52Directions

1

The Scottish Ministers may give directions to a local authority in relation to the carrying out of—

a

functions conferred on it by this Act,

b

functions delegated to it in pursuance of an integration scheme,

c

functions specified in the scheme that are to be carried out in conjunction with those functions.

The Scottish Ministers may give directions to a Health Board in relation to the carrying out of—

a

functions conferred on it by this Act,

b

functions delegated to it in pursuance of an integration scheme,

c

functions specified in the scheme that are to be carried out in conjunction with those functions.

The Scottish Ministers may give directions to an integration joint board in relation to the carrying out of—

a

functions conferred on it by this Act,

b

functions delegated to it in pursuance of an integration scheme.

A local authority, a Health Board or an integration joint board must comply with a direction given to it under this section.

Directions under this section—

a

may vary or revoke earlier directions under this section,

b

must be in writing.

The Scottish Ministers may not under subsection (1) or (2) give a direction requiring a local authority or Health Board to make a written application of the type mentioned in section 27.
