71Orders and regulations
1
Any power of the Scottish Ministers to make orders or regulations under this Act is exercisable by statutory instrument.

Any such power includes power to make—
a
such incidental, supplementary, consequential, transitional, transitory or saving provision as the Scottish Ministers think necessary or expedient,
b
different provision for different purposes.

A statutory instrument containing an order or regulations under this Act except—
a
an order under section 70(2), 76(1) or paragraph 2(5) of schedule 3, and
b
where subsection (4) applies, an order under section 74(1),
is subject to annulment in pursuance of a resolution of the Scottish Parliament.

No—
a
order under paragraph 2(5) of schedule 3, or
b
order under section 74(1) containing provisions which add to, replace or omit any part of the text of an Act,
is to be made unless a draft of the statutory instrument containing the order has been laid before, and approved by resolution of, the Parliament.
