integrates environmental policy objectives into the development of policies in other areas,</p></content></level><level class="para1" eId="section-47-3-f"><num>(f)</num><content><p>responds to global crises in relation to climate change and biodiversity.</p></content></level></subsection><subsection eId="section-47-4"><num>(4)</num><content><p>The strategy may consist of one or more documents (and the reference in subsection (3)  to the strategy includes any document forming part of it).</p></content></subsection><subsection eId="section-47-5"><num>(5)</num><content><p>The Scottish Ministers may designate one or more documents as forming the strategy or part of the strategy, whether the document or documents was or were prepared before or after this section comes into force (and whether before or after the Bill for this Act was passed).</p></content></subsection><subsection eId="section-47-6"><num>(6)</num><intro><p>In preparing the strategy or any document forming part of it, and before designating any document as forming the strategy or part of the strategy, the Scottish Ministers must consult—</p></intro><level class="para1" eId="section-47-6-a"><num>(a)</num><content><p>such persons as they consider would be likely to be affected by the proposals in the strategy or document,</p></content></level><level class="para1" eId="section-47-6-b"><num>(b)</num><content><p>such persons as they consider have appropriate expertise or experience in relation to the matters covered by the strategy or document,</p></content></level><level class="para1" eId="section-47-6-c"><num>(c)</num><content><p>such other persons (if any) as they consider appropriate.</p></content></level></subsection><subsection eId="section-47-7"><num>(7)</num><content><p>For the purpose of subsection (6), it is immaterial that anything done by way of consultation was done before this section comes into force (whether before or after the Bill for this Act was passed).</p></content></subsection><subsection eId="section-47-8"><num>(8)</num><intro><p>Before publishing the strategy or any document forming part of it, the Scottish Ministers must lay before the Scottish Parliament—</p></intro><level class="para1" eId="section-47-8-a"><num>(a)</num><content><p>a copy of the strategy or document, and</p></content></level><level class="para1" eId="section-47-8-b"><num>(b)</num><intro><p>a statement setting out—</p></intro><level class="para2" eId="section-47-8-b-i"><num>(i)</num><content><p>details of the consultation about the strategy or document that was carried out under subsection (6),</p></content></level><level class="para2" eId="section-47-8-b-ii"><num>(ii)</num><content><p>a summary of any views expressed in response to the consultation, and</p></content></level><level class="para2" eId="section-47-8-b-iii"><num>(iii)</num><content><p>either details of how those views (if any) have been taken into account in preparing the strategy or document or a statement that no views were expressed in response to the consultation or that no account has been taken of views expressed.</p></content></level></level></subsection><subsection eId="section-47-9"><num>(9)</num><intro><p>The Scottish Ministers—</p></intro><level class="para1" eId="section-47-9-a"><num>(a)</num><content><p>must from time to time review the strategy, and</p></content></level><level class="para1" eId="section-47-9-b"><num>(b)</num><content><p>may revise the strategy or any document forming part of it.</p></content></level></subsection><subsection eId="section-47-10"><num>(10)</num><content><p>Subsections (3) and (6) to (8) apply to the preparation and publication of a revised strategy or any document forming part of it as they apply to the preparation and publication of the first strategy or any document forming part of it.</p></content></subsection><subsection eId="section-47-11"><num>(11)</num><content><p>The Scottish Ministers must, in making policies (including proposals for legislation), have due regard to the strategy.</p></content></subsection><subsection eId="section-47-12"><num>(12)</num><content><p>The Scottish Ministers must, before the end of each reporting period, lay before the Scottish Parliament a report containing an explanation of progress towards preparation of the strategy.</p></content></subsection><subsection eId="section-47-13"><num>(13)</num><intro><p>The reporting periods are—</p></intro><level class="para1" eId="section-47-13-a"><num>(a)</num><content><p>the period of one year beginning with the day on which this section comes into force,</p></content></level><level class="para1" eId="section-47-13-b"><num>(b)</num><content><p>each subsequent period of one year while the duty under subsection (12) has effect.</p></content></level></subsection><subsection eId="section-47-14"><num>(14)</num><content><p>The duty under subsection (12) ceases to have effect when a copy of the strategy or any document forming part of it is laid before the Scottish Parliament under subsection (8) provided that consultation in accordance with subsection (6) was carried out in relation to the strategy or document after this section comes into force.