purposes.</p></longTitle></preface><body><part eId="part-1"><num>Part 1</num><heading>Protection of adults at risk of harm</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-introductory"><heading>Introductory</heading><section eId="section-1"><num>1</num><heading>General principle on intervention in an adult’s affairs</heading><intro><p>The general principle on intervention in an adult’s affairs is that a person may intervene, or authorise an intervention, only if satisfied that the intervention—</p></intro><level class="para1" eId="section-1-a"><num>(a)</num><content><p>will provide benefit to the adult which could not reasonably be provided without intervening in the adult’s affairs, and</p></content></level><level class="para1" eId="section-1-b"><num>(b)</num><content><p>is, of the range of options likely to fulfil the object of the intervention, the least restrictive to the adult’s freedom.</p></content></level><wrapUp><p>This section applies for the purposes of section 2 only.</p></wrapUp></section><section eId="section-2"><num>2</num><heading>Principles for performing Part 1 functions</heading><intro><p>A public body or office-holder performing a function under this Part in relation to an adult must, if relevant, have regard to—</p></intro><level class="para1" eId="section-2-a"><num>(a)</num><content><p>the general principle on intervention in an adult’s affairs,</p></content></level><level class="para1" eId="section-2-b"><num>(b)</num><content><p>the adult’s ascertainable wishes and feelings (past and present),</p></content></level><level class="para1" eId="section-2-c"><num>(c)</num><intro><p>any views of—</p></intro><level class="para2" eId="section-2-c-i"><num>(i)</num><content><p>the adult’s nearest relative,</p></content></level><level class="para2" eId="section-2-c-ii"><num>(ii)</num><content><p>any primary carer, guardian or attorney of the adult, and</p></content></level><level class="para2" eId="section-2-c-iii"><num>(iii)</num><content><p>any other person who has an interest in the adult’s well-being or property,</p></content></level><wrapUp><p>which are known to the public body or office-holder,</p></wrapUp></level><level class="para1" eId="section-2-d"><num>(d)</num><intro><p>the importance of—</p></intro><level class="para2" eId="section-2-d-i"><num>(i)</num><content><p>the adult participating as fully as possible in the performance of the function, and</p></content></level><level class="para2" eId="section-2-d-ii"><num>(ii)</num><content><p>providing the adult with such information and support as is necessary to enable the adult to so participate,</p></content></level></level><level class="para1" eId="section-2-e"><num>(e)</num><content><p>the importance of ensuring that the adult is not, without justification, treated less favourably than the way in which any other adult (not being an adult at risk) might be treated in a comparable situation, and</p></content></level><level class="para1" eId="section-2-f"><num>(f)</num><content><p>the adult’s abilities, background and characteristics (including the adult’s age, sex, sexual orientation, religious persuasion, racial origin, ethnic group and cultural and linguistic heritage).</p></content></level></section><section eId="section-3"><num>3</num><heading>Adults at risk</heading><subsection eId="section-3-1"><num>(1)</num><intro><p>“Adults at risk” are adults who—</p></intro><level class="para1" eId="section-3-1-a"><num>(a)</num><content><p>are unable to safeguard their own well-being, property, rights or other interests,</p></content></level><level class="para1" eId="section-3-1-b"><num>(b)</num><content><p>are at risk of harm, and</p></content></level><level class="para1" eId="section-3-1-c"><num>(c)</num><content><p>because they are affected by disability, mental disorder, illness or physical or mental infirmity, are more vulnerable to being harmed than adults who are not so affected.</p></content></level></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>An adult is at risk of harm for the purposes of subsection (1) if—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p>another person’s conduct is causing (or is likely to cause) the adult to be harmed, or</p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><content><p>the adult is engaging (or is likely to engage) in conduct which causes (or is likely to cause) self-harm.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-inquiries"><heading>Inquiries</heading><section eId="section-4"><num>4</num><heading>Council’s duty to make inquiries</heading><intro><p>A council must make inquiries about a person’s well-being, property or financial affairs if it knows or believes—</p></intro><level class="para1" eId="section-4-a"><num>(a)</num><content><p>that the person is an adult at risk, and</p></content></level><level class="para1" eId="section-4-b"><num>(b)</num><content><p>that it might need to intervene (by performing functions under this Part or otherwise) in order to protect the person’s well-being, property or financial affairs.</p></content></level></section><section eId="section-5"><num>5</num><heading>Co-operation</heading><subsection eId="section-5-1"><num>(1)</num><intro><p>This section applies to—</p></intro><level class="para1" eId="section-5-1-a"><num>(a)</num><content><p>the Mental Welfare Commission for Scotland,</p></content></level><level class="para1" eId="section-5-1-b"><num>(b)</num><content><p>the Care Commission,</p></content></level><level class="para1" eId="section-5-1-c"><num>(c)</num><content><p>the Public Guardian,</p></content></level><level class="para1" eId="section-5-1-d"><num>(d)</num><content><p>all councils,</p></content></level><level class="para1" eId="section-5-1-e"><num>(e)</num><content><p>chief constables of police forces,</p></content></level><level class="para1" eId="section-5-1-f"><num>(f)</num><content><p>the relevant Health Board, and</p></content></level><level class="para1" eId="section-5-1-g"><num>(g)</num><content><p>any other public body or office-holder as the Scottish Ministers may by order specify.</p></content></level></subsection><subsection eId="section-5-2"><num>(2)</num><intro><p>The public bodies and office-holders to which this section applies must, so far as consistent with the proper exercise of their functions, co-operate with—</p></intro><level class="para1" eId="section-5-2-a"><num>(a)</num><content><p>a council making inquiries under section 4, and</p></content></level><level class="para1" eId="section-5-2-b"><num>(b)</num><content><p>each other,</p></content></level><wrapUp><p>where such co-operation is likely to enable or assist the council making those inquiries.</p></wrapUp></subsection><subsection eId="section-5-3"><num>(3)</num><intro><p>Where a public body or office-holder to which this section applies knows or believes—</p></intro><level class="para1" eId="section-5-3-a"><num>(a)</num><content><p>that a person is an adult at risk, and</p></content></level><level class="para1" eId="section-5-3-b"><num>(b)</num><content><p>that action needs to be taken (under this Part or otherwise) in order to protect that person from harm,</p></content></level><wrapUp><p>the public body or office-holder must report the facts and circumstances of the case to the council for the area in which it considers the person to be.</p></wrapUp></subsection></section><section eId="section-6"><num>6</num><heading>Duty to consider importance of providing advocacy and other services</heading><subsection eId="section-6-1"><num>(1)</num><content><p>This section applies where, after making inquiries under section 4, a council considers that it needs to intervene in order to protect an adult at risk from harm.</p></content></subsection><subsection eId="section-6-2"><num>(2)</num><content><p>Where this section applies, the council must have regard to the importance of the provision of appropriate services (including, in particular, independent advocacy services) to the adult concerned.</p></content></subsection><subsection eId="section-6-3"><num>(3)</num><content><p>“Independent advocacy services” has the same meaning in subsection (2) as it has in section 259(1) of the Mental Health (Care and Treatment) (Scotland) Act <ref eId="c00001" href="http://www.legislation.gov.uk/id/asp/2003/13">2003 (asp 13)</ref>.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-investigations"><heading>Investigations</heading><section eId="section-7"><num>7</num><heading>Visits</heading><subsection eId="section-7-1"><num>(1)</num><content><p>A council officer may enter any place for the purpose of enabling or assisting a council conducting inquiries under section 4 to decide whether it needs to do anything (by performing functions under this Part or otherwise) in order to protect an adult at risk from harm.</p></content></subsection><subsection eId="section-7-2"><num>(2)</num><content><p>A right to enter any place under subsection (1) includes a right to enter any adjacent place for the same purpose.</p></content></subsection></section><section eId="section-8"><num>8</num><heading>Interviews</heading><subsection eId="section-8-1"><num>(1)</num><content><p>A council officer, and any person accompanying the officer, may interview, in private, any adult found in a place being visited under section 7.</p></content></subsection><subsection eId="section-8-2"><num>(2)</num><content><p>An adult interviewed under this section is not required to answer any question (and the adult must be informed of that fact before the interview starts).</p></content></subsection><subsection eId="section-8-3"><num>(3)</num><content><p>The power given by subsection (1) applies regardless of whether the sheriff has granted an assessment order authorising the council officer to take the person to another place to allow an interview to be conducted.</p></content></subsection></section><section eId="section-9"><num>9</num><heading>Medical examinations</heading><subsection eId="section-9-1"><num>(1)</num><intro><p>Where—</p></intro><level class="para1" eId="section-9-1-a"><num>(a)</num><content><p>a council officer finds a person whom the officer knows or believes to be an adult at risk in a place being visited under section 7, and</p></content></level><level class="para1" eId="section-9-1-b"><num>(b)</num><content><p>the officer, or any person accompanying the officer, is a health professional,</p></content></level><wrapUp><p>that health professional may conduct a private medical examination of the person.</p></wrapUp></subsection><subsection eId="section-9-2"><num>(2)</num><content><p>A person must be informed of the right to refuse to be examined before a medical examination is carried out (whether under this section or in pursuance of an assessment order).</p></content></subsection><subsection eId="section-9-3"><num>(3)</num><content><p>The power given by subsection (1) applies regardless of whether the sheriff has granted an assessment order authorising the council officer to take the person to another place to allow a medical examination to be conducted.</p></content></subsection></section><section eId="section-10"><num>10</num><heading>Examination of records etc.</heading><subsection eId="section-10-1"><num>(1)</num><content><p>A council officer may require any person holding health, financial or other records relating to an individual whom the officer knows or believes to be an adult at risk to give the records, or copies of them, to the officer.</p></content></subsection><subsection eId="section-10-2"><num>(2)</num><content><p>Such a requirement may be made during a visit or at any other time.</p></content></subsection><subsection eId="section-10-3"><num>(3)</num><content><p>Requirements made at such other times must be made in writing.</p></content></subsection><subsection eId="section-10-4"><num>(4)</num><intro><p>Records given to a council officer in pursuance of such a requirement may be inspected by—</p></intro><level class="para1" eId="section-10-4-a"><num>(a)</num><content><p>the officer, and</p></content></level><level class="para1" eId="section-10-4-b"><num>(b)</num><content><p>any other person whom the officer, having regard to the content of the records, considers appropriate,</p></content></level><wrapUp><p>for the purposes of enabling or assisting the council to decide whether it needs to do anything (by performing functions under this Part or otherwise) in order to protect an adult at risk from harm.</p></wrapUp></subsection><subsection eId="section-10-5"><num>(5)</num><content><p>Nothing in this section authorises a person who is not a health professional to inspect health records (other than to determine whether they are health records).</p></content></subsection><subsection eId="section-10-6"><num>(6)</num><content><p>A requirement under subsection (1) which is transmitted by electronic means is to be treated as being in writing if it is received in legible form and capable of being used for subsequent reference.</p></content></subsection><subsection eId="section-10-7"><num>(7)</num><content><p>“Health records” are records relating to an individual’s physical or mental health which have been made by or on behalf of a health professional in connection with the care of the individual.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-assessment-orders"><heading>Assessment orders</heading><section eId="section-11"><num>11</num><heading>Assessment orders</heading><subsection eId="section-11-1"><num>(1)</num><intro><p>A council may apply to the sheriff for an order (“an assessment order”) which authorises a council officer to take a specified person from a place being visited under section 7 in order to allow—</p></intro><level class="para1" eId="section-11-1-a"><num>(a)</num><content><p>a council officer, or any council nominee, to interview the specified person in private, and</p></content></level><level class="para1" eId="section-11-1-b"><num>(b)</num><content><p>a health professional nominated by the council to conduct a private medical examination of the specified person,</p></content></level><wrapUp><p>for the purposes set out in subsection (2).</p></wrapUp></subsection><subsection eId="section-11-2"><num>(2)</num><intro><p>Those purposes are to enable or assist the council to decide—</p></intro><level class="para1" eId="section-11-2-a"><num>(a)</num><content><p>whether the person is an adult at risk, and</p></content></level><level class="para1" eId="section-11-2-b"><num>(b)</num><content><p>if it decides that the person is an adult at risk, whether it needs to do anything (by performing functions under this Part or otherwise) in order to protect the person from harm.</p></content></level></subsection><subsection eId="section-11-3"><num>(3)</num><intro><p>An assessment order—</p></intro><level class="para1" eId="section-11-3-a"><num>(a)</num><content><p>is valid from the date specified in the order, and</p></content></level><level class="para1" eId="section-11-3-b"><num>(b)</num><content><p>expires 7 days after that date.</p></content></level></subsection></section><section eId="section-12"><num>12</num><heading>Criteria for granting assessment order</heading><intro><p>The sheriff may grant an assessment order only if satisfied—</p></intro><level class="para1" eId="section-12-a"><num>(a)</num><content><p>that the council has reasonable cause to suspect that the person in respect of whom the order is sought is an adult at risk who is being, or is likely to be, seriously harmed,</p></content></level><level class="para1" eId="section-12-b"><num>(b)</num><content><p>that the assessment order is required in order to establish whether the person is an adult at risk who is being, or is likely to be, seriously harmed, and</p></content></level><level class="para1" eId="section-12-c"><num>(c)</num><content><p>as to the availability and suitability of the place at which the person is to be interviewed and examined.</p></content></level></section><section eId="section-13"><num>13</num><heading>Restriction on exercise of assessment order</heading><intro><p>A person may be taken from a place in pursuance of an assessment order only if it is not practicable (due to a lack of privacy or otherwise) to—</p></intro><level class="para1" eId="section-13-a"><num>(a)</num><content><p>interview the person under section 8, or</p></content></level><level class="para1" eId="section-13-b"><num>(b)</num><content><p>conduct a medical examination of the person under section 9,</p></content></level><wrapUp><p>during a visit under section 7.</p></wrapUp></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-removal-orders"><heading>Removal orders</heading><section eId="section-14"><num>14</num><heading>Removal orders</heading><subsection eId="section-14-1"><num>(1)</num><intro><p>A council may apply to the sheriff for an order (“a removal order”) which authorises—</p></intro><level class="para1" eId="section-14-1-a"><num>(a)</num><content><p>a council officer, or any council nominee, to move a specified person to a specified place within 72 hours of the order being made, and</p></content></level><level class="para1" eId="section-14-1-b"><num>(b)</num><content><p>the council to take such reasonable steps as it thinks fit for the purpose of protecting the moved person from harm.</p></content></level></subsection><subsection eId="section-14-2"><num>(2)</num><content><p>A removal order expires 7 days (or such shorter period as may be specified in the order) after the day on which the specified person is moved in pursuance of the order.</p></content></subsection></section><section eId="section-15"><num>15</num><heading>Criteria for granting removal order</heading><subsection eId="section-15-1"><num>(1)</num><intro><p>The sheriff may grant a removal order only if satisfied—</p></intro><level class="para1" eId="section-15-1-a"><num>(a)</num><content><p>that the person in respect of whom the order is sought is an adult at risk who is likely to be seriously harmed if not moved to another place, and</p></content></level><level class="para1" eId="section-15-1-b"><num>(b)</num><content><p>as to the availability and suitability of the place to which the adult at risk is to be moved.</p></content></level></subsection><subsection eId="section-15-2"><num>(2)</num><intro><p>A removal order may require a council to allow any specified person to have contact with the adult at risk to whom the order relates—</p></intro><level class="para1" eId="section-15-2-a"><num>(a)</num><content><p>at any specified time during which the order has effect, and</p></content></level><level class="para1" eId="section-15-2-b"><num>(b)</num><content><p>in accordance with any specified conditions.</p></content></level></subsection><subsection eId="section-15-3"><num>(3)</num><intro><p>But the sheriff must, before including such a requirement, have regard to—</p></intro><level class="para1" eId="section-15-3-a"><num>(a)</num><content><p>any representations made by the council as to whether persons should be allowed to have contact with the adult at risk, and</p></content></level><level class="para1" eId="section-15-3-b"><num>(b)</num><intro><p>any relevant representations made by—</p></intro><level class="para2" eId="section-15-3-b-i"><num>(i)</num><content><p>the adult at risk,</p></content></level><level class="para2" eId="section-15-3-b-ii"><num>(ii)</num><content><p>any person who wishes to be able to have contact with the adult at risk, and</p></content></level><level class="para2" eId="section-15-3-b-iii"><num>(iii)</num><content><p>any other person who has an interest in the adult at risk’s well-being or property.</p></content></level></level></subsection></section><section eId="section-16"><num>16</num><heading>Right to move adult at risk</heading><subsection eId="section-16-1"><num>(1)</num><content><p>A council officer may enter any place in order to move an adult at risk from the place in pursuance of a removal order.</p></content></subsection><subsection eId="section-16-2"><num>(2)</num><content><p>A right to enter any place under subsection (1) includes a right to enter any adjacent place for the same purpose.</p></content></subsection></section><section eId="section-17"><num>17</num><heading>Variation or recall of removal order</heading><subsection eId="section-17-1"><num>(1)</num><content><p>The sheriff may vary or recall a removal order if satisfied that the variation or recall is justified by a change in the facts or circumstances in respect of which the order was granted or, as the case may be, last varied.</p></content></subsection><subsection eId="section-17-2"><num>(2)</num><content><p>A removal order may not be varied so as to authorise the council to do anything after the day which falls 7 days after the day on which the adult at risk to whom the order relates is moved in pursuance of the order.