Despite article A3 of the 1999 pensions order, Part S of the 1999 order is to continue to have effect in relation to—
a
any individual who is, or who has been, the First Minister or the Presiding Officer on or before the new rules day, and
b
the rights of any person to receive benefits under Part S of the 1999 order in respect of such an individual.

The SPCB is to continue as the manager of the scheme established by Part S of the 1999 order and, in particular, is to determine the extent of any benefits conferred on an individual in respect of that scheme in accordance with paragraph 2(2) of Schedule 5 to the Welfare Reform and Pensions Act 1999 (c. 30).

When calculating an individual's entitlement to benefits under article S2 of the 1999 scheme rules, any reduction of the deceased's pension by way of a pension debit arising under the Welfare Reform and Pensions Act 1999 (c. 30) is to be ignored.
