In section 77 of the Serious Organised Crime and Police Act 2005 (c.15) (financial reporting orders: making in Scotland), after subsection (4) insert—

“(4A)

A financial reporting order may be made—

(a)

on the prosecutor's motion, or

(b)

at the court's own instance.”.
