37Interpretation of Part 2S

In this Part—

  • devolved subordinate legislation” means subordinate legislation (other than special procedure orders) which is to be made by Scottish statutory instrument,

  • enactment” includes any enactment comprised in this Act [F1and any retained direct EU legislation] ,

  • [F2retained direct EU legislation” has the same meaning as in the European Union (Withdrawal) Act 2018 (see section 20(1) of that Act),]

  • special procedure order” means an order in relation to which Part 4 applies.

  • [F3subordinate legislation” includes an instrument made or to be made under any retained direct EU legislation on or after exit day (within the meaning of the European Union (Withdrawal) Act 2018 (see section 20(1) to (5) of that Act)).]
