or</p></content></level><level class="para1"><num>(b)</num><content><p>occurs in circumstances where it would appear to a reasonable person that it would amount to harassment of that person.</p></content></level></subsection><subsection><num>(2)</num><content><p>Subsection (1) only applies where the conduct referred to amounts to domestic abuse.</p></content></subsection><subsection><num>(3)</num><intro><p>Subsections (2) to (7) of section 8 apply in relation to subsection (1) as they apply in relation to subsection (1) of that section but with the following modifications––</p></intro><level class="para1"><num>(a)</num><content><p>in subsections (2) and (4), the words  “course of” are omitted;</p></content></level><level class="para1"><num>(b)</num><content><p><mod>for subsection (3) there is substituted—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection><num>(3)</num><content><p>For the purposes of this section—</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>“conduct”––</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>may involve behaviour on one or more than one occasion; and</p></item><item><num>(b)</num><p>includes—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>speech; and</p></item><item><num>(ii)</num><p>presence in any place or area; eId="crossheading-breach-of-domestic-abuse-interdict-with-power-of-arrest"><heading><i>Breach of domestic abuse interdict with power of arrest</i></heading><section eId="section-2"><num>2</num><heading>Breach of domestic abuse interdict with power of arrest</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>on or after the date on which this section comes into force, an interdict is granted against a person,</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><content><p>a determination has been made under section 3(1) that the interdict is a domestic abuse interdict,</p></content></level><level class="para1" eId="section-2-1-c"><num>(c)</num><content><p>that determination is in effect,</p></content></level><level class="para1" eId="section-2-1-d"><num>(d)</num><content><p>a power of arrest is attached to the interdict under section 1(1A) or (2) of the Protection from Abuse (Scotland) Act 2001 (asp 14), and</p></content></level><level class="para1" eId="section-2-1-e"><num>(e)</num><content><p>that power of arrest is in effect.</p></content></level></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>A person who breaches an interdict to which this section applies is guilty of an offence.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>A person guilty of an offence under subsection (2) is liable––</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>on summary conviction, to imprisonment for a term not exceeding 12 months or to a fine not exceeding the statutory maximum or to both,</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>on conviction on indictment, to imprisonment for a term not exceeding 5 years or to a fine or to both.</p></content></level></subsection><subsection eId="section-2-4"><num>(4)</num><content><p>Following conviction, a breach of an interdict to which this section applies is not punishable other than in accordance with subsection (3).</p></content></subsection><subsection eId="section-2-5"><num>(5)</num><content><p>Where a person is convicted of an offence under this section in respect of any conduct, that conduct is not punishable as a contempt of court.</p></content></subsection><subsection eId="section-2-6"><num>(6)</num><content><p>A person cannot be convicted of an offence under this section in respect of any conduct which has been punished as a contempt of court.</p></content></subsection><subsection eId="section-2-7"><num>(7)</num><content><p>In this section and section 3,  “<term refersTo="#term-interdict" eId="term-interdict">interdict</term>” includes interim interdict.</p></content></subsection></section><section eId="section-3"><num>3</num><heading>Determination as to whether an interdict is a domestic abuse interdict</heading><subsection eId="section-3-1"><num>(1)</num><content><p>A person who is applying for, or who has obtained, an interdict may apply to the court for a determination that the interdict is a domestic abuse interdict.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>The court may make the determination if satisfied that the interdict is, or is to be, granted for the protection of the applicant against a person who is (or was)—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>the applicant's spouse,</p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><content><p>the applicant's civil partner,</p></content></level><level class="para1" eId="section-3-2-c"><num>(c)</num><content><p>living with the applicant as if they were husband and wife or civil partners, or</p></content></level><level class="para1" eId="section-3-2-d"><num>(d)</num><content><p>in an intimate personal relationship with the applicant.</p></content></level></subsection><subsection eId="section-3-3"><num>(3)</num><content><p>Before making a determination under subsection (1), the court must give the person against whom the interdict is, or is to be, granted (“A”) an opportunity to make representations.</p></content></subsection><subsection eId="section-3-4"><num>(4)</num><content><p>A determination under subsection (1) is of no effect for the purposes of section 2 until a copy of the interlocutor containing the determination has been served on A.</p></content></subsection><subsection eId="section-3-5"><num>(5)</num><intro><p>Where a court varies an interdict in relation to which a determination under subsection (1) is in effect, the court must—</p></intro><level class="para1" eId="section-3-5-a"><num>(a)</num><content><p>review whether the interdict as varied continues to be a domestic abuse interdict, and</p></content></level><level class="para1" eId="section-3-5-b"><num>(b)</num><content><p>if not, recall the determination.</p></content></level></subsection><subsection eId="section-3-6"><num>(6)</num><content><p>A determination under subsection (1) ceases to have effect for the purposes of section 2 if it is recalled under subsection (5).</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="crossheading-general"><heading><i>General</i></heading><section eId="section-4"><num>4</num><heading>Ancillary provision</heading><subsection eId="section-4-1"><num>(1)</num><content><p>The Scottish Ministers may by order made by statutory instrument make such incidental, supplementary, consequential, transitional, transitory or saving provision as they consider appropriate for the purposes of, in consequence of, or for giving full effect to, any provision of this Act.</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><content><p>An order under subsection (1) may modify any enactment (including this Act).</p></content></subsection><subsection eId="section-4-3"><num>(3)</num><content><p>An order under subsection (1) is not to be made unless a draft of the statutory instrument containing the order has been laid before, and approved by resolution of, the Scottish Parliament.</p></content></subsection></section><section eId="section-5"><num>5</num><heading>Short title and commencement</heading><subsection eId="section-5-1"><num>(1)</num><content><p>This Act may be cited as the Domestic Abuse (Scotland) Act 2011.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><content><p>This Act, except section 4 and this section, comes into force three months after the day on which the Bill for
