After section 8(3) of the Land Tenure Reform (Scotland) Act 1974, there is inserted—

“(3ZA)

The condition contained in subsection (1) above does not apply in relation to a private residential tenancy as defined in the Private Housing (Tenancies) (Scotland) Act 2016.”.