</p></content></subsection><subsection eId="section-17-3"><num>(3)</num><intro><p>Where an adult at risk has been moved from any place in pursuance of a removal order which is recalled, the sheriff may direct the council to—</p></intro><level class="para1" eId="section-17-3-a"><num>(a)</num><content><p>return the adult to that place, or</p></content></level><level class="para1" eId="section-17-3-b"><num>(b)</num><content><p>take the adult to any other place which the sheriff, having regard to the adult’s wishes, may specify.</p></content></level></subsection><subsection eId="section-17-4"><num>(4)</num><intro><p>A removal order may be varied or recalled only on the application of—</p></intro><level class="para1" eId="section-17-4-a"><num>(a)</num><content><p>the adult at risk to whom the order relates,</p></content></level><level class="para1" eId="section-17-4-b"><num>(b)</num><content><p>any person who has an interest in the adult at risk’s well-being or property, or</p></content></level><level class="para1" eId="section-17-4-c"><num>(c)</num><content><p>the council.</p></content></level></subsection></section><section eId="section-18"><num>18</num><heading>Protection of moved person’s property</heading><subsection eId="section-18-1"><num>(1)</num><intro><p>The council must take reasonable steps to prevent any property owned or controlled by a person moved in pursuance of a removal order from being lost or damaged because—</p></intro><level class="para1" eId="section-18-1-a"><num>(a)</num><content><p>the moved person is unable to protect, care for or otherwise deal with it, and</p></content></level><level class="para1" eId="section-18-1-b"><num>(b)</num><content><p>no other suitable arrangements have been or are being made for the purposes of preventing such loss or damage.</p></content></level></subsection><subsection eId="section-18-2"><num>(2)</num><content><p>A council officer may enter any place which the council knows or believes to contain any property in respect of which it has a duty under subsection (1) in order to enable or assist the council to perform that duty.</p></content></subsection><subsection eId="section-18-3"><num>(3)</num><content><p>A right to enter any place under subsection (2) includes a right to enter any adjacent place for the same purpose.</p></content></subsection><subsection eId="section-18-4"><num>(4)</num><content><p>A council officer who finds any property in respect of which the council has a duty under subsection (1) may do anything which the officer considers reasonably necessary in order to prevent the property from being lost or damaged (and may, in particular, move the property to another place).</p></content></subsection><subsection eId="section-18-5"><num>(5)</num><content><p>The council is not entitled to recover from a moved person any expenses it incurs in performing functions under this section in relation to property owned or controlled by that person.</p></content></subsection><subsection eId="section-18-6"><num>(6)</num><content><p>The duty imposed by subsection (1) applies only while the removal order concerned has effect.</p></content></subsection><subsection eId="section-18-7"><num>(7)</num><content><p>A council which moves any property in pursuance of the duty imposed by subsection (1) must, as soon as is reasonably practicable after the removal order concerned ceases to have effect, return the property to the adult concerned.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-banning-orders"><heading>Banning orders</heading><section eId="section-19"><num>19</num><heading>Banning orders</heading><subsection eId="section-19-1"><num>(1)</num><content><p>A banning order is an order granted by the sheriff which bans the subject of the order (“the subject”) from being in a specified place.</p></content></subsection><subsection eId="section-19-2"><num>(2)</num><intro><p>A banning order may also—</p></intro><level class="para1" eId="section-19-2-a"><num>(a)</num><content><p>ban the subject from being in a specified area in the vicinity of the specified place,</p></content></level><level class="para1" eId="section-19-2-b"><num>(b)</num><content><p>authorise the summary ejection of the subject from the specified place and the specified area,</p></content></level><level class="para1" eId="section-19-2-c"><num>(c)</num><content><p>prohibit the subject from moving any specified thing from the specified place,</p></content></level><level class="para1" eId="section-19-2-d"><num>(d)</num><content><p>direct any specified person to take specified measures to preserve any moveable property owned or controlled by the subject which remains in the specified place while the order has effect,</p></content></level><level class="para1" eId="section-19-2-e"><num>(e)</num><content><p>be made subject to any specified conditions,</p></content></level><level class="para1" eId="section-19-2-f"><num>(f)</num><content><p>require or authorise any person to do, or to refrain from doing, anything else which the sheriff thinks necessary for the proper enforcement of the order.</p></content></level></subsection><subsection eId="section-19-3"><num>(3)</num><content><p>A condition specified in a banning order may, in particular, authorise the subject to be in the place or area from which the subject is banned in specified circumstances (for example, while being supervised by another person or during specified times).</p></content></subsection><subsection eId="section-19-4"><num>(4)</num><intro><p>The sheriff must, before including a condition of the type mentioned in subsection (3), have regard to any relevant representations made by—</p></intro><level class="para1" eId="section-19-4-a"><num>(a)</num><content><p>the applicant for the order,</p></content></level><level class="para1" eId="section-19-4-b"><num>(b)</num><content><p>the adult at risk,</p></content></level><level class="para1" eId="section-19-4-c"><num>(c)</num><content><p>any other person who has an interest in the adult at risk’s well-being or property, and</p></content></level><level class="para1" eId="section-19-4-d"><num>(d)</num><content><p>the subject.</p></content></level></subsection><subsection eId="section-19-5"><num>(5)</num><intro><p>A banning order expires on the earliest of the following dates—</p></intro><level class="para1" eId="section-19-5-a"><num>(a)</num><content><p>any specified expiry date,</p></content></level><level class="para1" eId="section-19-5-b"><num>(b)</num><content><p>if the banning order is recalled, the date on which it is recalled,</p></content></level><level class="para1" eId="section-19-5-c"><num>(c)</num><content><p>the date which falls 6 months after the date on which it is granted.</p></content></level></subsection></section><section eId="section-20"><num>20</num><heading>Criteria for granting banning order</heading><intro><p>The sheriff may grant a banning order only if satisfied—</p></intro><level class="para1" eId="section-20-a"><num>(a)</num><content><p>that an adult at risk is being, or is likely to be, seriously harmed by another person,</p></content></level><level class="para1" eId="section-20-b"><num>(b)</num><content><p>that the adult at risk’s well-being or property would be better safeguarded by banning that other person from a place occupied by the adult than it would be by moving the adult from that place, and</p></content></level><level class="para1" eId="section-20-c"><num>(c)</num><intro><p>that either—</p></intro><level class="para2" eId="section-20-c-i"><num>(i)</num><content><p>the adult at risk is entitled, or permitted by a third party, or</p></content></level><level class="para2" eId="section-20-c-ii"><num>(ii)</num><content><p>neither the adult at risk nor the subject is entitled, or permitted by a third party,</p></content></level><wrapUp><p>to occupy the place from which the subject is to be banned.</p></wrapUp></level></section><section eId="section-21"><num>21</num><heading>Temporary banning orders</heading><subsection eId="section-21-1"><num>(1)</num><content><p>The sheriff may grant a temporary banning order pending determination of an application for a banning order.</p></content></subsection><subsection eId="section-21-2"><num>(2)</num><content><p>A temporary banning order may include any provision which may be included in a banning order.</p></content></subsection><subsection eId="section-21-3"><num>(3)</num><content><p>Where a temporary banning order is granted, the sheriff must determine the related application for a banning order within such period as may be specified in rules made under section 32 of the Sheriff Courts (Scotland) Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/1971/58">1971 (c. 58)</ref>.</p></content></subsection><subsection eId="section-21-4"><num>(4)</num><intro><p>A temporary banning order expires on the earliest of the following dates—</p></intro><level class="para1" eId="section-21-4-a"><num>(a)</num><content><p>the date on which the sheriff determines the related application for a banning order,</p></content></level><level class="para1" eId="section-21-4-b"><num>(b)</num><content><p>the date by which subsection (3) requires the sheriff to determine the related application for a banning order,</p></content></level><level class="para1" eId="section-21-4-c"><num>(c)</num><content><p>if the temporary banning order is recalled, the date on which it is recalled,</p></content></level><level class="para1" eId="section-21-4-d"><num>(d)</num><content><p>any specified expiry date.</p></content></level></subsection></section><section eId="section-22"><num>22</num><heading>Right to apply for banning order</heading><subsection eId="section-22-1"><num>(1)</num><intro><p>An application for a banning order may be made only by or on behalf of—</p></intro><level class="para1" eId="section-22-1-a"><num>(a)</num><content><p>an adult whose well-being or property would be safeguarded by the order,</p></content></level><level class="para1" eId="section-22-1-b"><num>(b)</num><content><p>any other person who is entitled to occupy the place concerned, or</p></content></level><level class="para1" eId="section-22-1-c"><num>(c)</num><content><p>where subsection (2) applies, the council.</p></content></level></subsection><subsection eId="section-22-2"><num>(2)</num><intro><p>The council must apply for a banning order if it is satisfied—</p></intro><level class="para1" eId="section-22-2-a"><num>(a)</num><content><p>as to the matters set out in section 20,</p></content></level><level class="para1" eId="section-22-2-b"><num>(b)</num><content><p>that nobody else is likely to apply for a banning order in respect of the circumstances which caused the council to be satisfied as to those matters, and</p></content></level><level class="para1" eId="section-22-2-c"><num>(c)</num><content><p>that no other proceedings (under this Part or otherwise) to eject or ban the person concerned from the place concerned are depending before a court.</p></content></level></subsection><subsection eId="section-22-3"><num>(3)</num><content><p>An applicant for a banning order may also apply for a temporary banning order in respect of the same case.</p></content></subsection></section><section eId="section-23"><num>23</num><heading>Banning orders: occupancy rights of adult at risk</heading><content><p>The granting of a banning order or a temporary banning order does not affect any right the adult at risk has by virtue of being a non-entitled spouse to occupy a home within the place from which the subject is banned under section 1(1) of the Matrimonial Homes (Family Protection) (Scotland) Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1981/59">1981 (c. 59)</ref>.</p></content></section><section eId="section-24"><num>24</num><heading>Variation or recall of banning order</heading><subsection eId="section-24-1"><num>(1)</num><intro><p>The sheriff may vary or recall—</p></intro><level class="para1" eId="section-24-1-a"><num>(a)</num><content><p>a banning order, or</p></content></level><level class="para1" eId="section-24-1-b"><num>(b)</num><content><p>a temporary banning order,</p></content></level><wrapUp><p>if satisfied that the variation or recall is justified by a change in the facts or circumstances in respect of which the order was granted or, as the case may be, last varied.</p></wrapUp></subsection><subsection eId="section-24-2"><num>(2)</num><intro><p>A variation may not vary the date on which the order expires—</p></intro><level class="para1" eId="section-24-2-a"><num>(a)</num><content><p>in the case of a banning order, beyond the date which is 6 months after the date on which the order was granted,</p></content></level><level class="para1" eId="section-24-2-b"><num>(b)</num><content><p>in the case of a temporary banning order, beyond the date by which section 21(3) requires the sheriff to determine the related application for a banning order.</p></content></level></subsection><subsection eId="section-24-3"><num>(3)</num><intro><p>An order may be so varied or recalled only on an application by or on behalf of—</p></intro><level class="para1" eId="section-24-3-a"><num>(a)</num><content><p>the subject of the order,</p></content></level><level class="para1" eId="section-24-3-b"><num>(b)</num><content><p>the applicant for the order,</p></content></level><level class="para1" eId="section-24-3-c"><num>(c)</num><content><p>the adult at risk to whom the order relates,</p></content></level><level class="para1" eId="section-24-3-d"><num>(d)</num><content><p>any other person who has an interest in the adult at risk’s well-being or property.</p></content></level></subsection></section><section eId="section-25"><num>25</num><heading>Powers of arrest</heading><subsection eId="section-25-1"><num>(1)</num><intro><p>The sheriff may attach a power of arrest to any—</p></intro><level class="para1" eId="section-25-1-a"><num>(a)</num><content><p>banning order, or</p></content></level><level class="para1" eId="section-25-1-b"><num>(b)</num><content><p>temporary banning order.</p></content></level></subsection><subsection eId="section-25-2"><num>(2)</num><intro><p>Any such power of arrest—</p></intro><level class="para1" eId="section-25-2-a"><num>(a)</num><content><p>becomes effective when it is served (together with such documents as may be prescribed) on the subject of the order, and</p></content></level><level class="para1" eId="section-25-2-b"><num>(b)</num><content><p>expires together with the order to which it is attached.</p></content></level></subsection></section><section eId="section-26"><num>26</num><heading>Notification to adult at risk etc.</heading><subsection eId="section-26-1"><num>(1)</num><intro><p>This section applies where the sheriff—</p></intro><level class="para1" eId="section-26-1-a"><num>(a)</num><content><p>grants a banning order or temporary banning order, or</p></content></level><level class="para1" eId="section-26-1-b"><num>(b)</num><content><p>varies or recalls such an order,</p></content></level><wrapUp><p>on the application of a person other than the adult whose well-being or property is safeguarded by the order.</p></wrapUp></subsection><subsection eId="section-26-2"><num>(2)</num><intro><p>Where this section applies, the applicant (or such other person as may be prescribed) must deliver the document mentioned in subsection (3) to—</p></intro><level class="para1" eId="section-26-2-a"><num>(a)</num><content><p>the adult whose well-being or property is safeguarded by the order, and</p></content></level><level class="para1" eId="section-26-2-b"><num>(b)</num><content><p>any other person with an interest in that adult’s well-being or property as the sheriff may specify.</p></content></level></subsection><subsection eId="section-26-3"><num>(3)</num><intro><p>The document which is to be delivered under subsection (2) is a copy of—</p></intro><level class="para1" eId="section-26-3-a"><num>(a)</num><content><p>the order (and any power of arrest attached),</p></content></level><level class="para1" eId="section-26-3-b"><num>(b)</num><content><p>the varied order, or, as the case may be,</p></content></level><level class="para1" eId="section-26-3-c"><num>(c)</num><content><p>the order of recall.</p></content></level></subsection><subsection eId="section-26-4"><num>(4)</num><content><p>Failure to comply with subsection (2) does not invalidate the order, variation or recall concerned.</p></content></subsection></section><section eId="section-27"><num>27</num><heading>Notification to police</heading><subsection eId="section-27-1"><num>(1)</num><intro><p>The applicant for a banning order or temporary banning order (or such other person as may be prescribed) must, as soon as possible after any power of arrest attached to the order becomes effective, deliver to the chief constable—</p></intro><level class="para1" eId="section-27-1-a"><num>(a)</num><content><p>a copy of the order (with the power of arrest attached), and</p></content></level><level class="para1" eId="section-27-1-b"><num>(b)</num><content><p>such other documents as may be prescribed.</p></content></level></subsection><subsection eId="section-27-2"><num>(2)</num><intro><p>Where a banning order or temporary banning order is varied or recalled, the applicant for the variation or recall (or such other person as may be prescribed) must, as soon as possible after the variation or recall, deliver to the chief constable—</p></intro><level class="para1" eId="section-27-2-a"><num>(a)</num><content><p>a copy of the varied order or, as the case may be, a note of the recall, and</p></content></level><level class="para1" eId="section-27-2-b"><num>(b)</num><content><p>such other documents as may be prescribed.</p></content></level></subsection><subsection eId="section-27-3"><num>(3)</num><content><p>In this section, “chief constable” means the chief constable of the police force maintained for the area in which the place specified in the order concerned is situated.</p></content></subsection></section><section eId="section-28"><num>28</num><heading>Arrest for breach of banning order</heading><subsection eId="section-28-1"><num>(1)</num><intro><p>A constable may arrest without warrant the subject of any banning order, or temporary banning order, to which a power of arrest is attached if the constable—</p></intro><level class="para1" eId="section-28-1-a"><num>(a)</num><content><p>reasonably suspects the subject to be breaching, or to have breached, the order, and</p></content></level><level class="para1" eId="section-28-1-b"><num>(b)</num><content><p>considers that there would, if the subject were not arrested, be a risk of the subject breaching the order again.</p></content></level></subsection><subsection eId="section-28-2"><num>(2)</num><intro><p>The constable must—</p></intro><level class="para1" eId="section-28-2-a"><num>(a)</num><content><p>immediately inform the arrested person of the reason for the arrest, and</p></content></level><level class="para1" eId="section-28-2-b"><num>(b)</num><content><p>take the arrested person as quickly as is reasonably practicable to a police station.</p></content></level></subsection></section><section eId="section-29"><num>29</num><heading>Police duties after arrest</heading><subsection eId="section-29-1"><num>(1)</num><intro><p>The officer in charge of a police station to which any person arrested under section 28 is taken (“the officer in charge”) must detain the arrested person in custody until the person is—</p></intro><level class="para1" eId="section-29-1-a"><num>(a)</num><content><p>accused on petition or charged on complaint with an offence in respect of the facts and circumstances which gave rise to the arrest, or</p></content></level><level class="para1" eId="section-29-1-b"><num>(b)</num><content><p>brought before the sheriff under section 32.</p></content></level></subsection><subsection eId="section-29-2"><num>(2)</num><content><p>The officer in charge must ensure that the facts and circumstances which gave rise to the arrest are reported to the fiscal as soon as is practicable.