</p></content></subsection><subsection eId="section-47-15"><num>(15)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“the environment” and “environmental protection” have the meanings given by section 45,</p></content></hcontainer><hcontainer name="definition"><content><p>“making policies” includes developing, adopting and revising policies.</p></content></hcontainer></subsection></section></chapter></part><part eId="part-3"><num>PART 3</num><heading>GENERAL</heading><section eId="section-48"><num>48</num><heading>Purpose and effect of this Act</heading><subsection eId="section-48-1"><num>(1)</num><content><p>The purpose of this Act is to make provision in connection with the withdrawal of the United Kingdom from the EU in consequence of the notification given under section 1 of the European Union (Notification of Withdrawal) Act 2017 (“UK withdrawal”).</p></content></subsection><subsection eId="section-48-2"><num>(2)</num><content><p>In so far as any provision of this Act, or any provision made under it, would, if it were in effect before the relevant time, be incompatible with EU law, the provision is to have no effect until the relevant time.</p></content></subsection><subsection eId="section-48-3"><num>(3)</num><content><p>In subsection (2), “the relevant time”, in relation to any provision of this Act or any provision made under it, means the time at which the provision of EU law with which it would be incompatible ceases to have effect in Scots law as a consequence of UK withdrawal.</p></content></subsection><subsection eId="section-48-4"><num>(4)</num><content><p>For the purposes of this section, “EU law” has the same meaning as in the Scotland Act 1998 (see section 126(9) of that Act).</p></content></subsection></section><section eId="section-49"><num>49</num><heading>Regulations: supplementary</heading><subsection eId="section-49-1"><num>(1)</num><intro><p>Any power conferred by this Act on the Scottish Ministers to make regulations includes the power to make—</p></intro><level class="para1" eId="section-49-1-a"><num>(a)</num><content><p>different provision for different purposes, and</p></content></level><level class="para1" eId="section-49-1-b"><num>(b)</num><content><p>incidental, supplementary, consequential, transitional, transitory or saving provision.</p></content></level></subsection><subsection eId="section-49-2"><num>(2)</num><content><p>This section does not apply to regulations under section 51.</p></content></subsection></section><section eId="section-50"><num>50</num><heading>Ancillary provision</heading><subsection eId="section-50-1"><num>(1)</num><content><p>The Scottish Ministers may by regulations make any incidental, supplementary, consequential, transitional, transitory or saving provision they consider necessary for the purposes of, in connection with or for giving full effect to this Act or any provision made under it.</p></content></subsection><subsection eId="section-50-2"><num>(2)</num><content><p>Regulations under this section may modify any enactment (including this Act).</p></content></subsection><subsection eId="section-50-3"><num>(3)</num><intro><p>Regulations under this section—</p></intro><level class="para1" eId="section-50-3-a"><num>(a)</num><content><p>are subject to the affirmative procedure if they contain provision that adds to, replaces or omits any part of the text of an Act,</p></content></level><level class="para1" eId="section-50-3-b"><num>(b)</num><content><p>otherwise are subject to the negative procedure.</p></content></level></subsection></section><section eId="section-51"><num>51</num><heading>Commencement</heading><subsection eId="section-51-1"><num>(1)</num><content><p>This Part comes into force on the day after Royal Assent.</p></content></subsection><subsection eId="section-51-2"><num>(2)</num><content><p>The other provisions of this Act come into force on such day as the Scottish Ministers may by regulations appoint.</p></content></subsection><subsection eId="section-51-3"><num>(3)</num><intro><p>Regulations under this section may—</p></intro><level class="para1" eId="section-51-3-a"><num>(a)</num><content><p>include transitional, transitory or saving provision,</p></content></level><level class="para1" eId="section-51-3-b"><num>(b)</num><content><p>make different provision for different purposes.</p></content></level></subsection></section><section eId="section-52"><num>52</num><heading>Repeal of Part 1 of this Act</heading><subsection eId="section-52-1"><num>(1)</num><content><p>The Scottish Ministers may by regulations repeal Part 1 of this Act.</p></content></subsection><subsection eId="section-52-2"><num>(2)</num><content><p>Regulations under subsection (1) are subject to the affirmative procedure.</p></content></subsection></section><section eId="section-53"><num>53</num><heading>Short title</heading><content><p>The short title of this Act is the UK Withdrawal from the European Union (Continuity) (Scotland) Act
