59Knife dealers' licences: further provision

The Civic Government (Scotland) Act 1982 (c. 45) is amended in accordance with subsections (2) and (3).

In section 6(1)(a) (powers of entry to and search of unlicensed premises), after “Act” insert “(other than a knife dealer’s licence)”.

In section 7 (offences etc.)—

a

before subsection (1) insert—

Any person who without reasonable excuse does anything for which a licence is required under section 27A without having such a licence is guilty of an offence and liable—

a

on summary conviction to imprisonment for a term not exceeding 12 months or a fine not exceeding the statutory maximum or both;

b

on conviction on indictment to imprisonment for a term not exceeding 2 years or a fine or both.

in subsection (1)—

i

after “under” insert “any provision of”, and

ii

after “Act” insert “other than section 27A”,

c

in subsection (2)—

i

the word “and” immediately after paragraph (a) is repealed, and

ii

after that paragraph, insert—

aa

in a case where the licence is a knife dealer’s licence, to a fine not exceeding level 5 on the standard scale; and

d

in subsection (4), after “conviction,” insert—

a

in a case where the application is for a knife dealer’s licence, to a fine not exceeding level 5 on the standard scale; and

b

in any other case,
