Exclusions from conversion

33Qualifying condition where obligation assumed by public authority

Sections 29(1) and 31(1) do not apply to a qualifying condition in so far as such condition constitutes an obligation—

(a)

to maintain or reinstate, and

(b)

which has been assumed—

(i)

by a local or other public authority, or

(ii)

by virtue of any enactment, by a successor body to any such authority.
