SCHEDULE S MODIFICATIONS OF THE EDUCATION (ADDITIONAL SUPPORT FOR LEARNING) (SCOTLAND) ACT 2004

12 S In section 13 (provision of information etc. on occurrence of certain events)—

(a) in subsection (4A), for “to express” substitute “ in relation to such ”, and

(b) in subsection (5)—

(i) before paragraph (a) insert—

“(za) in the case of a child who has attained the age of 12 years and who the authority is satisfied has capacity to give consent, the child,”, and

(ii) in paragraph (a), for “a” substitute “ any other ”.