</p></content></subsection></section><section eId="section-30"><num>30</num><heading>Notification of detention</heading><subsection eId="section-30-1"><num>(1)</num><intro><p>Where a person is detained under section 29, the officer in charge must ensure that the detained person is informed immediately of—</p></intro><level class="para1" eId="section-30-1-a"><num>(a)</num><intro><p>the right to have, on request, intimation of the detention and of the place of detention given, without delay, to—</p></intro><level class="para2" eId="section-30-1-a-i"><num>(i)</num><content><p>a solicitor, and</p></content></level><level class="para2" eId="section-30-1-a-ii"><num>(ii)</num><content><p>one other person reasonably named by the person,</p></content></level></level><level class="para1" eId="section-30-1-b"><num>(b)</num><content><p>the right to have, on request, intimation given to a solicitor that the solicitor’s professional assistance is required,</p></content></level><level class="para1" eId="section-30-1-c"><num>(c)</num><content><p>the right to have, on request, the solicitor informed, as soon as the information is available, of the court to which the person is to be taken and the date when that is to happen, and</p></content></level><level class="para1" eId="section-30-1-d"><num>(d)</num><content><p>the right to have, on request, a private interview with the solicitor before any appearance before the sheriff under section 32.</p></content></level></subsection><subsection eId="section-30-2"><num>(2)</num><content><p>Where the officer in charge knows or believes that a person detained under section 29 is a child, the officer must, where practicable, give intimation, without delay, of the detention and of the place of detention to any person known to have parental responsibilities and rights in relation to the detained person.</p></content></subsection><subsection eId="section-30-3"><num>(3)</num><content><p>Any person to whom intimation is given under subsection (2) must be permitted reasonable access to the detained person.</p></content></subsection></section><section eId="section-31"><num>31</num><heading>Duty to keep record of detention</heading><intro><p>The officer in charge must ensure that the following matters are recorded in connection with the detention of a person under section 29—</p></intro><level class="para1" eId="section-31-a"><num>(a)</num><content><p>the time at which the person was arrested,</p></content></level><level class="para1" eId="section-31-b"><num>(b)</num><content><p>the police station to which the person was taken,</p></content></level><level class="para1" eId="section-31-c"><num>(c)</num><content><p>the time when the person arrived at that police station,</p></content></level><level class="para1" eId="section-31-d"><num>(d)</num><content><p>the address of any other place to which the person is, during the detention, taken,</p></content></level><level class="para1" eId="section-31-e"><num>(e)</num><content><p>the time when the person was informed of the rights set out in section 30(1),</p></content></level><level class="para1" eId="section-31-f"><num>(f)</num><content><p>the time and nature of any request made by the person to exercise any of those rights, and</p></content></level><level class="para1" eId="section-31-g"><num>(g)</num><content><p>the time and nature of any action taken by a police officer under section 30.</p></content></level></section><section eId="section-32"><num>32</num><heading>Duty to bring detained person before sheriff</heading><subsection eId="section-32-1"><num>(1)</num><intro><p>Where—</p></intro><level class="para1" eId="section-32-1-a"><num>(a)</num><content><p>a person is detained under section 29, and</p></content></level><level class="para1" eId="section-32-1-b"><num>(b)</num><content><p>the fiscal has not decided to take criminal proceedings in respect of the facts and circumstances which gave rise to the arrest,</p></content></level><wrapUp><p>the detained person must be brought, on the next court day on which it is practicable to do so, before the sheriff sitting as a court of summary jurisdiction for the district in which the person was arrested.</p></wrapUp></subsection><subsection eId="section-32-2"><num>(2)</num><intro><p>Nothing in this section prevents the detained person from being brought before the sheriff on a day other than a court day if—</p></intro><level class="para1" eId="section-32-2-a"><num>(a)</num><content><p>the sheriff is sitting on such a day for the disposal of criminal business, and</p></content></level><level class="para1" eId="section-32-2-b"><num>(b)</num><content><p>the fiscal has not decided to take criminal proceedings in respect of the facts and circumstances which gave rise to the arrest.</p></content></level></subsection></section><section eId="section-33"><num>33</num><heading>Information to be presented to sheriff</heading><intro><p>Where a person is brought before the sheriff under section 32, the fiscal must present to the sheriff a petition—</p></intro><level class="para1" eId="section-33-a"><num>(a)</num><content><p>giving the detained person’s particulars,</p></content></level><level class="para1" eId="section-33-b"><num>(b)</num><content><p>stating the facts and circumstances which gave rise to the arrest,</p></content></level><level class="para1" eId="section-33-c"><num>(c)</num><intro><p>giving any information known to the fiscal—</p></intro><level class="para2" eId="section-33-c-i"><num>(i)</num><content><p>about the circumstances which gave rise to the banning order or temporary banning order concerned, and</p></content></level><level class="para2" eId="section-33-c-ii"><num>(ii)</num><content><p>which is relevant to an assessment of whether the detained person is likely to breach that order again, and</p></content></level></level><level class="para1" eId="section-33-d"><num>(d)</num><content><p>requesting the sheriff to consider whether a longer period of detention is justified.</p></content></level></section><section eId="section-34"><num>34</num><heading>Criteria for authorising longer detention</heading><subsection eId="section-34-1"><num>(1)</num><intro><p>The sheriff may, if satisfied—</p></intro><level class="para1" eId="section-34-1-a"><num>(a)</num><content><p>that the information which the fiscal presents under section 33 ostensibly discloses a breach of a banning order or temporary banning order, and</p></content></level><level class="para1" eId="section-34-1-b"><num>(b)</num><content><p>that there is a substantial risk that the detained person will breach the order again,</p></content></level><wrapUp><p>by order authorise the continuation of the detention for a period of not more than 2 days (not counting days which are not court days).</p></wrapUp></subsection><subsection eId="section-34-2"><num>(2)</num><content><p>Where the sheriff refuses to authorise such a continuation, the detained person must be released from custody (unless that person is in custody in respect of any other matter).</p></content></subsection><subsection eId="section-34-3"><num>(3)</num><content><p>Before deciding whether to grant an order under this section, the sheriff must give the detained person the opportunity to make representations.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-protection-orders-and-visits-supplementary"><heading>Protection orders and visits: supplementary</heading><section eId="section-35"><num>35</num><heading>Consent of adult at risk</heading><subsection eId="section-35-1"><num>(1)</num><content><p>The sheriff must not make a protection order if the sheriff knows that the affected adult at risk has refused to consent to the granting of the order.</p></content></subsection><subsection eId="section-35-2"><num>(2)</num><content><p>A person must not take any action for the purposes of carrying out or enforcing a protection order if the person knows that the affected adult at risk has refused to consent to the action.</p></content></subsection><subsection eId="section-35-3"><num>(3)</num><intro><p>Despite subsections (1) and (2), a refusal to consent may be ignored if the sheriff or person reasonably believes—</p></intro><level class="para1" eId="section-35-3-a"><num>(a)</num><content><p>that the affected adult at risk has been unduly pressurised to refuse consent, and</p></content></level><level class="para1" eId="section-35-3-b"><num>(b)</num><content><p>that there are no steps which could reasonably be taken with the adult’s consent which would protect the adult from the harm which the order or action is intended to prevent.</p></content></level></subsection><subsection eId="section-35-4"><num>(4)</num><intro><p>An adult at risk may be considered to have been unduly pressurised to refuse to consent to the granting of an order or the taking of an action if it appears—</p></intro><level class="para1" eId="section-35-4-a"><num>(a)</num><content><p>that harm which the order or action is intended to prevent is being, or is likely to be, inflicted by a person in whom the adult at risk has confidence and trust, and</p></content></level><level class="para1" eId="section-35-4-b"><num>(b)</num><content><p>that the adult at risk would consent if the adult did not have confidence and trust in that person.</p></content></level></subsection><subsection eId="section-35-5"><num>(5)</num><content><p>Subsection (4) does not affect the generality of subsection (3).</p></content></subsection><subsection eId="section-35-6"><num>(6)</num><intro><p>Neither subsection (3) nor any other provision of this Part authorises a council officer or a health professional or other council nominee to ignore a refusal by a person to consent to participate in—</p></intro><level class="para1" eId="section-35-6-a"><num>(a)</num><content><p>an interview, or</p></content></level><level class="para1" eId="section-35-6-b"><num>(b)</num><content><p>a medical examination.</p></content></level></subsection><subsection eId="section-35-7"><num>(7)</num><intro><p>In this section, a “protection order” means any—</p></intro><level class="para1" eId="section-35-7-a"><num>(a)</num><content><p>assessment order,</p></content></level><level class="para1" eId="section-35-7-b"><num>(b)</num><content><p>removal order,</p></content></level><level class="para1" eId="section-35-7-c"><num>(c)</num><content><p>banning order, or</p></content></level><level class="para1" eId="section-35-7-d"><num>(d)</num><content><p>temporary banning order,</p></content></level><wrapUp><p>and “affected adult at risk”, in relation to a protection order, means the person whose well-being or property would be safeguarded by the granting, carrying out or enforcement of the order.</p></wrapUp></subsection></section><section eId="section-36"><num>36</num><heading>Visits: supplementary provisions</heading><subsection eId="section-36-1"><num>(1)</num><content><p>A council officer may visit a place at reasonable times only.</p></content></subsection><subsection eId="section-36-2"><num>(2)</num><intro><p>A council officer must, while visiting any place—</p></intro><level class="para1" eId="section-36-2-a"><num>(a)</num><content><p>state the object of the visit, and</p></content></level><level class="para1" eId="section-36-2-b"><num>(b)</num><content><p>produce evidence of the officer’s authorisation to visit the place.</p></content></level></subsection><subsection eId="section-36-3"><num>(3)</num><intro><p>A council officer may, while visiting any place—</p></intro><level class="para1" eId="section-36-3-a"><num>(a)</num><content><p>examine the place,</p></content></level><level class="para1" eId="section-36-3-b"><num>(b)</num><intro><p>take into the place—</p></intro><level class="para2" eId="section-36-3-b-i"><num>(i)</num><content><p>any other person, and</p></content></level><level class="para2" eId="section-36-3-b-ii"><num>(ii)</num><content><p>any equipment,</p></content></level><wrapUp><p>as may be reasonably required in order to fulfil the object of the visit, and</p></wrapUp></level><level class="para1" eId="section-36-3-c"><num>(c)</num><content><p>do anything else (under this Part or otherwise) which is reasonably required in order to fulfil the object of the visit.</p></content></level></subsection><subsection eId="section-36-4"><num>(4)</num><content><p>A council officer may not use force during, or in order to facilitate, a visit (but this does not prevent the sheriff from granting a warrant for entry authorising a constable to use force).</p></content></subsection><subsection eId="section-36-5"><num>(5)</num><content><p>A refusal to allow a council officer, or any person accompanying a council officer, to carry out a visit which is not authorised by a warrant for entry does not constitute an offence under section 49(1).</p></content></subsection></section><section eId="section-37"><num>37</num><heading>Warrants for entry</heading><subsection eId="section-37-1"><num>(1)</num><intro><p>A “warrant for entry” is a warrant which authorises—</p></intro><level class="para1" eId="section-37-1-a"><num>(a)</num><content><p>a council officer to visit any specified place under section 7 or 16 together with a constable, and</p></content></level><level class="para1" eId="section-37-1-b"><num>(b)</num><content><p>a constable who so accompanies a council officer to do anything, using reasonable force where necessary, which the constable considers to be reasonably required in order to fulfil the object of the visit.</p></content></level></subsection><subsection eId="section-37-2"><num>(2)</num><intro><p>A warrant for entry—</p></intro><level class="para1" eId="section-37-2-a"><num>(a)</num><content><p>expires 72 hours after it is granted, and</p></content></level><level class="para1" eId="section-37-2-b"><num>(b)</num><content><p>does not entitle any person to remain in a place which that person has entered in pursuance of the warrant after the warrant has expired.</p></content></level></subsection></section><section eId="section-38"><num>38</num><heading>Criteria for granting warrants for entry: section 7 visits</heading><subsection eId="section-38-1"><num>(1)</num><content><p>A sheriff who grants an assessment order must also grant a warrant for entry in relation to a visit under section 7 of a place from which a person may be taken in pursuance of the assessment order.</p></content></subsection><subsection eId="section-38-2"><num>(2)</num><intro><p>The sheriff may, on the application of the council, otherwise grant a warrant for entry in relation to a visit under section 7 only if satisfied, by evidence on oath—</p></intro><level class="para1" eId="section-38-2-a"><num>(a)</num><intro><p>that a council officer has been, or reasonably expects to be—</p></intro><level class="para2" eId="section-38-2-a-i"><num>(i)</num><content><p>refused entry to, or</p></content></level><level class="para2" eId="section-38-2-a-ii"><num>(ii)</num><content><p>otherwise unable to enter,</p></content></level><wrapUp><p>the place concerned, or</p></wrapUp></level><level class="para1" eId="section-38-2-b"><num>(b)</num><content><p>that any attempt by a council officer to visit the place without such a warrant would defeat the object of the visit.</p></content></level></subsection></section><section eId="section-39"><num>39</num><heading>Duty to grant warrants for entry: removal orders</heading><subsection eId="section-39-1"><num>(1)</num><content><p>A sheriff who grants a removal order must also grant a warrant for entry in relation to a visit under section 16.</p></content></subsection><subsection eId="section-39-2"><num>(2)</num><intro><p>Where—</p></intro><level class="para1" eId="section-39-2-a"><num>(a)</num><content><p>a removal order is varied, and</p></content></level><level class="para1" eId="section-39-2-b"><num>(b)</num><content><p>the subject of the varied order has not yet been moved in pursuance of the order,</p></content></level><wrapUp><p>the warrant for entry granted under subsection (1) in relation to the order is, regardless of whether the warrant has already expired, to be treated for the purposes of section 37(2) as having been granted on the date of variation.</p></wrapUp></subsection></section><section eId="section-40"><num>40</num><heading>Urgent cases</heading><subsection eId="section-40-1"><num>(1)</num><intro><p>A council which believes that the circumstances set out in subsection (2) have arisen may apply to a justice of the peace instead of the sheriff for—</p></intro><level class="para1" eId="section-40-1-a"><num>(a)</num><content><p>a removal order, or</p></content></level><level class="para1" eId="section-40-1-b"><num>(b)</num><content><p>a warrant for entry in respect of a visit under section 7.</p></content></level></subsection><subsection eId="section-40-2"><num>(2)</num><intro><p>Those circumstances are—</p></intro><level class="para1" eId="section-40-2-a"><num>(a)</num><content><p>that it is not practicable to apply to the sheriff, and</p></content></level><level class="para1" eId="section-40-2-b"><num>(b)</num><content><p>that an adult at risk is likely to be harmed if there is any delay in granting such an order or warrant.</p></content></level></subsection><subsection eId="section-40-3"><num>(3)</num><intro><p>A justice of the peace may grant a removal order only if satisfied, by evidence on oath—</p></intro><level class="para1" eId="section-40-3-a"><num>(a)</num><content><p>that the circumstances set out in subsection (2) have arisen, and</p></content></level><level class="para1" eId="section-40-3-b"><num>(b)</num><content><p>as to the matter set out in section 15(1).</p></content></level></subsection><subsection eId="section-40-4"><num>(4)</num><content><p>Subsections (3) to (7) of section 41 do not apply in relation to an application to a justice of the peace for a removal order.</p></content></subsection><subsection eId="section-40-5"><num>(5)</num><content><p>A justice of the peace who grants a removal order must also grant a warrant for entry in relation to a visit under section 16.</p></content></subsection><subsection eId="section-40-6"><num>(6)</num><intro><p>A justice of the peace may grant a warrant for entry in relation to a visit under section 7 only if satisfied, by evidence on oath—</p></intro><level class="para1" eId="section-40-6-a"><num>(a)</num><content><p>that the circumstances set out in subsection (2) have arisen, and</p></content></level><level class="para1" eId="section-40-6-b"><num>(b)</num><content><p>as to either of the matters set out in section 38(2).</p></content></level></subsection><subsection eId="section-40-7"><num>(7)</num><intro><p>A removal order granted under this section must—</p></intro><level class="para1" eId="section-40-7-a"><num>(a)</num><content><p>despite section 14(1)(a), specify a period of 12 hours beginning when the order is made as the period within which the person specified in the order may be moved in pursuance of the order, and</p></content></level><level class="para1" eId="section-40-7-b"><num>(b)</num><content><p>specify a period of no longer than 24 hours as the period within which the order is to have effect.</p></content></level></subsection><subsection eId="section-40-8"><num>(8)</num><content><p>Despite section 37(2)(a), a warrant for entry granted under this section expires 12 hours after it is granted.</p></content></subsection></section><section eId="section-41"><num>41</num><heading>Applications: procedure</heading><subsection eId="section-41-1"><num>(1)</num><intro><p>This section applies in relation to any application for—</p></intro><level class="para1" eId="section-41-1-a"><num>(a)</num><content><p>an assessment order,</p></content></level><level class="para1" eId="section-41-1-b"><num>(b)</num><content><p>a removal order,</p></content></level><level class="para1" eId="section-41-1-c"><num>(c)</num><content><p>a banning order,</p></content></level><level class="para1" eId="section-41-1-d"><num>(d)</num><content><p>a temporary banning order,</p></content></level><level class="para1" eId="section-41-1-e"><num>(e)</num><content><p>the variation or recall of a removal order, banning order or temporary banning order.</p></content></level></subsection><subsection eId="section-41-2"><num>(2)</num><intro><p>The sheriff may disapply any of the following provisions in relation to an application if satisfied that doing so will protect an adult at risk from serious harm or will not prejudice any person affected by the disapplication—</p></intro><level class="para1" eId="section-41-2-a"><num>(a)</num><content><p>subsections (3) to (7),</p></content></level><level class="para1" eId="section-41-2-b"><num>(b)</num><content><p>section 15(3),</p></content></level><level class="para1" eId="section-41-2-c"><num>(c)</num><content><p>section 19(4).</p></content></level></subsection><subsection eId="section-41-3"><num>(3)</num><intro><p>The applicant must give notice of an application to—</p></intro><level class="para1" eId="section-41-3-a"><num>(a)</num><content><p>the subject of the application, and</p></content></level><level class="para1" eId="section-41-3-b"><num>(b)</num><content><p>the affected adult at risk (where that person is neither the applicant nor the subject of the application).</p></content></level></subsection><subsection eId="section-41-4"><num>(4)</num><intro><p>The sheriff must, before determining an application, invite—</p></intro><level class="para1" eId="section-41-4-a"><num>(a)</num><content><p>the subject of the application, and</p></content></level><level class="para1" eId="section-41-4-b"><num>(b)</num><content><p>the affected adult at risk (where that person is neither the applicant nor the subject of the application).