This section applies if the Scottish Ministers lay a report under section 33 which states that an emissions reduction target has not been met.

As soon as reasonably practicable after the report referred to in F2subsection (1) has been laid, the Scottish Ministers must lay a report before the Scottish Parliament setting out proposals and policies to compensate in future years for the excess emissions.
