30Meaning of “the 1980 Act

In this Act, “the 1980 Act” means the Education (Scotland) Act 1980.

31Regulations

Any power of the Scottish Ministers to make regulations under this Act includes power to make—

a

different provision for different purposes,

b

such supplementary, incidental, consequential, transitional or transitory provision, or savings, as they consider appropriate.

Regulations under section 9(7) or 14(1) are subject to the affirmative procedure.

Regulations under section 32(1) containing provisions which add to, replace, or omit any part of the text of this or any other Act are subject to the affirmative procedure.

Otherwise, regulations under this Act are subject to the negative procedure.

This section does not apply to regulations under section 33(2).

32Ancillary provision

The Scottish Ministers may by regulations make such supplementary, incidental, consequential, transitional or transitory provision, or savings, as they consider appropriate for the purposes of, in consequence of, or for giving full effect to, any provision of this Act.

Regulations under subsection (1) may modify any enactment (including this Act).

33Commencement

1

This Part (other than section 30) comes into force on the day after Royal Assent.

The other provisions of this Act come into force on such day as the Scottish Ministers may by regulations appoint.

3

Different days may be appointed for different purposes.

4

Regulations under this section may include transitional or transitory provision or savings.

34Short title

The short title of this Act is the Education (Scotland) Act 2016.
