Education (Scotland) Act 2016, Section 31 is up to date with all changes known to be in force on or before 30 July 2025. There are changes that may be brought into force at a future date. Changes that have been made appear in the content and are referenced with annotations.
(1)Any power of the Scottish Ministers to make regulations under this Act includes power to make—
(a)different provision for different purposes,
(b)such supplementary, incidental, consequential, transitional or transitory provision, or savings, as they consider appropriate.
(2)Regulations under section 9(7) or 14(1) are subject to the affirmative procedure.
(3)Regulations under section 32(1) containing provisions which add to, replace, or omit any part of the text of this or any other Act are subject to the affirmative procedure.
(4)Otherwise, regulations under this Act are subject to the negative procedure.
(5)This section does not apply to regulations under section 33(2).
