PART 1Fixed monetary penalties

Imposition of fixed monetary penalties

(1)

The Electoral Commission may by notice impose a fixed monetary penalty on a person if satisfied beyond reasonable doubt that the person has committed a campaign offence listed in Part 7.

(2)

The Commission may by notice impose a fixed monetary penalty on a permitted participant if satisfied beyond reasonable doubt that the responsible person in relation to the permitted participant—

(a)

has committed a campaign offence listed in Part 7, or

(b)

has failed to comply with a requirement imposed by paragraph 24(2), (3) or (4) of schedule 3.

(3)

For the purposes of this schedule a “fixed monetary penalty” is a requirement to pay to the Commission a penalty of £200.