</p></content></level><wrapUp><p>to be heard by, or represented before, the sheriff.</p></wrapUp></subsection><subsection eId="section-41-5"><num>(5)</num><content><p>The affected adult at risk may be accompanied at any hearing conducted in respect of an application by a friend, a relative or any other representative chosen by the adult.</p></content></subsection><subsection eId="section-41-6"><num>(6)</num><content><p>The sheriff may appoint a person to safeguard the interests of the affected adult at risk in any proceedings relating to an application.</p></content></subsection><subsection eId="section-41-7"><num>(7)</num><content><p>Such an appointment may be made on such terms as the sheriff thinks fit.</p></content></subsection><subsection eId="section-41-8"><num>(8)</num><content><p>Nothing in this section affects the Court of Session’s power to make further provision under section 32 of the Sheriff Courts (Scotland) Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1971/58">1971 (c. 58)</ref> in connection with the procedure and practice to be followed in connection with an application.</p></content></subsection><subsection eId="section-41-9"><num>(9)</num><intro><p>For the purposes of this section, the “affected adult at risk” is—</p></intro><level class="para1" eId="section-41-9-a"><num>(a)</num><content><p>where an application relates to an assessment order or removal order, the subject of the application,</p></content></level><level class="para1" eId="section-41-9-b"><num>(b)</num><content><p>where an application relates to a banning order or a temporary banning order, the person whom that order would protect, or is protecting, from harm.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-adult-protection-committees"><heading>Adult Protection Committees</heading><section eId="section-42"><num>42</num><heading>Adult Protection Committees</heading><subsection eId="section-42-1"><num>(1)</num><intro><p>Each council must establish a committee (an “Adult Protection Committee”) with the following functions—</p></intro><level class="para1" eId="section-42-1-a"><num>(a)</num><content><p>to keep under review the procedures and practices of the public bodies and office-holders to which this section applies which relate to the safeguarding of adults at risk present in the council’s area (including, in particular, any such procedures and practices which involve co-operation between the council and other public bodies or office-holders to which this section applies),</p></content></level><level class="para1" eId="section-42-1-b"><num>(b)</num><content><p>to give information or advice, or make proposals, to any public body and office-holder to which this section applies on the exercise of functions which relate to the safeguarding of adults at risk present in the council’s area,</p></content></level><level class="para1" eId="section-42-1-c"><num>(c)</num><content><p>to make, or assist in or encourage the making of, arrangements for improving the skills and knowledge of officers or employees of the public bodies and office-holders to which this section applies who have responsibilities relating to the safeguarding of adults at risk present in the council’s area,</p></content></level><level class="para1" eId="section-42-1-d"><num>(d)</num><content><p>any other function relating to the safeguarding of adults at risk as the Scottish Ministers may by order specify.</p></content></level></subsection><subsection eId="section-42-2"><num>(2)</num><content><p>In performing its functions, an Adult Protection Committee must have regard to the desirability of improving co-operation between each of the public bodies and office-holders to which this section applies for the purpose of assisting those bodies and office-holders to perform functions in order to safeguard adults at risk present in the council’s area.</p></content></subsection><subsection eId="section-42-3"><num>(3)</num><intro><p>The public bodies and office-holders to which this section applies are—</p></intro><level class="para1" eId="section-42-3-a"><num>(a)</num><content><p>the council,</p></content></level><level class="para1" eId="section-42-3-b"><num>(b)</num><content><p>the Care Commission,</p></content></level><level class="para1" eId="section-42-3-c"><num>(c)</num><content><p>the relevant Health Board,</p></content></level><level class="para1" eId="section-42-3-d"><num>(d)</num><content><p>the chief constable of the police force maintained in the council’s area,</p></content></level><level class="para1" eId="section-42-3-e"><num>(e)</num><content><p>any other public body or office-holder as the Scottish Ministers may by order specify.</p></content></level></subsection></section><section eId="section-43"><num>43</num><heading>Membership</heading><subsection eId="section-43-1"><num>(1)</num><content><p>It is for the council to appoint the convener and the other members of its Adult Protection Committee in accordance with this section.</p></content></subsection><subsection eId="section-43-2"><num>(2)</num><content><p>Each public body and office-holder to which section 42 applies (other than the council and the Care Commission) must nominate a representative who appears to the body or office-holder to have skills and knowledge relevant to the functions of the Adult Protection Committee to be a Committee member.</p></content></subsection><subsection eId="section-43-3"><num>(3)</num><content><p>The Care Commission may nominate a representative who appears to it to have skills and knowledge relevant to the functions of the Adult Protection Committee to be a Committee member.</p></content></subsection><subsection eId="section-43-4"><num>(4)</num><content><p>The council must appoint the representatives nominated under subsections (2) and (3) as Committee members.</p></content></subsection><subsection eId="section-43-5"><num>(5)</num><content><p>The council may also appoint as Committee members such other persons who appear to it to have skills and knowledge relevant to the functions of the Adult Protection Committee.</p></content></subsection><subsection eId="section-43-6"><num>(6)</num><content><p>The Committee convener must not be a member or officer of the council.</p></content></subsection></section><section eId="section-44"><num>44</num><heading>Committee procedure</heading><subsection eId="section-44-1"><num>(1)</num><content><p>It is for an Adult Protection Committee to regulate its own procedures.</p></content></subsection><subsection eId="section-44-2"><num>(2)</num><intro><p>But those procedures must allow a representative of—</p></intro><level class="para1" eId="section-44-2-a"><num>(a)</num><content><p>the Mental Welfare Commission for Scotland,</p></content></level><level class="para1" eId="section-44-2-b"><num>(b)</num><content><p>the Public Guardian,</p></content></level><level class="para1" eId="section-44-2-c"><num>(c)</num><content><p>the Care Commission (where it has not nominated a representative to be a member of the Committee), and</p></content></level><level class="para1" eId="section-44-2-d"><num>(d)</num><content><p>any other public body or office-holder as the Scottish Ministers may by order specify,</p></content></level><wrapUp><p>to attend Committee meetings.</p></wrapUp></subsection></section><section eId="section-45"><num>45</num><heading>Duty to provide information to the Committee</heading><subsection eId="section-45-1"><num>(1)</num><content><p>Each of the public bodies and office-holders set out in subsection (2) must provide the Adult Protection Committee with any information which the Committee may reasonably require for the purposes of performing the Committee’s functions.</p></content></subsection><subsection eId="section-45-2"><num>(2)</num><intro><p>Those public bodies and office-holders are—</p></intro><level class="para1" eId="section-45-2-a"><num>(a)</num><content><p>each of the public bodies and office-holders represented on the Adult Protection Committee by virtue of section 43(4),</p></content></level><level class="para1" eId="section-45-2-b"><num>(b)</num><content><p>the Mental Welfare Commission for Scotland,</p></content></level><level class="para1" eId="section-45-2-c"><num>(c)</num><content><p>the Public Guardian,</p></content></level><level class="para1" eId="section-45-2-d"><num>(d)</num><content><p>the Care Commission (where it is not represented on the Committee), and</p></content></level><level class="para1" eId="section-45-2-e"><num>(e)</num><content><p>any other public body or office-holder as the Scottish Ministers may by order specify.</p></content></level></subsection></section><section eId="section-46"><num>46</num><heading>Biennial Report</heading><intro><p>The convener of an Adult Protection Committee must, as soon as practical after such date as the council may direct biennially—</p></intro><level class="para1" eId="section-46-a"><num>(a)</num><content><p>prepare a general report on the exercise of the Committee’s functions during the 2 years ending on that date, and</p></content></level><level class="para1" eId="section-46-b"><num>(b)</num><intro><p>after securing the Committee’s approval of the report, send a copy of it to—</p></intro><level class="para2" eId="section-46-b-i"><num>(i)</num><content><p>each of the public bodies and office-holders represented on the Adult Protection Committee by virtue of section 43(4),</p></content></level><level class="para2" eId="section-46-b-ii"><num>(ii)</num><content><p>the Scottish Ministers,</p></content></level><level class="para2" eId="section-46-b-iii"><num>(iii)</num><content><p>the Mental Welfare Commission for Scotland,</p></content></level><level class="para2" eId="section-46-b-iv"><num>(iv)</num><content><p>the Public Guardian,</p></content></level><level class="para2" eId="section-46-b-v"><num>(v)</num><content><p>the Care Commission (where it not represented on the Committee), and</p></content></level><level class="para2" eId="section-46-b-vi"><num>(vi)</num><content><p>any other public body or office-holder as the Scottish Ministers may by order specify.</p></content></level></level></section><section eId="section-47"><num>47</num><heading>Guidance</heading><content><p>Adult Protection Committees, and councils, must have regard to any guidance issued by the Scottish Ministers about their functions under sections 42 to 46.</p></content></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-1-crossheading-other-provisions"><heading>Other provisions</heading><section eId="section-48"><num>48</num><heading>Code of practice</heading><subsection eId="section-48-1"><num>(1)</num><intro><p>The Scottish Ministers must prepare a code of practice containing guidance about the performance of functions under this Part by—</p></intro><level class="para1" eId="section-48-1-a"><num>(a)</num><content><p>councils and their officers, and</p></content></level><level class="para1" eId="section-48-1-b"><num>(b)</num><content><p>health professionals.</p></content></level></subsection><subsection eId="section-48-2"><num>(2)</num><content><p>The Scottish Ministers must review the code of practice from time to time and may, following such a review, revise it.</p></content></subsection><subsection eId="section-48-3"><num>(3)</num><intro><p>Before preparing the code of practice, and when reviewing it, the Scottish Ministers must consult—</p></intro><level class="para1" eId="section-48-3-a"><num>(a)</num><content><p>such councils (or persons representing councils),</p></content></level><level class="para1" eId="section-48-3-b"><num>(b)</num><content><p>such health professionals (or persons representing health professionals), and</p></content></level><level class="para1" eId="section-48-3-c"><num>(c)</num><content><p>such other persons appearing to them to be interested in the code of practice,</p></content></level><wrapUp><p>as they think fit.</p></wrapUp></subsection><subsection eId="section-48-4"><num>(4)</num><content><p>The Scottish Ministers must publish the code of practice and any revisions to it.</p></content></subsection><subsection eId="section-48-5"><num>(5)</num><content><p>Councils, council officers and health professionals performing functions under this Part must, if relevant, have regard to the code of practice.</p></content></subsection></section><section eId="section-49"><num>49</num><heading>Obstruction</heading><subsection eId="section-49-1"><num>(1)</num><intro><p>A person commits an offence by, without reasonable excuse, preventing or obstructing any other person from doing anything which the other person is authorised or entitled to do by virtue of—</p></intro><level class="para1" eId="section-49-1-a"><num>(a)</num><content><p>an assessment order,</p></content></level><level class="para1" eId="section-49-1-b"><num>(b)</num><content><p>a removal order,</p></content></level><level class="para1" eId="section-49-1-c"><num>(c)</num><content><p>a banning order,</p></content></level><level class="para1" eId="section-49-1-d"><num>(d)</num><content><p>a temporary banning order,</p></content></level><level class="para1" eId="section-49-1-e"><num>(e)</num><content><p>a warrant for entry, or</p></content></level><level class="para1" eId="section-49-1-f"><num>(f)</num><content><p>any provision of this Part.</p></content></level></subsection><subsection eId="section-49-2"><num>(2)</num><content><p>A person commits an offence by, without reasonable excuse, refusing or otherwise failing to comply with a requirement made under section 10.</p></content></subsection><subsection eId="section-49-3"><num>(3)</num><intro><p>A person who is guilty of an offence under this section is liable, on summary conviction—</p></intro><level class="para1" eId="section-49-3-a"><num>(a)</num><content><p>to a fine not exceeding level 3 on the standard scale,</p></content></level><level class="para1" eId="section-49-3-b"><num>(b)</num><content><p>to be imprisoned for a term not exceeding 3 months, or</p></content></level><level class="para1" eId="section-49-3-c"><num>(c)</num><content><p>to both such a fine and such imprisonment.</p></content></level></subsection><subsection eId="section-49-4"><num>(4)</num><content><p>Nothing done by a person whose well-being or property another person is attempting to investigate or safeguard constitutes an offence under this section.</p></content></subsection></section><section eId="section-50"><num>50</num><heading>Offences by bodies corporate etc.</heading><subsection eId="section-50-1"><num>(1)</num><intro><p>Where—</p></intro><level class="para1" eId="section-50-1-a"><num>(a)</num><intro><p>an offence under this Part has been committed by—</p></intro><level class="para2" eId="section-50-1-a-i"><num>(i)</num><content><p>a body corporate,</p></content></level><level class="para2" eId="section-50-1-a-ii"><num>(ii)</num><content><p>a Scottish partnership, or</p></content></level><level class="para2" eId="section-50-1-a-iii"><num>(iii)</num><content><p>an unincorporated association other than a Scottish partnership, and</p></content></level></level><level class="para1" eId="section-50-1-b"><num>(b)</num><intro><p>it is proved that the offence was committed with the consent or connivance of, or was attributable to any neglect on the part of—</p></intro><level class="para2" eId="section-50-1-b-i"><num>(i)</num><content><p>a relevant person, or</p></content></level><level class="para2" eId="section-50-1-b-ii"><num>(ii)</num><content><p>a person purporting to act in the capacity of a relevant person,</p></content></level></level><wrapUp><p>that person as well as the body corporate, partnership or, as the case may be, unincorporated association is guilty of the offence and is liable to be proceeded against and punished accordingly.</p></wrapUp></subsection><subsection eId="section-50-2"><num>(2)</num><intro><p>In subsection (1), “relevant person” means—</p></intro><level class="para1" eId="section-50-2-a"><num>(a)</num><intro><p>in relation to a body corporate other than a council—</p></intro><level class="para2" eId="section-50-2-a-i"><num>(i)</num><content><p>a director, manager, secretary or other similar officer of the body,</p></content></level><level class="para2" eId="section-50-2-a-ii"><num>(ii)</num><content><p>where the affairs of the body are managed by its members, a member,</p></content></level></level><level class="para1" eId="section-50-2-b"><num>(b)</num><content><p>in relation to a council, an officer or member of the council,</p></content></level><level class="para1" eId="section-50-2-c"><num>(c)</num><content><p>in relation to a Scottish partnership, a partner, and</p></content></level><level class="para1" eId="section-50-2-d"><num>(d)</num><content><p>in relation to an unincorporated association other than a Scottish partnership, a person who is concerned in the management or control of the association.</p></content></level></subsection></section><section eId="section-51"><num>51</num><heading>Appeals</heading><subsection eId="section-51-1"><num>(1)</num><intro><p>No appeal is competent against the granting of—</p></intro><level class="para1" eId="section-51-1-a"><num>(a)</num><content><p>an assessment order,</p></content></level><level class="para1" eId="section-51-1-b"><num>(b)</num><content><p>a removal order, or</p></content></level><level class="para1" eId="section-51-1-c"><num>(c)</num><content><p>a warrant for entry.</p></content></level></subsection><subsection eId="section-51-2"><num>(2)</num><content><p>Any decision of a sheriff to grant, or to refuse to grant, a banning order or temporary banning order may be appealed to the sheriff principal.</p><p>But an appeal under this subsection against the granting of, or a refusal to grant, a temporary banning order is competent only with leave of the sheriff.</p></content></subsection><subsection eId="section-51-3"><num>(3)</num><content><p>The sheriff principal’s decision on an appeal under subsection (2) may be appealed to the Court of Session.</p><p>But an appeal under this subsection against a decision relating to a temporary banning order is competent only with leave of the sheriff principal.</p></content></subsection><subsection eId="section-51-4"><num>(4)</num><intro><p>Where a sheriff principal decides to quash a banning order or temporary banning order, the order concerned is (despite the sheriff principal’s determination) to continue to have effect until—</p></intro><level class="para1" eId="section-51-4-a"><num>(a)</num><content><p>the end of the period during which the decision to quash the order may be appealed to the Court of Session (if no such appeal is made),</p></content></level><level class="para1" eId="section-51-4-b"><num>(b)</num><intro><p>where such an appeal is made, the day on which—</p></intro><level class="para2" eId="section-51-4-b-i"><num>(i)</num><content><p>the appeal is abandoned, or</p></content></level><level class="para2" eId="section-51-4-b-ii"><num>(ii)</num><content><p>the Court of Session confirms the sheriff principal’s decision to quash the order, or</p></content></level></level><level class="para1" eId="section-51-4-c"><num>(c)</num><intro><p>any other day on which—</p></intro><level class="para2" eId="section-51-4-c-i"><num>(i)</num><content><p>the order otherwise expires by virtue of section 19(5) or 21(4), or</p></content></level><level class="para2" eId="section-51-4-c-ii"><num>(ii)</num><content><p>in the case of a temporary banning order, the sheriff principal refuses leave to appeal against the decision to quash the order.</p></content></level></level></subsection></section><section eId="section-52"><num>52</num><heading>Persons authorised to perform functions under this Part</heading><subsection eId="section-52-1"><num>(1)</num><content><p>The Scottish Ministers may by order restrict the type of individual who may be authorised by a council to perform functions given to council officers by virtue of this Part.</p></content></subsection><subsection eId="section-52-2"><num>(2)</num><intro><p>For the purposes of this Part, a person is a “health professional” if the person is—</p></intro><level class="para1" eId="section-52-2-a"><num>(a)</num><content><p>a doctor,</p></content></level><level class="para1" eId="section-52-2-b"><num>(b)</num><content><p>a nurse,</p></content></level><level class="para1" eId="section-52-2-c"><num>(c)</num><content><p>a midwife, or</p></content></level><level class="para1" eId="section-52-2-d"><num>(d)</num><content><p>any other type of individual described (by reference to skills, qualifications, experience or otherwise) by order made by the Scottish Ministers.