Functions of constables
22Failure to perform duty
(1)
It is an offence for a constable, without reasonable excuse, to be absent from duty.
(2)
A person who is guilty of an offence under subsection (1) is liable on summary conviction to imprisonment for a period not exceeding 60 days or a fine not exceeding level 3 on the standard scale.
(3)
It is an offence for a constable to neglect or violate the constable's duty.
(4)
A person who is guilty of an offence under subsection (3) is liable—
(a)
on conviction on indictment, to imprisonment for a term not exceeding 2 years, or to a fine, or to both, or
(b)
on summary conviction, to imprisonment for a term not exceeding 12 months, or to a fine not exceeding the statutory maximum, or to both.
