Offence
26Burial other than in burial ground: offence
(1)
It is an offence for a person knowingly to bury human remains unless—
(a)
the burial is carried out in a burial ground in accordance with section 8, or
(b)
the burial is a private burial carried out in accordance with section 22.
(2)
A person who commits an offence under subsection (1) is liable on summary conviction to imprisonment for a term not exceeding 12 months or to a fine not exceeding level 3 on the standard scale or to both.