</p></content></level></subsection></section><section eId="section-53"><num>53</num><heading>Interpretation of Part 1</heading><subsection eId="section-53-1"><num>(1)</num><intro><p>In this Part—</p></intro><hcontainer name="definition"><content><p>“adult” means an individual aged 16 or over,</p></content></hcontainer><hcontainer name="definition"><content><p>“adult at risk” has the meaning given by section 3,</p></content></hcontainer><hcontainer name="definition"><content><p>“Adult Protection Committee” means a committee established under section 42,</p></content></hcontainer><hcontainer name="definition"><content><p>“assessment order” has the meaning given by section 11,</p></content></hcontainer><hcontainer name="definition"><content><p>“attorney” means a continuing attorney or welfare attorney (within the meaning of the Adults with Incapacity (Scotland) Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/asp/2000/4">2000 (asp 4)</ref>),</p></content></hcontainer><hcontainer name="definition"><content><p>“banning order” has the meaning given by section 19,</p></content></hcontainer><hcontainer name="definition"><content><p>“Care Commission” means the Scottish Commission for the Regulation of Care,</p></content></hcontainer><hcontainer name="definition"><content><p>“child” means an individual under the age of 16,</p></content></hcontainer><hcontainer name="definition"><content><p>“conduct” includes neglect and other failures to act,</p></content></hcontainer><hcontainer name="definition"><content><p>“council” means a council constituted under section 2 of the Local Government etc. (Scotland) Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1994/39">1994 (c. 39)</ref>; and references to a council in relation to any person known or believed to be an adult at risk are references to the council for the area which the person is for the time being in,</p></content></hcontainer><hcontainer name="definition"><content><p>“council officer” means an individual appointed by a council under section 64 of the Local Government (Scotland) Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1973/65">1973 (c. 65)</ref> (but “council officer” must, where relevant, also be interpreted in accordance with any order made under section 52(1)),</p></content></hcontainer><hcontainer name="definition"><intro><p>“court day” means a day which is not—</p></intro><level class="para1"><num>(a)</num><content><p>a Saturday,</p></content></level><level class="para1"><num>(b)</num><content><p>a Sunday, or</p></content></level><level class="para1"><num>(c)</num><content><p>a court holiday prescribed for the relevant court under section 8 of the Criminal Procedure (Scotland) Act <ref eId="c00008" href="http://www.legislation.gov.uk/id/ukpga/1995/46">1995 (c. 46)</ref>,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“doctor” means a fully registered person within the meaning of the Medical Act <ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/1983/54">1983 (c. 54)</ref>,</p></content></hcontainer><hcontainer name="definition"><content><p>“fiscal” means the procurator fiscal,</p></content></hcontainer><hcontainer name="definition"><intro><p>“harm” includes all harmful conduct and, in particular, includes—</p></intro><level class="para1"><num>(a)</num><content><p>conduct which causes physical harm,</p></content></level><level class="para1"><num>(b)</num><content><p>conduct which causes psychological harm (for example: by causing fear, alarm or distress),</p></content></level><level class="para1"><num>(c)</num><content><p>unlawful conduct which appropriates or adversely affects property, rights or interests (for example: theft, fraud, embezzlement or extortion),</p></content></level><level class="para1"><num>(d)</num><content><p>conduct which causes self-harm,</p></content></level></hcontainer><hcontainer name="definition"><content><p>“health professional” has the meaning given by section 52(2),</p></content></hcontainer><hcontainer name="definition"><content><p>“midwife” means an individual registered in the register maintained under article 5 of the Nurses and Midwives Order 2001 (<ref eId="c00010" href="http://www.legislation.gov.uk/id/uksi/2002/253">S.I. 2002/253</ref>) by virtue of qualifications in midwifery,</p></content></hcontainer><hcontainer name="definition"><content><p>“nearest relative” has the meaning given by section 254 of the Mental Health (Care and Treatment) (Scotland) Act <ref eId="c00011" href="http://www.legislation.gov.uk/id/asp/2003/13">2003 (asp 13)</ref>,</p></content></hcontainer><hcontainer name="definition"><content><p>“nurse” means an individual registered in the register maintained under article 5 of the Nurses and Midwives Order 2001 (<ref eId="c00012" href="http://www.legislation.gov.uk/id/uksi/2002/253">S.I. 2002/253</ref>) by virtue of qualifications in nursing,</p></content></hcontainer><hcontainer name="definition"><content><p>“officer in charge” has the meaning given by section 29(1)</p></content></hcontainer><hcontainer name="definition"><content><p>“parental responsibilities and rights” has the same meaning as in the Children (Scotland) Act <ref eId="c00013" href="http://www.legislation.gov.uk/id/ukpga/1995/36">1995 (c. 36)</ref>,</p></content></hcontainer><hcontainer name="definition"><content><p>“prescribed” means prescribed by rules of court,</p></content></hcontainer><hcontainer name="definition"><content><p>“primary carer” has the same meaning as in the Mental Health (Care and Treatment) (Scotland) Act <ref eId="c00014" href="http://www.legislation.gov.uk/id/asp/2003/13">2003 (asp 13)</ref>,</p></content></hcontainer><hcontainer name="definition"><content><p>“relevant Health Board”, in relation to any council, means any Health Board or Special Health Board constituted by order under section 2 of the National Health Service (Scotland) Act <ref eId="c00015" href="http://www.legislation.gov.uk/id/ukpga/1978/29">1978 (c. 29)</ref> which exercises functions in relation to the council’s area,</p></content></hcontainer><hcontainer name="definition"><content><p>“removal order” has the meaning given by section 14,</p></content></hcontainer><hcontainer name="definition"><content><p>“specified”, in relation to any order or warrant, means specified in the order or warrant,</p></content></hcontainer><hcontainer name="definition"><content><p>“temporary banning order” has the meaning given by section 21,</p></content></hcontainer><hcontainer name="definition"><content><p>“visit” has the meaning given by subsection (2),</p></content></hcontainer><hcontainer name="definition"><content><p>“warrant for entry” has the meaning given by section 37.</p></content></hcontainer></subsection><subsection eId="section-53-2"><num>(2)</num><content><p>References in this Part to visiting any place are, unless the contrary intention appears, to be read as references to a council officer exercising a right of entry conferred by section 7, 16 or 18 (including any such right which is authorised by a warrant for entry).</p></content></subsection></section></hcontainer></part><part eId="part-2"><num>Part 2</num><heading>Adults with incapacity</heading><section eId="section-54"><num>54</num><heading>Preliminary</heading><content><p>References in this Part to “the 2000 Act” are references to the Adults with Incapacity (Scotland) Act <ref eId="c00016" href="http://www.legislation.gov.uk/id/asp/2000/4">2000 (asp 4)</ref>.</p></content></section><section eId="section-55"><num>55</num><heading>Applications and proceedings: sheriff to consider adult’s wishes and feelings</heading><content><p><mod>After section 3(5) of the 2000 Act insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><subsection eId="d25e3270"><num>(5A)</num><content><p>In determining an application or any other proceedings under this Act, the sheriff shall, without prejudice to the generality of section 1(4)(a), take account of the wishes and feelings of the adult who is the subject of the application or proceedings so far as they are expressed by a person providing independent advocacy services.</p></content></subsection><subsection eId="d25e3276"><num>(5B)</num><content><p>In subsection (5A), “independent advocacy services” has the same meaning as it has in section 259(1) of the Mental Health (Care and Treatment) (Scotland) Act <ref eId="c00017" href="http://www.legislation.gov.uk/id/asp/2003/13">2003 (asp 13)</ref>.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></section><section eId="section-56"><num>56</num><heading>Orders about incapable adults' nearest relatives</heading><subsection eId="section-56-1"><num>(1)</num><content><p>Section 4 (orders about functions of nearest relative etc.) of the 2000 Act is amended as follows.</p></content></subsection><subsection eId="section-56-2"><num>(2)</num><intro><p>In subsection (1)—</p></intro><level class="para1" eId="section-56-2-a"><num>(a)</num><content><p>the words “On an application by an adult,” are repealed,</p></content></level><level class="para1" eId="section-56-2-b"><num>(b)</num><content><p>for “the adult”, where first occurring, substitute “an adult with incapacity”,</p></content></level><level class="para1" eId="section-56-2-c"><num>(c)</num><content><p>in paragraph (b), for “application” substitute “order”.</p></content></level></subsection><subsection eId="section-56-3"><num>(3)</num><content><p>In subsection (3), the words “, on an application by an adult,” are eId="d25e3361"><num>(a)</num><content><p>the order applied for; or</p></content></level><level class="para1" eId="d25e3367"><num>(b)</num><content><p>such other order under this section as it thinks repealed.</p></content></subsection></section><section eId="section-57"><num>57</num><heading>Powers of attorney</heading><subsection eId="section-57-1"><num>(1)</num><intro><p>Section 15 (continuing powers of attorney) of the 2000 Act is amended as follows—</p></intro><level class="para1" eId="section-57-1-a"><num>(a)</num><content><p><mod>after paragraph (b) of subsection (3) class="para1" eId="d25e3401"><num>(ba)</num><content><p>where the continuing power of attorney is exercisable only if the granter is determined to be incapable in relation to decisions about the attorney,</p></content></level><wrapUp><p>the validity requirements imposed by sections 15(3)(c) and 16(3)(c) may be satisfied by incorporating a single certificate which certifies the matters set out (registration of powers of attorney) of the 2000 Act is amended as follows—</p></intro><level class="para1" eId="section-57-4-a"><num>(a)</num><content><p>in subsection (2)(c), for “send a copy of it to” substitute “give notice of the registration of the document to both the local authority and”,</p></content></level><level class="para1" eId="section-57-4-b"><num>(b)</num><intro><p>in subsection words “(in a case where the incapacity of the granter is by reason of, or reasons which include, mental disorder)”, where they occur in subsections (1) and (2), are repealed.</p></content></subsection><subsection eId="section-57-7"><num>(7)</num><content><p><mod>After section 22 of the 2000 Act insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section eId="d25e3610"><num>22A</num><heading>Revocation of continuing or welfare power of attorney</heading><subsection eId="d25e3614"><num>(1)</num><content><p>The granter of a continuing or welfare power of attorney may revoke the power of attorney (or any of the powers granted by it) after the document conferring the power of attorney has been registered under section 19 by giving a revocation notice to the Public Guardian.</p></content></subsection><subsection eId="d25e3620"><num>(2)</num><intro><p>A revocation notice shall be valid only if it is expressed in a written document which—</p></intro><level class="para1" eId="d25e3626"><num>(a)</num><content><p>is subscribed by the granter; and</p></content></level><level class="para1" eId="d25e3632"><num>(b)</num><intro><p>incorporates a certificate in the prescribed form by a practising solicitor or by a member of another prescribed class that—</p></intro><level class="para2" eId="d25e3638"><num>(i)</num><content><p>he has interviewed the granter immediately before the granter subscribed the document;</p></content></level><level class="para2" eId="d25e3644"><num>(ii)</num><content><p>he is satisfied, either because of his own knowledge of the granter or because he has consulted another person (whom he names in the certificate) who has knowledge of the granter, that at the time the revocation is made the granter understands its effect;</p></content></level><level class="para2" eId="d25e3650"><num>(iii)</num><content><p>he has no reason to believe that the granter is acting under undue influence or that any other factor vitiates the revocation of the power.</p></content></level></level></subsection><subsection eId="d25e3656"><num>(3)</num><intro><p>The Public Guardian, on receiving a revocation notice, shall—</p></intro><level class="para1" eId="d25e3662"><num>(a)</num><content><p>enter the prescribed particulars of it in the register maintained by him under section 6(2)(b)(i) or (ii) as the case may be; and</p></content></level><level class="para1" eId="d25e3668"><num>(b)</num><intro><p>notify—</p></intro><level class="para2" eId="d25e3674"><num>(i)</num><content><p>the continuing or welfare attorney; and</p></content></level><level class="para2" eId="d25e3680"><num>(ii)</num><content><p>where it is the welfare attorney who is notified, the local authority and the Mental Welfare Commission.</p></content></level></level></subsection><subsection eId="d25e3686"><num>(4)</num><content><p>A revocation has effect when the revocation notice is registered under this section.</p></content></subsection><subsection eId="d25e3692"><num>(5)</num><content><p>No liability shall be incurred by any person who acts in good faith in ignorance of the revocation of a power of attorney under this section. Nor shall any title to heritable property acquired by such a person be challengeable on that ground alone.</p></content></subsection></section></quotedStructure><inline eId="section-58"><num>58</num><heading>Accounts and funds</heading><content><p><mod>For Part 3 of the 2000 Act substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><part eId="d25e3731"><num>Part 3</num><heading>Accounts and funds</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e3736"><heading>Purposes and application of Part</heading><section eId="d25e3742"><num>24A</num><heading>Intromissions with funds</heading><subsection eId="d25e3746"><num>(1)</num><content><p>This Part makes provision for the authorisation of persons by the Public Guardian to intromit with the funds of an adult for the purposes mentioned in subsection (2).</p></content></subsection><subsection eId="d25e3752"><num>(2)</num><intro><p>Those purposes are—</p></intro><level class="para1" eId="d25e3758"><num>(a)</num><content><p>the payment of central and local government taxes for which the adult is responsible;</p></content></level><level class="para1" eId="d25e3764"><num>(b)</num><content><p>the provisions of sustenance, accommodation, fuel, clothing and related goods and services for the adult;</p></content></level><level class="para1" eId="d25e3770"><num>(c)</num><content><p>the provision of other services provided for the purposes of looking after or caring for the adult;</p></content></level><level class="para1" eId="d25e3776"><num>(d)</num><content><p>the settlement of debts owed by or incurred in respect of the adult, including any prescribed fees charged by the Public Guardian in connection with an application under this Part;</p></content></level><level class="para1" eId="d25e3782"><num>(e)</num><content><p>the payment for the provision of items other than those mentioned in paragraphs (a) to (d) such as the Public Guardian may, in any case, authorise.</p></content></level></subsection></section><section eId="d25e3791"><num>24B</num><heading>Adults in respect of whom applications may be made</heading><subsection eId="d25e3795"><num>(1)</num><content><p>An application to the Public Guardian under this Part may be made only in relation to an adult who is incapable in relation to decisions about, or of safeguarding the adult’s interests in, the funds to which the application relates.</p></content></subsection><subsection eId="d25e3801"><num>(2)</num><intro><p>But an application may not be made in the case of an adult in relation to whom—</p></intro><level class="para1" eId="d25e3807"><num>(a)</num><content><p>there is a guardian of the type mentioned in section 33(1)(a) with powers relating to the funds in question;</p></content></level><level class="para1" eId="d25e3813"><num>(b)</num><content><p>there is a continuing attorney with powers relating to the funds in question; or</p></content></level><level class="para1" eId="d25e3819"><num>(c)</num><content><p>an intervention order relating to the funds in question has been granted.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e3825"><heading>Authority to take preliminary steps</heading><section eId="d25e3831"><num>24C</num><heading>Authority to provide information about funds</heading><subsection eId="d25e3835"><num>(1)</num><intro><p>This section applies where a person—</p></intro><level class="para1" eId="d25e3841"><num>(a)</num><content><p>believes than an adult holds funds in an account in the adult’s sole name; but</p></content></level><level class="para1" eId="d25e3847"><num>(b)</num><intro><p>cannot make an application under section 25 or section 26G because the person does not know—</p></intro><level class="para2" eId="d25e3853"><num>(i)</num><content><p>where the account is held;</p></content></level><level class="para2" eId="d25e3859"><num>(ii)</num><content><p>the account details;</p></content></level><level class="para2" eId="d25e3865"><num>(iii)</num><content><p>how much is held in the account; or</p></content></level><level class="para2" eId="d25e3871"><num>(iv)</num><content><p>any other information needed to complete the application.</p></content></level></level></subsection><subsection eId="d25e3877"><num>(2)</num><content><p>Where this section applies, the person may apply to the Public Guardian for a certificate authorising any fundholder to provide the person with such information as the person may reasonably require in order to make an application under section 25 or 26G.</p></content></subsection><subsection eId="d25e3883"><num>(3)</num><content><p>Where the Public Guardian grants an application under subsection (2), the Public Guardian must issue the certificate to the applicant.</p></content></subsection><subsection eId="d25e3889"><num>(4)</num><intro><p>A fundholder presented with a certificate issued under subsection (3) is not prevented by—</p></intro><level class="para1" eId="d25e3895"><num>(a)</num><content><p>any obligation as to secrecy; or</p></content></level><level class="para1" eId="d25e3901"><num>(b)</num><content><p>any other restriction on disclosure of information,</p></content></level><wrapUp><p>from providing the person who presents the certificate to it with such information as the person may reasonably require in order to make an application under section 25 or 26G about funds held by it on behalf of the adult.</p></wrapUp></subsection></section><section eId="d25e3912"><num>24D</num><heading>Authority to open account in adult’s name</heading><subsection eId="d25e3916"><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1" eId="d25e3922"><num>(a)</num><intro><p>a person believes that—</p></intro><level class="para2" eId="d25e3928"><num>(i)</num><content><p>an adult holds funds;</p></content></level><level class="para2" eId="d25e3934"><num>(ii)</num><content><p>an adult is entitled to income or other payments or is likely to become so entitled; or</p></content></level><level class="para2" eId="d25e3940"><num>(iii)</num><content><p>a fundholder holds funds on behalf of an adult; but</p></content></level></level><level class="para1" eId="d25e3946"><num>(b)</num><content><p>the adult does not have a suitable account in the adult’s sole name in which the funds, income or other payments can be placed for the purposes of intromitting with the adult’s funds under this Part.</p></content></level></subsection><subsection eId="d25e3952"><num>(2)</num><content><p>Where this section applies, the person may apply to the Public Guardian for a certificate authorising the opening of an account in the adult’s name for the purpose of intromitting with the adult’s funds.</p></content></subsection><subsection eId="d25e3958"><num>(3)</num><content><p>Where the Public Guardian grants an application under subsection (2), the Public Guardian must issue the certificate to the applicant.