25Investigation of complaint

(1)

This section applies to the investigation of a complaint assessed as admissible under section 22(2)(a).

(2)

The investigation must be conducted with a view to making findings of fact in relation to compliance with a requirement mentioned in section 22(1)(a) to (d) by the person who is the subject of the complaint.

(3)

The Commissioner may make a finding of fact if satisfied on the balance of probabilities that the fact is established.

(4)

If the Commissioner has not completed the investigation before the end of the period of 6 months beginning on the date the complaint is found to be admissible, the Commissioner must, as soon as possible thereafter, make a report to the Parliament on the progress of the investigation.
