A person may appeal to the First-tier Tribunal against a decision by the Scottish Ministers—

a

under section 32 to refuse to enter that person in the register or to renew that person's existing entry in the register,

b

under section 39 to remove that person from the register.

An appeal must be made before the end of the period of 21 days beginning with the date of notification of the decision.

In determining an appeal the Tribunal may make an order requiring the Scottish Ministers to enter the person in the register.