</p></content></subsection><subsection eId="d25e3964"><num>(4)</num><content><p>The certificate issued under subsection (3) may specify the kind of account which may be opened by a fundholder.</p></content></subsection><subsection eId="d25e3970"><num>(5)</num><content><p>A fundholder presented with a certificate issued under subsection (3) may open an account in the adult’s name.</p></content></subsection><subsection eId="d25e3976"><num>(6)</num><content><p>But, if the certificate specifies a kind of account, the fundholder may open only an account of the type specified.</p></content></subsection><subsection eId="d25e3982"><num>(7)</num><content><p>On an account being opened in pursuance of subsection (5), the applicant must notify prescribed particulars of the account to the Public Guardian.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e3988"><heading>Authority to intromit</heading><section eId="d25e3994"><num>25</num><heading>Authority to intromit</heading><subsection eId="d25e3998"><num>(1)</num><content><p>A person mentioned in subsection (2) may apply to the Public Guardian for a certificate authorising the person to intromit with an adult’s funds.</p></content></subsection><subsection eId="d25e4004"><num>(2)</num><intro><p>Those persons are—</p></intro><level class="para1" eId="d25e4010"><num>(a)</num><content><p>an individual (other than an individual acting in his capacity as an officer of a local authority or other body established by or under an enactment);</p></content></level><level class="para1" eId="d25e4016"><num>(b)</num><content><p>two or more individuals who wish to act jointly; or</p></content></level><level class="para1" eId="d25e4022"><num>(c)</num><content><p>a body (other than a manager of an authorised establishment within the meaning of section 35(2)).</p></content></level></subsection><subsection eId="d25e4028"><num>(3)</num><intro><p>An application under subsection (1) which is accompanied by an application under section 24D may only be granted if—</p></intro><level class="para1" eId="d25e4034"><num>(a)</num><content><p>an account is opened in pursuance of section 24D(5); and</p></content></level><level class="para1" eId="d25e4040"><num>(b)</num><content><p>prescribed particulars of that account are notified to the Public Guardian in pursuance of section 24D(7).</p></content></level></subsection><subsection eId="d25e4046"><num>(4)</num><intro><p>Where the Public Guardian grants an application under subsection (1), the Public Guardian must—</p></intro><level class="para1" eId="d25e4052"><num>(a)</num><content><p>enter prescribed particulars in the register maintained by the Public Guardian under section 6(2)(b)(iii); and</p></content></level><level class="para1" eId="d25e4058"><num>(b)</num><content><p>issue a certificate of authority (a “withdrawal certificate”) to the applicant.</p></content></level></subsection><subsection eId="d25e4064"><num>(5)</num><content><p>No application may be made under subsection (1) if a person is already authorised to intromit with the funds of the adult to whom the application relates (unless the application is made by that person).</p></content></subsection><subsection eId="d25e4070"><num>(6)</num><content><p>In this Act, an individual or a body who holds a valid withdrawal certificate issued under this Part is referred to as a “withdrawer”.</p></content></subsection></section><section eId="d25e4079"><num>26</num><heading>Authority to intromit: application</heading><subsection eId="d25e4083"><num>(1)</num><intro><p>An application under section 25(1) must—</p></intro><level class="para1" eId="d25e4089"><num>(a)</num><content><p>state the purposes of the proposed intromission with the adult’s funds, setting out the specific sums relating to each purpose;</p></content></level><level class="para1" eId="d25e4095"><num>(b)</num><content><p>specify an account held by a fundholder in the adult’s sole name which the applicant wishes to use for the purpose of intromitting with the adult’s funds (or be accompanied by an application under section 24D to open an account for that purpose);</p></content></level><level class="para1" eId="d25e4101"><num>(c)</num><intro><p>contain an undertaking that the applicant will open an account (the “designated account”) solely for the purposes of—</p></intro><level class="para2" eId="d25e4107"><num>(i)</num><content><p>receiving funds transferred under the authority of any certificate granted; and</p></content></level><level class="para2" eId="d25e4113"><num>(ii)</num><content><p>intromitting with those funds;</p></content></level></level></subsection><subsection eId="d25e4119"><num>(2)</num><content><p>The application may also specify another account held by a fundholder in the adult’s sole name which the applicant also wishes to use for the purpose of intromitting with the adult’s funds (or be accompanied by an application under section 24D to open an account for that purpose).</p></content></subsection><subsection eId="d25e4125"><num>(3)</num><intro><p>In this Part—</p></intro><level class="para1" eId="d25e4131"><num>(a)</num><content><p>the account specified or, as the case may be, opened for the purposes of subsection (1)(b) is referred to as the adult’s current account.</p></content></level><level class="para1" eId="d25e4137"><num>(b)</num><content><p>the account specified or, as the case may be, opened for the purposes of subsection (2) is referred to as the adult’s second account.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e4143"><heading>Withdrawal certificates</heading><section eId="d25e4149"><num>26A</num><heading>Withdrawal certificates</heading><subsection eId="d25e4153"><num>(1)</num><intro><p>A withdrawal certificate may—</p></intro><level class="para1" eId="d25e4159"><num>(a)</num><intro><p>authorise the transfer of funds—</p></intro><level class="para2" eId="d25e4165"><num>(i)</num><content><p>from the adult’s current account to the designated account;</p></content></level><level class="para2" eId="d25e4171"><num>(ii)</num><content><p>from the adult’s current account to the adult’s second account;</p></content></level><level class="para2" eId="d25e4177"><num>(iii)</num><content><p>from the designated account to the adult’s second account;</p></content></level></level><level class="para1" eId="d25e4183"><num>(b)</num><content><p>authorise the continuance or making of arrangements for the regular or occasional payment of funds from the adult’s current account for specified purposes (for example: by standing order or direct debit);</p></content></level><level class="para1" eId="d25e4189"><num>(c)</num><content><p>authorise the withdrawal of funds from the designated account for specified purposes;</p></content></level><level class="para1" eId="d25e4195"><num>(d)</num><content><p>place limits on the amount of funds that may be so transferred, paid or withdrawn.</p></content></level></subsection><subsection eId="d25e4201"><num>(2)</num><intro><p>But such a certificate does not authorise a transfer of funds or payment that would cause—</p></intro><level class="para1" eId="d25e4207"><num>(a)</num><content><p>the adult’s current account;</p></content></level><level class="para1" eId="d25e4213"><num>(b)</num><content><p>the adult’s second account; or</p></content></level><level class="para1" eId="d25e4219"><num>(c)</num><content><p>the designated account,</p></content></level><wrapUp><p>to become overdrawn.</p></wrapUp></subsection><subsection eId="d25e4227"><num>(3)</num><content><p>If any of the accounts mentioned in paragraphs (a) to (c) of subsection (2) is overdrawn, the fundholder of that account has a right of relief against the withdrawer.</p></content></subsection><subsection eId="d25e4233"><num>(4)</num><content><p>In subsection (1)(b), “specified” means specified in the certificate of appointment.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e4239"><heading>Joint and reserve withdrawers</heading><section eId="d25e4245"><num>26B</num><heading>Addition of joint withdrawer</heading><subsection eId="d25e4249"><num>(1)</num><content><p>This section applies where an individual has or individuals have been appointed as a withdrawer in relation to an adult.</p></content></subsection><subsection eId="d25e4255"><num>(2)</num><content><p>Where this sections applies, another individual may apply to the Public Guardian for appointment as a joint withdrawer.</p></content></subsection><subsection eId="d25e4261"><num>(3)</num><content><p>An application under subsection (1) must be signed by the existing withdrawer.</p></content></subsection><subsection eId="d25e4267"><num>(4)</num><intro><p>Where the Public Guardian grants an application under subsection (1), the Public Guardian must—</p></intro><level class="para1" eId="d25e4273"><num>(a)</num><content><p>enter prescribed particulars in the register maintained by the Public Guardian under section 6(2)(b)(iii); and</p></content></level><level class="para1" eId="d25e4279"><num>(b)</num><content><p>issue a certificate of authority (a “withdrawal certificate”) to the existing withdrawer and the applicant.</p></content></level></subsection><subsection eId="d25e4285"><num>(5)</num><content><p>Subject to sections 31(2) and 31A, a certificate issued under subsection (4)(b) is valid until the date on which the withdrawal certificate held by the existing withdrawer would cease to be valid under section 31(1) or 31E(6), as the case may be (regardless of any subsequent extension, reduction, termination or suspension of the existing withdrawer’s authority).</p></content></subsection><subsection eId="d25e4291"><num>(6)</num><content><p>In this section, “the existing withdrawer” means the individual or individuals mentioned in subsection (1).</p></content></subsection><subsection eId="d25e4297"><num>(7)</num><content><p>In this Part, where two or more individuals are appointed as withdrawers, each individual is referred to as a “joint withdrawer”.</p></content></subsection></section><section eId="d25e4306"><num>26C</num><heading>Joint withdrawers: supplementary</heading><subsection eId="d25e4310"><num>(1)</num><intro><p>Joint withdrawers may, subject to subsection (2), exercise their functions individually, and each joint withdrawer is liable for any loss incurred by the adult arising out of—</p></intro><level class="para1" eId="d25e4316"><num>(a)</num><content><p>the joint withdrawer’s own acts or omissions; or</p></content></level><level class="para1" eId="d25e4322"><num>(b)</num><content><p>the joint withdrawer’s failure to take reasonable steps to ensure that another joint withdrawer does not breach any duty of care or fiduciary duty owed to the adult.</p></content></level></subsection><subsection eId="d25e4328"><num>(2)</num><content><p>Where more than one joint withdrawer is liable under subsection (1), they are liable jointly and severally.</p></content></subsection><subsection eId="d25e4334"><num>(3)</num><intro><p>A joint withdrawer must, before exercising any function conferred on the joint withdrawer, consult the other joint withdrawers, unless—</p></intro><level class="para1" eId="d25e4340"><num>(a)</num><content><p>consultation would be impracticable in the circumstances; or</p></content></level><level class="para1" eId="d25e4346"><num>(b)</num><content><p>the joint withdrawers agree that consultation is not necessary.</p></content></level></subsection><subsection eId="d25e4352"><num>(4)</num><content><p>Where joint withdrawers disagree as to the exercise of their functions, one or more of them may apply to the Public Guardian for directions.</p></content></subsection><subsection eId="d25e4358"><num>(5)</num><content><p>Directions given by the Public Guardian in pursuance of subsection (4) may be appealed to the sheriff, whose decision is final.</p></content></subsection><subsection eId="d25e4364"><num>(6)</num><intro><p>Where there are joint withdrawers—</p></intro><level class="para1" eId="d25e4370"><num>(a)</num><content><p>a third party in good faith is entitled to rely on the authority to act of any one or more of them; and</p></content></level><level class="para1" eId="d25e4376"><num>(b)</num><content><p>section 31A(5) (interim authority) only applies where the Public Guardian terminates the authority of all of the joint withdrawers.</p></content></level></subsection></section><section eId="d25e4385"><num>26D</num><heading>Reserve withdrawers: applications</heading><subsection eId="d25e4389"><num>(1)</num><content><p>In any case where an individual is issued with a withdrawal certificate (“a main withdrawer”), the Public Guardian may, on an application by the main withdrawer, appoint another individual (“a reserve withdrawer”) to act as a withdrawer in the event of the main withdrawer temporarily becoming unable to act.</p></content></subsection><subsection eId="d25e4395"><num>(2)</num><content><p>An application for appointment of a reserve withdrawer may be made at the time of the application under section 25 for a withdrawal certificate or at any later time.</p></content></subsection><subsection eId="d25e4401"><num>(3)</num><content><p>The application for appointment as a reserve withdrawer must be signed by the proposed reserve withdrawer.</p></content></subsection><subsection eId="d25e4407"><num>(4)</num><content><p>Where the Public Guardian grants the application, the Public Guardian must enter prescribed particulars in the register maintained by the Public Guardian under section 6(2)(b)(iii).</p></content></subsection></section><section eId="d25e4416"><num>26E</num><heading>Reserve withdrawers: authority to act</heading><subsection eId="d25e4420"><num>(1)</num><intro><p>Where—</p></intro><level class="para1" eId="d25e4426"><num>(a)</num><content><p>a reserve withdrawer has been appointed under section 26D; and</p></content></level><level class="para1" eId="d25e4432"><num>(b)</num><content><p>the main withdrawer considers that the main withdrawer is or will be unable to carry out some or all of the main withdrawer’s functions under this Part,</p></content></level><wrapUp><p>the main withdrawer may notify the Public Guardian that the main withdrawer wishes the Public Guardian to authorise the reserve withdrawer to intromit with the adult’s funds for a specified period.</p></wrapUp></subsection><subsection eId="d25e4440"><num>(2)</num><intro><p>Where a reserve withdrawer becomes aware that the main withdrawer is unable—</p></intro><level class="para1" eId="d25e4446"><num>(a)</num><content><p>to carry out some or all of the main withdrawer’s functions in relation to intromitting with the funds concerned; and</p></content></level><level class="para1" eId="d25e4452"><num>(b)</num><content><p>to notify the Public Guardian under subsection (1),</p></content></level><wrapUp><p>the reserve withdrawer may apply to the Public Guardian for a certificate authorising the reserve withdrawer to intromit with the adult’s funds for a specified period.</p></wrapUp></subsection><subsection eId="d25e4460"><num>(3)</num><intro><p>The Public Guardian, on being notified under subsection (1), must or, on an application under subsection (2), may—</p></intro><level class="para1" eId="d25e4466"><num>(a)</num><content><p>enter prescribed particulars in the register maintained by him under section 6(2)(b)(iii);</p></content></level><level class="para1" eId="d25e4472"><num>(b)</num><content><p>issue a certificate of authority (a “withdrawal certificate”) to the reserve withdrawer; and</p></content></level><level class="para1" eId="d25e4478"><num>(c)</num><content><p>notify the adult and the main withdrawer.</p></content></level></subsection><subsection eId="d25e4484"><num>(4)</num><intro><p>The certificate issued under subsection (3)(b) is—</p></intro><level class="para1" eId="d25e4490"><num>(a)</num><content><p>valid for the specified period, or such shorter period as the Public Guardian thinks fit, but does not extend beyond the date on which the validity of the withdrawal certificate issued to the main withdrawer would cease under section 31(1) or 31E(6), as the case may be;</p></content></level><level class="para1" eId="d25e4496"><num>(b)</num><content><p>suspended during any period when the authority of the main withdrawer is suspended;</p></content></level><level class="para1" eId="d25e4502"><num>(c)</num><content><p>terminated if the authority of the main withdrawer is terminated.</p></content></level></subsection><subsection eId="d25e4508"><num>(5)</num><content><p>The main withdrawer and the reserve withdrawer are liable (jointly and severally) for any loss incurred by the adult arising out of the reserve withdrawer’s acts or omissions.</p></content></subsection><subsection eId="d25e4514"><num>(6)</num><content><p>In this section, “specified” means specified in the notice or, as the case may be, application.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e4520"><heading>Variation of withdrawer’s authority</heading><section eId="d25e4526"><num>26F</num><heading>Variation of withdrawal certificate</heading><subsection eId="d25e4530"><num>(1)</num><intro><p>The Public Guardian may—</p></intro><level class="para1" eId="d25e4536"><num>(a)</num><content><p>on the application of a withdrawer, or</p></content></level><level class="para1" eId="d25e4542"><num>(b)</num><content><p>if notified under section 30A,</p></content></level><wrapUp><p>vary the withdrawal certificate (the “existing certificate”) issued to the withdrawer.</p></wrapUp></subsection><subsection eId="d25e4550"><num>(2)</num><content><p>But a withdrawal certificate may not be varied under this section so as to alter the period of validity of the certificate.</p></content></subsection><subsection eId="d25e4556"><num>(3)</num><intro><p>Where the Public Guardian decides to vary the withdrawal certificate under subsection (1), the Public Guardian must—</p></intro><level class="para1" eId="d25e4562"><num>(a)</num><content><p>enter prescribed particulars in the register maintained by the Public Guardian under section 6(2)(b)(iii); and</p></content></level><level class="para1" eId="d25e4568"><num>(b)</num><content><p>issue a varied withdrawal certificate to the withdrawer.</p></content></level></subsection><subsection (3)(b).</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e4580"><heading>Authority to transfer funds</heading><section eId="d25e4586"><num>26G</num><heading>Authority to transfer specified sums</heading><subsection eId="d25e4590"><num>(1)</num><intro><p>A person mentioned in subsection (2) may apply to the Public Guardian for a certificate authorising the transfer of a specified sum from a specified account (“the original account”) in an adult’s sole name to—</p></intro><level class="para1" eId="d25e4596"><num>(a)</num><content><p>the designated account;</p></content></level><level class="para1" eId="d25e4602"><num>(b)</num><content><p>the adult’s current account;</p></content></level><level class="para1" eId="d25e4608"><num>(c)</num><content><p>the adult’s second account; or</p></content></level><level class="para1" eId="d25e4614"><num>(d)</num><content><p>such other account as may be specified.</p></content></level></subsection><subsection eId="d25e4620"><num>(2)</num><intro><p>Those persons are—</p></intro><level class="para1" eId="d25e4626"><num>(a)</num><content><p>a withdrawer;</p></content></level><level class="para1" eId="d25e4632"><num>(b)</num><content><p>a person who has applied for a withdrawal certificate under section 25;</p></content></level></subsection><subsection eId="d25e4638"><num>(3)</num><intro><p>An application under subsection (1) may also seek authority—</p></intro><level class="para1" eId="d25e4644"><num>(a)</num><content><p>to close the original account;</p></content></level><level class="para1" eId="d25e4650"><num>(b)</num><content><p>to terminate an arrangement for the payment of funds from the original account to another account (for example: a standing order or direct debit).</p></content></level></subsection><subsection eId="d25e4656"><num>(4)</num><intro><p>Where the Public Guardian grants an application under subsection (1), the Public Guardian must—</p></intro><level class="para1" eId="d25e4662"><num>(a)</num><content><p>enter prescribed particulars in the register maintained by the Public Guardian under section 6(2)(b)(iii); and</p></content></level><level class="para1" eId="d25e4668"><num>(b)</num><content><p>issue the certificate to the applicant.</p></content></level></subsection><subsection eId="d25e4674"><num>(5)</num><content><p>In this section, “specified” means specified in the application under subsection (1) or, as the case may be, in the certificate granted under subsection (4).