9Offence of breaching order

Any person who, knowingly and without reasonable excuse, breaches a forced marriage protection order commits an offence.

A constable may arrest without warrant any person the constable reasonably believes is committing or has committed an offence under subsection (1).

Subsection (2) is without prejudice to any power of arrest conferred by law apart from that subsection.

A person guilty of an offence under subsection (1) is liable—
a
on summary conviction, to imprisonment for a period not exceeding 12 months, to a fine not exceeding the statutory maximum, or to both,
b
on conviction on indictment, to imprisonment for a period not exceeding 2 years, to a fine, or to both.

Where a person is convicted of an offence under subsection (1) in respect of any conduct, that conduct is not punishable as a contempt of court.
