Civil Partnership (Scotland) Act 2020 Explanatory Notes

Forced civil partnerships

Section 13: Forced civil partnerships

30.Section 13 of the Act amends section 122 of the Anti-social Behaviour, Crime and Policing Act 2014. Section 122 makes it an offence under the law of Scotland to use coercion for the purpose of causing another person to enter into a marriage. It is amended by section 13 of the Act so as to extend to the use of coercion for the purpose of causing another person to enter into a civil partnership, including a purported civil partnership. A purported civil partnership in this context might be one which is void as a matter of law, for example because one party did not freely consent to its formation.