</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e4680"><heading>Applications: general</heading><section eId="d25e4686"><num>27</num><heading>Applications: general requirements</heading><intro><p>An application under section 24C, 24D, 25, 26B, 26D, 26F or 26G must—</p></intro><level class="para1" eId="d25e4692"><num>(a)</num><content><p>be signed by the applicant;</p></content></level><level class="para1" eId="d25e4698"><num>(b)</num><content><p>contain the name and addresses of the nearest relative, named person and primary carer of the adult, if known;</p></content></level><level class="para1" eId="d25e4704"><num>(c)</num><intro><p>be submitted to the Public Guardian no later than 14 days after—</p></intro><level class="para2" eId="d25e4710"><num>(i)</num><content><p>where it is required to be countersigned under section 27A, the day the application is so countersigned, or</p></content></level><level class="para2" eId="d25e4716"><num>(ii)</num><content><p>in any other case, the day the application is signed by the applicant as mentioned in paragraph (a).</p></content></level></level></section><section eId="d25e4725"><num>27A</num><heading>Countersigning of applications</heading><subsection eId="d25e4729"><num>(1)</num><intro><p>An application under section 24C, 24D, 25, or 26B must be countersigned by a person who must declare in the application that—</p></intro><level class="para1" eId="d25e4735"><num>(a)</num><content><p>the person knows the applicant and has known the applicant for at least one year prior to the date of the application;</p></content></level><level class="para1" eId="d25e4741"><num>(b)</num><intro><p>the person is not any of the following—</p></intro><level class="para2" eId="d25e4747"><num>(i)</num><content><p>a relative of or person residing with the applicant or the adult;</p></content></level><level class="para2" eId="d25e4753"><num>(ii)</num><content><p>a director or employee of the fundholder;</p></content></level><level class="para2" eId="d25e4759"><num>(iii)</num><content><p>a solicitor acting on behalf of the adult or any other person mentioned in this paragraph in relation to any matter under this Act;</p></content></level><level class="para2" eId="d25e4765"><num>(iv)</num><content><p>the medical practitioner who has issued the certificate under section 27B in connection with the application;</p></content></level><level class="para2" eId="d25e4771"><num>(v)</num><content><p>a guardian of the adult;</p></content></level><level class="para2" eId="d25e4777"><num>(vi)</num><content><p>a welfare or continuing attorney of the adult;</p></content></level><level class="para2" eId="d25e4783"><num>(vii)</num><content><p>a person who is authorised under an intervention order in relation to the adult;</p></content></level></level><level class="para1" eId="d25e4789"><num>(c)</num><content><p>the person believes the information contained in the application to be true; and</p></content></level><level class="para1" eId="d25e4795"><num>(d)</num><content><p>the person believes the applicant to be a fit and proper person to intromit with the adult’s funds.</p></content></level></subsection><subsection eId="d25e4801"><num>(2)</num><content><p>An application under section 26D (reserve withdrawers) must be countersigned by a person who must declare in the application the matters set out in paragraphs (a) to (d) of subsection (1) but with references in those paragraphs to “applicant” read as references to the proposed reserve withdrawer.</p></content></subsection><subsection eId="d25e4807"><num>(3)</num><content><p>This section does not apply to an application made by a body.</p></content></subsection></section><section eId="d25e4816"><num>27B</num><heading>Medical certificates</heading><intro><p>An application under section 24C, 24D, or 25 must be accompanied by a certificate in prescribed form from a medical practitioner that the adult is—</p></intro><level class="para1" eId="d25e4822"><num>(a)</num><content><p>incapable in relation to decisions about; or</p></content></level><level class="para1" eId="d25e4828"><num>(b)</num><content><p>incapable of acting to safeguard or promote the adult’s interests in,</p></content></level><wrapUp><p>the adult’s funds.</p></wrapUp></section><section eId="d25e4839"><num>27C</num><heading>Intimation of applications</heading><subsection eId="d25e4843"><num>(1)</num><intro><p>On receipt of a competent application under section 24C, 24D, 25, 26B, 26D, 26F or 26G, the Public Guardian must intimate the application to—</p></intro><level class="para1" eId="d25e4849"><num>(a)</num><content><p>the adult;</p></content></level><level class="para1" eId="d25e4855"><num>(b)</num><content><p>the adult’s nearest relative;</p></content></level><level class="para1" eId="d25e4861"><num>(c)</num><content><p>the adult’s primary carer;</p></content></level><level class="para1" eId="d25e4867"><num>(d)</num><content><p>the adult’s named person;</p></content></level><level class="para1" eId="d25e4873"><num>(e)</num><intro><p>where the applicant is—</p></intro><level class="para2" eId="d25e4879"><num>(i)</num><content><p>the individual mentioned in both paragraph (b) and (c); or</p></content></level><level class="para2" eId="d25e4885"><num>(ii)</num><content><p>a body other than a local authority,</p></content></level><wrapUp><p>the chief social work officer of the local authority; and</p></wrapUp></level><level class="para1" eId="d25e4893"><num>(f)</num><content><p>any other person who the Public Guardian considers has an interest in the application.</p></content></level></subsection><subsection eId="d25e4899"><num>(2)</num><content><p>A competent application is an application which complies with section 27 and, where appropriate, sections 27A and 27B.</p></content></subsection></section><section eId="d25e4908"><num>27D</num><heading>Determination of applications: applicant to be fit and proper</heading><subsection eId="d25e4912"><num>(1)</num><intro><p>The Public Guardian may grant an application made under section 24C, 24D, 25, 26B or 26D only if satisfied that—</p></intro><level class="para1" eId="d25e4918"><num>(a)</num><content><p>the applicant in an application under section 24C, 24D, 25 or 26B, or</p></content></level><level class="para1" eId="d25e4924"><num>(b)</num><content><p>the proposed reserve withdrawer in an application under section 26D,</p></content></level><wrapUp><p>is a fit and proper person to intromit with the funds of the adult.</p></wrapUp></subsection><subsection eId="d25e4932"><num>(2)</num><content><p>In deciding whether a person is fit and proper, the Public Guardian must have regard to any guidance issued in relation to that matter by the Scottish Ministers.</p></content></subsection></section><section eId="d25e4941"><num>27E</num><heading>Determination of applications: opportunity to make representations</heading><subsection eId="d25e4945"><num>(1)</num><content><p>The Public Guardian must not grant an application under section 24C, 24D, 25, 26B, 26D, 26F or 26G without affording to any person who receives intimation of the application under section 27C or any other person who wishes to object an opportunity to make representations.</p></content></subsection><subsection eId="d25e4951"><num>(2)</num><content><p>Where the Public Guardian proposes to refuse the application the Public Guardian must intimate the proposed decision to the applicant and advise the applicant of the prescribed period within which the applicant may object to the proposed refusal.</p></content></subsection><subsection eId="d25e4957"><num>(3)</num><content><p>The Public Guardian must not refuse an application without affording to the applicant, if the applicant objects, an opportunity to make representations.</p></content></subsection></section><section eId="d25e4966"><num>27F</num><heading>Referral of application to sheriff</heading><subsection eId="d25e4970"><num>(1)</num><intro><p>The Public Guardian may remit an application under section 24C, 24D, 25, 26B, 26D, 26F or 26G for determination by the sheriff at the instance of—</p></intro><level class="para1" eId="d25e4976"><num>(a)</num><content><p>the Public Guardian;</p></content></level><level class="para1" eId="d25e4982"><num>(b)</num><content><p>the applicant; or</p></content></level><level class="para1" eId="d25e4988"><num>(c)</num><content><p>any person who objects to the granting of the application.</p></content></level></subsection><subsection eId="d25e4994"><num>(2)</num><content><p>The sheriff’s decision on an application remitted under subsection (1) is final.</p></content></subsection></section><section eId="d25e5003"><num>27G</num><heading>Multiple applications etc.</heading><subsection eId="d25e5007"><num>(1)</num><content><p>Where a person who has made an application under section 24C, 24D or 25 in respect of an adult makes another application under any of those sections in respect of the same adult, the Public Guardian may disapply any of the provisions in sections 27 to 27B to that application.</p></content></subsection><subsection eId="d25e5013"><num>(2)</num><content><p>Where the Public Guardian is to issue more than one certificate under this Part to the same person, the Public Guardian may instead issue a combined certificate to the person.</p></content></subsection><subsection eId="d25e5019"><num>(3)</num><content><p>References in this Part to a withdrawal certificate or other certificate issued under this Part include references to any combined certificate issued by the Public Guardian instead of the withdrawal or other certificate.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e5025"><heading>Fundholders</heading><section eId="d25e5031"><num>28</num><heading>Fundholders of adult’s current account and adult’s second account</heading><subsection eId="d25e5035"><num>(1)</num><content><p>The fundholder of an adult’s current account may act on the instructions of a withdrawer to the extent authorised by the withdrawal certificate issued to the withdrawer.</p></content></subsection><subsection eId="d25e5041"><num>(2)</num><content><p>The fundholder of an adult’s current account presented with a withdrawal certificate must not allow any operations to be carried out on that account other than those carried out in accordance with the certificate by the withdrawer.</p></content></subsection><subsection eId="d25e5047"><num>(3)</num><content><p>The fundholder of an adult’s current account or an adult’s second account presented with a withdrawal certificate may provide the withdrawer with a copy of any statement or other correspondence issued by the fundholder to the adult during the period when the withdrawal certificate is valid.</p></content></subsection></section><section eId="d25e5056"><num>28A</num><heading>Fundholder of original account</heading><content><p>The fundholder of an original account may act on the instructions of a withdrawer to the extent authorised by the certificate issued to the withdrawer under section 26G(4).</p></content></section><section eId="d25e5065"><num>29</num><heading>Fundholder’s liability</heading><content><p>The fundholder of an account mentioned in section 28 or 28A is liable to the adult for any funds removed from the account under that section at any time when it was aware that the withdrawer’s authority had been terminated or suspended by the Public Guardian under section 31A but, on meeting such liability, the fundholder of the account has a right of relief against the withdrawer.</p></content></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e5072"><heading>Withdrawers</heading><section eId="d25e5078"><num>30</num><heading>Use of funds by withdrawer</heading><subsection eId="d25e5082"><num>(1)</num><content><p>Any funds used by the withdrawer must be applied only for the benefit of the adult.</p></content></subsection><subsection eId="d25e5088"><num>(2)</num><content><p>Despite subsection (1), where the withdrawer lives with the adult, the withdrawer may, to the extent authorised by the certificate, apply any funds withdrawn towards household expenses.</p></content></subsection></section><section eId="d25e5097"><num>30A</num><heading>Notification of change of address</heading><subsection eId="d25e5101"><num>(1)</num><intro><p>A withdrawer must notify the Public Guardian—</p></intro><level class="para1" eId="d25e5107"><num>(a)</num><content><p>of any change in the withdrawer’s address; and</p></content></level><level class="para1" eId="d25e5113"><num>(b)</num><content><p>of any change in the address of the adult.</p></content></level></subsection><subsection eId="d25e5119"><num>(2)</num><content><p>A notice under subsection (1) must be given within 7 days of the date of the change to which it relates.</p></content></subsection></section><section eId="d25e5128"><num>30B</num><heading>Records and inquiries</heading><subsection eId="d25e5132"><num>(1)</num><content><p>A withdrawer must keep records of the exercise of the withdrawer’s powers.</p></content></subsection><subsection eId="d25e5138"><num>(2)</num><content><p>The Public Guardian may make inquiries from time to time as to the manner in which a withdrawer has exercised the withdrawer’s functions under this Part.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e5144"><heading>Duration etc. of authority</heading><section eId="d25e5150"><num>31</num><heading>Duration of withdrawal certificate</heading><subsection eId="d25e5154"><num>(1)</num><content><p>Unless this Part provides otherwise, a withdrawal certificate issued under section 25 is valid for a period of 3 years commencing with the date of issue of the certificate.</p></content></subsection><subsection eId="d25e5160"><num>(2)</num><content><p>The Public Guardian may reduce or extend the period of validity of a withdrawal certificate; and an extension may be without limit of time.</p></content></subsection><subsection eId="d25e5166"><num>(3)</num><content><p>Subsections (1) and (2) are without prejudice to the right of the withdrawer to make subsequent applications under section 25 after the withdrawal certificate ceases to be valid or, as the case may be, a suspension or termination of the withdrawer’s authority.</p></content></subsection><subsection eId="d25e5172"><num>(4)</num><intro><p>The validity of a withdrawal certificate ceases—</p></intro><level class="para1" eId="d25e5178"><num>(a)</num><content><p>on the appointment of a guardian with powers relating to the funds or account in question;</p></content></level><level class="para1" eId="d25e5184"><num>(b)</num><content><p>on the granting of an intervention order relating to the funds or account in question; or</p></content></level><level class="para1" eId="d25e5190"><num>(c)</num><content><p>on a continuing attorney’s acquiring authority to act in relation to the funds or account in question,</p></content></level><wrapUp><p>but no liability is incurred by any person who acts in good faith under this Part in ignorance of the withdrawal certificate ceasing to be valid under this subsection.</p></wrapUp></subsection></section><section eId="d25e5201"><num>31A</num><heading>Suspension and termination of authority</heading><subsection eId="d25e5205"><num>(1)</num><content><p>The Public Guardian may suspend or terminate the authority of a withdrawer under a withdrawal certificate.</p></content></subsection><subsection eId="d25e5211"><num>(2)</num><intro><p>The Public Guardian must without delay intimate the suspension or termination to—</p></intro><level class="para1" eId="d25e5217"><num>(a)</num><content><p>the withdrawer whose authority is suspended or terminated;</p></content></level><level class="para1" eId="d25e5223"><num>(b)</num><content><p>any other joint withdrawer;</p></content></level><level class="para1" eId="d25e5229"><num>(c)</num><content><p>any reserve withdrawer; and</p></content></level><level class="para1" eId="d25e5235"><num>(d)</num><content><p>the fundholder of the designated account; and</p></content></level><level class="para1" eId="d25e5241"><num>(e)</num><content><p>such other persons as the Public Guardian thinks fit.</p></content></level></subsection><subsection eId="d25e5247"><num>(3)</num><content><p>A suspension or termination under subsection (1) suspends or, as the case may be, terminates all operations on the designated account by the withdrawer whose authority is suspended or terminated.</p></content></subsection><subsection eId="d25e5253"><num>(4)</num><content><p>The Public Guardian must on suspending or terminating the authority of the withdrawer enter prescribed particulars in the register maintained by the Public Guardian under section 6(2)(b)(iii).</p></content></subsection><subsection eId="d25e5259"><num>(5)</num><content><p>The Public Guardian may on terminating the authority of the withdrawer issue to the withdrawer an interim withdrawal certificate to continue to intromit with the adult’s funds for a period not exceeding 4 weeks from the date of the termination.</p></content></subsection></section><section eId="d25e5268"><num>31B</num><heading>Renewal of authority to intromit</heading><subsection eId="d25e5272"><num>(1)</num><content><p>This section applies to an application under section 25 if condition A or B is satisfied.</p></content></subsection><subsection eId="d25e5278"><num>(2)</num><content><p>Condition A is that the application is made by a person holding an existing withdrawal certificate.</p></content></subsection><subsection eId="d25e5284"><num>(3)</num><intro><p>Condition B is that—</p></intro><level class="para1" eId="d25e5290"><num>(a)</num><content><p>the main withdrawer has died or become incapable or the main withdrawer’s authority under this Part has been terminated; and</p></content></level><level class="para1" eId="d25e5296"><num>(b)</num><content><p>the application is made, without undue delay, by an individual who was the reserve withdrawer at the time of the death, incapacity, or termination, as the case may be.</p></content></level></subsection><subsection eId="d25e5302"><num>(4)</num><content><p>Where this section applies, the Public Guardian may disapply any of the provisions in sections 26(1), 27A and 27B to an application to which this section applies (but may require the applicant to provide such other information as the Public Guardian requires to determine the application).</p></content></subsection><subsection eId="d25e5308"><num>(5)</num><content><p>Where condition A is satisfied in relation to an application under section 25, the existing withdrawal certificate will continue to be valid until the application is determined.</p></content></subsection><subsection eId="d25e5314"><num>(6)</num><content><p>Where an application to which this section applies is granted, the existing withdrawal certificate ceases to be valid.</p></content></subsection></section><section eId="d25e5323"><num>31C</num><heading>Duration of certificates issued under section 24C, 24D, and 26G etc.</heading><subsection eId="d25e5327"><num>(1)</num><content><p>A certificate issued under section 24C, 24D or 26G is valid for such period as it may specify.</p></content></subsection><subsection eId="d25e5333"><num>(2)</num><content><p>But the Public Guardian may cancel the certificate at any time before the end of any period so specified.</p></content></subsection><subsection eId="d25e5339"><num>(3)</num><intro><p>The Public Guardian must without delay intimate such a cancellation to—</p></intro><level class="para1" eId="d25e5345"><num>(a)</num><content><p>the person to whom the certificate was issued,</p></content></level><level class="para1" eId="d25e5351"><num>(b)</num><content><p>where the certificate was issued under section 26G, the fundholder of the original account, and</p></content></level><level class="para1" eId="d25e5357"><num>(c)</num><content><p>such other persons as the Public Guardian thinks fit.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e5363"><heading>Appeals</heading><section eId="d25e5369"><num>31D</num><heading>Appeals</heading><subsection eId="d25e5373"><num>(1)</num><intro><p>A decision of the Public Guardian—</p></intro><level class="para1" eId="d25e5379"><num>(a)</num><content><p>to grant or refuse an application under section 24C, 24D, 25, 26B, 26D, 26E, 26F or 26G;</p></content></level><level class="para1" eId="d25e5385"><num>(b)</num><content><p>to refuse to remit an application to the sheriff under section 27F;</p></content></level><level class="para1" eId="d25e5391"><num>(c)</num><content><p>to reduce or extend the period of validity of a withdrawal certificate under section 31(2); or</p></content></level><level class="para1" eId="d25e5397"><num>(d)</num><content><p>to suspend or terminate the authority of a withdrawer under section 31A,</p></content></level><wrapUp><p>may be appealed to the sheriff.</p></wrapUp></subsection><subsection eId="d25e5405"><num>(2)</num><content><p>The sheriff’s decision on an appeal under subsection (1) is final.