SCHEDULE 2 S Forfeiture under section 46 or 47

Decision whether to apply for order forfeiting property S

5 (1) Where a notice of claim in respect of the property is duly served in accordance with paragraph 3, the Scottish Ministers must decide whether to make an application to a sheriff for an order forfeiting the property (a “forfeiture application”). S

(2) The decision whether to make such an application must be taken as soon as reasonably practicable after receipt of the notice of claim.
