An offence (other than a List A offence) to which either of the following provisions of the Offences (Aggravation by Prejudice) (Scotland) Act 2009 applies—

(a)

section 1(1) (prejudice relating to disability), or

(b)

section 2(1) (prejudice relating to sexual orientation or transgender identity).