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e5411"><heading>Transition from guardianship</heading><section eId="d25e5417"><num>31E</num><heading>Transition from guardianship</heading><subsection eId="d25e5421"><num>(1)</num><intro><p>This section applies where—</p></intro><level class="para1" eId="d25e5427"><num>(a)</num><content><p>there is a guardian with powers relating to the property or financial affairs of an adult; and</p></content></level><level class="para1" eId="d25e5433"><num>(b)</num><content><p>an application is made under section 25 in relation to the adult’s funds.</p></content></level></subsection><subsection eId="d25e5439"><num>(2)</num><content><p>Section 27A does not apply to the application if it is made by the adult’s guardian.</p></content></subsection><subsection eId="d25e5445"><num>(3)</num><content><p>The Public Guardian may disapply section 27B to the application.</p></content></subsection><subsection eId="d25e5451"><num>(4)</num><intro><p>Where—</p></intro><level class="para1" eId="d25e5457"><num>(a)</num><content><p>it appears to the Public Guardian that, if the application were granted, the adult’s interests in the adult’s property and affairs can be satisfactorily safeguarded or promoted otherwise than by the existing guardianship; and</p></content></level><level class="para1" eId="d25e5463"><num>(b)</num><content><p>the Public Guardian proposes to grant the application,</p></content></level><wrapUp><p>the Public Guardian must initiate the recall of the guardianship under section 73.</p></wrapUp></subsection><subsection eId="d25e5471"><num>(5)</num><content><p>The Public Guardian may not grant the application unless the guardianship is recalled.</p></content></subsection><subsection eId="d25e5477"><num>(6)</num><content><p>Where the Public Guardian grants the application, the withdrawal certificate issued to the withdrawer is valid for such period as the Public Guardian specifies at the time the Public Guardian grants the application.</p></content></subsection><subsection eId="d25e5483"><num>(7)</num><intro><p>This section does not apply, and no application under this Part may be made, in the case of an adult if there is a person who is—</p></intro><level class="para1" eId="d25e5489"><num>(a)</num><content><p>appointed or otherwise entitled under the law of any country other than Scotland to act as a guardian (however called) in relation to the adult’s property and financial affairs during the adult’s incapacity; and</p></content></level><level class="para1" eId="d25e5495"><num>(b)</num><content><p>recognised by the law of Scotland as the adult’s guardian.</p></content></level></subsection><subsection eId="d25e5501"><num>(8)</num><content><p>Despite subsection (7), no liability is incurred by any person who acts in good faith under this Part in ignorance of any guardian of the type mentioned in that subsection.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e5507"><heading>Miscellaneous</heading><section eId="d25e5513"><num>32</num><heading>Joint accounts</heading><intro><p>Where an individual who along with one or more others is the holder of a joint account with a fundholder becomes incapable in relation to decisions about, or of safeguarding the individual’s interests in, the funds in the account, any other joint account holder may continue to operate the account unless—</p></intro><level class="para1" eId="d25e5519"><num>(a)</num><content><p>the terms of the account provide otherwise; or</p></content></level><level class="para1" eId="d25e5525"><num>(b)</num><content><p>the joint account holder is barred by an order of any court from so doing.</p></content></level></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="d25e5531"><heading>Interpretation</heading><section eId="d25e5537"><num>33</num><heading>Interpretation of Part</heading><subsection eId="d25e5541"><num>(1)</num><intro><p>In section 24B, 27A and 31 any reference to—</p></intro><level class="para1" eId="d25e5547"><num>(a)</num><content><p>a guardian includes a reference to a guardian (however called) appointed under the law of any country to, eId="d25e5795"><num>(i)</num><content><p>holds qualifications recognised in the place where the adult is present and has special experience in relation to the diagnosis and treatment of mental disorder which correspond to the qualifications and experience needed to be an approved medical practitioner; and</p></content></level><level class="para2" eId="d25e5801"><num>(ii)</num><content><p>has consulted the Mental Welfare Commission for Scotland about the report concerned; or</p></content></level></level><level class="para1" eId="d25e5807"><num>(c)</num><content><p>any other type of individual described (by reference to skills, qualifications, experience or otherwise) by regulations made by the Scottish Ministers.</p></content></level></subsection><subsection eId="d25e5813"><num>(6C)</num><content><p>The Scottish Ministers shall consult the Mental Welfare Commission before making regulations under personal welfare, a report, in the prescribed form, from the mental health officer (but where it is in jeopardy only because of the adult’s inability to communicate, from the chief social work officer), containing the officer’s opinion as to—</p></intro><level class="para2" eId="d25e5888"><num>(i)</num><content><p>the general appropriateness of continuing the guardianship, based on an interview and assessment of the adult carried out not more than 30 days before the lodging of the application; and</p></content></level><level class="para2" eId="d25e5894"><num>(ii)</num><content><p>the suitability of the applicant to continue to be the adult’s guardian; and</p></content></level></level><level class="para1" eId="d25e5900"><num>(c)</num><intro><p>where the application relates to the adult’s property or financial affairs, a report from the Public Guardian, in the prescribed form, containing the Public Guardian’s opinion as to—</p></intro><level class="para2" eId="d25e5906"><num>(i)</num><content><p>the applicant’s conduct as the adult’s guardian; and</p></content></level><level class="para2" eId="d25e5912"><num>(ii)</num><content><p>the suitability of the applicant to continue to be the adult’s guardian.</p></content></level></level></subsection><subsection eId="d25e5918"><num>(3A)</num><intro><p>In a case where the incapacity is by reason of mental disorder—</p></intro><level class="para1" eId="d25e5924"><num>(a)</num><content><p>where a single report is lodged under subsection (3)(a), the related examination and assessment must be carried out by a relevant medical practitioner;</p></content></level><level class="para1" eId="d25e5930"><num>(b)</num><intro><p>where 2 or more reports are so lodged, at least one of the related examinations and assessments must be carried out by a relevant medical local authority for such a recall.</p></content></level></level></subsection><subsection eId="d25e6189"><num>(2)</num><intro><p>Where this section applies—</p></intro><level class="para1" eId="d25e6195"><num>(a)</num><content><p>the local authority shall, for the purposes of section 73(5), treat the Public Guardian and the Mental Welfare Commission as persons whom they consider to have an interest in the recall of the guardian’s powers; and</p></content></level><level class="para1" eId="d25e6201"><num>(b)</num><intro><p>if the Public Guardian, the Mental Welfare Commission or any other person to whom intimation is given under section 73(5) objects to the recall of the guardian’s powers, the local authority—</p></intro><level class="para2" eId="d25e6207"><num>(i)</num><content><p>shall not recall the guardian’s powers; but</p></content></level><level class="para2" eId="d25e6213"><num>(ii)</num><content><p>shall instead remit the matter section 60(17) (which amends this paragraph) of the Adult Support and Protection (Scotland) Act <ref eId="c00020" href="http://www.legislation.gov.uk/id/asp/2007/10">2007 (asp 10)</ref> came into force.</p></content></level></quotedStructure><inline name="appendText">,</inline></mod></p></content></level><level class="para1" eId="section-60-17-b"><num>(b)</num><content><p><mod>after sub-paragraph (3) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="schedule" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="schedule" ukl:Format="default"><subparagraph eId="d25e6398"><num>(3A)</num><intro><p>A person who has become a guardian to an adult by virtue of this schedule and who was a curator bonis, tutor dative or tutor-in-law to that adult shall cease to be authorised to act as that adult’s guardian—</p></intro><level class="para1" eId="d25e6404"><num>(a)</num><content><p>where the person does not apply for renewal of guardianship within the 2 year period set by sub-paragraph (3), on the expiry of that period;</p></content></level><level class="para1" eId="d25e6410"><num>(b)</num><intro><p>where—</p></intro><level class="para2" eId="d25e6416"><num>(i)</num><content><p>the person applies for such a renewal within that period; and</p></content></level><level class="para2" eId="d25e6422"><num>(ii)</num><content><p>the sheriff refuses the application,</p></content></level><wrapUp><p>on the date of refusal;</p></wrapUp></level><level class="para1" eId="d25e6430"><num>(c)</num><intro><p>where—</p></intro><level class="para2" eId="d25e6436"><num>(i)</num><content><p>the person applies for such a renewal within that period; and</p></content></level><level class="para2" eId="d25e6442"><num>(ii)</num><content><p>the sheriff grants the application,</p></content></level><wrapUp><p>in accordance with the provisions of this Act.</p></wrapUp></level></subparagraph><subparagraph eId="d25e6450"><num>(3B)</num><content><p>Sub-paragraph (3A) does not prevent the authority of a guardian of the type mentioned in that sub-paragraph from being terminated (by virtue of the terms on which the guardian is authorised to act or sections 71, 73, 75 or 79A) earlier than the date on which it would otherwise terminate by operation of that sub-paragraph.</p></content></subparagraph><subparagraph eId="d25e6456"><num>(3C)</num><intro><p>Where—</p></intro><level class="para1" eId="d25e6462"><num>(a)</num><content><p>a person (“G”) who was a curator bonis, tutor dative or tutor-at-law to an adult becomes the adult’s guardian by virtue of this schedule; and</p></content></level><level class="para1" eId="d25e6468"><num>(b)</num><content><p>another person is appointed under section 62 as an additional guardian to the adult before G’s appointment as guardian has been renewed in accordance with the provisions of this Act,</p></content></level><wrapUp><p>subsection (3A) applies in relation to the additional guardian as it applies in relation to G.</p></wrapUp></subparagraph><subparagraph eId="d25e6476"><num>(3D)</num><intro><p>The Public Guardian must take reasonable steps to give notice of the effect of sub-paragraph (3A) to any person who—</p></intro><level class="para1" eId="d25e6482"><num>(a)</num><content><p>is a guardian to an adult by virtue of this schedule;</p></content></level><level class="para1" eId="d25e6488"><num>(b)</num><content><p>was a curator bonis to that adult; and</p></content></level><level class="para1" eId="d25e6494"><num>(c)</num><content><p>has not applied for renewal of guardianship.</p></content></level></subparagraph><subparagraph eId="d25e6500"><num>(3E)</num><intro><p>A local authority must take reasonable steps to give notice of the effect of sub-paragraph (3A) to any person who—</p></intro><level class="para1" eId="d25e6506"><num>(a)</num><content><p>is a guardian to an adult residing within the local authority’s area by virtue of this schedule;</p></content></level><level class="para1" eId="d25e6512"><num>(b)</num><content><p>was a tutor dative or tutor-in-law to that adult; and</p></content></level><level class="para1" eId="d25e6518"><num>(c)</num><content><p>has not applied for renewal of guardianship.</p></content></level></subparagraph></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></subsection></section><section eId="section-61"><num>61</num><heading>Power to obtain records</heading><content><p><mod>After section 81 of the 2000 Act insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section eId="d25e6539"><num>81A</num><heading>Public Guardian’s power to obtain records</heading><subsection eId="d25e6543"><num>(1)</num><intro><p>The Public Guardian may, when carrying out an investigation under section 6(2)(c) or (d) or inquiries under section 30B(2)—</p></intro><level class="para1" eId="d25e6549"><num>(a)</num><intro><p>require any person falling within subsection (2) to provide the Public Guardian with—</p></intro><level class="para2" eId="d25e6555"><num>(i)</num><content><p>the person’s records of the exercise of the person’s powers in relation to the adult to whom the investigation relates; and</p></content></level><level class="para2" eId="d25e6561"><num>(ii)</num><content><p>such other information relating to the exercise of those powers as the Public Guardian may reasonably require,</p></content></level></level><level class="para1" eId="d25e6567"><num>(b)</num><intro><p>require any person who holds (or who has held) funds on behalf of the adult to whom the investigation relates to provide the Public Guardian with—</p></intro><level class="para2" eId="d25e6573"><num>(i)</num><content><p>its records of the account; and</p></content></level><level class="para2" eId="d25e6579"><num>(ii)</num><content><p>such other information relating to those accounts as the Public Guardian may reasonably require.</p></content></level></level></subsection><subsection eId="d25e6585"><num>(2)</num><intro><p>A person falls within this subsection if the person is or has been—</p></intro><level class="para1" eId="d25e6591"><num>(a)</num><content><p>a continuing attorney appointed by the adult to whom the investigation relates;</p></content></level><level class="para1" eId="d25e6597"><num>(b)</num><content><p>a withdrawer with authority to intromit with that adult’s funds;</p></content></level><level class="para1" eId="d25e6603"><num>(c)</num><content><p>a person authorised under an intervention order to act in relation to that adult; or</p></content></level><level class="para1" eId="d25e6609"><num>(d)</num><content><p>that adult’s guardian.</p></content></level></subsection><subsection eId="d25e6615"><num>(3)</num><content><p>A fundholder may charge a reasonable fee for complying with a requirement under subsection (1)(b) and may recover that fee from the account concerned.</p></content></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></section></part><part eId="part-3"><num>Part 3</num><heading>Adult support etc.: miscellaneous amendments and repeals</heading><section eId="section-62"><num>62</num><heading>Accommodation charges: removal of liability to startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><section eId="d25e6726"><num>13ZA</num><heading>Provision of services to incapable adults</heading><subsection eId="d25e6730"><num>(1)</num><intro><p>Where—</p></intro><level class="para1" eId="d25e6736"><num>(a)</num><content><p>a local authority have decided under section 12A of this Act that an adult’s needs call for the provision of a community care service; and</p></content></level><level class="para1" eId="d25e6742"><num>(b)</num><content><p>it appears to the local authority that the adult is incapable in relation to decisions about the service,</p></content></level><wrapUp><p>the local authority may take any steps which they consider would help the adult to benefit from the service.</p></wrapUp></subsection><subsection eId="d25e6750"><num>(2)</num><content><p>Without prejudice to the generality of subsection (1) above, steps that may be taken by the local authority include moving the adult to residential accommodation provided in pursuance of this Part.</p></content></subsection><subsection eId="d25e6756"><num>(3)</num><content><p>The principles set out in subsection (2) to (4) of section 1 of the 2000 Act apply in relation to any steps taken under subsection (1) above as they apply to interventions in the affairs of an adult under or in pursuance of that Act.</p></content></subsection><subsection eId="d25e6762"><num>(4)</num><intro><p>Subsection (1) does not authorise a local authority to take steps if they are aware that—</p></intro><level class="para1" eId="d25e6768"><num>(a)</num><content><p>there is a guardian or welfare attorney with powers relating to the proposed steps;</p></content></level><level class="para1" eId="d25e6774"><num>(b)</num><content><p>an intervention order has been granted relating to the proposed steps; or</p></content></level><level class="para1" eId="d25e6780"><num>(c)</num><content><p>an application has been made (but not yet determined) for an intervention order or guardianship order under Part 6 of the 2000 Act relating to the proposed steps.</p></content></level></subsection><subsection eId="d25e6786"><num>(5)</num><intro><p>In this section—</p></intro><level class="para1" eId="d25e6792"><num>(a)</num><content><p>“the 2000 Act” means the Adults with Incapacity (Scotland) Act <ref eId="c00027" href="http://www.legislation.gov.uk/id/asp/2000/4">2000 (asp 4)</ref>;</p></content></level><level class="para1" eId="d25e6801"><num>(b)</num><content><p>“adult” has the meaning given in section 1(6) of the 2000 Act;</p></content></level><level class="para1" eId="d25e6807"><num>(c)</num><content><p>“community care service” has the meaning given in section 5A of this Act;</p></content></level><level class="para1" eId="d25e6813"><num>(d)</num><content><p>“incapable” has the meaning given in section 1(6) of Act”;</p></content></level><level class="para1" eId="d25e6825"><num>(f)</num><intro><p>the reference to a guardian includes a reference to—</p></intro><level class="para2" eId="d25e6831"><num>(i)</num><content><p>a guardian appointed under the 2000 Act; and</p></content></level><level class="para2" eId="d25e6837"><num>(ii)</num><content><p>a guardian (however called) appointed under the law of any country to, or entitled under the law of any country to act for, an adult during his incapacity, if the guardianship is recognised by the law of Scotland;</p></content></level></level><level class="para1" eId="d25e6843"><num>(g)</num><intro><p>the reference to a welfare attorney includes a reference to—</p></intro><level class="para2" eId="d25e6849"><num>(i)</num><content><p>a welfare attorney within the meaning of section 16 of the 2000 Act; and</p></content></level><level class="para2" eId="d25e6855"><num>(ii)</num><content><p>a person granted, under a contract, grant or appointment governed by the law of any country, powers (however expressed) relating to the granter’s personal welfare and having effect during the granter’s incapacity.</p></content></level></level></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></section><section eId="d25e6969"><num>(5)</num><intro><p>Where subsection (4) applies—</p></intro><level class="para1" eId="d25e6975"><num>(a)</num><content><p>any expenditure incurred under the arrangements by a provider which is a local authority is recoverable from the responsible authority; and</p></content></level><level class="para1" eId="d25e6981"><num>(b)</num><content><p>any period during which the person is accommodated under the arrangements is to be disregarded in determining the person’s ordinary residence for the purposes of subsection (1) of this section.</p></content></level></subsection><subsection eId="d25e6987"><num>(6)</num><intro><p>The Scottish Ministers may make regulations specifying circumstances in which a local authority (“the providing authority”) may recover from another local authority (“the other authority”) expenditure which the providing authority incurs in the provision of services or facilities under arrangements made with the other authority for the purpose of enabling that other authority to perform a function under—</p></intro><level class="para1" eId="d25e6993"><num>(a)</num><content><p>this Act;</p></content></level><level class="para1" eId="d25e6999"><num>(b)</num><content><p>Part II of the Children (Scotland) Act <ref eId="c00033" amendments and repeals</heading><section eId="section-68"><num>68</num><heading>Review of determination extending compulsory treatment order</heading><intro><p>Section 101 (duty of Mental Health Tribunal to review determination extending compulsory treatment order) of the Mental Health (Care and Treatment) (Scotland) Act <ref eId="c00038" href="http://www.legislation.gov.uk/id/asp/2003/13">2003 (asp 13)</ref> is amended as follows—</p></intro><level class="para1" eId="section-68-a"><num>(a)</num><content><p><mod>for subsection (2)(b)
