SCHEDULE 1 Minor and consequential amendments of the 1985 Act

10 In section 12 (when sequestration is awarded)—

(a) in subsection (1)(c), for “subsections (6) and” substitute “subsection”;

(b) in subsection (2)—

(i) for “court to which” substitute “sheriff to whom”; and

(ii) for “it” substitute “him”;

(c) in subsection (3)—

(i) for “court” substitute “sheriff”; and

(ii) for “it” substitute “he”; and

(d) in subsection (4)—

(i) in paragraph (a), for “the petition for sequestration is presented by the debtor” substitute “a debtor application is made”; and

(ii) in paragraph (b)(i), for “court” substitute “sheriff”.
