This section applies if the Scottish Ministers lay a report under section 33 which states that an emissions reduction target has not been met.

F3Within the period of 6 months beginning with the day that the report referred to in subsection (1) is laid before the Parliament, the Scottish Ministers must lay a report before the Scottish Parliament setting out proposals and policies to compensate in future years for the excess emissions.
