Modifications of Part 2 of Land Reform (Scotland) Act 2003

48Approval of members of community to buy land

In section 51 of the 2003 Act (exercise of right to buy: approval of community and consent of Ministers), in subsection (2)(a)—

(a)

in sub-paragraph (i)—

(i)

for the words “at least half”, substitute “ the proportion ”,

(ii)

after “above,”, insert “ who ”, and

(iii)

after “land”, insert “ is, in the circumstances, sufficient to justify the community body's proceeding to buy the land; ”,

(b)

the word “; or” immediately following sub-paragraph (i) is repealed, and

(c)

sub-paragraph (ii) is repealed.
