2Requirement for air weapon certificateS

(1)It is an offence for a person to use, possess, purchase or acquire an air weapon without holding an air weapon certificate.
(2)A person who commits an offence under subsection (1) is liable—
(a)on summary conviction, to imprisonment for a term not exceeding 12 months or a fine not exceeding the statutory maximum (or both),
(b)on conviction on indictment, to imprisonment for a term not exceeding 2 years or a fine (or both).
(3)Schedule 1 contains exemptions from—
(a)the offence under subsection (1), and
(b)certain other offences under this Part.
(4)The Scottish Ministers may by regulations amend schedule 1 so as to—
(a)add further exemptions,
(b)remove or modify exemptions.
