or</p></content></level><level class="para1" eId="d25e157"><num>(b)</num><content><p>such longer period (not exceeding 6 months) beginning with that date as the sheriff may specify in the order.</p></content></level></subsection><subsection eId="d25e163"><num>(6B)</num><intro><p>In subsection (3)(a), “relevant medical practitioner” means—</p></intro><level class="para1" eId="d25e169"><num>(a)</num><content><p>an approved medical practitioner;</p></content></level><level class="para1" eId="d25e175"><num>(b)</num><intro><p>where the adult concerned is not present in Scotland, a person who—</p></intro><level class="para2" eId="d25e181"><num>(i)</num><content><p>holds qualifications recognised in the place where the adult is present and has special experience in relation to the diagnosis and treatment of mental disorder which correspond to the qualifications and experience needed to be an approved medical practitioner; and</p></content></level><level class="para2" eId="d25e187"><num>(ii)</num><content><p>has consulted the Mental Welfare Commission for Scotland about the report concerned; or</p></content></level></level><level class="para1" eId="d25e193"><num>(c)</num><content><p>any other type of individual described (by reference to skills, qualifications, experience or otherwise) by regulations made by the Scottish Ministers.</p></content></level></subsection><subsection eId="d25e199"><num>(6C)</num><content><p>The Scottish Ministers shall consult the Mental Welfare Commission before making regulations under subsection (6B)(c).</p></content></subsection></quotedStructure><inline name="appendText">,</inline></mod></p></content></level><level class="para1" eId="section-60-1-e"><num>(e)</num><content><p>in subsection (7), for “(3)(a)” substitute “(6B)”.</p></content></level></subsection><subsection eId="section-60-2"><num>(2)</num><intro><p>In section 58 (disposal of application for guardianship) of the 2000 Act—</p></intro><level class="para1" eId="section-60-2-a"><num>(a)</num><intro><p>in subsection (6)—</p></intro><level class="para2" eId="section-60-2-a-i"><num>(i)</num><content><p>for the words from “shall” to the end of paragraph (b) substitute “may”,</p></content></level><level class="para2" eId="section-60-2-a-ii"><num>(ii)</num><content><p>after “caution”, where last occurring, insert “or to give such other security as the sheriff thinks fit”,</p></content></level></level><level class="para1" eId="section-60-2-b"><num>(b)</num><content><p>in subsection (7)(b), after “caution” insert “or given other security”.</p></content></level></subsection><subsection eId="section-60-3"><num>(3)</num><intro><p>In section 60 (renewal of guardianship)—</p></intro><level class="para1" eId="section-60-3-a"><num>(a)</num><content><p><mod>for subsection (3) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection eId="d25e256"><num>(3)</num><intro><p>There must be lodged in court along with an application under this section—</p></intro><level class="para1" eId="d25e262"><num>(a)</num><content><p>at least one report, in the prescribed form, of an examination and assessment of the adult carried out by a medical practitioner not more than 30 days before the lodging of the application;</p></content></level><level class="para1" eId="d25e268"><num>(b)</num><intro><p>where the application relates to the adult’s personal welfare, a report, in the prescribed form, from the mental health officer (but where it is in jeopardy only because of the adult’s inability to communicate, from the chief social work officer), containing the officer’s opinion as to—</p></intro><level class="para2" eId="d25e274"><num>(i)</num><content><p>the general appropriateness of continuing the guardianship, based on an interview and assessment of the adult carried out not more than 30 days before the lodging of the application; and</p></content></level><level class="para2" eId="d25e280"><num>(ii)</num><content><p>the suitability of the applicant to continue to be the adult’s guardian; and</p></content></level></level><level class="para1" eId="d25e286"><num>(c)</num><intro><p>where the application relates to the adult’s property or financial affairs, a report from the Public Guardian, in the prescribed form, containing the Public Guardian’s opinion as to—</p></intro><level class="para2" eId="d25e292"><num>(i)</num><content><p>the applicant’s conduct as the adult’s guardian; and</p></content></level><level class="para1" eId="d25e557"><num>(b)</num><intro><p>either—</p></intro><level class="para2" eId="d25e563"><num>(i)</num><content><p>the local authority wish to recall their chief social work officer’s guardianship powers at their own instance; or</p></content></level><level class="para2" eId="d25e569"><num>(ii)</num><content><p>another person (including the adult himself) applies to the local authority for such a recall.</p></content></level></level></subsection><subsection eId="d25e575"><num>(2)</num><intro><p>Where this section applies—</p></intro><level class="para1" eId="d25e581"><num>(a)</num><content><p>the local authority shall, for the purposes of section 73(5), treat the Public Guardian and the Mental Welfare Commission as persons whom they consider to have an interest in the recall of the guardian’s powers; and</p></content></level><level class="para1" eId="d25e587"><num>(b)</num><intro><p>if the Public Guardian, the Mental Welfare Commission or any other person to whom intimation is given under section 73(5) objects to the recall of the guardian’s powers, the local authority—</p></intro><level class="para2" eId="d25e593"><num>(i)</num><content><p>shall not recall the guardian’s powers; and</p></content></level><level class="para2" eId="d25e677"><num>(iii)</num><content><p>in a case where the adult’s incapacity is by reason of, or reasons which include, mental disorder and the guardianship order relates to the adult’s personal welfare or factors including it, the Mental Welfare Commission;</p></content></level></level><level class="para1" eId="d25e683"><num>(b)</num><content><p>enter prescribed particulars in the register maintained under section 6(2)(b)(iv); but no guardianship order made in relation to a child shall have effect until the child becomes an adult.