3Notice of claim

A person claiming that the property is not liable to forfeiture under section 46 or 47 must serve notice of the claim (a “notice of claim”) on the Scottish Ministers.

A notice of claim must be served—

a

within one month of the day of the serving of the notice of intended forfeiture, or

b

if no such notice has been served, within one month of the date of the seizure of the property.

A notice of claim must specify the name and address of the claimant.

In a case in which notice of intended forfeiture was served on different persons on different days, the reference in this paragraph to the day on which that notice was served is a reference—

a

in relation to a person on whom the notice of intended forfeiture was served, to the day on which that notice was served on that person, and

b

in relation to any other person, to the day on which notice of intended forfeiture was served on the last person on whom such a notice was served.