</p></content></section></hcontainer></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-60-17"><num>(17)</num><intro><p>In paragraph 6 (application of 2000 Act to curator bonis, tutor-dative or tutor-at-law treated as guardian appointed under that Act) of schedule 4 to the 2000 Act—</p></intro><level class="para1" eId="section-60-17-a"><num>(a)</num><content><p><mod>in sub-paragraph (3), for the words from “to the period” to the end of that sub-paragraph substitute<quotedText startQuote="“">—</quotedText><quotedStructure endQuote="”" uk:context="schedule" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="default"><level class="para1" eId="d25e745"><num>(a)</num><intro><p>in the case of a curator bonis who, under paragraph 1(2), became guardian to a person on the person attaining the age of 16 years, to the period of 2 years from the later of the following dates—</p></intro><level class="para2" eId="d25e751"><num>(i)</num><content><p>the date on which section 60(17) (which amends this paragraph) of the Adult Support and Protection (Scotland) Act <ref eId="c00019" href="http://www.legislation.gov.uk/id/asp/2007/10">2007 (asp 10)</ref> came into force;</p></content></level><level class="para2" eId="d25e760"><num>(ii)</num><content><p>the date on which the person attained the age of 16 years,</p></content></level></level><level class="para1" eId="d25e766"><num>(b)</num><content><p>in any other case, to the period of 2 years from the date on which section 60(17) (which amends this paragraph) of the Adult Support and Protection (Scotland) Act <ref eId="c00020" href="http://www.legislation.gov.uk/id/asp/2007/10">2007 (asp 10)</ref> came into force.</p></content></level></quotedStructure><inline name="appendText">,</inline></mod></p></content></level><level class="para1" eId="section-60-17-b"><num>(b)</num><content><p><mod>after sub-paragraph (3) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="default"><subparagraph eId="d25e784"><num>(3A)</num><intro><p>A person who has become a guardian to an adult by virtue of this schedule and who was a curator bonis, tutor dative or tutor-in-law to that adult shall cease to be authorised to act as that adult’s guardian—</p></intro><level class="para1" eId="d25e790"><num>(a)</num><content><p>where the person does not apply for renewal of guardianship within the 2 year period set by sub-paragraph (3), on the expiry of that period;</p></content></level><level class="para1" eId="d25e796"><num>(b)</num><intro><p>where—</p></intro><level class="para2" eId="d25e802"><num>(i)</num><content><p>the person applies for such a renewal within that period; and</p></content></level><level class="para2" eId="d25e808"><num>(ii)</num><content><p>the sheriff refuses the application,</p></content></level><wrapUp><p>on the date of refusal;</p></wrapUp></level><level class="para1" eId="d25e816"><num>(c)</num><intro><p>where—</p></intro><level class="para2" eId="d25e822"><num>(i)</num><content><p>the person applies for such a renewal within that period; and</p></content></level><level class="para2" eId="d25e828"><num>(ii)</num><content><p>the sheriff grants the application,</p></content></level><wrapUp><p>in accordance with the provisions of this Act.</p></wrapUp></level></subparagraph><subparagraph eId="d25e836"><num>(3B)</num><content><p>Sub-paragraph (3A) does not prevent the authority of a guardian of the type mentioned in that sub-paragraph from being terminated (by virtue of the terms on which the guardian is authorised to act or sections 71, 73, 75 or 79A) earlier than the date on which it would otherwise terminate by operation of that sub-paragraph.</p></content></subparagraph><subparagraph eId="d25e842"><num>(3C)</num><intro><p>Where—</p></intro><level class="para1" eId="d25e848"><num>(a)</num><content><p>a person (“G”) who was a curator bonis, tutor dative or tutor-at-law to an adult becomes the adult’s guardian by virtue of this schedule; and</p></content></level><level class="para1" eId="d25e854"><num>(b)</num><content><p>another person is appointed under section 62 as an additional guardian to the adult before G’s appointment as guardian has been renewed in accordance with the provisions of this Act,</p></content></level><wrapUp><p>subsection (3A) applies in relation to the additional guardian as it applies in relation to G.</p></wrapUp></subparagraph><subparagraph eId="d25e862"><num>(3D)</num><intro><p>The Public Guardian must take reasonable steps to give notice of the effect of sub-paragraph (3A) to any person who—</p></intro><level class="para1" eId="d25e868"><num>(a)</num><content><p>is a guardian to an adult by virtue of this schedule;</p></content></level><level class="para1" eId="d25e874"><num>(b)</num><content><p>was a curator bonis to that adult; and</p></content></level><level class="para1" eId="d25e880"><num>(c)</num><content><p>has not applied for renewal of guardianship.</p></content></level></subparagraph><subparagraph eId="d25e886"><num>(3E)</num><intro><p>A local authority must take reasonable steps to give notice of the effect of sub-paragraph (3A) to any person who—</p></intro><level class="para1" eId="d25e892"><num>(a)</num><content><p>is a guardian to an adult residing within the local authority’s area by virtue of this schedule;</p></content></level><level class="para1" eId="d25e898"><num>(b)</num><content><p>was a tutor dative or tutor-in-law to that adult;
